The e-mail to John Witmer from his daughter Michelle came on Father's Day in 2003.

"Dear Daddy," it said, "Happy Father's Day. I love you so much and you can't imagine how often I think of you. I hope you have lots of fun today and that the weather is lovely.

"We had a briefing telling us to prepare ourselves as best as possible for what lies ahead. Things like children running out in front of vehicles to try and get them to stop. We have to prepare ourselves to hit people because stopping is not an option. I guess every convoy that's gone up north so far has taken fire or been ambushed. The question of whether we will or not is not even really a question, more like a guess as to when.

"These things, as you can imagine, are a lot to take in. I'm doing my best. I've been a little depressed lately but I'm trying to keep my chin up. I really miss home. Tomorrow will be exactly three months since I got deployed. Wow, time does not fly. Jeez, this letter wasn't supposed to be down. Sorry. Back to the point. Happy Father's Day. I love and miss you so much.

"Love, Shelly."

Specialist Michelle Witmer of New Berlin, Wis., survived for nearly 10 more slowly moving months in Iraq, until she was cut down by enemy fire in Baghdad last April 9. She was 20 when she died.

The e-mail was read on camera by her dad in an extremely moving documentary, "Last Letters Home," http://www.hbo.com/docs/programs/lastlettershome/
which was jointly produced by The New York Times and HBO. It premiered on HBO last night.

In the hourlong program, grieving relatives read aloud from letters, cards and e-mail sent by troops who died in Iraq, and comment on the ways they've been affected by the loss of their loved ones. The program is not about pro-war or anti-war sentiments, or grand geopolitical visions. It just gives us a glimpse of the searing personal toll that is inevitable in war. I imagine it would be difficult for anyone to see it and not take the war more seriously. Anything that imposes such unmitigated agony should give us pause.

Second Lt. Leonard Cowherd III of Culpeper, Va., commented in his last letter to his wife, Sarah, about how young so many of the soldiers were, which was interesting because he was only 22 himself. He wrote:

"Some of these guys out here, Sarah, they're just kids. I'm not that old myself but I couldn't imagine going through the experiences these guys are going through at the age of 18, 19 and 20. If you saw them walking down the street you would think that they belonged in an arcade or at a movie theater doing stuff kids do. Not putting their lives on the line every second of every day."

The Cowherds were married last year and spent only a few months together before Lieutenant Cowherd was shipped to Iraq. He was shot to death in Karbala in May.

A theme that runs through the documentary is the overwhelming sense of dread that grips relatives when their doors are knocked upon by soldiers or marines in dress uniforms.

"It was the lightest tap on my door that I've ever heard in my life," said Paula Zasadny, the mother of Specialist Holly McGeogh, a 19-year-old who was killed by a bomb in Kirkuk.

"I opened the door and I seen the man in the dress greens and I knew. I immediately knew. But I thought that if, as long as I didn't let him in, he couldn't tell me. And then it -- none of that would've happened. So he kept saying, 'Ma'am, I need to come in.' And I kept telling him, 'I'm sorry, but you can't come in.' "

As much as possible, the reality of war is kept at a distance from the American people, which is a shame. My own belief is that the pain of war should be much more widely shared. That would help guard us against wars that are unnecessary, and ensure a more collective effort in those that are inevitable.

This documentary takes us a small step toward understanding the awful depth of that pain.

Melissa Givens was told by a chaplain that her husband, Pfc. Jesse Givens, who was 34, had drowned when his tank fell into the Euphrates River. Distraught, she insisted that the chaplain was lying. But she said that was O.K., because she would never tell anyone that he had lied. She said he could walk away and she would just forget about the whole thing.

Private Givens died on May 1, 2003, the day that President Bush, on the aircraft carrier Abraham Lincoln, declared that "major combat operations in Iraq have ended."

In unserer gestrigen Info brachten wir nachfolgende PM über die Planung von Vorrangflächen für Mobilfunksendeanlagen in Schwabenheim.

Wir nehmen die dort gebrachte Ansicht der Bau-, Umwelt- und Rechtsabteilung der Verbandsgemeindeverwaltung zum Anlaß, darauf hinzuweisen, dass es nicht zutrifft, daß Ausweisungen von Vorrangflächen nicht möglich seien.

In einem Dialog am 8-11-04 mit dem Planungsverband Ballungsraum Frankfurt/Rhein-Main äußert sich zum Thema Planungshoheit etc. und den diesbezüglichen Steuerungsmöglichkeiten Herr Rechtsanwalt Dietmar Freund, Bruchköbel - s. Anlage -.

Dass der Ortsbürgermeister Herr Peter Merz sich von den negativen Äußerungen nicht beeinflussen läßt und sich den "Empfehlungen " der Verbandsgemeindeverwaltung widersetzt, verdient Respekt!

Er handelt im Gegensatz zu anderen Kommunen im Sinne der Vorsorge für seine Gemeinde und hat klar erkannt, dass es sehr wohl eine Planungshoheit für Gemeinden gibt, die auch gleichzeitig als Planungsverpflichtung zu verstehen ist.

Man muß es nur wollen!!!

Die Kommune hat eine Planungshoheit. Wenn ein Planungswille vorhanden ist, kann sie sehr wohl Einfluss auf eine vernünftige Senderstandortplanung nehmen (Veränderungssperre, positive Bauleitplanung usw.). Im Übrigen hat auch die Kommune unter dem Aspekt der Fürsorgepflicht eine moralische Planungspflicht! Sie muss es nur wollen!

Dieses Bedenken greift keineswegs. Wie praktische Beispiele zeigen (z.B. in Gräfelfing) ist es durchaus möglich, ohne Negativ- oder gar "Willkürplanung" in Bebauungsplänen über § 1 Abs. 6 Nr. 1 Baunutzungsverordnung (zumindest weitgehend) mobilfunkantennenfreie Wohngebiete mit minimaler Belastung zu schaffen, weil die bauplanerische Zulässigkeit von Antennenanlagen in Wohngebieten nur durch Ausnahmevorschriften, sei es § 4 Abs. 3 Nr. 2 oder § 14 Abs. 1 Nr. 2 Baunutzungsverordnung begründet ist. Abgesehen davon, dass schon die sog. "Privilegierung" im Außenbereich in § 35 BauGB diese Wertung vorgibt, was vom Planungsverband in dem angeführten Schreiben in Übereinstimmung mit dem Hess. Umweltminister - Landtagsdrucksache 15/3872 - grundsätzlich bestätigt wurde. In der angeführten Landtagsdrucksache ist unter der Antwort zum 2. Teil der Antwort auf Frage 2 auf Seite 2 ist folgende Passage zu finden: "Die Möglichkeit der Mitentscheidung über die Errichtung von Sendeanlagen durch kommunale Gremien und die Bürgerschaft ist soweit gegeben, wie die planerische Steuerung entsprechender Standorte der städtebaulichen Planung zugänglich ist. Prinzipiell kommen als Möglichkeit der Bestimmung von Standorten für Sendeanlagen, soweit sie bodenrechtlich relevant sind, Regelungen in den Bauleitplänen in Betracht. Denkbar ist der Ausschluss oder die Einschränkung von Anlagen im Bebauungsplan im Rahmen von Festsetzungen über die Art der baulichen Nutzung. Die Möglichkeit der Bestimmung von Standorten für Mobilfunkanlagen im Rahmen der Bauleitplanung sind jedoch sachlich begrenzt durch die Bindung aller Maßnahmen der planerischen Steuerung von Mobilfunkanlagen an die Grundsätze des § 1 Abs. 3 bis 6 BauGB. Die Planung muss nach § 1 Abs. 3 BauGB für die städtebauliche Entwicklung und Ordnung erforderlich sein. Es müssen also hinreichend gewichtige städtebauliche Belange für die Planung sprechen….."

Für derartige "Beschränkungen" sind prinzipiell städtebauliche Gründe nach § 1 Abs. 5 BauGB vorhanden. Nach dieser Vorschrift sollen die Bauleitpläne nämlich dazu beitragen, eine menschenwürdige Umwelt zu sichern und die natürlichen Lebensgrundlagen schützen und entwickeln.

Aufgrund von § 1 Abs. 5 Nr. 1 und Nr. 7 und 1a BauGB (Vgl. BayVGH M 11 K 01.5934 1.8.02 - Gröbenzell Planungshoheit + städebaurechtl. Relevanz + auch wegen Funktion u. ges. Wohn- u. Arbeitsverhältnissen gem. § 1 V S. 2 Nr. 1 BauGB), in Verbindung mit dem Vorsorgeprinzip der §§ 3, 5 Abs. 1 Nr. 1, 2 BlmSchG, kommt der Bauleitplanung nicht nur die Aufgabe der Abwehr von bereits eingetretenen schädlichen Umwelteinwirkungen, sondern auch die Aufgabe des vorsorgenden Immissionsschutzes zu (vgl. Battis/Krautsberger/Löhr, BauGB, 7. Auflage, § 1 Rdnr. 67). Hier ist insbesondere zu beachten, dass die 26. BImSchV keine Vorsorgekomponente enthält (wie dies übrigens der BGH am 13.2.04 ausdrücklich bestätigte!) sowie nicht-thermische Wirkungen nicht berücksichtigt und es deshalb ein bauplanerisches Ziel sein kann, Wohngebiete nach Möglichkeit von Mobilfunkanlagen frei zu halten.

Der Bayerische VGH hat etwa am 18.3.03 (15 N 98.2262) zu einer entsprechenden Planung in Dittelbrunn folgendes ausgeführt: "Eine Gemeinde kann in einem Bebauungsplan bestimmen, dass "von außen erkennbar technische Anlagen" und damit auch Funkantennen und dazugehörige Masten in einem Wohngebiet unzulässig sind. Da § 14 Abs. 1 Satz 3 BauNVO die Gemeinde ermächtigt, die Zulässigkeit von Nebenanlagen einzuschränken oder auszuschließen, ist eine derartige Festsetzung im Interesse eines einheitlichen optischen Erscheinungsbildes als Bestimmung zur Art der baulichen Nutzung nach § 9 Abs. 1 Nr. 1 BauGB möglich."

Das Bundesverwaltungsgericht (BVerwG) hat am 28.2.02 (4 CN 5.01) zur Vorsorge bei der Bauleitplanung, bei der es um Geruchsbeeinträchtigungen ging, u.a. angeführt: "Wenn städtebauliche Gründe dies rechtfertigen, darf die Gemeinde im Wege der Bauleitplanung unterhalb der durch § 3 Abs. 1 BImSchG bestimmten Erheblichkeitsschwelle eigenständig gebietsbezogen das Maß hinnehmbarer (Geruchs-)Beeinträchtigungen nach den Maßstäben des Vorsorgegrundsatzes steuern."

Im selben Jahr hat dies das BVerwG am 17.12.02 (4 C 15/01) bekräftigt und ausgeführt: "Daraus kann aber nicht gefolgert werden, dass die Gemeinde umgekehrt im Interesse von Bauinteressenten von ihren planerischen Befugnissen keinen anderen Gebrauch machen darf, als Nutzungen bis an die Grenze dessen zu ermöglichen, was anhand der Maßstäbe des Immissionsschutzrechts gerade noch zulässig ist, ohne als schädliche Umwelteinwirkungen im Sinne des § 3 Abs. 1 BImschG qualifiziert werden zu können. Wie der Senat wiederholt ausgeführt hat, ist es ihr vielmehr bereits im Vorfeld der Abwehr schädlicher Umwelteinwirkungen gestattet, durch ihre Bauleitplanung eigenständig gebietsbezogen das Maß des Hinnehmbaren zu steuern."

Das BayVG-München (M 11 K 03.2059 - Grafrath) hat zuletzt am 22.04.2004 sogar eine nachträglich verhängte Veränderungssperre als wirksam erachtet und das Mobilfunkvorhaben als nicht genehmigungsfähig und den Belang der Planung im Landschaftsschutzgebiet als vorrangig bezeichnet.

Der immer wieder auch seitens des HStGB angeführte (einzigen negativen) Entscheidung des OVG-Koblenz (vom 07.08.2003, 1 A 10196/03.OVG) lag keine Planung, sondern nur ein diffuses "Konzept" zugrunde, so dass diese den anderen Vorgaben keineswegs entgegensteht.

Der Kollege Dahlen (Stadtdirektor a.D. und RA aus Bocholt) bestätigt in KommunalPraxis MO 2003, 4-12, u.a. mit eingehenden Argumenten (wie etwa allein schon der ständigen Anpassungspflicht des Gesetzgebers als hinreichenden Anlass für ein Tätigwerden unterhalb der heutige zulässigen Werte!, S. 15) den Weg auf der Grundlage der Planungshoheit als gangbar und geboten (unter Ziff. 5.,Seiten 6ff.). Desweiteren weist er auch noch einmal auf die nicht unerheblichen Schadensersatzrisiken auch der Kommunen hin....

Wie bereits angeführt, ist für Gemeinden die an gesundheitlicher Vorsorge interessiert sind (und damit für die Bürger), von allen rechtlichen Möglichkeiten zur vernünftigen Beschränkung von Mobilfunkanlagen eine Verabschiedung entsprechender Bebauungspläne bzw. die Änderung von diesen Bebauungsplänen das derzeit juristisch erfolgversprechendste Mittel. Und der Planungsverband ist dabei maßgeblich einzubinden.

Zur Falschaussage, dass eine Stadt keine Einflussmöglichkeiten hat folgendes:

Eine Gemeinde besitzt eine autonome Planungshoheit. Voraussetzung hierzu ist allerdings der Planungswille. Ist dieser vorhanden, kann sehr wohl durch eine vernünftige Senderstandortplanung eine Belastungsminimierung für die Bevölkerung erzielt werden. Niemand kann den Planungswillen einer Gemeinde innerhalb ihres rechtlichen Rahmens aufhalten. Über eine Veränderungssperre und einer positiven Bauleitplanung innerhalb des kommunalen Flächennutzungsplanes kann eine für alle Beteiligten vernünftige Mobilfunkversorgung erreicht werden. Beispiele dieser Art gibt es zur Genüge: Gräfelfing, Attendorn um nur zwei zu nennen. Durch die Bereitstellung von qualifizierten ausgewiesenen Alternativstandorten ergibt sich auch für die Betreiber eine Planungssicherheit. Dass Letztere ihre eigenen Vorstellungen aus monetären Interessen favorisieren liegt auf der Hand, sollte aber für kein Grund sein, ausnahmslos den Betreiberinteressen zu folgen. Die Hauptamtlichen hätten also durchaus die Möglichkeit, die Bevölkerung vor möglicher Gesundheitsgefährdung zu schützen. Mobilfunksender sollten, soweit es die topografischen Gegebenheiten ermöglichen, nur außerhalb von sensiblen Gebieten wie Wohngebieten, Kindergärten, Schulen, Altersheime etc., errichtet werden. Eine qualifizierte, funktechnisch fundierte Netzplanung, welche von einem unabhängigen Ingenieurbüro vorgenommen werden sollte, bietet hierzu die beste Voraussetzung.

Mit flotten Sprüchen kann man zwar der Bevölkerung möglicherweise temporär Sand in die Augen streuen, aber eine reale Konfliktlösung wird damit nicht erzielt. Von einer Entwarnung sind wir also leider noch nach wie vor weit entfernt.

Vorrangflächen für Mobilfunk-Anlagen -
Schwabenheim bringt Antrag in VG-Rat ein

nwi. SCHWABENHEIM Ohne Gegenstimme stellte der Schwabenheimer Ortsgemeinderat einen Antrag an die Verbandsgemeinde. Dabei ging es um die Fortschreibung des Flächennutzungsplans der VG Gau-Algesheim, konkret um die Ausweisung von Vorrangflächen für Mobilfunk.

Bereits im März 2001 hatte der Schwabenheimer Gemeinderat eine Resolution dazu beschlossen. Darin steht, solange nicht geklärt sei, ob Mobilfunkanlagen gesundheitsschädigend wirken, diese nur dann mit Einverständnis der Gemeinde errichtet werden dürfen, wenn sie 400 Meter vom Ortsrand entfernt stehen.

"Durch das EU-Anpassungsgesetz besteht nun die Möglichkeit, Vorrangflächen für solche Mobilfunk-Anlagen auszuweisen. Davon wollen wir auch Gebrauch machen", so Ortsbürgermeister Peter Merz.

Die Bau-, Umwelt- und Rechtsabteilung der Verbandsgemeindeverwaltung riet dem Ortsgemeinderat von dem Beschluss ab. In ihrer Begründung kam sie zu dem Schluss, dass die Ausweisung von Vorrangflächen für Mobilfunk-Anlagen nicht möglich ist. Diese Auffassung sei auch vom Gemeinde- und Städtebund Rheinland-Pfalz sowie von verschiedenen Planungsbüros bestätigt worden.

"Wir verstehen die Begründung der Verbandsgemeinde als Aktenvermerk. Sie entspricht aber keinesfalls unserer Meinung", verdeutlichte Merz.

Dass der Spielraum für die Kommunalpolitiker begrenzt ist, muss leider bestätigt werden.

Wenn seitens einer Kommune keine spezielle Mobilfunkbauleitplanung vorgenommen wurde, wie vielerorts und auch in Homberg nicht geschehen, dann sind den Betreibern Tür und Tore geöffnet, zu Lasten der Bevölkerung. Dann sind in der Tat die Abläufe in Homberg "rechtens". Das Versäumnis der Hauptamtlichen, keine positive Bauleitplanung organisiert zu haben, ist der Grund. Je nach Topografie ist es nämlich möglich, in Bebauungsplänen Mobilfunkantennenfreie Wohngebiete zu schaffen, weil die Zulässigkeit von Antennenanlagen nur durch Ausnahmevorschriften begründet ist. Schon die "Privilegierung" im Außenbereich in § 35 Baugesetzbuch gibt die generelle Wertung vor, dass diese Anlagen nicht in den Innenbereich gehören. Bauleitpläne sollen nämlich dazu beitragen, eine menschenwürdige Umwelt zu sichern und die natürliche Lebensgrundlagen schützen und entwickeln.

Eine Gemeinde kann also durchaus in einem Bebauungsplan bestimmen, dass "von außen erkennbar technische Anlagen" und damit auch Funkantennen und dazugehörige Masten in einem Wohngebiet unzulässig sind. Voraussetzung hierzu ist, dass man von seiner originären Planungshoheit Gebrauch macht.

Leider ist dies in Homberg nicht geschehen, und nur deswegen ist die Genehmigung formal rechtens. Sie stellt leider kein Indiz für eine Unbedenklichkeit dar. Jüngste seriöse internationale Studien bezüglich der Gesundheitsrisiken werden auch durch epidemiologische Untersuchungen bei Sendeanlagen belegt.

Unser Rat an die Hauptamtlichen: Verhandeln Sie erneut mit den Betreibern.

Rechtsanwalt Prof. Dr. jur. Klaus Kniep hat schon vor Jahren darauf hingewiesen, dass unter Benutzung von § 1 Abs. 9 BNVO es möglich ist, innerhalb einer Gemeinde bestimmte Gebiete positiv für die Ansiedlung von Mobilfunk zuzulassen oder anders ausgedrückt: in einigen Gemeindeteilen die Ansiedlung von Mobilfunk auszuschließen. Wichtig sind hier allein städtebauliche Grunde. Ggf. müsste dies durch ein Gutachten festgelegt werden. In der Vergangenheit wurde diese Art des Ausschlusses auch praktiziert bei der Ansiedlung von großflächigen Handelsbetrieben. Das BVerwG hat in mehreren Entscheidungen eine derartige positive oder negative Festlegung als zulässig angesehen. Wichtig ist jedoch, dass bei dem Ausschluss von Mobilfunkanlagen auf einem Gemeindegebiet nicht die gesamte Gemeinde ausgeschlossen wird.

Der Vorsorgegrundsatz, den Rechtsanwalt Freund zum Ausdruck bringt, ist auch enthalten einerseits in Art. 20 a GG und vor allem auch in Art. 174 EGV. Die kommunale Planungshoheit liegt aufgrund von Art. 28 GG bei der jeweiligen Gemeinde und diese hat sehr wohl die Möglichkeit, die entsprechenden Maßnahmen vorbeugend zu tätigen.

Landratsamt setzt Bauantrag für Ebermannsdorf aus - Juristisches Neuland

[...] Der Bauantrag sei an sich zulässig, informierte auf Anfrage unserer Zeitung gestern Baujurist Regierungsrat z.A. Matthias Steck. Doch seit dem 30. Juli gibt es den Absatz 3 in Paragraph 15 des Baugesetzes in der jetzigen Form. Danach ist ein Aussetzungsantrag möglich, davon wurde Gebrauch gemacht.

Dieser ist nur zulässig, wenn die Gemeinde beginnt, den Flächennutzungsplan neu zu erarbeiten und Standpunkte festzulegen, an denen Mobilfunkmasten nicht errichtet werden dürfen oder solche, an denen das möglich sein wird. Positive und negative Standorte würden so benannt. [...]

[...] Deshalb hätte das Vorhaben, den Masten an der geplanten Stelle zu verhindern nur einen Sinn, wenn städtebauliche Gründe geltend gemacht werden könnten, erläuterte der Baujurist. Dies gelte beispielsweise bei Landschaftsschutz, Denkmalschutz, wegen der eventuellen Errichtung eines Wohnviertels an der angedachten Stelle oder weil genau dort die Trasse für eine Straße verlaufen könne.[...]

[...] Dann könnten alle rechtlichen Konsequenzen folgen. "Ein derartiger Streit kann bis zum Bundesverwaltungsgericht nach Leipzig gehen. Das würde Jahre dauern." Betroffen ist im Landkreis übrigens neben Ebermannsdorf auch Vilseck, wo ein ähnliches Vorgehen erwogen wird.

LOS ANGELES, November 9, 2004 - At 7:50 PM armored tanks showed up at an anti-war protest in front of the federal building in Westwood.

The tanks circled the block twice, the second time parking themselves in the street and directly in front of the area where most of the protesters were gathered.

Enraged, some of the people attempted to block the tanks, but police quickly cleared the street.

The people continued to protest the presence of the tanks, but after about ten minutes the tanks drove off. It is unclear as to why the tanks were deployed to this location.

Foster Kids on Mind-Altering Drugs?

Why would a child as young as three years old ever be on mind-altering drugs? For the past eight months, the News 4 WOAI Trouble Shooters have poured through reams of state documents and discovered thousands of foster kids appear to be on powerful psychotropic drugs. Or have we become a nation that the views of such people are dangerous because of their suspicious political activism and morally bankrupt worldviews? One need only compare Pat Robertson to the Rev. Martin Luther King Jr. to consider the contrast. We know what the Rev. King’s dream was by heart, but what about Dr. Robertson’s? What’s his dream?

Zusammenfassung

Im Anschluss an die durch den rasanten Anstieg der drahtlosen Telefonie in den letzten Jahren bedingte zunehmenden Mobilfunksendeanlagen in oder in unmittelbarer Nähe von Wohngebieten erfolgte die Aufforderung des Präsidenten des Bundesamtes für Strahlenschutz, Wolfram König, an alle Ärzte, aktiv an der Abschätzung des Risikos durch Mobilfunkstrahlung mitzuarbeiten. Das Ziel dieser Untersuchung war daher, zu prüfen, ob Anwohner in der Nähe von Mobilfunksendeanlagen einem erhöhten Risiko für Neuerkrankungen an bösartigen Tumoren ausgesetzt sind.

Datengrundlage waren PC-gespeicherte und mit den Krankenkassen abgerechnete Patientenunterlagen der Jahre 1994 bis 2004. In die ohne Fremdmittel erstellte Studie wurden Angaben von knapp 1.000 Patienten aus Naila (Oberfranken) unter Wahrung des Datenschutzes aufgenommen.

Als Ergebnis zeigte sich, dass der Anteil von neu aufgetretenen Krebsfällen bei den Patienten, die während der letzten zehn Jahre in einem Abstand bis zu 400 Meter um die seit 1993 betriebene Mobilfunksendeanlage gewohnt hatten, gegenüber weiter entfernt lebenden Patienten signifikant höher war und die Patienten in durchschnittlich jüngerem Alter erkrankt waren.

Für die Jahre 1999 bis 2004 - also nach fünf und mehr Jahren Betriebszeit des Senders - hatte sich das Malignomrisiko für die näher an der Sendestation lebende Bevölkerungsgruppe im Vergleich mit der Gruppe im Nailaer Außenbereich verdreifacht.

Summary

Following the call by Wolfram König, President of the Bundesamt für Strahlenschutz (Federal Agency for radiation protection), to all doctors of medicine to collaborate actively in the assessment of the risk posed by cellular radiation, the aim of our study was to examine whether people living close to cellular transmitter antennas were exposed to a heightened risk of taking ill with malignant tumors.

The basis of the data used for the survey were PC files of the case histories of patients between the years 1994 and 2004. While adhering to data protection, the personal data of almost 1.000 patients were evaluated for this study, which was completed without any external financial support. It is intended to continue the project in the form of a register.

The result of the study shows that the proportion of newly developing cancer cases was significantly higher among those patients who had lived during the past ten years at a distance of up to 400 metres from the cellular transmitter site, which bas been in operation since 1993, compared to those patients living further away, and that the patients fell ill on average 8 years earlier.

In the years 1999-2004, i.e. after five years’ operation of the transmitting installation, the relative risk of getting cancer had trebled for the residents of the area in the proximity of the installation compared to the inhabitants of Naila outside the area.

I am working on it to produce a very much smaller version as soon as I can. This is a very important study, you should read it and be familiar with it. I don't believe at his stage that the rise in particular cancers has anything to do with breaking DNA necessarily. There are direct and plausible reasons for quite other mechanisms, so this study cannot be set against the "not enough energy in mast emissions" argument favoured by the HPA or WHO.

An election judge where I voted Tuesday in a heavily Democratic precinct in Maryland knows what that means and wasn’t averse to sharing his opinion of the Republican-owned company. As I was about to vote with the electronic system, I asked this judge if they had a way to check people’s votes through a paper backup. The official said no, and then in a low voice so no one else would hear, added, “And that really makes us nervous, with Diebold as the owner of that system.” Goodbye, hanging chads. Hello, computer fraud that leaves no trace. Diebold Inc. of North Canton, Ohio, supplied scores of machines and counted millions of votes Tuesday, while reportedly discarding many votes for Democrat John Kerry, according to investigative reporter Greg Palast. Walden O’Dell, chief executive of Diebold and a top fundraiser for the Bush campaign, wrote in a fund-raising letter last year that he was “committed to helping Ohio deliver its electoral votes to the president next year.” That he did.

The morning after Election Day, Democratic presidential candidate John Kerry and the vice presidential candidate John Edwards promised the nation that the Democrats would make sure that every vote counts, and that every vote is counted. Later in the day, Kerry and Edwards, however, conceded defeat before some 170,000 to 250,000 provisional ballots from Ohio, which could have changed the outcome of the election, had been counted. But how were the votes actually counted across the nation on Nov. 2? On Election Day, voters in Cook County, Ill., were among the 60 million Americans who voted with machines made by Election Systems & Software, a secretive company based in Omaha.

ES&S, as it is known, calls itself “the world’s largest and most experienced provider of total election management solutions.” According to the company’s own figures, 42 percent of all registered voters in the United States voted on ES&S equipment on Election Day.

Hundreds of angry Ohio residents marched through the streets of Columbus—Ohio’s Capital—this evening and stormed the Ohio State House, defying orders and arrest threats from Ohio State Troopers. "O-H-I-O ! suppressed democracy has got to go,"they chanted. After troopers pushed and scuffled with people, nearly a hundred people took over the steps and entrance to the State’s giant white column capital building and refused repeated orders to disperse or face arrest. People prepared for arrests, ready to face jail—writing lawyers phone numbers on their arms, signing jail support lists and discussing non-cooperation and active resistance (linking arms, but not fighting back). A freshly painted banner held on the steps read "ONE VOTE DENIED = DEMOCRACY IN TROUBLE! 100’S OF 1000’S OF VOTES SURPRESSED = DEMOCRACY FAILED" articulated the crisis. An unprecedented massive grassroots voter registration and get out the vote effort and widespread opposition to Bush went up against the massive coordinated Republican effort to suppress, intimidate and possibly steal millions of votes. In addition to the voter suppression and intimidation is the fact that Bush campaign co-chair Secretary of State Kenneth Blackwell is in charge of the election and vote counting. But much deeper questions about fundamental flaws in the system hang in the air. CNN's exit poll showed Kerry beating Bush among Ohio women by 53 percent to 47 percent. Kerry also defeated Bush among Ohio's male voters 51 percent to 49 percent. Investigative reporter Greg Palast in an article today titled "Kerry Won" details how the deciding states, Ohio and New Mexico, if all votes were actually counted, would have gone to Kerry. Palast explains, "Although the exit polls show that most voters in Ohio punched cards for Kerry-Edwards, thousands of these votes were simply not recorded. The election in Ohio was not decided by the voters but by something called "spoilage." Typically in the United States, about 3 percent of the vote is voided, just thrown away, not recorded." But that is just a piece of it.

Since the late 1960’s, every president winning a second term has found his administration embroiled in a scandal of some sort. For those of us who truly love liberty and yearn for the days of politicians, who at least played at honoring their oath to uphold and defend the Constitution, perhaps a nice juicy scandal will stop the second Bush administration from totally destroying this country. In 2002, a multitude of lawsuits, most by some 500 family members of those lost in the disasters of 9/11, were filed in several different federal courts. The Bush administration is already seeking to stifle discovery, therefore preventing the release of possibly incriminating evidence in all of these lawsuits. In addition, San Francisco-based attorney, Stanley G. Hilton has filed a class-action federal lawsuit that names President Bush and members of his Cabinet as defendants. The named Cabinet members include Defense Secretary Donald Rumsfeld, National Security Adviser Condoleezza Rice, Vice President Dick Cheney, and Attorney General John Ashcroft.
"I hope the lawsuit will expose the fact that there are numbers of people in the government, including Bush and his top assistants, who wanted this to happen," Hilton was quoted as saying by the San Francisco Examiner in June of 2002.

With US forces massing outside Fallujah, 35 marines swayed to Christian rock music and asked Jesus Christ to protect them in what could be the biggest battle since American troops invaded Iraq last year. Men with buzzcuts and clad in their camouflage waved their hands in the air, M-16 assault rifles beside them, and chanted heavy metal-flavoured lyrics in praise of Christ late on Friday in a yellow-brick chapel. They counted among thousands of troops surrounding the city of Fallujah, seeking solace as they awaited Iraqi Prime Minister Iyad Allawi's decision on whether or not to invade Fallujah. "You are the sovereign. You're name is holy. You are the pure spotless lamb," a female voice cried out on the loudspeakers as the marines clapped their hands and closed their eyes, reflecting on what lay ahead for them. The US military, with many soldiers coming from the conservative American south and midwest, has deep Christian roots. In times that fighting looms, many soldiers draw on their evangelical or born-again heritage to help them face the battle. One spoke of their Old Testament hero, a shepherd who would become Israel's king, battling the Philistines 3 000 years ago. "Thus David prevailed over the Philistines," the marine said, reading from scripture, and the marines shouted back "Hoorah, King David," using their signature grunt of approval. The marines drew parallels from the verse with their present situation, where they perceive themselves as warriors fighting barbaric men opposed to all that is good in the world. "Victory belongs to the Lord," another young marine read. Their chaplain, named Horne, told the worshippers they were stationed outside Fallujah to bring the Iraqis "freedom from oppression, rape, torture and murder ...

Now that Bush dynasty has illicitly secured its second term in the eyes of the American people plans are fully underway for John Ashcroft's "Patriot Act Concentration Camps" to jail and disappear US Citizens. Atty. Gen. John Ashcroft's announced to Bush administration aides yesterday his desire for camps for U.S. citizens he deems to be "enemy combatants" such as anarchists, anti-war protesters, americans of arab descent, communists and homosexuals. Ashcroft's plan would allow him to order the indefinite incarceration of U.S. citizens and summarily strip them of their constitutional rights and access to the courts by declaring them enemy combatants.

Now that a second term for George Bush has been secured, Ashcroft plans to use his self made "enemy combatant" stamp for any citizen whom he deems to be part of a wider terrorist conspiracy.

Getrübter Durchblick im Elektrosmog

Studien zur Strahlenbelastung durch den Mobilfunk sind schwierig und liefern nach wie vor widersprüchliche Resultate.

Trotzdem gab sich Bernhard Aufdereggen, Vorstandsmitglied von Ärztinnen und Ärzten für Umweltschutz, an der Diskussion in Zürich überzeugt: «Es bestehen ernst zu nehmende Hinweise für Beeinträchtigungen der Gesundheit durch Basisstationen.»

Der Arzt führte unter anderem eine Studie des holländischen TNO-Labors an, die vor einem Jahr für Aufsehen gesorgt hatte. Die TNO-Forscher untersuchten eine Gruppe elektrosensibler Personen, die sich in ihrem Wohlbefinden durch Sendemasten beeinträchtigt fühlten. Eine zweite Versuchsgruppe gab an, nicht elektrosensibel zu sein.

Beide Gruppen wurden verschiedenen Hochfrequenzfeldern mit einer Feldstärke von 1 Volt pro Meter ausgesetzt. Einmal entsprach das Feld jener Strahlung, wie sie von GSM-Antennen ausgeht, dem heute gebräuchlichen europäischen Mobilfunkstandard der zweiten Generation.

Ein andermal wurden die Testpersonen mit einem UMTS-Signal bestrahlt, dem geplanten globalen Mobilfunkstandard der dritten Generation. Zu Kontrollzwecken wurden die Personen auch «nur zum Schein» bestrahlt. Die Versuche wurden doppelblind durchgeführt, weder die Testpersonen noch der Versuchsleiter wussten also, wann welches Signal und wann überhaupt kein Signal ausgesandt wurde.

Wohlbefinden beeinträchtigt

Das erstaunliche Ergebnis: In beiden Versuchsgruppen verschlechterte sich das Wohlbefinden, wenn die Testpersonen während 20 Minuten dem UMTS-Feld ausgesetzt waren. Selbst bei den nicht elektrosensiblen Personen war dieser Effekt nachweisbar.

Den Ärzten für Umweltschutz gab die TNO-Studie den Anstoß, ein Moratorium für die neue Mobilfunkgeneration UMTS zu fordern. «Ich rate zur Vorsicht gegenüber neuen Technologien», sagt Bernhard Aufdereggen. Denn wenn das Entwicklungstempo so weitergetrieben werde, «drohen mögliche Katastrophen».

Nun wird die Untersuchung in der Schweiz mit einer verbesserten Methodik wiederholt. Insgesamt sollen 84 Personen getestet werden, «deutlich mehr als in der Originalstudie», schreibt die Forschungsstiftung Mobilkommunikation.

Die gut 700 000 Franken teure Schweizer Studie wird zu 60 Prozent von der öffentlichen Hand finanziert. 40 Prozent zahlen Orange, Sunrise und Swisscom Mobile. Wenn die Mobilfunkanlagen potenzielle Auswirkungen auf die Gesundheit hätten, müsse man dies frühzeitig wissen, begründet Carsten Schloter, Chef von Swisscom Mobile, das finanzielle Engagement. Und: Die Forschung sei wichtig, um bei den Kunden das Vertrauen zu fördern.
Die Wiederholung der TNO-Studie in der Schweiz wird gut ein Jahr dauern. Erste Ergebnisse sollen Ende 2005 veröffentlicht werden.

Die immer neuen, meist völlig überflüssigen „neuen“ Forschungsstudien dienen doch nur dem einen Zweck: sich vor den notwendigen Konsequenzen der Forschungsergebnisse zu schützen, nämlich eine gesundheitsverträglichere Mobilfunktechnik einzusetzen und für die angerichteten Schäden zu haften. Für eine gesundheitsverträglichere Mobilfunktechnik zu forschen und die Forschungsgelder dafür einzusetzen wäre viel sinnvoller, als zu hoffen etwas „wegzuforschen“ zu können, was schon lange als schädlich bewiesen ist. Außerdem wird es den letzten, ultimativen Beweis auch niemals geben, weil es so was in der Wissenschaft überhaupt nicht gibt. In der Zwischenzeit bauen die Mobilfunkbetreiber unter Hochdruck ihre Netze zu Lasten der Gesundheit der Bevölkerung immer weiter aus und nutzen die Forderungen nach immer weiterer Forschung als Zeitaufschub und Alibi für ihre wirtschaftlichen Interessen, nämlich dem Bestandsschutz für ihre Anlagen. Wir wissen doch ganz genau, dass es wirklich 100 % reproduzierbare Studien überhaupt nicht gibt. Die Studien und deren Ergebnisse unterscheiden sich alle mehr oder weniger. Kaum ein Geldgeber wäre bereit eine Studie zu finanzieren, die bereits mit einem identischen Forschungsaufbau und -ziel gelaufen ist und Forschungsziele und deren erwünschte Ergebnisse lassen sich leicht vor Beginn der Studie definieren.

Wie kann man von Interessierten, die aus wirtschaftlichen Gründen ein für sich positives Ergebnis anstreben und wünschen, auch ein anderes Verhalten erwarten? Da liegt doch Parteilichkeit vor und dann will man die Studienergebnisse der Öffentlichkeit als „neutral“, „unabhängig“ oder „objektiv“ verkaufen. Aufgrund der Tatsache, dass die Mobilfunkbetreiber an vielen Studien finanziell beteiligt sind und waren, braucht man sich über die unterschiedlichen und sich oft auch widersprechenden Forschungsergebnisse nicht wundern, denn wenn man den „Bock zum Gärtner“ macht, was kann man denn dann anderes erwarten? Nur wirklich unabhängige Forschung, ohne Beteiligung der wirtschaftlich interessierten Parteien, macht wirklich einen Sinn. Während sich über die Auswirkungen der Sendemasten weiterhin nur spekulieren lässt, sind sich die meisten Forscher einig: Das Handy kann die elektrische Aktivität des Gehirns beeinflussen. Verschiedene Studien zeigten eine Veränderung der Hirnstromwellen, wenn die Versuchspersonen Mobilfunkstrahlung ausgesetzt waren.

Krebsrisiko untersuchen

Ungewiss ist nach wie vor auch, ob es einen Zusammenhang zwischen Handystrahlung und Krebs gibt. «Es scheint möglich, dass Mobilfunkstrahlung die Entstehung von Tumoren fördert», sagt Bernhard Aufdereggen. «Die Diskussion in Wissenschaftskreisen ist kontrovers.»

Seit Oktober 2000 läuft eine internationale Studie, die klären soll, ob die regelmäßige Nutzung des Handys das Risiko erhöht, an einem Hirntumor zu erkranken. Im Rahmen der von der WHO koordinierten Untersuchung werden in 13 Ländern Tumorpatienten befragt.

Die bisher veröffentlichten Ergebnisse dieser so genannten Interphone-Studie sind widersprüchlich und lassen gemäss Fachleuten noch keine eindeutigen Schlüsse zu. Das Programm endet 2005.

The 500 metres from habitation recommendation - this came from the Stewart Report and can be accessed on the internet. No withstanding the recommendation, 'Phone companies seem to be able to plonk masts wherever they like. The one in our village is 14 metres from front doors and has been causing the usual symptoms - chronic insomnia and headaches; sore bloodshot eyes; earache and tinnitus; nose bleeds. Also, ulcerated mouths and throats; rashes/eczema; exacerbation of existing symptoms - and of course exhaustion and depression!

Several dogs have developed growths on paws; loss of appetite; vomiting and restlessness; one dog a growth in its mouth and one cat a tumour in its throat. Noone will take any notice of the evidence from Russia and Schwarzenburg which prove the actual effects of electromagnetic radio frequency emissions.
