ASHINGTON, Dec. 18 - The Pentagon is drawing up a plan that would give the military a more prominent role in intelligence-collection operations that have traditionally been the province of the Central Intelligence Agency, including missions aimed at terrorist groups and those involved in weapons proliferation, Defense Department officials say.


The proposal is being described by some intelligence officials as an effort by the Pentagon to expand its role in intelligence gathering at a time when legislation signed by President Bush on Friday sets in motion sweeping changes in the intelligence community, including the creation of a national intelligence director. The main purpose of that overhaul is to improve coordination among the country's 15 intelligence agencies, including those controlled by the Pentagon.

The details of the plan remain secret and are evolving, but indications of its scope and significance have begun to emerge in recent weeks. One part of the overall proposal is being drafted by a team led by Lt. Gen. William G. Boykin, a deputy under secretary of defense.

Among the ideas cited by Defense Department officials is the idea of "fighting for intelligence," or commencing combat operations chiefly to obtain intelligence.

The proposal also calls for a major expansion of human intelligence, which is information gathered by spies rather than by technological means, both within the military services and the Defense Intelligence Agency, including more missions aimed at acquiring specific information sought by policy makers.

The proposal is the latest chapter in the fierce and long-running rivalry between the Pentagon and the C.I.A. for dominance over intelligence collection.

White House officials are monitoring the Pentagon's planning, as is the C.I.A. The proposal has not yet won White House approval, according to administration officials. It is unclear to what extent American military forces have already been given additional authority to carry out intelligence-gathering missions.

Until now, intelligence operations run by the Pentagon have focused primarily on gathering information about enemy forces. But the overarching proposal being drafted in the Pentagon, which encompasses General Boykin's efforts, would focus military intelligence operations increasingly on counterterrorism and counterproliferation, areas in which the C.I.A. has played the leading role.

"Right now, we're looking at providing Special Operations forces some of the flexibility the C.I.A. has had for years," said a Defense Department official who spoke on the condition of anonymity because the plan has not yet been approved. "It would be used judiciously, and with all appropriate oversight controls."

General Boykin's proposal would revamp military commands to ensure that senior officers planning and fighting wars work more closely with the intelligence analysts tracking threats like terrorists and insurgency cells. Another part of the Pentagon's plan was articulated in a recent directive by Defense Secretary Donald H. Rumsfeld that instructed regional commanders to expand the military's role in intelligence gathering, particularly in tracking terrorist and insurgent leaders.

While declining to comment directly on the recent directive, a Pentagon spokesman, Bryan Whitman, said, "Regional commanders are looking at ways to maximize the use of their resources to contribute to the overall intelligence picture."

In public allusions to the plan, both General Boykin and Vice Adm. Lowell E. Jacoby, the director of the Defense Intelligence Agency, have stuck to generalities. It is still unclear how many additional personnel may be assigned to intelligence gathering or when and where such operations may take place. But some intelligence officials say they believe those remarks open the way to more clandestine military operations intended to gather intelligence on terrorists and weapons proliferators.

Aiming to investigate the possibility of electromagnetic fields (EMF) developed by nonionizing radiation to be a noxious agent capable of inducing genotoxicity to humans, in the current study we have investigated the effect of 910-MHz EMF in rat bone marrow. Rats were exposed daily for 2 h over a period of 30 consecutive days. Studying bone marrow smears from EMF-exposed and sham-exposed animals, we observed an almost threefold increase of micronuclei (MN) in polychromatic erythrocytes (PCEs) after EMF exposure. An induction of MN was also observed in polymorphonuclear cells. The induction of MN in female rats was less than that in male rats. The results indicate that 910-MHz EMF could be considered as a noxious agent capable of producing genotoxic effects.

It could happen. But a group of doctors and others don't want it happening in Oregon — at least not yet.

They will ask the Legislature next month to impose a four-year moratorium on biopharming, crops genetically altered to fight or prevent human diseases. The state chapter of Physicians for Social Responsibility is concerned that such crops would infiltrate the environment, exposing residents to drugs they don't need. Biopharming represents the latest twist on genetic modification in agriculture. Biotechnology companies already have produced corn varieties containing a protein found in HIV, the virus that causes AIDS. Their goal is to manufacture food products, such as breakfast cereals, to orally deliver an AIDS vaccine.

Biopharming Draws Criticism

But a group of Oregon doctors is asking the legislature next month to ban biopharming. That's the latest twist on genetic engineering. Marines Staged Mock Executions of Juveniles

Marines in Iraq conducted mock executions of juvenile prisoners during the war there last year, burned and tortured other prisoners with electrical shocks, and allegedly warned one Navy medic to keep his "mouth shut" about abuse and threatened to kill another medic if he assisted an injured Iraqi soldier or civilian, according to investigators' records. The new revelations of detainee mistreatment, disclosed today after the ACLU obtained them in a lawsuit against the federal government, for the first time detail case histories in which 11 Marines have been punished for abusing prisoners and two were disciplined for falsely boasting about killing and torturing detainees. Further, the records describe government officials deep in debate about what to do with the bodies of detainees killed while in the custody of U.S. troops and of Navy criminal investigators scrambling to keep up with the growing number of abuse cases after the Abu Ghraib prison scandal became public last spring.

"Heads up," an assistant special agent-in-charge of the Navy's investigative field office in the Middle East warned his superiors in an urgent e-mail dispatched at 6 a.m. on June 14. He was desperate for more investigators.

US troops used mock executions, electric shocks on Iraqis

US Marines fired a pistol in a mock execution involving four young Iraqi looters and shocked another Iraqi detainee with an electric transformer until he danced, a US Navy document shows. The document dated June 16 detailed 10 substantiated incidents of detainee abuse in Iraq involving 24 Marines dating back to May 2003.

On Monday the Pentagon was forced to admit it was investigating two more deaths in custody in Afghanistan that it had previously acknowledged.

The Marine Corps said 13 Marines were convicted in courts-martial stemming from the incidents, getting prison sentences of up to 15 months.

Files show more US abuse in Iraq

Evidence of more prisoner abuse in Iraq has come to light after the US military was forced to release it by the courts. The documents show that US marines carried out a mock execution, used electric shocks and burned prisoners. American campaign groups obtained the US navy documents by using freedom of information legislation. The navy said those found guilty of abuse had been punished, but added that many allegations - some relating to killings - had been dismissed.

Ten "substantiated" incidents of detainee abuse were detailed, leading to the court martial conviction of 13 marines, and the jailing of some others.

US Troops Ordered To Commit War Crimes

As Americans prepared for Thanksgiving, an estimated 100,000 residents of the besieged Iraqi city of Fallujah, trapped in their homes, struggled to survive without fresh food, water or electricity, reportedly cut off by U.S. forces on Nov. 8. Meanwhile, on the streets of Fallujah, a city of more than 350,000, dogs gnaw on bloated and rotting corpses that remain unburied for weeks. Thousands of families in Fallujah were reported to be in a critical humanitarian situation after U.S. forces prevented the delivery of relief supplies. An Iraq Red Crescent Society (IRCS) humanitarian aid convoy, reportedly blocked by U.S. troops for more than two weeks, was allowed to deliver aid to residents in the heart of the city on Nov. 25. On Thanksgiving, U.S. forces permitted the IRCS convoy carrying thousands of food parcels, blankets, tents and medical supplies to enter the city and allowed one of the clinics to be converted into a temporary hospital to treat the injured.

Rana Sidani of the International Committee of the Red Cross (ICRC) in Geneva, Switzerland, however, told American Free Press on Nov. 30 that "many civilians" were still prevented from receiving aid or medical care.

Last week another gigantic step was taken toward the Sovietization of America. The so-called "Intelligence Reform" bill was passed by the Republican-controlled Congress. I feel confident in saying that 95 percent of Congress didn't bother to read this 3,000 page tome except the portions that guarantee pork to their big donors. Beginning in 2005, the Department of Homeland Security, overriding the sovereignty of the states, will issue all driver's licenses and birth certificates that meet some "federalized standards" including biometric "security" provisions. Contrary to existing law, newborns will be automatically issued a Social Security number, which would force them into the federal taxing scheme called Social Security. All children will be denied enrollment in the government indoctrination centers (schools) without first supplying a Homeland Security registered birth certificate. If this doesn't chill you, it should. Since the Social Security taxing scheme came into being back in 1935, no one has ever been required to join. The government has never automatically issued numbers because it has always been voluntary. Should this toxic bill get signed into law by Bush (a given), for the first time, Americans will be forced into this program against their will.

One of the highest priorities in instilling the communist moral principles into a population is the joining of all human beings into a single collective (we) where the individual no longer thinks independently. The Soviets believe that the "new communist man" will become one with the state by persuading him or her to relinquish their individuality, their identity, their own self and merge into the collective (community).

Um die Möglichkeit zu untersuchen ob elektromagnetische Felder (EMF), produziert durch nichtionisierende Strahlung, als schädliche Erreger dazu fähig sind, gentoxische Effekte in Menschen zu verursachen, haben wir in der vorliegenden Studie den Effekt von 910MHz EMF auf Rattenknochenmark untersucht.

Ratten wurden täglich 2 Stunden über eine Periode von 30 Tagen bestrahlt. Bei der Untersuchung von Knochenmark Schmieren von EMF exponierten und scheinexponierten Tieren haben wir eine fast dreifache Erhöhung von Microkernen (MN) in Polychomatischen Erythrozyten (PCE) nach EMF Exposition beobachtet. Ein Vorkommen von Microkernen wurde auch bei Polymorphkernigen Zellen beobachtet. Die Vorkommen von Microkernen in weiblichen Ratten war kleiner als die in männlichen Ratten. Die Ergebnisse zeigen auf, dass 910MHz EMF als ein schädlicher Erreger betrachtet werden kann, welcher in der Lage dazu ist, gentoxische Effekte zu produzieren.

Aiming to investigate the possibility of electromagnetic fields (EMF) developed by nonionizing radiation to be a noxious agent capable of inducing genotoxicity to humans, in the current study we have investigated the effect of 910-MHz EMF in rat bone marrow. Rats were exposed daily for 2 h over a period of 30 consecutive days. Studying bone marrow smears from EMF-exposed and sham-exposed animals, we observed an almost threefold increase of micronuclei (MN) in polychromatic erythrocytes (PCEs) after EMF exposure. An induction of MN was also observed in polymorphonuclear cells. The induction of MN in female rats was less than that in male rats. The results indicate that 910-MHz EMF could be considered as a noxious agent capable of producing genotoxic effects.

Petition to Stop Iraq War - Effort to Save Lives

The wars upon Iraq and Afghanistan have included torture of prisoners and murders of civilians. Such actions inspires more and more Muslim men to want revenge against the United States. They refer to the United States as the "Great Satan". There are 1.4 billion Muslims. The United States has about 300 million people. Bush and his war team either didn't give any consideration that Muslims outnumber Americans or else didn't care. Bush, Cheney, and their friends are getting richer and richer from war while Americans are no safer than before those wars and our soldiers are becoming disabled, such as limbs or faces blown off, or dead as a result of war.

Also unless the war is stopped, there will be a draft. No doubt, I'm not the only that has relatives that would be in the age range to be drafted. I have a daughter, a niece, and a nephew that are now in the age range to be drafted. Prior to the Iraqi war I wrote a letter to Bush to try to influence him to not attack the Iraqi people, but instead to have a thorough inspection of Iraq and find and arrest Saddam Hussein. Saddam Hussein has been arrested. Bush said the war was over a while back but keeps it going on and on.

I've heard news that war will go on 4-5 more years and troops be in Iraq up to 10 years from now. It's turning into another Vietnam. Iraq belongs to the Iraqi people. The U.S.A. has no business trying to take control of Iraq. Desperation for oil is no reason for such wars and occupation. If a country can't find enough oil on it's own land, then the proper way to get oil is to buy it.

Another fact to consider is that as long as the war goes on the costs keep running up the national debt. Someone told me that when the U.S.A.'s national debt was $6 trillion, that most of that had been caused by the Vietnam war. I can see how when a war costs mega- billions of dollars and it's borrowed money, the interest on that debt could accumulate into trillions of dollars. Please sign the petition.

Funkchips sind unsichtbare Wächter. In Verpackungen, Bauteile, Karten oder gar Körpergewebe integriert, können sie eifrig Daten sammeln und vom Nutzer unbemerkt umhersenden. Während Unternehmen auf effizientere Produktion und Logistik hoffen, rufen Konsumentenvereinigungen zum Boykott der so genannten RFID-Systeme auf.

Eingesetzt werden sollen die "intelligenten Etiketten" nicht nur bei der Kennzeichnung von Waren und Tieren, sondern auch bei der Zutrittüberwachung von Firmen, Stadien und Räumen sowie der Steuerung industrieller Prozesse. (Foto: dpa)

"Wir sind jetzt schon gläserne Menschen, aber die Dimension wird mit der RFID-Technik noch einmal deutlich zunehmen", sagt Britta Oertel vom Institut für Zukunftsstudien und Technologiebewertung (IZT). Allzu leicht ließen sich mit den Chips exakte Daten zu Gewohnheiten und Eigenarten eines Menschen sammeln.

Auf RFID (Radio-Frequenz-Identifikation) basierende Systeme bestehen aus einem Datenträger sowie einem Lesegerät und sollen etwa den Barcode ersetzen. Je nach Bauart lassen sich die Datenträger nicht nur ablesen, sondern auch verändern. Eingesetzt werden sollen die "intelligenten Etiketten" bei der Zutrittsüberwachung von Unternehmen, Stadien und Räumen, der Steuerung industrieller Prozesse, der Kennzeichnung von Waren, Tieren und Menschen sowie in Ersatzteil- und Recyclingkreisläufen.

Unter Fachleuten ist umstritten, ob RFID-Systeme noch intensiver als bereits mit Kreditkarten, Kundenkarten und Mobiltelefonen geschehen die Privatsphäre zerstören. Experten des IZT und der Eidgenössischen Materialprüfungs- und Forschungsanstalt (EMPA) untersuchten daher im Auftrag des Bundesamtes für Sicherheit in der Informationstechnik die Chancen und Risiken.

"Wie jede neue Technik hat auch diese zwei Seiten", zieht Oertel ein Fazit der Studie. So ermögliche beispielsweise die Markierung von Nutztieren mit RFID-Chips eine gläserne Produktionskette bis zur Ladentheke. Andererseits könnten Arbeitgeber die Technik dazu nutzen, Verhalten und Leistung ihrer Angestellten zu observieren. "Solche Daten werden gesammelt, auch wenn es verboten ist", ist Oertel überzeugt.

"In Skigebieten gibt es solche Funketiketten schon", sagt Oertel. "Der Vorteil ist, dass der Skipass nicht mehr mühsam aus den Taschen rausgepellt werden muss." Oft dienten die Chips zusätzlich als Schlüssel fürs Hotel, als Sammelkarte für die Hotelbar-Rechnungen und als Busticket. Wer sich als Weinliebhaber oder Wellnessurlauber zu erkennen gebe, könne künftig laut Oertel nach seiner Reise mit Bergen gezielter Werbung "beglückt" werden.

In den USA werden die Schnüffelchips sogar Schwerkranken implantiert, um ihnen eine freiere Bewegung bei steter gesundheitlicher Überwachung zu ermöglichen. "RFIDs in Menschen sollte es grundsätzlich nicht geben. Da wurde eine Grenze überschritten", kritisiert Oertel.

Bei aller Kritik dürfe nicht vergessen werden, dass viele der sensiblen Informationen schon längst mit anderen Systemen gesammelt werden. So legten Besitzer von Kundenkarten gegen einen minimalen Preisvorteil ihre gesamten persönlichen Kaufinteressen offen, die von den Firmen Gewinn bringend ausgewertet würden. "Da erfolgt kein Aufschrei", rätselt Oertel. "Der Kunde ist sich gar nicht bewusst, was für eine gute Informationsquelle er schon ist."

Risiken ergeben sich der Studie nach nicht nur durch die gigantischen Datensammlungen und die Missbrauchsmöglichkeiten, sondern auch durch die neue technische Abhängigkeit. "Stellen Sie sich mal Tausende Fußball-Fans vor, die wegen eines Chip-Versagens nicht ins Stadion kommen", sagt Oertel.

Normenerlassklage wegen rechtswidrigem Unterlassen einer gesetzlichen Rechtsvorschrift

Bezüglich der Grenzwerte im Rahmen der 26. Bundesimmissionsschutzverordnung ist klar erkennbar, dass einerseits in der Verordnung nur die sogenannten thermischen Werte enthalten sind, obgleich es athermische Werte gibt. Der Bundesverordnungsgeber hat bei dem Erlass der Verordnung über elektromagnetische Felder am 16.12.1996 entscheidend zum Ausdruck gebracht, dass diese Verordnung zu gegebener Zeit nachgeprüft werden sollte. Zwar hat das Bundesamt für Strahlenschutz anscheinend weitere Forschungen in Auftrag gegeben, trotzdem sind zwischenzeitlich acht Jahre vergangen, ohne dass bezüglich der Werte in der 26. Bundesimmissionsschutzverordnung irgendwelche "Veränderungen" oder "Nachbesserungen" erfolgt sind.

Es stellt sich deshalb die Frage, ob nicht eine sogenannte Normenerlassklage wegen rechtswidrigem Unterlassen einer gesetzlichen Rechtsvorschrift angestrengt werden sollte. Diese Klage müsste nach Ansicht des Unterzeichners beim Verwaltungsgericht in Berlin erhoben werden, da Ansprechpartner in diesem Fall die Deutsche Bundesregierung ist. Verklagt werden müsste wahrscheinlich die Bundesregierung, vertreten durch das Bundesumweltministerium. Es müsste gegebenenfalls ein Bürger klagen, der in der Nähe einer Mobilfunkanlage wohnt und einen Nachweis der thermischen Grenzwerte und die Existenz thermischer Grenzwerte vorlegen könnte. Diese sogenannte Normergänzungsklage ist bislang nach Kenntnis des Unterzeichners nicht erhoben worden. Der führende Kommentar zur Verwaltungsgerichtsordnung von Kopp-Schenke, 13. Auflage, verweist in § 47 Band Nr. 14 darauf hin, dass eine derartige Normergänzungsklage als zulässig angesehen werden kann, wenn geltend gemacht wird, dass eine Rechtsvorschrift deshalb fehlerhaft sei, weil sie bestimmte Regelungen nicht enthält, d.h. diese unterlassen hat (z.B. es zu unrecht unterlassen hat, eine bestimmte Regelung selbst zu treffen und es statt dessen der Verwaltung überlässt, Regelungen zu treffen).

Nachdem die 26. Bundesimmissionsschutzverordnung als sogenannte abschließende Regelung der Rechtssprechung der Verwaltungsgerichte verstanden wird, dürfte sie dadurch gegen höherrangiges Recht, insbesondere gegen Art. 3 GG verstoßen. Diese sogenannte Normergänzungsklage könnte auch unter Bezugnahme auf Art. 19 Abs. 4 GG, erhoben werden.

Unsere Kanzlei verfügt bislang auf diesem Sektor nur über Kenntnisse in der Literatur. Wir selbst haben noch nie eine derartige Klage erhoben, könnten uns jedoch vorstellen, dass bei Klageerhebung Bewegung in die Kruste der Struktur der Verwaltungsgerichte und insbesondere ein gewisser Druck auf die Bundesregierung erfolgen würde.

Vielleicht können Sie diese Anregung einmal mit beteiligten Kreisen erörtern; zur Unterstützung der Meinung konnte der Unterzeichner in einer Zeitschrift einen entsprechenden Aufsatz veröffentlichen.
