Jülich Report: Keep Mobile Phone Calls short

Keep mobile phone calls short, not in a car and not at a far distance from the base station.

This precautionary warning is given by Prof. Dr. Maria Blettner (Johannes Gutenberg University, Mainz), Prof. Dr. Karl-Heinz Jöckel (University Clinic, Essen) and Prof. Dr. Andreas Stang (Martin Luther University, Halle) in a report by the Jülich Institute in Jülich, Germany. Together with 22 other experts they studied the scientific literature between 2000 and 2004 about the effects of mobile telephone systems on well-being and health.

The warning by the German experts is more strict than by Sir William Stewart of the British National Radiation Protection Board (NRPB) in January 2005. He said children up to 8 years old should not use a mobile phone. The precautionary warning by Blettner, Jöckel enStang goes for everybody, young and old. It is based on the renewed uncertainty about the risk of cancer in the long term. The warning coincides with news from the University Hospital in Orebro, Sweden, that mobile users in rural areas (generally at a far distance from the base station) have four times more brain tumors after five years than mobile users in cities.

The radiation of a mobile telephone has effect on the central nervous system. It itensifies the neuronal activity and the radiation influences the cerebral blood stream and the EEG, so it has an impact on the brain. That is confirmed by Dr. Peter Achermann and psychologist Sabine Regel of Zürich University. It seems thatpulse-modulated radiation has the most severe effects. They write that radiation has also an effect on the cognitive performance. The reaction time is shorter or prolonged and the task performance is better or worse, depending on the parameters of the radiation. The same has been found by many investigations before, also by the TNO-Cofam research in 2003, ordered by the government of The Netherlands. The experts agree with the TNO-Cofam report, that the effects have to be non-thermal. They can not be triggered by thermal heating.

Mobile telephone systems also damage DNA, the genetic material. That is confirmed in the report by Dr. R. Gminski, Dr. K. Schlatterer, Dr. R.G. Fitzner and Prof. Dr. R. Tauber of the Berlin Charité-University in Berlin and by Dr. Myrtill Simkó of Rostock University.

The experts suppose that the radiation of mobile telephone systems probably has no consequences for young, healthy adults. They write that this opinion does not has a scientific base. The radiation, possibly combined with other factors, could have consequences for other groups. The experts did not find a link between the radiation and well-being, except for headaches and eventually problems with concentration and remembrance. Dr. Heike Seitz, Dr. Doris Stinner and Prof. Dr. Thomas Eikmann of Giessen University state that non-specific complaints are so common, that there is no proof of a causal relationship with the radiation of mobile systems. However, Dr. Martin Röösli of Bern University adds, that the absence of evidence is not evidence of absence.

The experts have studied relevant scientific research between 2000 and 2004 only. They did not pay attention to the many individual and independent stories by people suffering from radiofrequency radiation by puls-modulated wireless communications systems like GSM, UMTS, DECT, WLAN, WIFI, C2000 and TETRA. Their complaints however fit in perfectly well with effects on the central nervous system, intensified neuronal activity and influence on the brain. The damage of DNA fits in with the findings of epidemiologic research, pointing at a higher risk for cancer in the long run. The experts however write that the epidemiologic investigations speak against each other, so more research is needed.

The report of the Jülich Institute has been ordered and financed by T-Mobile, a provider of mobile communication. It has been presented to the public on May 9th, 2005. The whole report is written in German and consists of a general part and eight specific parts A to H. It can be found here

Scientific research concerning human well-being and health in the vicinity of phone masts

This is an overview of all epidemiologic and provocative research concerning human well-being and health in the vicinity of masts for GSM and UMTS (3G) mobile communication. The object of the research are living humans. This overview does not contain in vitro or in vivo (animals) laboratory research, because they do not give a consistent picture of what happens to people who are exposed permanently to pulsed radiofrequency radiation.

All the epidemiologic and provocative research with living humans find negative effects, from unacceptable sleep disturbances to serious illness and disablement. Therefore, the conclusion can only be: it is irresponsible to place phone masts in the vicinity of places where people live and work. Note that wireless communication systems like DECT, WLAN, WIFI and TETRA principally generate the same kind of pulsed radiofrequency radiation as GSM and UMTS (3G), so the approval of these systems for use in the vicinity of people is irresponsible as well. The second conclusion is, the current exposure limits are much too high. The values of the research are from 100 microWatt/m2 to a few thousand microWatt/m2 (0,2 V/m to 1 V/m). The limits advised by bodies like ICNIRP, NRPB and the Dutch Health Council are about 10.000.000 microWatt/m2. They protect only from the effects of overheating, not from the impact on well-being and health.

People living in the vicinity of base stations report various complaints mostly of the circulatory system, but also of sleep disturbances, irritability, depression, blurred vision, concentration difficulties, nausea, lack of appetite, headache and vertigo. The performed studies showed the relationship between the incidence of individual symptoms, the level of exposure, and the distance between a residential area and a base station. This association was observed in both groups of persons, those who linked their complaints with the presence of the base station and those who did not notice such a relation.

Comparisons of complaints frequencies in relation with distance from base station and sex, show significant (p<0.05) increase as compared to people living > 300 m or not exposed to base station, till 300 m for tiredness, 200 m for headache, sleep disturbance, discomfort, etc. 100 m for irritability, depression, loss of memory, dizziness, libido decrease, etc. Women significantly more often than men (p<0.05) complained of headache, nausea, loss of appetite, sleep disturbance, depression, discomfort and visual perturbations.

This study found significant ill-health effects in those living in the vicinity of two GSM mobile phone base stations. The strongest five associations found are depressive tendency, fatigue, sleeping disorder, difficulty in concentration and cardiovascular problems. Based on the data of this study the advice would be to strive for levels not higher than 0.02 V/m for the sum total, which is equal to a power density of 0.0001 µW/cm2 or 1 µW/m2, which is the indoor exposure value for GSM base stations proposed on empirical evidence by the Public Health Office of the Government of Salzburg in 2002.

In two groups (hypersensitive and non-hypersensitive subjects) exposure to UMTS had a negative influence on well-being in both groups. Cognitive function was consistently affected in both groups exposed to GSM and UMTS.

The radiation of a cell phone base station at a distance of 80 metres causes significant changes of the electrical currents in the brains of testees (measured by electroencefalogram, EEG). All the testees said they felt unwell during the radiation, some of them seriously.

A colleague of mine unfortunately needs to use a mobile as part of his job, but is worried about the health effects. Does anyone know whether bluetooth would be a better alternative than using a phone next to his ear, or are they just as bad?

I know of people who are as affected by Bluetooth as by phones. Bluetooth is shorter range, but why spend all day with a radio transmitter clamped to one ear?

Reason suggests that a mobile with hands free is far better than Bluetooth. Certainly Bluetooth is NOT in the clear.

My principled objection is that no employer has the right to require another person to place themselves at any kind of risk against their consent, in order to do their job in a particular way. But there is no health & safety guidance beyond ICNIRP for employers to follow, and nothing on chronic exposures to EMF of any kind.

Mit großer Freude hat Attac Deutschland den Ausgang des französischen Referendums über die EU-Verfassung aufgenommen. "Das französische Nein ist eine klare Botschaft: Die Menschen wollen ein sozialeres Europa und ein Ende der neoliberalen Politik", sagte Heike Hänsel, Sprecherin der bundesweiten Attac EU-AG. "Wir gratulieren unseren französichen Freunden und dem progressiven NON-Bündnis!" Jetzt müsse es zu einer Neuausrichtung des europäischen Integrationsprozesses unter breiter Bürgerbeteiligung kommen. In der EU sei bereits zu lange über die Köpfe der betroffenen Menschen hinweg entschieden worden. "Jetzt ist es Zeit für mehr Demokratie."

"Wir fordern, soziale Rechte rechtsverbindlich zu verankern, dem Europäischen Parlament ein Initiativrecht einzuräumen und die Militarisierung zu stoppen", sagte Stephan Lindner, EU-Experte im bundesweiten Koordinierungskreis. Attac bekräftigt die Ablehnung der EU-Verfassung und fordert die Einstellung des Ratifizierungsprozesses. The letters to the Bath newspaper about Mr Dolan were a good thing to do - maybe it would help if we did something similar with the Planning Inspectorate?

With the Inspectorate overturning so many mast applications refused at local level? With the complaints route against Inspectorate decisions being so expensive and user-unfriendly, people power seems to have become the only way left for ordinary folk to fight back and win.

Why, oh why, won't the Inspectorate listen to the general public and the local Councils who are honestly and lawfully representing local communities concerns and wishes?

Why is the Inspectorate awarding punishing high costs against some Councils for properly carrying out their lawful duties to their local communities and yet not punishing others?

I think it may be time for all those suffering from a poor Inspectorate decision to take direct action and write in huge numbers to the Chief Executive at the Planning Inspectorate to complain about poor decisions and the difficult complaints system - where masts are concerned, there must be literally hundreds of thousands of dissatisfied people. At a time when banks and other large service industries are regularly asking customers for feedback on the quality of service, it seems wrong there is no easy way for the public to show dissatisfaction of the Inspectorate's performance and service.

If the Planning Inspectorate was a private firm accountable to the general public - there would have to be a faster, easier user-friendly direct complaints system, a system that gave the opportunity to review both the evidence provided and have the power to reverse a poor decision.

I think it is wrong that the Inspectorate restrict what you can complain to them about, i.e. the Inspector's opinion. I do not see how this can be in any way moral or democratic when it is the Inspector's singular personal opinion that matters most when he/she overturns a democratically made local council/community decision!

Thank you for this (and to Sylvia and Sandi for your subsequent comments). The trouble is that the Planning Inspectorate has no remit outside planning law and government policy with respect to telecommunications installations. Common law and democracy simply do not enter the equation.

I know that several people have written to the Quality Assurance Unit at the Inspectorate expressing their concerns about the Sidlesham Inquiry, and more of that in a moment, but such action won't have any impact. The Inspectorate is an advertised instrument of government; it emphasises its impartial status and that it is apolitical but there is little doubt that it follows the agenda of the government of the day. Whatever the position hitherto, this is patently evident in the context of the general 'politicisation' of the Civil Service since New Labour came to power in 1997.

At the Sidlesham Inquiry, we introduced rock-solid evidence from Grahame Blackwell and Ian Sharp on the differences between Tetra and mobile phone technology and covered both biological effects and electrosensitivity in considerable detail. The evidence of Collins, the Airwave technical witness, was shallow, glib and pitiful - and was systematically taken apart during some 3 hours of cross-examination by our extremely well-briefed barrister. The man ended up a gibbering wreck. We introduced three local residents to express their fears about Tetra 'on their doorsteps' and submitted documentary evidence of the very poignant concerns of local people already suffering disabilities. One family are tenants of the landowner and live 50 metres from the proposed site - they are concerned about their epileptic son and, notwithstanding their precarious circumstances, decided to speak out against the proposal. The result was a suggestion by the landowner that they look for alternative accommodation during the New Year - in a note appended to a Christmas Card. So how did the Inspector, Paul Griffiths, deal with all this?

Firstly, he itemised Grahame and Ian's evidence within three short paragraphs - and then summarised by saying that, "Material was adduced by the appellant's technical witness suggesting the opposite....on the balance of evidence before me, I consider that mobile phone technology in its widest sense or Tetra signal characteristics in particular, have no direct, harmful effects". This is an absolute travesty considering the evidence presented. He goes on to say, "I also heard evidence from Mrs ....whose son is epileptic..and there is concern that the installation could trigger seizures. Under cross-examination, the appellant's technical witness accepted the presence of anecdotal evidence that radiation can have this effect ....However, this can only be speculative.... In any event, Mrs... has been given notice to quit....so the situation she is concerned about will not arise".

Our barrister did a very good job for us. But he is a professional lawyer who, with the dice loaded against us, had no illusions about the prospect of success. That said, a synopsis of his comments on Griffiths' Decision Letter is as follows: "The outcome was, unfortunately, perhaps to be expected, but the letter is a pretty poor consideration of the issues. We came close to winning. However, the decision is carefully crafted to reduce the weight to be applied.....issues of weight are difficult to challenge in decision-making, which is one reason why I think the decision letter has been written with legal or other advice. There are significant flaws/omissions in the decision letter, in particular .... (several examples). I would advise that you have good grounds to challenge. The issue is whether you have the stomach/funds for a further round of the battle (noting that even if the decision is quashed, the appeal will have to be decided again)".

Everything is stacked against local democracy in these matters and the Inspectorate has absolutely no cohesive structure for conducting appeals - as you have said. It amounts to the luck of the draw.

Last year's judgement by the European Court of Human Rights on the legality of courts martial in the Royal Navy was quite specific. Given its conclusions and findings, there is absolutely no way in which that same Court would consider the Planning Inspectorate to be a lawful body. But we have to get the issue to the European Court - and that means first exhausting the domestic process.

Sorry to ramble on. I applaud the suggestion of inundating the chief executive with letters of complaint about his organisation - but bear in mind that such people are civil servants beholden to the government of the day. Don't expect too much!

I have been doing so for the past 6 months. I have been corresponding with Prescott's office. The Deputy Planning minister Yvette Cooper has been responding with the usual standard responses i.e. Stewart and ICNIRP/NRPB prove every thing is ok. I have of course been quoting what these reports actually say and she has now given up and got the Dept of Health to respond to me with the usual "no evidence of ill health" argument. I have sent them the ill health evidence.

In my letters to the Deputy Planning Minister I originally said that there would be 100,000 masts sited throughout Britain. There was an extremely patronising response to this with the usual 50,000 number quoted. Now of course since then Orange alone estimated they will need 50,000 masts throughout Britain for 3G (April's Radiation Research newsletter) s o if they need 50,000 for 3G then a total of 200,000/250,000 would n ot seem unreasonable. I wrote back to Cooper in a similar patronising fashion and asked her if she would care to revise the Government estimate following Orange's recent announcement. I received a response dated 25 May 2005 from somebody called Iain Clark, Policy Adviser, Planning Development Control Policy (Office of Deputy PM) saying that "Neither this Department nor Orange is aware of any announcement which contradicts these figures". I understand Yvette Cooper is no longer the Deputy Planning Minister but if anybody would like to take up the mast numbers issue with Iain Clark, his email address is iain.clark@odpm.gov.uk . Seems like they want to keep a lid on the mast numbers issue. I am continuing my letter campaign and always cc my MP.

Ein Ziel des IZMF ist es, den Widerstand in der Bevölkerung und in der Ärzteschaft gegen den Mobilfunk, insbesondere gegen die allgegenwärtige künstliche Bestrahlung der Mobilfunk-Basisstationen, auszuschalten.

Beim Mobilfunk geht es um handfeste wirtschaftlichen Interessen der Netzbetreiber (lt. IZMF 2004 ca. 22 Milliarden € Einnahmen). Die Einnahmen der Netzbetreiber steigen auch nicht mehr so steil wie früher prognostiziert. Dazu kommt, daß trotz aller Anstrengungen, eine Vielzahl von Studien nicht mehr unter den Teppich gekehrt werden kann, die immer deutlicher eine Gesundheitsbeeinträchtigung, wenn nicht sogar eine Gesundheitsschädigung, durch Mikrowellenstrahlen - zu denen die Mobilfunkstrahlen gehören - aufzeigen. Es würde u.U. zu einer wirtschaftlichen Katastrophe der Mobilfunk-Netzbetreiber führen, wenn Ärzte ihre Patienten vor möglichen Gefahren durch Mobilfunk warnen.

In dieser für die Mobilfunk-Betreiber prekären Situation scheint jetzt der IZMF-Verein die Flucht nach vorne anzutreten und im Rahmen der Fortbildung der Landesärztekammern bei Ärzten für die angebliche „Ungefährlichkeit“ des Mobilfunks zu werben. Dazu werden mobilfunkgeneigte Referenten das Thema „Gefahren durch Mobilfunk“ weiterhin bagatellisieren.

Im süddeutschen Raum gibt es massive Kritik und Proteste gegen den ungezügelten Ausbau der Mobilfunknetze. Anscheinend deshalb beginnt der IZMF-Verein seine Werbeveranstaltungen in der scheinbar unkritischen Nordschiene (Potsdam, Hannover, Oldenburg, Braunschweig, Lüneburg, Frankfurt).

Worum geht es ?

Die Wirtschaft will Umsätze und Profit machen. Dies ist prinzipiell in Ordnung, wenn diese Profite nicht zu Lasten der Gesundheit der Bevölkerung gehen. Manche Firmen aber machen ihre Profite, ohne dabei auf die Gesundheit der Bevölkerung Rücksicht zu nehmen (wir erinnern uns an: Contergan, Holzschutzmittel, Asbest, Libobay usw.). Obwohl diese Firmen frühzeitig von den Auswirkungen/Todesfällen wußten, haben sie diese Schäden wider besseren Wissens abgestritten und die schädlichen Produkte weiter verkauft.

Die Regierung will eine florierende Wirtschaft und Arbeitsplätze. Die Gesundheit der Bevölkerung scheint der Regierung zweitrangig. Entsprechend handeln manche Behörden. Wir erinnern uns an das Bundesgesundheitsamt, das sich nicht nur teuere Geräte von der Pharma-Industrie schenken ließ, sondern dessen Präsident und leitende Beamte gegen Privathonorar Gutachten verfaßten, um dann diese „Gutachten“ dem Bundesgesundheitsamt zur Arzneimittelgenehmigung wieder vorzulegen. Dieser Fall war so kraß, daß das Bundesgesundheitsamt aufgelöst und ein strengeres Genehmigungsverfahren für die Zulassung von Arzneimittel eingeführt wurde.

Während jetzt für die Zulassung von Arzneimittel wenigstens entsprechende Studien vorgelegt werden müssen, gibt es beim Mobilfunk, dessen Basisstationen eine unfreiwillige Dauerbestrahlung von 24-Stunden an 365 Tagen im Jahr auch an der nicht handybenutzenden Bevölkerung verursacht, weder eine Zulassung noch wurden vor Mobilfunk-Einführung Unbedenklichkeitsstudien verlangt.

Grenzwerte:

Der Blauäugige glaubt, Grenzwerte seien zum Schutz der Gesundheit der Bevölkerung gemacht. Der Realist glaubt, Grenzwerte sind hauptsächlich zur Haftungsfreistellung der Industrie erlassen. Dies ist für die Netzbetreiber umso wichtiger, als die Versicherungswirtschaft im Rahmen der Betriebshaftpflicht der Netzbetreiber zwar für Schäden durch umstürzende Sendemasten, nicht aber für Schäden durch elektromagnetische Strahlen aufkommt (die Netzbetreiber mögen Ihnen doch eine Bestätigung ihres Versicherers und des Rückversicherers vorlegen, dass diese für Schäden aus elektromagnetischen Strahlen in unbegrenzter Höhe und ohne zeitliches Limit haften).

Art der Grenzwerte nach der 26. Bundesimmissionsschutzverordnung (26. BImSchV):

Mobilfunkstrahlen sind Mikrowellenstrahlen. Mikrowellen haben zumindest zwei Arten von Wirkungen. Zum einen dienen sie der Energieübertragung (u.a. Mikrowellenherd/Wärme = thermisch) zum anderen der Informationsübertragung (u.a. Handy/Radar = athermisch/biologisch).

Der Grenzwert der 26. BImSchV ist ein reiner thermischer Wert, also wie weit muß jemand mindestens von der Basisstation (= Mikrowellensender) weg sein, um nicht gegrillt und gegart zu werden. Nur dieser Abstand ist auf Grund eines Computerberechnungsprogramms in der Standortbescheinigung der RegTP (Regulierungsbehörde für Telekommunikation und Post) an den Netzbetreiber angegeben, die der Netzbetreiber nach der Errichtung der Basisstation und 14 Tage vor Anschaltung dem örtlichen Umweltamt vorlegen muß. Sonst nichts.

Für die Informationsübertragung (biologische bzw.athermische Wirkungen) gibt es in der 26. BImSchV weder einen Grenzwert noch gibt es eine Vorsorge, obwohl dies immer wieder wider besseren Wissens behauptet wird.

Schon Schliephake hat 1932 (also vor 73 Jahren) beschrieben, dass es Kurzwellen unterhalb der thermischen Schwelle, Gesundheitsbeeinträchtigungen auftreten wie:
- starke Mattigkeit am Tag,
- dafür in der Nacht unruhiger Schlaf,
- zunächst ein eigenartig ziehendes Gefühl in der Stirn und Kopfhaut,
- dann Kopfschmerzen, die sich immer mehr steigern, bis zur Unerträglichkeit.
- Dazu Neigung zu depressiver Stimmung und Aufgeregtheit.

Diese unspezifischen Beeinträchtigungen werden heute zu den biologischen bzw. athermischen Wirkungen gerechnet. Für diese Art der biologischen Wirkungen gibt es keinen Grenzwert.

Wieso gibt es biologische Wirkungen durch Mikrowellenstrahlen (auch beim Mobilfunk)?

Ohne eine Wertung vorzunehmen, hier sinngemäß die Meinung von Robert O. Becker:
Die Chemie des Lebens beruht auf den grundlegenden Kräften der Elektrizität und des Magnetismus. Unser Körper und unser Gehirn erzeugen in und um uns elektromagnetische Felder ( ). Die Steuerung läuft bei Stromstärken im Bereich von Milliardstel Ampere (x).

Andere Forscher wie Heinrich, Rostock, weisen darauf hin, dass durch Enzyme in unserem Körper „ganz besonders wichtige Reaktionen wie z.B. der Auf- und Abbau für schnellste zelluläre Reaktionen erforderlicher Informationsträger (Messenger/Radikalische Zwischenstufen ect.) müssen ultraschnell ablaufen. Die Frequenzen solcher Enzym-Reaktionen liegen im Bereich von 10 hoch minus7 bis 10 hoch minus11 pro Sekunde (das entspricht Substrat-Spaltungs-Frequenzen von 10 MHz bis 100 GHz).

Gerade bei diesen ultraschnell erforderlichen Umsetzungen sind nun durch äußere Einflüsse von hochfrequenten Wechselfelder (auch als Träger-Frequenzen im Mobilfunk angewendet) ... unterschiedliche Störeinflüsse durch Resonanz (partielle Schritt-Löschungen, Aktivitäts-Umschaltungen und sogenannte wring-Resonanzen mit Kettenschädigungen bei DNA und Proteinen) nachgewiesen bzw. möglich.“

Damit ist nachvollziehbar, dass die Vielzahl der heute erzeugten künstlichen elektromagnetischen Felder (negative) Auswirkungen auf unsere vitalen Lebensfunktionen haben müsste.

Wenn Störsignale von außen (z.B. durch Mobilfunk) ständig die Funktionen in unserem Körper beeinträchtigen können, kann Streß entstehen, der sich zuerst in Unwohlsein, dann in Gesundheitsbeeinträchtigungen und schließlich in Gesundheitsschäden äußern kann.

Mit diesen Erscheinungen sind die Ärzte in ihrer täglichen Praxis konfrontiert. Ihren Patienten können sie nur helfen, wenn sie die Ursachen kennen. Dafür sind belastbare Informationen und keine Verschleierungen nötig. Die Netzbetreiber bzw. ihre Organisationen sind daran wohl nicht interessiert.

Im Medizinbereich kommt Sporsoring häufig vor, weshalb dies für viele Ärzte nicht ungewöhnlich ist.. Der Sponsor hat knallharte wirtschaftliche Interessen und nicht unbedingt die Gesundheit der Patienten im Auge. An einem gesunden Patienten verdient der Sponsor nichts. Bezogen auf die obigen Veranstaltungen des Informationszentrums Mobilfunk e.V., eine Warnung von Ärzten vor den möglichen Folgen des Mobilfunks (Basisstationen und Handy) würden die Geschäfte der Netzbetreiber schmälern. Deshalb sollte jeder Teilnehmer an derartigen Veranstaltungen bzw. Leser von Broschüren, an denen das Informationszentrum Mobilfunk e.V. mitgearbeitet hat, prüfen, ob dort Desinformationen enthalten sind.

Die Argumentationsweise der Netzbetreiber und ihrer Unterstützer, lautet u.a.:

„Gesundheitsschäden sind wissenschaftlich nicht nachgewiesen.“

Die Manipulation liegt in der von der Deutschen Strahlenschutzkommission (SSK) vorgelegten Definition von „wissenschaftlich nachgewiesen“. Diese Definition ist erst dann erfüllt, wenn die gleichen Ergebnisse von mehreren unabhängigen Instituten reproduziert sind und eine kausale Erklärung geliefert wurde. Reproduziert sind z.B. DNA-Strangbrüche durch Mobilfunkbestrahlung (siehe Reflex-Studie, AG Tauber Berlin, AG Rüdiger, Wien) nur man behauptet, es gäbe keinen kausalen Zusammenhang, weil die Arbeiten noch nicht in einer wissenschaftlichen Publikation erschienen seien und kleine Unterschiede in der Dokumentation vorhanden seien.

DNA-Strangbrüche durch Mobilfunkstrahlung sind auch in vielen anderen Studien nachgewiesen, die man aber nicht zur Kenntnis nehmen will; u.a. verweist man auf körpereigene Reparaturmechanismen. Dies ist unzulässig, denn bei geschwächtem Immunsystem oder bei einer großen Anzahl von DNA-Strangbrüchen ist das Reparatursytem überfordert. Aber unbestritten ist, daß jeder DNA-Strangbruch gefährlich werden kann.

„Ist es fraglich, ob man Ergebnisse „in vitro“ bzw. bei Tieren überhaupt auf den Menschen übertragen könnte.“

Gewagt ist der Hinweis, wenn Hühnerembryonen geschädigt werden, dann sei damit noch lange nicht bewiesen, dass auch der menschliche Fötus geschädigt werde, schließlich sei der Mensch kein Huhn.

Die Frage sei erlaubt, warum unternimmt man Tierexperimente, wenn man sie bei ungünstigem Ausgang prinzipiell auf den Menschen für nicht übertragbar hält?

„Nicht-ionisierende Strahlen sind viel zu schwach um Schäden an bzw. in den Zellen anzurichten“

Dieser Glaubenssatz wird als Standardlehre zwar ständig wiederholt, er wurde aber vor seiner Aufstellung nicht experimentel überprüft.

Die Mobilfunkbetreiber haben bisher zwar Millionen ausgegeben, aber in Labors meist für nebensächliche Fragen, z.B. wie können wir die Gesundheitsbeeinträchtigungen als Hirngespinste diffamieren, in der Behördensprache „die Risikoakzeptanz der Bevölkerung verbessern“, nicht aber: „Wie können wir das Risiko minimieren“.

Die Erhöhung des Erkrankungsrisikos nach 5 Jahren Dauerbestrahlung in Naila, stimmt auch mit den langjährigen arbeitsmedizinischen Untersuchungen in Rußland überein. Dort hat man ermittelt, dass die Erkrankungen nach 3 bis 5 Jahren Exposition am Arbeitsplatz signifikant beginnen (siehe Hecht). Die Mobilfunk-Basisstationen strahlen aber 24 Stunden am Tag und 365 Tage im Jahr, auch wenn keine Handy-Gespräche geführt werden.

Bezeichnenderweise hat sich noch kein Vorstand eines Netzbetreibers oder ein Mitglied der Deutschen Strahlenschutzkommission dazu bereit erklärt, sich unter ärztlicher Begleitung zwei Wochen einer Strahlenbelastung in Höhe des Grenzwertes der 26. BImSchV auszusetzen, obwohl man diesen Wert als Dauerbelastung über Jahre hinweg für Säuglinge und Kranke als unbedenklich erklärt hat. Man kann diesem Personenkreis nur zurufen

Wenn Ihr den Grenzwert für unbedenklich haltet, dann seid konsequent und setzt Euch ihm nur zwei Wochen aus.

Und zu Mühlendahl und Otto können wir nur eins sagen: Haben diese Herren ihren Hypokratischen Eid vergessen? Gerade in Bezug auf Kinder kommen uns ihre Aktivitäten sehr suspekt vor. Ob sie sich damit einen Gefallen tun? Oder ist ihre Akademie mittlerweile in solchen finanziellen Nöten, dass sie sich auf dieses Abenteuer einlassen müssen? Gerade sie müßten es doch sein, die kritisch mit dem Thema umgehen sollten, aber wie heißt es doch im Volksmund so schön, "Geld regiert die Welt" und verdirbt bei so manchen auch den Charakter.

FALLUJAH: AN UNNATURAL DISASTER

Today, I did what few internationals have dared to do, I went to Fallujah.

Fallujah is completely surrounded by US Forces, the only way in or out is through one of four very restrictive checkpoints. People normally have to wait hours, but since we had our magic US passports, we made it through in about 45 minutes. We did not observe them searching any cars, soldiers just held-up traffic and slowly checked IDs. Like Palestine, these checkpoints seem to have little to do with security and more to do with harassment and intimidation.

Fallujah is devastating to drive through. There is more destruction and rubble than I’ve ever seen in my life; even more than in Rafah, Gaza. The US has leveled entire neighborhoods, and about every third building is destroyed or damaged from US artillery. Rubble and bullet holes are everywhere, the city is indescribably ravaged. It looks like it’s been hit by a series of tornados; it’s hard to believe that humans could actually do this. I have a new understanding of the destructive potential of modern warfare. US troops, Iraqi military, and Iraqi police have an overwhelming presence in the city. I’ve never seen such dirty looks directed at the passing forces; I guess in most places people get used to the occupier, but in Fallujah, the hate is still very alive. 16,000 Fallujan police lost their jobs after the US attacks and were replaced by Shiite from the South. The US intentionally sends Shiite to patrol Sunni strongholds to breed resentment and abuse, and it works. Soldiers shoot anyone who drives too close to their convoys, which makes driving anywhere in this small city incredibly dangerous. It is very easy to accidentally turn a corner and find yourself in the midst of a convoy. The hospital said that around 1-2 people a week die from the indiscriminate fire of US and Shiite occupation forces.

There are horror stories everywhere. We visited a family’s home in a neighborhood where every structure is damaged or destroyed. Their home was full of holes and completely black inside from fire. They said that they’d left during the fighting with their home in tact, and returned to find all of their possessions had burned. Three families are now living in this 3-room house because their homes were completely destroyed. Over 25 people live in this burn-out shell of a home, including four infants. Some of them tried to get compensation from the US military but were denied.

There is the hopeful site of rebuilding. Around 25% of families who suffered damaged property have gotten a little bit of compensation from the US military, however it usually covers less than half of the cost for building materials for a new home. Particularly because the compensation rates are based on the price of building materials before the attacks, and now supplies cost nearly double because of the restrictive checkpoints.

Food prices have also dramatically increased because of the checkpoints. We talked with one shop-keeper who said that farmers from around Fallujah can no longer deliver their produce unless they have a US-issued Fallujah ID. The shopkeepers now have to go out and pick up the produce each day. He said it takes him around four hours because of the checkpoint delays. “They mistreat us,” he said, “they point guns at us and insult us, even the women”. He said that both US and Iraqi troops search through the vegetables roughly, even dumping them on the ground and sometimes smashing them. As soon as he’s finished with one checkpoint and cleaned up the mess, another will ransack his load all over again. This can happen as many as four times he said. Sometimes, much of the produce rots from sitting in the hot sun. For all these reasons, the prices have gone up and more Fallujans are going hungry.

Fallujah has only one hospital with inpatient care. Other clinics and treatment centers were bombed by US troops, and soldiers prevented many people from getting to the hospital during the attacks. Even after the fighting, the US kept the bridges closed which caused several people to die of heart attacks when they couldn’t get to the hospital fast enough. People from the rural areas surrounding Fallujah are also now dying of treatable illnesses because they can’t get through the checkpoints to the Fallujah hospital. One hospital employee said that many patients die when they try to transfer them to hospitals outside Fallujah. “It’s better to take them in a civilian car than in an ambulance” he said, “because the troops delay and search ambulances more.” During the first attack, the hospital became a main source of information for the outside world. So when the US attacked the second time, they took over the hospital area first and controlled what information got out.

Meeting a Sunni cleric was the highlight of the trip. He was a young, passionate man and a quite eloquent speaker. He told us about some horror stories he’d witnessed. During the first invasion, several families near his Mosque took cover in a home. US troops used megaphones to order all them out into the street and told them to carry a white flag. They did this, but when they all got out, the soldiers opened fire into the group, killing five. He said one boy had run to his mother who’d been shot, and Americans shot him in the head. He said he saw a US commander cry as this happened, “but what good were his tears?” he asked, “he didn’t do anything to stop it.”

While meeting with the cleric, a man told us some of his horror stories. “The Americans shot and killed my 15-year-old daughter” he said, “was she a terrorist?” He said the US military denied killing her and refused to give him even minimal compensation. The US gave him only half the compensation for his house that they destroyed. “With all respect to you,” he said, “I hate Americans, they killed my family. My children cannot play in the street, they shot and killed my sister-in-law while she was washing clothes, and my other brother’s hands and feet were blown off.” He apologized for interrupting, but said that he had to tell us because he’s in so much pain.

I felt incredibly safe in Fallujah; the people I spoke with were kind and gentle. They are rightfully angry and indignant at what the US has done to them, but they seemed to understand that it wasn’t me or all American’s that did it. The cleric said, “We are grateful that you come here and share in our suffering and agony, it shows that there are good and human Americans.”

Fallujah is the face of US occupation. It shows how ruthless the US will be toward anyone who dares resist its agenda. But Fallujah has not stopped resisting. It is said that “you can’t bomb a resistance out of existence, but you can bomb one into it.” The unnatural disaster the US has unleashed on the Middle East is horrifying, and we all must resist it.

Absolute strafrechtliche Immunität für Finanzbeamte seit Jahren in Deutschland bittere Realität

Seit inzwischen 9 Jahren, sie lesen richtig, genießt der Unterzeichner und dessen Ehefrau eine gezielt andauernde "Sonderbehandlung" der nds. Finanzverwaltung. Und es dreht sich einzig und allein um das vom Bundesamt für Seeschifffahrt und Hydrographie klassifizierte "Arbeits- und Forschungsschiff" des Unterzeichners http://www.naturetv.de/cvp_natur/cvp_natur.html , das dieser als zwingend notwendiges Betriebsmittel braucht.

Von "Willkür", "Befangenheit" und anderem "rechtswidrigen Verhalten" will bis hin zum Ministerpräsidenten des Landes Niedersachsen niemand Verantwortliches etwas wissen, geschweige denn bis heute bemerkt haben.

Ziel dieser gezielten "Sonderbehandlung" ist eben nicht eine im Sinne der Abgabenordnung durchzuführende objektive Besteuerung, sowie wie es der § 85 AO vorschreibt, sondern ein willkürliches Steuerneintreiben, schlimmer als im Mittelalter und vergleichbar mit diversen Systemen, die auch deutsche Politiker gerne populistisch als Bananenrepubliken titulieren.

Der Steuerstaat Deutschland leistet sich inzwischen eine Armee von nicht weniger als 124.000 Finanzbeamte (Quelle: manager-magazin), die Süddeutsche Zeitung schreibt von rund 254.000, die sich selbst in den letzten 60 Jahren ein Vorschriftendickicht von inzwischen über 100.000 Verwaltungsvorschriften geschaffen haben, durch die sie selbst schon längst nicht mehr durchblicken, aber der Steuerbürger natürlich ebensowenig, soll er aber auch gar nicht, es reicht wenn er damit behandelt werden kann.

Seit dem 01.04.2005 reicht ein Anlass aus, bitteschön was ist ein Anlass, um bundesweit auf Kontenrecherche zu gehen und das nicht nur im konkreten Einzelfallanlass, sondern auch, man braucht nur in der Abgabenordnung nachlesen, für die eventuelle Zukunft...

Auch wenn am 01.04. in Kraft getreten, so handelt es sich mitnichten um einen Aprilscherz, sondern um bitteren Ernst, denn es kann jeden treffen, selbst dann wenn es gar keinen objektiven Anlass gibt.

Im Zusammenhang mit der gezielten "Sonderbehandlung" des Unterzeichners sind gegen einzelne besonders aktiv tätige Finanzbeamte Strafanzeigen erstattet worden, z.B. wegen keiner geringeren Straftat wie Rechtsbeugung (§ 339 StGB), Verleitung von Untergebenen zu Straftaten (§ 357 StGB), Falschbeurkundung im Amt (§ 348 StGB) sowie Üble Nachrede und Verleumdung (§§ 186, 187 StGB).

Diese Anzeigen wurden und werden allesamt sowohl von der jeweils zuständigen StA als auch der Generalstaatsanwaltschaft in Celle mit der Begründung, sie seinen unbegründet, eingestellt bzw. es lägen nicht einmal Anhaltspunkte für das Vorliegen von Straftaten vor.

Das klingt nach einer Selbst - Immunisierung ohne irgendeine bundesdeutsche gesetzliche Rechtsgrundlage von operativ tätigen Finanzbeamten, denen jedoch ein solcher Status in der Bundesrepublik Deutschland überhaupt nicht zusteht. Finanzbeamte stehen damit deutschen Abgeordneten sowie ausländischen Diplomaten mehr als gleich, nur mit dem krassen Unterschied, das deren Immunität aufgehoben werden kann bzw. ausländische Diplomaten des Landes verwiesen werden können, da dieses gesetzlich ausdrücklich so geregelt ist.

Zitat von der Website des Deutschen Bundestages :

Immunität: Abgeordnete dürfen nach Art. 46 Abs. 2 für Straftaten nur zur Verantwortung gezogen werden, wenn der Bundestag es genehmigt. Die Genehmigung wird bei kriminellen Delikten regelmäßig erteilt. Die Immunität besteht nur, solange die Abgeordneten ihr Mandat ausüben.

Finanzbeamte bleiben quasi strafrechtlich unbehelligt, genießen gesetzwidrig einen eigenen rechtsfreien Raum und sind immun gegen jede strafrechtliche Verfolgung und können somit Tun und Lassen was sie beim Steuernbeitreiben "pro Fisko" wollen/sollen !!!

Weder das Grundgesetz, das im Übrigen in der Fiskalverwaltung der Bundesrepublik Deutschland gerne ausgeblendet wird, noch andere Gesetze und Verordnungen lassen an irgendeiner Stelle erkennen, dass dann, wenn Finanzbeamte sich besonders "pro fiskalisch" hervortun, sie auch dieses unter objektiver Erfüllung von ausgesprochen schweren Straftatbeständen mir nichts dir nichts tun dürfen, da ihnen strafrechtlich nicht beizukommen sein soll.

Gerade unter dem Aspekt des jüngsten Interwievs des renomierten Verfassungsrechtlers und Bundesverfassungsrichters a.D. Prof. Dr. Paul Kirchhof in der Zeitschrift Euro/05, müssen einen jeden rechtstaatlich denkenden und handelnden Bundesbürger/ Bundesbürgerin aufhorchen lassen, denn aus einem Rechtstaat wird, wenn nicht frühzeitig aufgepasst und mit den entsprechenden Mitteln gegengesteuert wird, plötzlich und unerwartet ein Unrechtsstaat.

Prof. Dr. Paul Kirchhof hat dieses staatliche Unrecht bereits im deutschen Steuerrecht und dessen in weiten Teilen rechtswidriger Anwendung offenbar erkannt und es öffentlich ausgesprochen, wie auch auf dem FDP-Parteitag in Köln am 06.05.2005 geschehen.

Die Staatsanwaltschaften in Niedersachsen können, wollen oder aber dürfen dieses aufgrund ihrer vielleicht politischen Weisungsgebundenheit nicht erkennen und schützen somit gewollt oder ungewollt die Täter in den Finanzämtern?

Die Justiz bezieht sich hier auf ein unveröffentlichtes "Alturteil" des OLG Celle aus dem Jahr 1986 i.V.m. mit einem noch älteren Urteil des BGH aus dem Jahre 1972, das ausdrücklich Finanzbeamte vom Vorwurf der Rechtsbeugung, immerhin ein Verbrechenstatbestand mit Haftandrohung von nicht unter einem Jahr, gegen den Wortlaut des Straftatbestandes des § 339 StGB, früher § 336 StGB, freispricht, in dem jedoch das OLG Celle die aberwitzige These aufstellte, dass ausgerechnet dieser Straftatbestand die Finanzbeamten an ihrer originären Aufgabe, nämlich Steuern beizutreiben, behindern würde. Es wird seither rechtswidrig in Abrede gestellt, dass Finanzbeamte hier "andere Amtsträger" seien, die zur Leitung oder Entscheidung einer Rechtssache berufen sind.

Anderslautende Rechtsprechung wie z.B. die des OLG Hamm in NRW aus dem Jahre 1999, die unter dem Aktenzeichen 2 Ws 20/99 OLG Hamm zu finden ist, lässt die Generalstaatsanwaltschaft in Celle einfach nicht zu, so wie sie auch den tatsächlichen Wortlaut des Straftatbestandes des § 339 StGB schlicht ignoriert und "andere Amtsträger" zu denen eben auch ohne Zweifel die Finanzbeamten zählen (siehe § 7 AO) gar nicht als Täter erkennen will. http://www.steuernetz.de/gesetze/ao04/p7.html

Doch was sind denn dann Steuerbescheide, Einspruchsbescheide, Änderungsbescheide, Pfändungs- und Einziehungsverfügungen ?

Und wie ist unter diesen an den Haaren herbeigezogenen Rechtskonstruktionen der folgende Leitsatz des OLG Koblenz mit der Geschäfts-Nr.: 1 U 1588/01 vom 17.07.2002 in Richtung aller Finanzämter zu verstehen:

"Ein besonders strenger Sorgfaltsmaßstab gilt für Behörden, die wie die Finanzämter durch den Erlass von Bescheiden selbst vollstreckbare Titel schaffen. Eine objektiv unrichtige Gesetzesauslegung oder Rechtsanwendung ist schuldhaft, wenn sie gegen den klaren und eindeutigen Wortlaut der Norm verstößt oder wenn aufgetretene Zweifelsfragen durch die höchstrichterliche Rechtsprechung, sei es auch nur in einer einzigen Entscheidung, geklärt sind" Zitatende.

Nur Amtsträger, die zur Leitung oder Entscheidung einer Rechtssache berufen sind, können und dürfen durch den Erlass von Bescheiden "selbst vollstreckbare Titel" schaffen und diese auch mittels Zwang, man schaut dazu bloß in die Abgabenordnung hinein, durchsetzen. Wer im Sinne der Abgabenordnung Amtsträger ist, steht im § 7 AO unmissverständlich geschrieben.

Die Finanzgerichte sind denn allem Anschein auch nur Alibigerichte, die aufgrund ihrer Besetzung aus den eigenen Reihen, nämlich der Finanzverwaltung (aus den Finanzämtern) in den meisten Fällen verzögern, verschleppen und schließlich mit haarsträubenden Begründungen das in den Finanzämtern laut Kirchhof inzwischen nahezu flächendenkende "Unrecht" am Steuerbürger im Namen des (unwissenden) deutschen Steuerbürgers mittels oftmals abenteuerlichen Rechtsfiguren zu vollziehbarem Recht erklären.

Wenn denn dann der eine oder andere den Weg bis zum Bundesfinanzhof gefunden hat und dort aufgrund einer noch gewissen Unabhängigkeit der dortigen Richter "Eichel's Schergen" zurück in ihre Schranken gewiesen werden, dann dauert es in der Regel nicht sehr lange, bis eine solche BFH-Entscheidung sang und klanglos mit Hilfe eines vom Bundesfinanzministeriums ausgesprochenen Nichtanwendungserlasses wieder von der juristischen Bildfläche verschwunden ist und für den Steuerpflichtigen beginnt der ganze Spuk von neuem.

Wehret den Anfängen, gerade weil Deutschland eine so unrühmliche Vergangenheit hat, deren Ereignisse erst 60 Jahre zurückliegen..., da waren es auch und in erster Linie "funktionierende Schreibtischtäter", die einem Unrechtsregime die Treue gehalten haben...

Die Abgeordnete Ursula Peters (FDP) hat denn auch als einzige Person die unmittelbare Inaugenscheinnahme des "Arbeits- und Forschungsschiffes" im Basishafen in den Niederlanden im Nationalpark Lauwersmeer am 02.05.2005 persönlich durchgeführt und nur Anhaltspunkte für eine "ausschließliche betrieblich bedingte Nutzung" erkennen können.

Begleitet wurde sie von ihrem wissenschaftlichen Mitarbeiter, der Dozent an der Seefahrtschule in Leer/Ostfr. ist.

Beide haben sich im Beisein des Reporters Olaf Jahn der Presseagentur ddp (Berlin) nicht nur das "Schiff", sondern auch diejenigen Nachweise und Unterlagen an Bord angeschaut, die das Finanzamt in Cuxhaven nicht zur Kenntnis nehmen will, diese stattdessen in einer denkwürdigen Szene am 17.10.2002 allesamt auf den Fußboden des Büros des Betriebsstellenprüfungsleiters K. im Finanzamt Cuxhaven flogen, weil derselbe sie in hohem Bogen dorthin warf, um sie nicht zur Kenntnis nehmen zu wollen. http://specialinfos.afk-pirol.org/specialinfos088/specialinfos088.html

Der Reporter Olaf Jahn sowie die beiden nds. Landtagsabgeordneten Johannßen und Klein haben sich im Studio des Unterzeichners auch jene Aufzeichnungen angeschaut, die der Unterzeichner aber auch der Betriebsprüfer L./FA Cuxhaven als "Kalenderbücher" tituliert, in denen handschrftlich sämtliche für die Finanzverwaltung nachvollziehbaren Daten und Fakten von beruflich veranlassten Pkw-Fahrten (Fahrtenbuch) sowie die durchgeführten Schiffsaufenthalte "lückenlos" fixiert worden sind.

Der Finanzbeamte L: hat sogar schriftlich bestätigt, dass diese Kalenderbücher im Finanzamt Cuxhaven jahrelang vorgelegen haben, nur bewirkt hat deren Inhalt nichts !!! Weil man dort des Lesens unkundig ist oder weil man schlicht aus niederen Motiven "nicht zur Kenntnis nehmen will", denn nur so macht der verbürgte Satz vom 24.06.1996, Zitat:

Das Schiff kriegen sie hier nicht durch, das habe ich (Betriebsprüferin B., Finanzamt Cuxhaven ) mit der Rechtsbehelfstelle im Hause bereits so abgestimmt. (Zeuge: StB H.-G. H., Buxtehude) einen inzwischen auch für Dritte unschwer erkennbaren Sinn.

§ 353
Abgabenüberhebung, Leistungskürzung
(1) Ein Amtsträger, der Steuern, Gebühren oder andere Abgaben für eine öffentliche Kasse zu erheben hat, wird, wenn er Abgaben, von denen er weiß, daß der Zahlende sie überhaupt nicht oder nur in geringerem Betrag schuldet, erhebt und das rechtswidrig Erhobene ganz oder zum Teil nicht zur Kasse bringt, mit Freiheitsstrafe von drei Monaten bis zu fünf Jahren bestraft.
(2) Ebenso wird bestraft, wer als Amtsträger bei amtlichen Ausgaben an Geld oder Naturalien dem Empfänger rechtswidrig Abzüge macht und die Ausgaben als vollständig geleistet in Rechnung stellt.

Ein denkwürdiger Straftatbestand, der zeigt, wohin dieses rechtstaatliche System steuert, nämlich in die fiskalische Willkür, nur wenn der Amtsträger nämlich sich persönlich zu bereichern versucht, macht er sich hier strafbar, führt er das "rechtswidrig" erhobene Steuergeld an die Finanzkasse ordnungsgemäß ab, na dann, freut sich der Fiskus über einen so einfallsreichen Finanzbeamten, oder...

Der Scheins in diesen Tagen begonnen habende Wahlkampf zur Wahl der Abgeordneten des 16. Deutschen Bundestag im Herbst diesen Jahres sollte Anlass sein, die zukünftigen Volksvertreter auf diese Kernmissstände im deutschen Steuerrecht wie Strafrecht unmittelbar hinzuweisen, denn so lange eine ganze Verwaltung tun und lassen kann, was sie will und gegen wen sie will, dann braucht es keinen Rechtstaat mehr, denn der oder die Rechtsuchenden werden keinen Rechtsschutz erfahren können in einer diesbezüglich rechtlosen Situation...

Die Konsequnz kann nur lauten, Menschen, die Innovation und Kreativität sowie den Mut zur Selbständigkeit in diesem Deutschland noch besitzen, müssen das Land mit all ihrer Habe dauerhaft verlassen, sich an einen Ort begeben, an dem andere wirtschaftliche Klimaverhältnisse herrschen, wenn sie nicht Gefahr laufen wollen, von irgendwelchen subalternen Finanzbeamten irgendwann sowohl wirtschaftlich als auch persönlich vernichtet zu werden, ungestraft, willkürlich...

Diese Aktionen werden auch weiterhin schlicht und Scheins harmlos "Betriebsprüfungen" genannt...

zur Erinnerung: heute ist Referendumstag in Frankreich.

Das heißt für uns:

Die heutige Zustimmung des deutschen Bundesrats zur EU-Verfassung wird in Frankreich genutzt, um kurz vor dem Verfassungsreferendum an diesem Sonntag den französischen WählerInnen Angst zu machen. Kanzler Schröder wird heute Präsident Chirac bei einer Veranstaltung für das 'Oui' in Toulouse persönlich unterstützen. Bisher liegen die Gegner des neoliberalen Verfassungsentwurfes in Führung. Ein riesiger Erfolg für Attac Frankreich und 950 Bürgerkomittees!

Damit das 'Non' diesen Sonntag wirklich gewinnt, bittet Attac Deutschland alle Mitglieder und UnterstützerInnen, eine E-Mail an ihre französischen Freundinnen und Freunde zu schreiben. Medien-Zensur gegen NON in Frankreich

In skandalöser Weise haben sich die Medien in Frankreich auf die Seite der EU-Verfassungsbefürworter geschlagen: Von Januar bis März entfielen bei Sendungen zur EU-Verfassung 71 Prozent der Sendezeit auf das Ja, 29 Prozent auf das Nein. Gegen diese einseitige Berichterstattung hat eine Gruppe von FernsehjournalistInnen in einem Aufruf protestiert, den mittlerweile mehr als 17.000 Menschen unterzeichnet haben. Bis zum Wochenende wollen die InitiatorInnen auf 20.000 Unterschriften kommen.

Public High Schools must hand over personal information about students to local military recruiters

You may not know it, but under a little known provision of No Child Left Behind, public high schools must hand over personal information about students -- including minors -- to local military recruiters, or risk losing federal education funding. I think it's a real invasion of family privacy and local school control.

The good news is that I just found some great information and a useful online tool that makes it easy to "opt out" our children from these lists. Just go to http://www.leavemychildalone.org/friend . Apparently the huge desertion problem is, as many real problems, not being publicized in this country...

Die ödp fordert daher eine konsequente Vorsorgepolitik zum Schutz der Bevölkerung.

Außerdem wird Prof. Buchner das bayerische Volksbegehren „Für Gesundheitsvorsorge beim Mobilfunk“ vorstellen. Ziel ist die Einführung von Genehmigungsverfahren für Mobilfunk-Sendemasten und die Verankerung der Gesundheitsvorsorge im Landesentwicklungsplan. „Wir sind nicht grundsätzlich gegen Handys, aber die Mobilfunkbetreiber sollen ihre Sendemasten nicht länger hinstellen können wo sie wollen. Mit dem Volksbegehren wird eine deutliche Reduzierung der Strahlenbelastung, eine Vorsorgeplanung mit unproblematischeren Standorten und mehr Nachbarschutz möglich“, erklärt Prof. Buchner.

Die Eintragungszeit beginnt am 5. Juli und endet am 18. Juli 2005. Die Initiative ist erfolgreich, wenn sich während dieses Zeitraums 916.000 Wahlberechtigte in die in den Rathäusern ausliegenden Unterschriftenlisten eintragen.

MP to meet Orange over mast proposals

JEREMY Hunt has criticised Tony Blair and is calling on the Prime Minister to stop ignoring the concerns of local communities about the siting of mobile phone masts. The newly elected MP for South West Surrey is meeting representatives from mobile operator Orange to discuss 13 new mast planning applications around the south Bourne area. “We all want to be able to use a mobile phone, but this doesn’t mean masts should be constructed without any regard for the well- being of local people in south-west Surrey,” he said. “It is time for Mr Blair to start listening and stop ignoring the views of local communities. As your member of parliament I will be calling on Mr Blair’s government to address the feelings of powerlessness and frustration experienced by those living under the threat of badly sited masts,” he added. One of the sites Mr Hunt will be discussing at the meeting concerns the proposed site on Waverley Lane, opposite Bourne Infant School. Niki Hearnshaw, campaign co-ordinator for the Bourne School Masts Action Group, said: “It is great news that this meeting is taking place and that Mr Hunt is helping us with our campaign against the siting of this mast.” Ms Hearnshaw has been invited to attend the meeting to discuss her concerns about the mast. “I am delighted to get the opportunity speak with Orange face to face. I want them to know that there is no way we will give up our fight no matter how long it takes,” she said. “The fundamental problem is that Orange has failed to fulfil their promise to consult with the school and the local community about the siting of the mast.” All Ms Hearnshaw’s children have attended the school and she is worried out the health effects of the mast on the children. “The mast will be about 50 metres from the school and because the school is on a hill the mast’s beam will be in line with the playground. We have had this independently verified by local radiologists,” she said. And in a further boost for protesters, BBC television cameras visited Bourne Infant School on Wednesday to publicise its fight against the possible siting of a mast nearby the school. A statement from Orange said: “We are currently reconsidering a number of proposals as a direct result of the consultation undertaken at The Bush Hotel back in April. “We understand the strength of feeling among the local community and although we have a few options left available to us, we have agreed to revisit some of the previously discounted alternative sites. We hope to have made some final decisions about which sites we will be progressing within the next two months. The footage taken at Bourne Infant School will be broadcast on BBC’s South Today during the news coverage of the meeting between Jeremy Hunt, Niki Hearnshaw and representatives from Orange at the House of Commons on Tuesday, May 31.

Fears for the health of their children and the environment have prompted parents to tackle mobile phone giant Vodafone over a proposed mast. The world's largest mobile phone company plans to construct a 12-metre high mast on the corner of Beehive Hill and Birmingham Road, yards away from Priors Field School and even closer to resident's homes.

The planned mast falls short of the 15-metre limit, which requires planning permission and so is exempt from the need for formal consent from Warwick District Council.

Arvine Bird, who lives opposite the proposed site and has three young children, said: "Warwickshire County Council has actually banned these masts on the top of school buildings so there is obviously a question mark over the safety of them.

"The health risks cannot be proven but this does not mean they can be disproved either."

Clinton Lane resident Bob Owens believes the mast is needed to improve reception in the area, particularly for photo messaging.

He said: "It will damage the environment - it is on the approach to Kenilworth, close to a school and nursery and will be within 15 metres of residents' properties. It is something we do not want.

"The people who are going to suffer will be the people around it and nobody is sure yet what damage these things can do."

Gillian Gould, a lunchtime supervisor at Priors Field, remembers fighting a similar plan by Orange seven years ago.

She said: "It's absolute madness to put a mast next to a school with over 200 children. The playing fields back right onto Chase Lane. Orange didn't get away with it when they tried so hopefully Vodafone won't either."

But Steve Maggs, who works as a scientist at the University of Warwick, said: "Most of the research done suggests there are no problems with any of these masts. It's not necessarily harmful and a lot of the concerns have been brought about by scaremongering."

Vodafone has embarked on a consultation process inviting nearby residents, schools, councils and councillors to give their opinions before making a final decision.

People living near the site have written their objections to ward councillors and Vodafone, and a petition has also been circulated in the neighbourhood.

Coun Michael Coker (Con, Abbey) said: "As far as the masts are concerned we have to approach them very carefully, one because they tend to be ugly and two because people are still concerned about the health aspects. Whether they are right or wrong I understand their feelings.

"My own feeling is that if we have to have them, they should be well away from houses in the middle of a field."

A spokeswoman for Vodafone explained that other potential locations had been investigated but this is a preferred site.

She added: "Nothing is set in stone. We will take people's views on board and then we will make a decision."

A PROPOSAL by a major telecommunications company to install a mobile phone mast is causing concern among residents in Fetcham.

Mobile phone firm Vodafone has approached Mole Valley District Council to install a mast off Shamrock Close, Fetcham.

But residents living in the close are concerned about their health and the subsequent impact on the value of their properties.

Michael Cliff, who is already living 50ft from another telecommunications mast belonging to T-Mobile, said the new mast will be 28ft from his fence.

He is one of a group of residents to have written a letter in protest to the planning department to express his concerns about having a second mast placed next to his bungalow.

"When I spoke to the council they didn't seem bothered about our concerns of the impact on our health and the effects this might have on the value our property," said Mr Cliff, 73. "I am not in very good health at the moment so I am concerned about what effect this will have on me, and the value of our property.

"I have spent £28,000 on improvements on the house, but if the planning department allow the mast to be built I will never be able to sell. "If the second phone mast goes up it won't matter where you sit in the garden because all you will be able to see are these masts. "We already have one phone mast in the village so why do we need a second?"

Mole Valley's area planning manager, Gary Rhoades-Brown said: "It is inappropriate for any comment to be made on an application, but all material circumstances are fully considered before any decision is made by the council."

Jane Frapwell, public relations officer for Vodafone, said: "All Vodafone installations are designed to be compliant with stringent international guidelines and they are recommended by Government and have the general backing from the World Health Organisation.

"The guidelines are in place to protect all of us whether the mast is one or 1,000 metres away."

Florence Jack, who lives opposite Mr Cliff on Shamrock Close has written to Mole Valley's planning department and MP Sir Paul Beresford objecting to the proposal.

She said: "I wrote to the council when they put up the first mast. It's bad enough having one there, it will be visually intrusive.

"Why are they going to place the mast in a populated area?"

PLACARD-waving protesters took to the street to show their anger against plans for a second mobile phone mast in their Chester community.

Residents in Newhall Road, Upton, are angered by the plans to build an O2 mast at the junction of Newhall Road and Handford Road.
The worried residents are concerned about the potential health effects of the base station, as they are officially called, and believe a new mast would be another eyesore.

If built, it would be the second one in the area. Hutchinson 3G has already built one, despite opposition from more than 300 residents.
One of the residents angered by the plans is Sylvia Molloy, 68, who lives on Newhall Road. She was at the forefront of the protest against the 3G mast and now plans to campaign against the new proposals. “No-one wanted the first in this area, let alone another,” she said. “The first mast is a blot on the landscape and I believe this new one will damage my view further. If they built another, we would have two big masts in this area. “On top of that, there are the health risks. I am very concerned about it. There will be children walking past this mast all the time.” And because the mast is under 15 metres high, the plans will not go to a full committee meeting. Instead it will be decided by planning officials.

Upton parish councillor Pete Griffiths said: “It seems bad that it will not go to full planning committee. What are councillors for? This will probably be decided by people do not know where Upton is. “We have too many masts in Upton as it is. We do not need another one. Why can’t they put it somewhere in Chester that does not have so many.”

Andrew Kelleher, a spokesman for O2, said: “This mast is designed to look like street furniture so it will not look particularly bad. “O2 recognise the public’s concerns over health effects and we would like to say we work with experts and regulators and also we work within stringent guidelines. “But we need to put a mast in there to improve reception in a high demand area.”

Mast plan gets go-ahead

Mobile phone company Vodafone will be able to put up a 14.5-metre mast in Strathmartine Road, Dundee, after the Scottish Executive overturned a decision by councillors.

Last year the development quality committee voted 21 to six to refuse planning permission for the mast, close to Cox Street, on the grounds that it was near an existing mast and would affect the environmental quality enjoyed by residents.

Council officials had recommended approval because Vodafone had looked at 18 alternative sites but had been forced to discard them because they were technically unsuitable or too close to houses.

Vodafone appealed to the Executive’s planning inquiry unit. A company spokeswoman said the mast was needed to improve customer service and its height was not unusual for an urban area.

The Executive has now granted planning permission for the development, including an antenna, equipment housing and compound, to go ahead at 534b Strathmartine Road.

Meanwhile, Airwave O2 has lodged an application asking the council to remove a specific no TETRA condition imposed on a mast at Peacehill Farm, by Wormit, even although they have no plans to use the site.

In February, North East Fife Environment and Development Committee approved an application by Orange PCS for a 13-metre mobile phone (2G) mast. But, because of objections from locals and health concerns associated with the controversial TETRA system, councillors added a condition there should be no addition of such equipment at the site.

A spokesman from Airwave O2 defended TETRA and said they could not let the condition go without fighting against it.

He said; “We have no plans, or need for a mast or a site share. But we felt on principle we couldn’t let this blatant discrimination against TETRA go un-opposed and are asking for that condition to be removed.”

Arthur Jarrett, who has campaigned against TETRA masts and is a member of Scottish Action on TETRA, praised councillors for including the condition in the original application and urged concerned locals to object to Airwave’s attempt to have the ban removed.

He said; “I think it was the first time a local authority had done such a thing and councillors thought carefully about this condition.

“It can’t have been well received, especially as some of these companies have exercised an almost devious right to do what they like elsewhere.

“Airwave O2 simply don’t want any council development committee acting in the interest of communities and pro-actively blocking them out. They certainly don’t want Fife councillors to create such a dangerous precedent, which might sensibly be followed elsewhere.

“This is really the company and industry teaching councillors all over Britain a lesson, putting them in their place and making sure they stay there.

“Local people who have appreciated the effort made by North East Fife councillors, now require to act swiftly again to object to Airwave O2’s application to undo their protection.”

Angry residents in North Tonbridge have protested against a mobile phone mast being erected on their doorstep.

Plans for the controversial mast on land at the junction of Hunt Road and Constable Road have raised concerns among residents over its visual impact and the possible effects on their health.

Tonbridge and Malling Borough Council originally refused planning permission for the 11.7m high mast last June.

However T-Mobile appealed and a visit was made to the site in March by a Secretary of State-appointed inspector.

The inspector decided to grant permission for the slimline monopole that will hold three antennas and a microwave dish on the area that already holds gas and electricity units.

But residents are angry that the mast has been allowed in a densely populated residential area that lies between Woodlands Infant and Junior Schools and the playgroup held at the Methodist church.

Resident Betty O'Loughlin put together a petition with nearly 200 signatures when the original application was made last year.

She was disappointed by the decision and said: "I don't know what else we can do. I don't know why they have put it there when people will be walking past all the time."

Mrs O'Loughlin, who was in the Auxiliary Territorial Service during the war, was most concerned about the health effects and said: "The government said the same thing about radar and how it wouldn't do any harm, but I know for a fact that one man I worked with had a rash for the rest of his life from his contact with a radar mast."

Another Hunt Road resident, George Carey, who will be able to see the mast from his bedroom window said: "It will be unsightly and could pose long-term risks to the health of the surrounding residents."

The 58-year-old said that as both he and his wife Jennifer were disabled they were in the house more than the average family.

He also suspected that Kent County Council, which is believed to own the island, would receive a generous rent from the mast as he claimed £5,000 was offered to the Methodist church as developers originally wanted to place it there.

A spokesman for the county council denied this and said money was only offered for private land.

Stephanie Genner, of Hunt Road, has a 15-year-old son with cystic fibrosis and she wrote an initial letter of objection.

She said: "We don't know the effects on people's health and I need to maintain my health for when my son gets more ill."

But a report published by the National Radiological Protection Board in 2000 concluded: "The balance of evidence indicates that there is no general risk to the health of people living near base stations, on the basis that exposures are expected to be small fractions of guidelines."

Mrs O'Loughlin disagreed and said she had read an article in a national newspaper about a man who had managed to roast a chicken on the top of a mobile mast.

The expert who led the research, NRPB chairman Sir William Stewart added: "Some people worry about the radio waves from mobile phone masts and we want to provide as much clear information as we can on this topic.

"Many of the concerns can relate to planning matters rather than scientific and health issues. This is a matter we expect to return to when NRPB issues a statement on mobile phones and health later this year."

Despite this, new information released by the group this year recommended that exposure to vulnerable groups such as children should be minimised.

Another planning application has been put forward by T-Mobile to erect an 8.5m high mobile phone mast at the junction of Hadlow Road and Three Elm Lane.

RELIEF AS MAST PLAN SCRAPPED

The Owner of a small goat dairy farm in Nutley has spoken of his relief after plans to build a mobile phone mast metres from his kidding shed were withdrawn.

Brian Willcock, 74, of Humphreys Farm, said he would have been forced to get rid of his goats if plans to site the mast got approval.

But weeks after submitting plans for the site off the A22, telecommunications giants Vodafone and Orange have unexpectedly withdrawn their application.

Steve Arnold of Crown Castle UK said: "Orange and Vodafone are now not wanting to proceed with the project on that site. So we will be withdrawing the application."

A Vodaphone spokeswoman said: "We withdrew [the plan] because of a financial reprioritisation. It may not be a permanent withdrawl, it may be transferred to a future financial year."

Mr Willcock said: "I'm very relieved indeed, and most grateful to Crown Castle for withdrawing their application. I think it is a morally correct decision."

The former pilot - who looks after the farm with his wife Margaret - was convinced that emissions from the proposed structure would have proven harmful to his herd and said that research into the effects of electromagnetic waves on animals confirmed his fears.

His concerns followed an application to Wealden District Council earlier this month by telecommunication sites manager Crown Castle UK for a new lattice mast to be built at the Nutley Telephone Exchange.

The proposed structure would have stood at 17.5m with a 3.2m slimline rocket extension to support Vodafone and Orange antennae.

If given approval, it would have been only 8m from a kidding shed at the farm and 21m from a milking parlour.

Mr Willcock said he feared the effect that the mast would have had on his goats and pointed towards a recent study in which cattle exposed to electromagnetic fields experienced lower milk yields and increased occurrence of poor health and behavioural abnormalities.

The German experts behind the investigation found that when removed from a nearby transmitting antenna the cows recovered, only for symptoms to reoccur when they were returned to the original field.

Mr Willcock - a mobile phone user himself - has now called on network operators to position masts away from people and livestock.

He said: "We don't mind masts, but what we do not want is masts that are close to houses.

"All we are asking is for the masts to be 400m away."

Over the last eight years, repeated bids to station a mast on land next to his farm have been made. During one previous application, Mr Willcock collected 600 names on a petition objecting to the mast.

Residents lose mast battle

HUNDREDS of residents have lost their battle against a 20 metre-high mobile phone mast near their homes after the issue caused a rift between councillors.

Labour over-ruled opposition members of Blackburn with Darwen Council's planning committee to approve the mast at Welding Engineering Ltd, Spring Vale Road, Darwen.

A petition with 250 signatures from residents opposing the mast, to be used by O2, was presented to the committee.

In January, residents won a similar battle when O2 asked to build the mast at a site close by.

But last night Darwen Labour councillor Dave Smith told the committee: "This is the best site for the mast within this area.

"They have looked at other sites, but they aren't suitable.

"People complain about masts wherever they are put, but on the other hand they are using mobile phones like never before."

Residents argued that the proximity of the mast to their homes could pose a future health hazard, and it would be an eyesore.

Staff at the nearby Barnabas House nursery had also complained to the council on health grounds.

Resident Paul Singleton said: "This site is just over the road from the one refused. There have to be better sites locally."

Conservative Darwen councillor Fred Slater said: "There are much more suitable sites, like closer to Cranberry Moor where it would be higher.

"I'm not happy, and I feel for the residents."

The committee was told it would not be held liable under law for any subsequent health problems caused by mast, because government guidance currently stated there was no risk to people from being close to masts.

People power has stopped a mobile phone mast being built near a play area in Frost Hill.

Dozens of campaigners were celebrating after Kirklees overturned the plans last Thursday.

Every councillor on the Heavy Woollen planning sub-committee voted against the application – despite recommendations by planning officers to give it the go ahead.

The 15-metre T-Mobile mast would have been built on the BMK Industrial Estate – just metres away from greenery used by children as a play area. Plans showed that Millbridge Junior, Infant and Nursery School was just 70 metres away from the mast and homes on Bank Street only 26 metres away.

They also revealed the mast would have included two equipment cabins and been enclosed by a two-metre high fence.

But councillors agreed with protesters and said the mast would be too close to housing and the play area.

One, ward councillor David Sheard (Lab), said other sites further away from housing were more suitable.

He said: "The amenities the residents have at the moment are very poor. There is very little open space – and a massive area of industrial land. It is too close to the amenities."

Andrew Nield, who spoke for the protesters at the meeting, said dozens of residents had signed letters of objection to the siting of the 48ft mast.

He said the location was picked by T-Mobile despite being in the middle of a residential area.

After the meeting, at Dewsbury Town Hall last Thursday, he added: "It was an amazing meeting. The councillors were smashing – they got it spot on. It's the only green area we've got and that would have been taken away. It would have taken away our privacy also.

"It's not just that an area where the kids play was being taken away, there may be health risks too."

After 19 years in military, homeless in Philadelphia

Luis Mejias admits he did something wrong. Last year, while stationed in Baghdad with the National Guard, he failed a random drug test. The Guard has a zero-tolerance drug policy, and Mejias was immediately discharged.

Now Mejias, 39, is home in Philadelphia - and homeless.

About 250,000 veterans are homeless on any given night, according to Linda Boone, executive director of the National Coalition for Homeless Veterans. More than twice that number are homeless during the year.

A recent survey by the U.S. Department of Veterans Affairs shows about 220 of those individuals served in the current conflicts in Afghanistan and Iraq. That number is expected to grow with the troops' continued deployment.

"We're obviously monitoring this pretty closely," said Pete Dougherty, the department's director of homeless veterans programs. "We're not in a panic mode, but it is a concern."

So as Americans mark Memorial Day this weekend, Mejias, his girlfriend, and her three children will be hunkered down in an abandoned North Philadelphia home temporarily claimed by the Kensington Welfare Rights Union.

It is not much - with just mattresses on the floor of the three-bedroom home - but it is better than the battered 1982 Buick Skylark in which they once slept, the adults upright in the front seats, the three children ages 7 to 10 crammed into the back.

"I feel I'm less of a man because I can't provide for them," said Mejias, who served in Kosovo and Iraq during his 12 years in the Army and seven years in the National Guard. "All I want is to be able to walk into a house and say, 'Hi, honey. I'm home.' All I expect from [the government] is to help me find some place to live."

Newspapers nationwide have reported on veterans returning from Iraq and facing homelessness.

"It makes me angry that my government is treating veterans like this, especially with all the flag-waving and 'Support Our Troops' magnets on the cars," said Patrick Resta, a member of Iraq Veterans Against the War, a national organization based in Philadelphia.

Mejias' case is complicated. Although separated from his unit, he still is not officially separated from the National Guard. Mejias has been assigned a Judge Advocate General lawyer who can appeal the pending discharge on his behalf, said Capt. Cory Angell, a Pennsylvania National Guard public-relations specialist.

"I never had any problems, anything, for 19 years," Mejias said. "I gave them the time, and I should be penalized for what I did, but I don't think they should go, 'Boom. You're out.'"

Because Mejias is not formally separated from the military, he is not considered a veteran, making him ineligible for veterans' services.

Cheri Honkala, founder of the Kensington Welfare Rights Union, said she has contacted city and state officials on Mejias' behalf but has had no luck.

"Homelessness is bad, period. But this is a disgrace," Honkala said. "Here's a man who risked his life, was shot at, is emotionally damaged for life, and we can't even find a place for him and these beautiful kids and his partner to sleep."

When Mejias was sent home about a year ago, he found that the house he once had shared with his brother had been foreclosed upon. He found it difficult to find jobs in landscaping and auto repair, work he had done previously. He now suffers from seizures - a side effect of his years in a combat zone, he said - and once when he found work, he suddenly tightened up, nearly broke the rake in his hand in two, and fell to the ground. He awoke in the hospital.

Of Iraq, Mejias said: "It's left me with cockroaches in my head. Sometimes at night I wake up and tell myself, 'You're safe. You're safe.'

"It consumes who you are."


The Mejias family is being housed temporarily in an abandoned HUD house "reclaimed" by the Kensington Welfare Rights Union (KWRU). This family is but one of thousands of homeless families with no place to go in the Philadelphia area, dozens of whom are currently being housed temporarily with the KWRU (in takeover houses, Human Rights Houses, etc). The KWRU believes that decent, affordable housing is a human right.

Like all families struggling for affordable housing, health care, and other basic human rights with the KWRU and PPEHRC, the Mejias family is becoming an active part of the movement for economic human rights in the United States, united with the poor around the world.

To help house the Mejias family and other homeless KWRU families, please:

1) Join our emergency response list, to be called to come to the house in case of an effort to evict the Mejias family.

2) Write a statement supporting the Mejias' family's and the KWRU's struggle for the right to housing.

3) Contribute much needed food, toys, household items to the Mejias household.

4) Make a contribution to the KWRU's ongoing struggle to fight for housing for homeless families in the Philadelphia area.

5) Contribute to buy minutes for a cell phone that is needed for constant communication from the house.

6) Contact the KWRU about how your congregation/ organization can support KWRU's Human Rights Houses, housing homeless families as they both fight for affordable housing for themselves and become leaders in a movement for economic human rights for all.

If we have a case to be made against any of the 500 or so inmates still in Guantánamo, then it is high time we put them on trial, convict as many possible (which will not be easy because of bungled interrogations) and then simply let the rest go home or to a third country. Sure, a few may come back to haunt us. But at least they won't be able to take advantage of Guantánamo as an engine of recruitment to enlist thousands more.
