Greg says that Secretary of State Ken Blackwell in Ohio will not even allow the counting of the provisional ballots to begin unless he is threatened with a lawsuit from the Kerry folks, and that does not seem to be forthcoming. Honestly, I find this hard to believe, but that's what he said in this telephone interview.

Greg also claims that black voters -- I think it was in Florida and Ohio -- are eight times less likely to have their votes counted than are whites, and that special efforts have been made by Republican operatives to make sure most blacks either never get to vote -- or if they vote, that their votes are never counted. Why is this? Because 90-95% of all blacks vote Democratic.

Could change outcome of local, statewide races

GASTONIA - About 12,000 votes cast in Gaston County have not yet been counted, elections director Sandra Page said Tuesday. Page said most early and absentee votes were not included in the county's unofficial election results because of a procedural error.

The inclusion of the votes in the county's results, expected Tuesday afternoon, could change the outcome of several local and statewide races.

Page emphasized that the votes are still in the computer system. She said officials failed to release the votes from the machine on which they were stored into the database where votes were tallied. She said she discovered the error Tuesday morning and results would be updated that afternoon.

"We apologize to anybody for this," she said. "After an election the boards of elections need their time and nothing is official until the board signs off and people need to understand that."

The number of uncounted votes is larger than the current margin of victory in statewide races for Commissioner of Agriculture and Superintendent of Public Instruction.

It is also larger than the margin of victory in several local races, particularly for the board of education.

At least 30% of American voters reported errors

At least a third of Americans reported errors with voting machines during the 2004 presedential election. Many of the machines were made by companies which supported Bush's campaign, a clear conflict of interests, and there are reports of machines showing Bush even when Kerry was chosen.

Western Shoshone Nation Calls Bush Administration Land Bill a Fraud

Phoenix, AZ – As open war rages in Fallujah, Iraq the home front faces an insurgency of its own, one where the Indigenous Nations stand with principles of spiritual nonviolence to assert their ancestral responsibilities as the true caretakers of the homeland. Western Shoshone Nation elder Carrie Dann will speak today at a press conference in Phoenix to address the violation of the 1863 Ruby Valley Treaty between the United States and the Western Shoshone Nation. The issue was addressed by the Inter-American Commission on Human Rights (IACHR), which in January of 2003 sentenced in a final report by the Commission that the United States claims to Western Shoshone land are illegal and contrary to international human rights law. The IACHR also concluded that the United States had used illegitimate means to assert ownership of the lands.

Said Carrie Dann, "It's disgraceful how the United States makes international statements about human rights and then commits this kind of assault in our own frontyard. It destroys their credibility and moral authority".

After an exhaustive review, the Commission concluded that the United States has been violating the human rights of the Western Shoshone, including the right to equality before the law, the right to judicial protection and due process, and the right to property. The ruling was highly critical of the Indian Claims Commission’s handling of the Dann Sisters’ case. It is the first time that the US has been formally found in violation of international human rights in its treatment of Indigenous Peoples within its border.

In attempt to silence the opposition by the Western Shoshone Nation to the theft and illegal mineral expropriation of Western Shoshone territories, third largest gold producing area in the world, the Bush administration has moved to silence the legitimate land claims of the Western Shoshone under the 1863 Ruby Valley Treaty with a domestic monetary settlement which the Western Shoshone call a fraud and illegal act of aggression against the Western Shoshone Nation.

Downsizing the Federal Government

Executive Summary

The federal government is headed toward a financial crisis as a result of chronic overspending, large deficits, and huge future cost increases in Social Security and Medicare. Social Security and Medicare would be big fiscal challenges even if the rest of the government were lean and efficient, but the budget is littered with wasteful and unnecessary programs.

In recent years, mismanagement scandals have occurred in many federal agencies, including the Army Corps of Engineers, the Bureau of Indian Affairs, the Department of Energy, the Federal Bureau of Investigation, and the National Aeronautics and Space Administration. Even the National Zoo in Washington has recently been shaken by scandal. The $2.3 trillion federal government has simply become too big for Congress to oversee.

The good news is that Americans do not need such a big government. Most federal programs are unconstitutional, unnecessary, actively damaging, or properly the responsibility of state governments or the private sector. This study analyzes programs that could be cut to create annual budget savings of $300 billion. If these cuts were phased in over five years, the budget would be balanced by fiscal year 2009 with all of President Bush's tax cuts in place.

Some reform ideas should be applied throughout the government. Business subsidies should be terminated, and commercial activities should be privatized. Also, federal grants to the states should be scaled back. Currently, a complex array of 716 grant programs disgorges more than $400 billion annually to state and local governments, which become strangled in federal regulations. That form of "trickle-down" economics is very inefficient.

Such reforms were on the agenda in the Reagan administration and in the Republican Congress of the mid-1990s. But the need for spending cuts is even more acute today because of the large fiscal imbalances that loom from projected growth in entitlement costs. Spending cuts would not just balance the budget; they would also increase individual freedom and expand the economy. All federal spending displaces private spending, but many federal programs actively damage the economy, cause social ills, despoil the environment, or restrict liberty as well.

Given the government's record of mismanaged and damaging programs reviewed in this report, policymakers should be far more skeptical about the government's ability to solve problems with higher spending.

The US Constitution's policies are not reality in the USA. Justice doesn't always prevail. It's at the option of the powers that be. Often unjust court decisions are made by judges, district attorneys, lawyers, and magistrates. That results in violations of constitutional rights, motion churning causing excessive legal fees due to the unjust court decisions, and not protecting crime victims resulting in additional terrible crimes upon people that could have been prevented.

There is no domestic tranquility in the USA. The rampant crime that has been going on for decades is keeping us from having tranquility. Although you may have heard some elected officials speak of protecting Americans, the crime facts, statistics, and case examples of court corruption revealed at websites I've built proves we are not being protected. Many more Americans are terrorized, attacked, inflicted with pain and injuries, disabled, and robbed of their lives with perpetrators being Americans than foreign terrorists. That reality has been ignored by our elected officials even though they've been notified about this matter. Unless there are wise reforms of the USA court system, with the way the USA court system is run now 5 out of 6 Americans will be victims of violent crimes during their lifetime. The 2nd Amendment right to bear arms is useful for Americans to better enable them to protect themselves and their families from criminals. Although I've read about studies proving that in areas where people are allowed to bear arms there is less crime, there is still much violent crime that requires to be dealt with using other methods. Some people, for example children, some disabled people, and some elderly people don't have the capacity to use weapons to protect themselves. Sometimes women have the capacity to use weapons to protect themselves from criminals and sometimes they don't depending upon circumstances. Often women become victims of violent crimes in the home with perpetrators being people they thought they could trust. Subsequently, they weren't prepared to defend themselves. There have been murders of people when they were asleep - absolutely no opportunity for self-defense in those cases.

Due to these vulnerabilities that affect people more than the 2nd Amendment is needed. We need a court system where all of the judges will always enforce wise laws, always honor the evidence, always rescue crime victims from perpetrators, and always run the courts in such a way as to discourage crimes. We need state legislatures that will make and put into practice needed wise court and law reforms that will work to get a handle on the court system inadequacies, incompetence, and corruption that allow unjust court decisions and violent crimes not being dealt with properly.

Over a period of more than 20 years individual citizen activists and small groups of citizen activists have often lobbied the elected officials, which are mainly from the Democrat and Republican parties, but they brush us off - providing no representation.

Subsequently, elections aren't making a difference for these serious societal problems. However, we must not give up as other methods of citizen activism will work. Having observed that the elected officials do listen to requests of a large organized group of citizen activists, I have decided to start such a large organized group of citizen activists. I have also prepared websites to educate people with crime statistics, facts, and case examples of court system inadequacies, incompetence, and corruption. The hope is that citizens will be inspired to become volunteer citizen activists for this court and law reforms movement.

This is a good place to relate your knowledge and opinions, unjust court experiences you have had or other people have had, crimes experienced by you, your family, and friends, crimes and court cases in current or past news, present and discuss proposed court and law reforms, join in networking and strategizing for this court and law reforms movement. Computer glitch still baffles county clerk

LaPORTE - The day after a two-and-a-half-hour delay in counting ballots due to a glitch in a computer program, LaPorte County election officials are still trying to figure out what happened. "Maybe there was a power surge," LaPorte County Clerk Lynne Spevak said. "Something zapped it."

At about 7 p.m. Tuesday, it was noticed that the first two or three printouts from individual precinct reports all listed an identical number of voters. Each precinct was listed as having 300 registered voters.

That means the total number of voters for the county would be 22,200, although there are actually more than 79,000 registered voters.

Vote counting resumed at about 9:30 p.m.

Spevak said workers at the clerk's office thought a computer correction could be done once they received a software patch from Election Systems and Software, the Chicago company that provided the tabulation software. However, the patch did not work.

"We thought we could get a copy of it e-mailed file to us and start all over, but once the program was downloaded from Chicago, it still didn't work right," Spevak said.

Spevak said the Board of Election was in contact with Indianapolis to see if they could certify the vote. She said Wednesday that LaPorte County election officials might have to manually input the information so that the ballots could be certified with the state.

155,000 Ballots Uncounted in Ohio; More Votes than Voters in Some Precincts

The article below reports that "Ohio election officials said Monday that they would begin this week the final count of 155,428 provisional ballots and an unknown number of overseas absentee ballots that were cast in the presidential election." The article claims "irregularities and problems have cropped up nonetheless. On Friday, officials in Franklin County — which includes state capital Columbus — acknowledged that they may have improperly counted votes for Bush because of a touch-screen voting system malfunction. In 29 precincts there, the County’s website shows, we had the most unexpected results in years: more votes than voters. I’ll repeat that: more votes than voters. 93,000 more votes than voters. Oops. Talk about successful get-out-the-vote campaigns! What a triumph for democracy in Fairview Park, twelve miles west of downtown Cleveland. Only 13,342 registered voters there, but they cast 18,472 votes." Obvious discrepancies such as this should be investigated because they may have impacted the outcome of the election.

Arbeitszeitverlängerung, weniger Urlaub und weniger Feiertage sollen den Bundeshauhalt entlasten beziehungsweise den Aufschwung bringen. Abgesehen davon, dass die Verzichtsforderungen ausschließlich an die Adresse der abhängig Beschäftigten gehen, sind sie weder begründbar, noch Erfolg versprechend. Wir leben nicht über unsere Verhältnisse, sondern unter unseren Möglichkeiten, meint Harald Werner, der gewerkschaftspolitische Sprecher des Parteivorstandes.

Nach dem weder die Hartz-Gesetze, noch die drastischen Steuergeschenke, die den Unternehmen in den vergangen Jahren ausgereicht wurden, für Wachstum und Beschäftigung sorgen konnten, will die rot-grüne Bundesregierung die Dosis der unwirksamen Rezeptur nochmals erhöhen. Weil in Eichels Steuerbilanz ein neues fünf Milliarden Loch klafft und das Staatsdefizit wieder einmal über der Maastricht-Grenze liegt, setzen Bundesregierung und Arbeitgeber wieder einmal auf längere Arbeitszeiten und sinkende Lohnkosten. Immer lauter wird die Behauptung, dass Deutschland über seine Verhältnisse lebt. Die Begründung hält allerdings keiner Überprüfung stand, wenn man sie auf diejenigen anwendet, von denen neue Opfer verlangt werden. Die Arbeitseinkommen der abhängig Beschäftigten befinden sich seit drei Jahren im Sinkflug und ihre Kaufkraft liegt inzwischen um 2,8 Prozent unter dem Niveau von 1991. Und während die Arbeitsleistung je Beschäftigten um 16,7 Prozent zunahm, sank die Zahl der bezahlten Arbeitsstunden in Folge des Stellenabbaus um rund acht Prozent, so dass schon seit einem guten Jahrzehnt für weniger Geld länger gearbeitet wird. Mehr Arbeitsplätze hat das nicht gebracht, eher das Gegenteil.

Wenn hierzulande jemand über unsere Verhältnisse lebt, dann sind es die Bezieher von Gewinn- und Vermögenseinkommen, die im gleichen Zeitraum, in dem die Arbeitseinkommen stagnierten oder abnahmen, um fast 60 Prozent gestiegen sind. Hauptsächlich deshalb, weil die Produktivitätsfortschritte einseitig an die Bezieher von Gewinneinkommen weiter gereicht wurden. Fast mehr noch allerdings durch Eichels Steuergeschenke. Nun haben die Steuerschätzer die Quittung präsentiert und was fordert die Bundesregierung? Die Beschäftigten sollen auf Feier- und Urlaubtage verzichten, um zum gleichen Geld mehr zu produzieren.

Nicht nur sozial gerechter, sondern vor allem sinnvoller wäre allerdings eine Rückkehr zur leistungsgerechten Besteuerung. Eine Korrektur der Unternehmenssteuerreform und die Wiedererhebung der Vermögenssteuer würde nämlich nicht nur Eichels Haushaltsloch schließen, sondern obendrein Mittel für staatliche Investitionen einbringen, mit denen dann wiederum neue Arbeitsplätze geschaffen würden. Und weil die Bundesregierung darauf verzichtet, lebt dieses Land nicht über seine Verhältnisse, sondern unter seinen Möglichkeiten.

Undervotes are an unknown

The undervotes are an unknown quantity at this point -- they would probably be counted only in a recount. The mysterious 97,000 extra votes in Cuyahoga may have an innocent explanation having to do with them assigning all the absentee ballots for a certain area to one precinct when they count the totals. Still a strange way to do math, and I'm not convinced it's 100% kosher even now, but the "extra votes" do correlate with the number of absentee ballots reported, so as long as *those* are legit (at this point I'm not 100% convinced anything is legit), that particular mystery is solved.

I do think they need to recount Ohio, period. Even though they aren't done counting yet, they just plain need a recount regardless, and preferably a hand-recount in some precincts. We need to know what's really there.

Take Action : Protest the Attack on Falluja

November 8, 2004

George Bush didn’t waste time. He decided to quickly use his “political capital” to widen the war in Iraq by launching an all-out assault on Falluja. We know you are all exhausted from the election work, but we can’t let this attack happen without protesting the horrendous escalation of violence.

As we write, U.S. warplanes are dropping huge bombs on civilian neighborhoods, and ground troops are entering the city. One hospital, Nazzal Emergency Hospital, was destroyed in an air strike; another, Falluja General Hospital, has been seized by U.S. forces, making it unlikely that injured civilians will be able to go there for treatment. The estimated 50,000 civilians who remain in Falluja lack running water, electricity, and food.

There will undoubtedly be many civilian injuries and deaths: during the last siege of Falluja in April, at least 600 Iraqis were killed, most of them civilians. The death toll is expected to be high on the U.S. side as well: Marine commanders have warned that deaths among U.S. forces could reach levels not seen since the Vietnam War.

The U.S. assault on Falluja is a catastrophic action that will result in horrific and unnecessary bloodshed, fuel anger and resentment against the U.S., and swell the ranks of terrorist groups rather than eradicating terrorism. We need to raise our voices in opposition to this attack, insist that the U.S. return to peace negotiations, and call for our troops to be brought home now.

We need to be vocal and visible in our opposition to the assault on Falluja. Organize actions this week outside local Congressional offices, while Congress is in recess, or in a high-profile location in your community.

Ideas for action include:

* candlelight vigils to mourn the deaths that will be caused by this attack

President Bush can run, but he cannot hide from the Constitution of the United States. The election does not pardon the President for past, or future "high Crimes and Misdemeanors."

Impeachment is not a partisan political issue. The House of Representatives, possessed of the "sole power of impeachment," is required to consider a bill of impeachment on the facts even if every Member were of the same party, or political persuasion, as the President. The seven specific provisions of the Constitution setting forth the powers and duties of the Congress in considering impeachment intend that any President or other civil officer of the United States who has committed a high Crime or Misdemeanor "...shall be removed from Office."

The power of impeachment assures the people against criminal acts and despotic ambitions by government officials.

We, the People have the power to require the House of Representatives to do its duty and act on a bill of impeachment after full investigation and consideration. If it fails to do so those House members who failed to perform this Constitutional duty can and should be voted from office. Remember that President Nixon resigned under threat of impeachment for Watergate less than two years after his landslide reelection in 1972.

Impeachment is Imperative

For the American people who support and defend the Constitution of the United States, who want to prevent further crimes by a lawless administration, who believe we can redeem our country in the eyes of those we have assaulted and those who have witnessed this brutality and who dare to demand of future government leadership, NEVER AGAIN, Impeachment is Imperative. A decent respect to the opinions of mankind requires that we Americans should declare the causes which impel us to impeach.

President George W. Bush chose to wage a war of aggression against Iraq, which had not attacked the United States and presented no imminent threat to our people, or legitimate interests. A small cabal, Cheney, Rumsfeld, Rice, Wolfowitz, Feith, Libby and Rove wrested decision making processes from established institutions of government to reinforce President Bush’s desire to seize Iraq, defying international institutions, the opinions of humankind and the rule of law to commence a disastrous criminal military adventure.

A Campaign of Deceit and False Propaganda

War of aggression is the first offense listed in the Nuremberg Charter as a Crime against Peace. The Nuremberg Tribunal after hearing evidence of Nazi crimes in World War II convicted the leaders of waging wars of aggression, which it called "the supreme international crime."

At Nuremberg, the Chief U.S. Prosecutor, Robert H. Jackson, promised posterity that in the future all nations, including our own, would be held accountable for such crimes.

President Bush and key administration officials engaged in a lengthy campaign of deceit, concealment and false propaganda to create support for, and acceptance of, its war of aggression by claiming Iraq possessed weapons of mass destruction, harbored terrorists, had close ties with and supported Al Qaeda and intended to attack the U.S., U.S. citizens and U.S. interests. A free society, democratic institutions and constitutional government cannot survive such deceit by its own government.

The U.S. has made civilians and civilian facilities its direct object of attack. It has pursued assassination and summary executions as official policy. President Bush boasted of summary executions in his State of the Union message in 2003. Excessive and indiscriminate force and illegal weapons have been used. Many thousands of Iraqi citizens, whole families, women, children, elderly Iraqis have been killed as a result.

U.S. military casualties exceed 10,000 including more than 1,100 deaths with many additional thousands returned to the United States for physical and mental illnesses.

The U.S. has employed torture, including torture to death, rape and sexual assault and humiliation, as approved and ordered policy from Afghanistan and Guantanamo to Iraq, inflicted on thousands of prisoners, many, if not most, without any evidence of wrongful conduct. An admitted 37 human beings have been murdered while being held in captivity by the United States under these conditions. We know not how many more. All the mounting evidence makes clear that this program of torture and death is not aberrational conduct of rogue or undisciplined soldiers but is rather the policy adopted at the highest levels of the Bush/Rumsfeld chain of command. All this in violation of the Geneva Conventions, the International Convention Against Torture, the laws of all nations and common human decency.

Article II, Section 4 of the Constitution of the United States provides: The President, Vice President and all civil Officers of the United States, Shall Be Removed From Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors

More than 100,000 Dead Based on a Lie

We learn from the prominent medical journal Lancet of the report by researchers at John Hopkins University, Columbia University and the Al-Mustansiriya University in Baghdad that the U.S. war of aggression against Iraq and military occupation has cost "at least" 100,000 Iraqi lives already must civilian, women and children. Already President Bush has launched a massive aerial and ground assault on Falluja which may kill thousands of defenseless civilians.

Haiti, where President Bush forced the elected President Jean Bertrand Aristide from office, is in chaos with many thousands killed by widespread daily violence committed by U.S. supported paramilitaries against Aristide supporters.

Nearly 500,000 have voted to impeach. Help us increase that number into millions the Congress cannot ignore.

Every American should choose whether to vote for impeachment entirely on the facts, straight up, or down, without political, or partisan fear, or favor. We owe this to the country, its future, the Constitution and our common heritage. Impeachment is Required Now.

Impeachment now is the only way we, the American people, can promise ourselves and the world that we will not tolerate crimes against peace and humanity by our government. Knowing what we know, to wait longer is to condone what has been done and risk more.

BMW Group reduziert drastisch Strahlungsbelastung durch innerbetriebliche DECT-Telefone

09.11.2004 Als erster Großkonzern hat der Automobilhersteller BMW Group die zulässige Strahlungsbelastung seiner weltweit rd. 105.000 Mitarbeiter durch betriebliche DECT-Schnurlostelefone auf höchstens 100 µW/m² reduziert. Dieser Strahlungswert liegt um den Faktor 100.000 unter dem derzeit gültigen gesetzlichen Grenzwert. BMW reagiert damit auf die heftig geführte und nach wie vor offene Diskussion über die Gesundheitsrisiken von Mobilfunkgeräten.

Wie die zuständige Abteilung Arbeits- und Umweltschutz bei BMW auf Anfrage mitteilte, hat man sich vorab intensiv über die Sachlage informiert. Von beiden Seiten wurde Rat eingeholt (z. B. von dem bekannten Elektrosmog-Experten Prof. G. Käs und von DECT-Lieferant Siemens), bevor sich die Verantwortlichen für die massive Reduzierung entschieden, die für die gesamte BMW Group weltweit gültig ist.

Zur Umsetzung des niedrigen BMW-Grenzwerts wurde die Sendeleistung der DECT-Basisstationen (Mittelwert 10 mW, Spitzenwert 250 mW) durch den Einbau von Dämpfungsgliedern soweit verringert, dass auch in unmittelbarer Nähe einer solchen Station der BMW-Grenzwert eingehalten wird. Insbesondere im Münchener Forschungszentrum FIZ konnte dann jedoch die Funkversorgung nicht mehr zuverlässig gewährleistet werden. Grund: In dem Büro- und Laborkomplex lassen sich dämpfende Trennwände problemlos versetzen oder neu einziehen. Auf diese Weise kann schon durch Trockenbauarbeiten eine zuvor intakte Funkversorgung plötzlich zusammenbrechen. Um dies zu vermeiden, müssen etliche DECT-Basisstationen im FIZ mit höherer Leistung senden als ursprünglich geplant.

Damit der BMW-Grenzwert dennoch eingehalten wird, wurden die in Deckennähe montierten DECT-Basisstationen mit einem Kostenaufwand von rd. 100 000 Euro – getragen von BMW – durch metallbedampfte Glasscheiben abgeschirmt. Diese “Deflektoren” sind nahe der Stationen montiert, sie lassen die seitliche Abstrahlung ungehindert zu, schützen jedoch den unterhalb einer Station sitzenden Mitarbeiter. BMW ließ die Deflektoren bei einem Zulieferer anfertigen. Schlichte Metallplatten haben dieselbe Schutzwirkung, die schmucken Glasplatten wurden nur wegen der Optik gewählt.

Die ödp begrüßt die Initiative von BMW. Denn erstmals greift ein Großkonzern tatkräftig das Vorsorgeprinzip zum Schutz seiner Mitarbeiter auf und wartet nicht tatenlos ab, bis die wissenschaftliche Diskussion über die Schädlichkeit des Elektrosmogs ein unstrittiges Resultat hervorbringt. Der jetzt bei BMW geltende niedrige Grenzwert von 100 µW/m² Leistungsflussdichte entspricht exakt der Forderung der ödp nach einer massiven Senkung der viel zu hohen gesetzlichen Strahlungsgrenzwerte im Mobilfunk. Die ödp ist die einzige politische Partei Deutschlands, die menschenverträglichen Mobilfunk in ihrem Parteiprogramm als Zielsetzung nennt.

I have great sympathy and respect for the millions of people who worked so hard in so many different ways to get rid of the most despicable president in American history. Dubious though I am about the effectiveness of electoral politics, I too would have dearly loved to see him defeated by a landslide.

But just to put it in perspective...

Roughly speaking we can distinguish five degrees of "government":

(1) Unrestricted freedom
(2) Direct democracy
(3) Delegate democracy
(4) Representative democracy
(5) Overt minority dictatorship

The present society oscillates between (4) and (5), i.e. between overt minority rule and covert minority rule camouflaged by a facade of token democracy. A liberated society would eliminate (4) and (5) and would progressively reduce the need for (2) and (3). . . .

In representative democracy people abdicate their power to elected officials. The candidates' stated policies are limited to a few vague generalities, and once they are elected there is little control over their actual decisions on hundreds of issues -- apart from the feeble threat of changing one's vote, a few years later, to some equally uncontrollable rival politician. Representatives are dependent on the wealthy for bribes and campaign contributions; they are subordinate to the owners of the mass media, who decide which issues get the publicity; and they are almost as ignorant and powerless as the general public regarding many important matters that are determined by unelected bureaucrats and independent secret agencies. Overt dictators may sometimes be overthrown, but the real rulers in "democratic" regimes, the tiny minority who own or control virtually everything, are never voted in and never voted out. Most people don't even know who they are. . . .

In itself, voting is of no great significance one way or the other (those who make a big deal about refusing to vote are only revealing their own fetishism). The problem is that it tends to lull people into relying on others to act for them, distracting them from more significant possibilities. A few people who take some creative initiative (think of the first civil rights sit-ins) may ultimately have a far greater effect than if they had put their energy into campaigning for lesser-evil politicians.

At best, legislators rarely do more than what they have been forced to do by popular movements. (The Vietnam war, for example, was not ended by electing antiwar politicians, but because there was so much pressure from several different directions that the prowar president Nixon was forced to withdraw.) A conservative regime under pressure from independent radical movements often concedes more than a liberal regime that knows it can count on radical support. If people invariably rally to lesser evils, all the rulers have to do in any situation that threatens their power is to conjure up a threat of some greater evil.

Even in the rare case when a "radical" politician has a realistic chance of winning an election, all the tedious campaign efforts of thousands of people may go down the drain in one day because of some trivial scandal discovered in his personal life, or because he inadvertently says something intelligent. If he manages to avoid these pitfalls and it looks like he might win, he tends to evade controversial issues for fear of antagonizing swing voters. If he actually gets elected he is almost never in a position to implement the reforms he has promised, except perhaps after years of wheeling and dealing with his new colleagues; which gives him a good excuse to see his first priority as making whatever compromises are necessary to keep himself in office indefinitely. Hobnobbing with the rich and powerful, he develops new interests and new tastes, which he justifies by telling himself that he deserves a few perks after all his years of working for good causes. Worst of all, if he does eventually manage to get a few "progressive" measures passed, this exceptional and usually trivial success is held up as evidence of the value of relying on electoral politics, luring many more people into wasting their energy on similar campaigns to come.

As one of the May 1968 graffiti put it, "It's painful to submit to our bosses; it's even more stupid to choose them!"

I am grateful to the many people who have contacted me to express their deep concern about questions of miscounting, fraud, vote suppression, and other problems on election day, especially in Florida and Ohio. Their concern reflects how much people care about the outcome of this election.

I want to you to know we are not ignoring it. Election protection lawyers are still on the job in Ohio and Florida and in DC making sure all the votes are counted accurately. I have been conferring with lawyers involved and have made them aware of the information and concerns people have given me. Even if the facts don't provide a basis to change the outcome, the information will inform the continuing effort to protect the integrity of our elections.

I am angry and getting emails and recrimination from people wondering why KERRY just caved and is not fighting this before the final count in Ohio, before any of the fraud was challenged, before New Mexico and Iowa even came in.

There is widespread feeling that he did not lose the election and that it was taken from him.

There is enough here to warrant investigation and enough to challenge the results. It's coming from all corners.

I understand that he has until the official count certification in Ohio to Un Concede which is several days from now.

Anyone who thinks that he should unconcede should give reasons why - whatever they noticed, particularly in Red Republican Governed States using electronic machines- and send them directly to Cameron KERRY, John Kerry's brother at his law firm at the address CKerry@Mintz.com

They should inform us if they were not allowed to vote provisionally (for whatever reason- they lost forms, ran out of forms, etc.) I personally witnessed a number of things as I reported in Texas with the DCCC. (Democratic Congressional Campaign Committee)

If you know anyone in particular in Ohio who tried to vote and was turned away at the polls please get their information and notify the campaign.

They should be notified if they experienced lines longer than four hours - particularly elderly or infirm people (we call that torture when they do it to political prisoners). They should be notified if people were told as has been reported that due to too many people showing up in African American precincts, particularly in Ohio where there were too few booths (some only had two or three for the entire precinct) and told because of heavy turn out they could vote on Wednesday. If the numbers of these sorts of incidents creates a percentage margin that exceeds the margin of victory- Un Concession has to be made to challenge the count.

If people wanted to and tried to vote and were prevented or actively discouraged from doing so, that is a Civil Rights matter and must be dealt with in terms of the ultimate count.

This is the last email that I am writing on this subject in this venue. I am taking it up in other venues.

Countinghouse Blues: Too many votes in Nebraska county

Sarpy County election officials are trying to figure out how they ended up with more votes than voters in the general election. As many as 10,000 extra votes have been tallied and candidates are still waiting for corrected totals.

Johnny Boykin lost his bid to be on the Papillion City Council. The difference between victory and defeat in the race was 127 votes.

Boykin says, "When I went in to work the next day and saw that 3,342people had shown up to vote in our war, I thought something's not right."

He's right. There are not even 3,000 people registered to vote in his ward.

For some reason, some votes were counted twice.

Deputy Sarpy County Election Commissioner Ed Gilbert says, "It affected 32 of the 80 precincts. And I suppose as many as 10,000 votes."

Sarpy County borrowed the election equipment from Omaha-based Election Systems & Software. Its employees operated the machines that are now double-checking the ballots.

No one is sure exactly what went wrong.

Gilbert says, "The only thing we know is that if you load the disc out there, it reads fine. They didn't read fine on this computer."

Election officials say they don't believe the glitch will impact who wonand who lost any of the races. They figure that when votes were doubled in a particular race, the totals were doubled for both candidates. Vote totals would be skewed but percentages would not change.

In spite of that, the candidates want to know the real numbers.

Boykin says, "I think we owe it to those folks to make sure all the votes got counted, correctly."

As of Thursday night, the problem still had not been pinpointed. The Sarpy County Election office had hoped to post the updated results on its Web site but, at last check, we got the following message: "Updated unofficial results for the 2004 General Election are pending. Please check back later."

Cuyahoga County Precincts

There have been several emails regarding this page. I will be inquiring to Cuyahoga County in the coming days. It seems that the precinct/ward differences may be where the problem is as the official summary report does not show these spikes in turn-out.

The summary, however, does not report on the number of registered voters for precincts or wards, whereas the referenced link does. I am using the referenced link data below (more complete totals), not the summary report, which only reflects total districts.

This amounts to 97,489 EXTRA votes beyond 100% in those precincts! This is just for ONE county!

No further evidence needed - a recount MUST be done - and possibly another national election using ONLY paper ballots, hand counts, and observers making sure all counts are valid. I don't trust these computers AT ALL! We should have the UN observe!

--We demand a thorough, impartial, and immediate investigation into electoral fraud, racially based suppression of voters, and a full count of all provisional and absentee ballots and ‘spoiled’ votes.

--We demand that the December 13 electoral college vote be suspended, if necessary, until these questions are resolved. The legitimacy of our government is compromised when the integrity of our electoral system is in question, free and fair elections are the basis of a democratic government.

When the integrity of the electoral system is in question, the government loses its legitimacy. No recount could be as destabilizing as the widespread suspicion that the Republicans have stolen a second election.

Here are just a few of the serious concerns that have arisen:

--Around the world, exit polls are used to verify that elections are free from fraud. Here in the US, polls in precincts using computer voting machines with no paper trail were consistently at odds with the reported outcome, while polls in precincts using paper ballots matched the outcome.

--In Ohio, adequate numbers of voting machines were not provided in African American and student neighborhoods, causing voters hours of waiting time at the polls.

--1,074 instances of voter intimidation were reported to the Election Protection Coalition.

--In Franklin County, Ohio, voting machines gave George Bush 3,893 votes in one precinct alone, far more than the number of registered voters. In Craven County, North Carolina, a software error gave Bush 11,283 extra votes, in Broward County, Florida, voting machines were discovered to be counting backwards.

--In Ohio, the number of provisional ballots may be far higher than Secretary of State Blackwell claims. Absentee and ‘spoiled’ ballots have not been counted—African American and Latino voters are far more likely to have their ballots discarded.

--Purging of supposed ‘felons’ in Florida and Colorado disproportionately targets communities of color and may violate the Voting Rights Act of 1965.

--The Diebold machines and central computer processors were never tested to assure that they could not be hacked by outsiders.

--And much, much more!

It’s not too late! The Watergate Scandal brought Nixon down long after he took office. We can counter the false perception of Bush’s ‘mandate’, push the mainstream media into covering these serious issues, maybe even put some spine into the Democrats, stand in alliance with youth and communities of color, and protect the integrity of our vote. Fighting for fair elections is vital—for the present and the future!

Using a mobile phone for ten or more years doubles the risk of getting a type of benign head tumour, a Swedish study has found.

The study is relatively small, it looked at 148 patients and 600 controls, and the effect will need to be confirmed with larger groups. But it is the first to show clear evidence that mobile phone use could increase the risk of getting tumours.

"We were surprised about the results, but the outcome is quite clear," says Anders Ahlbom, an epidemiologist at the Karolinska Institute, who was involved in the study.

"We are now convinced of the quite strong risk due to the use of mobile phones, and we are waiting for confirmation from the other research groups," says Ahlbom.

Sweden is one of the 13 countries taking part in the INTERPHONE study. This research programme, coordinated by the World Health Organization's International Agency for Research on Cancer (IARC) in Lyon, France, was set up in 1998 to investigate whether exposure to the radio-frequency electromagnetic fields from mobile phones causes damaging health effects.

The outcome is clear. We are now convinced of the quite strong risk due to the use of mobile phones.

Twice the tumours

The Karolinska team looked at the incidence of acoustic neuroma, a benign tumour that grows on the nerve connecting the ear to the brain. Normally the chance of developing acoustic neuroma is 1 in 100,000.

The researchers studied 148 acoustic neuroma patients and 604 healthy controls. 14 of the neuroma patients had regularly used mobile phones for over ten years, compared with 29 of the controls. That translates into a doubled risk of developing the condition, the researchers say.

All of the extra cases seemed to occur on the same side of the head to which the patients normally held their phone.

Danish comparison

The first results of the INTERPHONE study came in January from Danish researchers. Scientists from the Institute of Cancer Epidemiology in Copenhagen identified no link between phone use and the frequency of tumours, even though the average size of tumours that did occur was significantly larger for regular users than for nonusers.

But the Danish study was smaller than the Swedish one: it involved 106 acoustic neuroma patients and 212 healthy controls. Jörgen H. Olsen, head of the Danish institute, says that the Karolinska team's results are very convincing, and the differences in the outcome between the two studies, which used identical methodology, could be explained by the bigger sample size.

However, Olsen cautions that the Swedish results were partly based on asking the patients which side of the head they normally held their phone. People with a tumour on a particular side of the head might be more likely to say they held their phone on that side, he points out.

Studies are now complete in nearly all the countries involved in the INTERPHONE project, and the final results are expected to be released in early 2005, according to Elisabeth Cardis, chief of the radiation and cancer unit at the IARC.

Five of the countries involved in the project are also planning to start prospective studies following 250,000 people (50,000 in each country) to confirm any effects that INTERPHONE finds.

Der Kinderreport 2004 macht deutlich: Hartz IV ist Armut per Gesetz. Wenn im Ergebnis von Hartz IV 1,5 Millionen Kinder mehr gezwungen sein werden, an der Armutsgrenze zu leben, führt das die Hartz-Gesetze und die dahinter stehende Philosophie endgültig ad absurdum. Sie bringen keine Existenz sichernden Arbeitsplätze, sondern rauben denjenigen Zukunftsperspektiven und Lebenschancen, die sich am wenigsten wehren können. Jedes zehnte Kind in Deutschland wird ab Januar 2005 in Armut leben - das ist der sozialpolitische Offenbarungseid der rot-grünen Bundesregierung.

Hartz IV setzt für Millionen einen verhängnisvollen Kreislauf der Armut in Gang, der vom Kindes- bis zum Rentenalter andauert. Die Bundesagentur für Arbeit kalkuliert damit, dass eine halbe Million Menschen überhaupt keine Leistung mehr erhält und dass davon vor allem Frauen in Ostdeutschland betroffen sein werden. Diese mittelbare Diskriminierung, die die Frauen in extreme Abhängigkeiten stürzt, ist verfassungswidrig. Die Betroffenen fallen nicht nur aus dem Leistungsbezug, sie sind auch nicht mehr rentenversichert. Altersarmut droht. Krankenversichert sind sie nur noch über die Familienversicherung ihres Partners, sofern sie verheiratet sind. Vermittlungsbemühungen auf den Arbeitsmarkt werden praktisch für sie nicht mehr stattfinden. Eine Rückkehr in den Arbeitsmarkt und damit in eine eigenständige Existenzsicherung wird fast unmöglich. Dies ist auch psychologisch katastrophal für die zu DDR-Zeiten selbstverständlich erwerbstätigen ostdeutschen Frauen.

Das Sozialstaatsgebot des Grundgesetzes ist eine Grundkonstituente der Bundsrepublik. Bundesregierung und konservativ-liberale Opposition legen die Axt an diese Säule unseres Gemeinwesens.
