The historic class action to be heard before a court from ASL France against Orange France which was to be held in the Court of Justice in Valence, Drôme, France, on Wednesday the 7th of July 2005, has just been postponed; another date will be given in a few days.
Since the 25th of November 2004, ASL has been instituting various proceedings among which an administrative appeal in order to get the permission cancelled for Orange concerning the works that the M P and Mayor of Crest allowed Orange to do; this made the instalment of the Orange Relay-Antennas Macro broadcasting station possible in the very urban area in Crest.
Moreover, ASL has taken legal action in order to have broadcasting transmissions cancelled on Wednesday the 8th of June 2005, because the session has been postponed by the Court to make Orange able to assert his rights on the 6th of July 2005.
Then, on the 4th of July 2005 in the morning, Orange gave ASL lawyer a file of about 800 pages and moreover 69 pages as conclusions of the folder in reply to the Administrative Court.
Moreover, Orange is to give conclusions (100 pages?!) of the class action on the very 4th of July 2005 in the evening, … but nothing at all has been yet delivered to us.
This manoeuvre forces ASL lawyer to get a postponement in order to examine and give an answer to all the files: so, Orange Macro broadcasting station will be able to continue to broadcast.
ASL is currently examining other proceedings among which an administrative class action against the French Government to obtain an expert opinion.
