Supreme Court Affirms Right to Sue For Pesticide Harm

The Supreme Court today ruled that citizens damaged by pesticides have the right to sue companies of these toxic products, saying that federal pesticide law does not offer adequate protection from "manufacturers of poisonous substances." Dow Chemical Company argued that, because its products are registered by EPA, chemical manufacturers should be shielded from litigation. The Bush Administration joined the case in support of Dow.

Washington, DC, April 27, 2005 - In a landmark decision, the Supreme Court today upheld the rights of citizens to sue for damages caused by pesticides, after Dow Chemical Company and the Bush Administration argued that the chemical industry should be shielded from such litigation. "This decision affirms a moral value that life is more precious than chemical company profits," said Jay Feldman, executive director of Beyond Pesticides, a Washington, DC-based environmental group. The Bush Administration filed a brief in support of Dow Chemical, arguing against the rights of citizens who are poisoned or damaged from pesticide use.

The case, Bates et al v. Dow AgroSciences LLC, involves Texas peanut farmers, who argued that the Dow herbicide Strongarm (diclosulam) ruined their crops, but were prevented from suing after Dow successfully argued in a lower District court that registration of pesticides under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) insulates it from citizen suits, or preempts litigation. The Bush administration weighed in the case on the side of Dow, officially reversing the position of the Clinton administration (see Etcheverry v. Tri-Ag Service, Bayer Corp, et al.). The Justice Department brief filed before the high court in late November, 2004 was designed to protect pesticide manufacturers when their products cause harm. Advocates cite that this position is contradictory to the administration's public support of states' rights.

The court decision reads, "The long history of tort litigation against manufacturers of poisonous substances adds force to the presumption against pre-emption, for Congress surely would have expressed its intention more clearly if it had meant to deprive injured parties of a long available form of compensation." The decision continues, "Moreover, this history emphasizes the importance of providing an incentive to manufacturers to use the utmost care in distributing inherently dangerous items. Private remedies that enforce federal misbranding requirements would seem to aid, rather than hinder, the function of FIFRA [the Federal Insecticide, Fungicide and Rodenticide Act]."

The Court criticized Dow and the Bush Administration's attempts to undermine public protection, stating, "Dow and the United States exaggerate the disruptive effects of using common-law suits to enforce the prohibition on misbranding. FIFRA has prohibited inaccurate representations and inadequate warnings since its enactment in 1947, while tort suits alleging failure-to-warn claims were common well before that date and continued beyond the 1972 amendments. We have been pointed to no evidence that such tort suits led to a 'crazy-quilt' of FIFRA standards or otherwise created any real hardship for manufacturers or for EPA."

According to Beyond Pesticides, the court decision is extremely important because: (i) "Pesticides are registered by the Environmental Protection Agency under a risk assessment review process that implicitly does not consider all aspects of potential harm," (ii) "The potential for court review of cases in which people are harmed creates a strong incentive for the development of safer products," and (iii) "The same companies or their trade associations, including Dow Chemical Company, that have successfully lobbied for weak national laws and standards do not want people who are harmed as a result to seek redress."

Beyond Pesticides joined an amicus brief in the case with Earthjustice, Defenders of Wildlife, Farmworker Justice Fund, Natural Resources Defense Council, Physicians for Social Responsibility, Public Citizen, Sierra Club, and Trial Lawyers for Public Justice.

Am 12. Mai 2005 entscheidet der Deutsche Bundestag über die Verfassung für Europa. Am 27. Mai wird voraussichtlich der Bundesrat sein Votum abgeben. Am 29. Mai 2005 stimmen die Französinnen und Franzosen in einem Referendum über den Vertrag ab. In Deutschland ist der Bevölkerung trotz zahlreicher Forderungen eine direkte Beteiligung an dieser Entscheidung verwehrt. Es ist klar, dass die Verfechter des Ja die zu erwartende Entscheidung des Bundestages instrumentalisieren wollen, um Druck auf die französischen Wähler auszuüben. Diese Verfälschung der Demokratie zur Beeinflussung des freien Willens der Völker Europas widerspricht dem wachsenden Streben der Bürgerinnen und Bürger nach einem Europa, wie sie es wollen.

Im Geiste der Freundschaft zwischen dem deutschen und französischen Volk bekräftigen wir in diesem für die Demokratie so wichtigen Augenblick unsere Solidarität mit den sozialen und politischen Kräften, den vielen Frauen und Männern in allen Ländern, die sich gegen dieses Projekt aussprechen, weil sie für ein wahrhaft soziales, demokratisches und friedliches Europa eintreten.

Most have fled to Syria, apparently a more secure and tolerant country for Christians than liberated Iraq. LOS ALAMOS A RED HERRING?

We are being told by media pundits that the security lapses at the Los Alamos nuclear laboratory present the worst threat to our national security in decades. Could anything be worse? In a word, yes!

David Bresnahan, an investigative reporter for WorldNetDaily, has published two articles on the burgeoning scandal at the Army Research Lab (ARL) at Maryland’s Aberdeen Proving Grounds. Allegations, based on reports and documentation from at least ten whistleblowers, include "a long history of corruption, including use of Army computers by unauthorized foreign nationals, plagiarism, falsification of research, illegal appropriation of private property, even smuggling of precious gems."

Various members of Congress have been provided the information and have been sitting on it for four years while nothing has been done. Why the cover-up? It may have something to do with type of research and development being conducted at the lab.

We may have been given a clue on March 19, 1999 at President’s Clinton’s press conference when Fox News reporter Wendell Goler dropped this bombshell. He stated, "Fox News has information that China has stolen top secret technical data on Electro-Magnetic Pulse (EMP) weaponry from four of our eleven secret weapons laboratories and have successfully tested the weaponry." Since that day, not one word has appeared in the national media on the subject. Instead, we have been inundated with information about lapses in security at the Los Alamos nuclear lab.

EMP weaponry stems from the findings and inventions of the brilliant European scientist Nikola Tesla, who gave us alternating current electricity. His research is being applied at a top-secret installation in Alaska called HAARP (High-Frequency Active Auroral Research program).

Although passed off as merely a scientific inquiry into phenomena like aurora borealis (northern lights), in reality it is testing such things as anti-missile lasers, massive weather modification and non-lethal "psychotronic" weapons for use against military and civilian populations.

When questioned about appropriations for the HAARP project, this writer’s representative in Congress (who sits on the House Science Committee) admitted those appropriations are buried in the "black budget" for the intelligence community.

This writer has written two articles on the subject detailing the capabilities of EMP weapons and their development and use, not just by the United States, but by Russia. Copies of those articles ("Chinese Steal EMP Weapons Secrets-Huh?" of 3/21/99 and "EMP Weaponry-A Conspiracy of Silence?" of 10/14/99) may be obtained by directing an E-mail to jimrarey@comcast.net with the phrase "EMP articles please" in the title line.

Since those articles, the United States has successfully tested a laser weapon which destroyed a live missile in mid-air. News reports say the weapon will be furnished to Israel for its defense against short-range missiles from its neighbors.

So the as yet unanswered question is, was the Aberdeen Army Research Lab one of the four facilities Fox News was talking about on March 19th of last year? If so, the suspicious deaths of three key players takes on added significance.

Bresnahan reports that two of the whistleblowers, ARL scientists Franz Lynn and Robert Deas, died shortly after trying to report their suspicions that technology from ARL was being provided to China. Deas died in a single-car accident in Canada. Lynn’s death was reported as a suicide.

Even more intriguing is the supposed "suicide" of John Millis, staff director of the House Intelligence Committee. Washington Times reporter, Bill Gertz, in a 6/28/00 article described Millis, "(he) had access to the U.S. intelligence community’s most intimate secrets. He knew about all U.S. covert action operations, which require written presidential notifications. He also was privy to the most sensitive information collected by CIA agents, electronic eavesdropping and photographic satellites."

Was someone afraid that Millis was going to go public with his knowledge of activities bordering on treason? According to Porter Goss, Chairman of the House Select Intelligence Committee (and himself a former CIA case officer), Millis had been suspended from his job and was under investigation for (undisclosed) "inappropriate" actions. Although no classified documents were reported to have been found in the motel room where Millis supposedly shot himself (no suicide note was found either), Security officials reportedly found some in a safe at Millis’ home.

What is known so far (by the public) may be just the tip of the iceberg. There is obviously a massive cover-up in progress. Whistleblowers can only be cowed by the three deaths and reportedly are being harassed into silence under the rubric of "national security."

The radiation of a cell phone base station at a distance of 80 metres causes significant changes of the electrical currents in the brains of testees (measured by electroencefalogram, EEG). All the testees said they felt unwell during the radiation, some of them seriously.

That is the result of an investigation by a team of Austrian scientists. They measured alpha 1 (8 to 10 Hz), alpha 2 (10 to 12 Hz) and beta waves (13 to 20 Hz). A small density of GSM 900 and GSM 1800 radiation already caused several significant changes in these three frequency ranges. This means the body is stressed - temporarily this may have some positive effect, in the long run however stress certainly reduces the quality of life, capacity for work and state of health.

The results of the research will be published in international scientific magazines and confirmed by replication. The research was financed by Land Salzburg in Austria. The testees were nine women and three men between 20 and 78, who considered themselves 'electrosensitive'. They were invited to sit in a chair, eyes covered and ears plugged. Of course they were not aware of the sequence of the tests.

The side of the room directed at the cell phone base station was shielded against radiation, except for a small part which could be (un)shielded easily. In the first phase, the radiation density near the head was 26 mikroWatt/m2, in the second phase 3327 mikroWatt/m2 and in the third phase 26 mikroWatt/m2 again. Several other environmental parameters were measured to be sure they could not influence the results, such as radiation by television and FM-radio, noise, CO2, temperature, relative humidity, low frequency magnetic fields and soherics (electrical discharges in the atmosphere, possibly causing radiation).

During the second phase the parameters of all the brainwaves, measured by EEG, changed significantly. Afterwards the testees were asked to describe their experiences. All of them felt unwell during the second phase. They reported symptoms like buzzing in the head, palpitations of the heart, unwellness, lightheadedness, anxiety, breathlessness, respiratory problems, nervousness, agitation, headache, tinnitus, heat sensation and depression.

According to the scientists, this is the first worldwide proof of significant changes of the electrical currents in the brain by a cell phone base station at a distance of 80 metres. It has been scientifically established before that the radiation of cell phone base stations leads to unwellness and health complaints.

Cell phone base stations are not the only source of radiofrequent radiation. Also UMTS-videophones, DECT-telephones, WLAN- and WIFI-networks, C2000/TETRA-networks and many other digital wireless communication systems contribute to the level of radiation. In many houses and offices the densities by DECT and WLAN are higher than those by cell phone base stations.

The scientists involved were dr. med. Gerd Oberfeld (Land Salzburg, dept. of environmental medicin), dr. Hannes Schimke (Salzburg University, EEG-measurements, psychofysiology, statistics) and univ. prof. dr. Günther Bernatzky (Salzburg University, neurodynamics and neurosignalling). The research was supported by dr. med. univ. Gernot Luthringshausen (permanent member of the ethical commission of Land Salzburg, neurology and psychiatry).

Nach der Auffassung der Staatsanwaltschaft Konstanz dürfen Handynutzer ab sofort ihr Mobiltelefon weder ans Ohr halten noch dabei anfassen, da die Geräte damit ihre Zulassung verlieren. Durch das Berühren selbst des isolierten Gehäuses soll es sich um ein invasives Medizinprodukt mit therapeutischer Wirkung handeln.

Der Strafbefehl richtet sich keineswegs gegen die offiziell festgelegten Grenzwerte für elektromagnetische Wellen. Er betrifft vielmehr die biologische Wirkung der von jedem Mobilfunksender ebenfalls abgestrahlten, aber bisher unbeachtet gebliebenen Störstrahlung. Diese ist mit den Antennenverlusten bzw. mit dem Antennenrauschen gleichzusetzen.

Gehen wir bei einem Mobiltelefon z.B. von einem unbefriedigenden Antennenwirkungsgrad von 60 % aus, dann strahlt dieses neben der Nutzwelle noch zu 40% eine breitbandige Störstrahlung ab, die überwiegend aus dem bekannten Antennenrauschen besteht. Dieses wird weder gemessen, noch sind Grenzwerte fixiert. Der menschliche Körper strahlt seinerseits ein erhebliches Rauschsignal ab, mit dem sich z.B. der Empfang schwacher Rundfunksender verhindern lässt, wie jeder selber mit einem Kofferradio ausprobieren kann.

Es ist also naheliegend, dass von dem Antennenrauschen eine biologische Wirkung ausgeht, und eben nicht von der elektromagnetischen Welle. Dafür sind zwei stichhaltige Argumente vorhanden:

1. Nur Rauschsignale können mit Rauschsignalen wechselwirken. Für jede biologische Wirksamkeit ist die Wechselwirkung notwendige Voraussetzung.

2. Für Wechselwirkung oder Empfang elektromagnetischer Wellen fehlen dem Menschen die erforderlichen Antennenstrukturen.

Kommen wir zu dem Schluss, dass die Diskussion um Grenzwerte ins Leere läuft, solange ausnahmslos nur die elektromagnetischern Wellen in Betracht gezogen werden. Was dagegen fehlt ist eine wissenschaftliche Erforschung der Störstrahlung und des Antennenrauschens. Die Diskussion um die Grenzwerte der elektromagnetischen Wellen ist daher nur geeignet, die Bevölkerung und die Wirtschaft gleichermaßen hinters Licht zu führen.

Noch vor vier Jahren ist der vom Vertreter der Regulierungsbehörde (RegTP) in der Strahlenschutzkommission eingebrachte Vorschlag, die Störstrahlung nach der Empfehlung von Prof. Meyl zu erforschen, von einer Mehrheit abgewiesen worden. Mehr noch, die Forschung der Störstrahlung wurde in der Folgezeit auf vielfältige Weise behindert. So traten ungefragt selbsternannte Fachleute mit der Extremposition in Erscheinung, dass es nur elektromagnetische Wellen gäbe und nur diese allein in Betracht zu ziehen sind. Man weiß eben nicht, was man nicht weiß, sonst wüsste man es.

Der Strafbefehl gegen ein von Prof. Meyl entwickeltes Nachweisgerät hat jedoch die Situation gründlich geändert, unabhängig davon, wie das Verfahren ausgehen wird. Mit der Anerkennung der medizinischen Wirksamkeit durch die deutsche Justiz ist die von Mobiltelefonen abgestrahlte Störstrahlung zu einem Thema mit großem öffentlichen Interesse geworden.

In Anbetracht der systematischen Unterdrückung des so bedeutungsvollen wissenschaftlichen Anliegens einerseits und der hohen Summen verschwendeter Steuergelder zur wissentlichen Erforschung der falschen Strahlung andererseits wird eine Entschuldigung der für die Volksgesundheit Verantwortung Tragenden nicht ausreichen. Hier sind ganze Kommissionen und Ämter neu zu besetzen. Es müssen Wissenschaftler, Politiker und Amtsträger zum Zuge kommen, die ihrer Aufgabe auch gewachsen sind und die sich der Wahrheit verpflichtet fühlen. Die Wahrheit ist dem Menschen zumutbar (Kurt Schumacher) und die Menschen haben ein Recht, sie zu erfahren, und das besonders dann, wenn es um ihre Gesundheit geht.

Worum geht es?

II. Teil: Zeitungsbericht (für Fachzeitschriften).

Gegen den Hersteller eines Skalarwellengerätes hat das Amtsgericht Villingen-Schwenningen einen Strafbefehl erlassen, nachdem die Staatsanwaltschaft Konstanz das Gerät eigenmächtig als invasives medizinisches Therapiegerät eingestuft hat. Richtig ist jedenfalls, dass dieses Gerät laut Beschreibung des Herstellers technischen, physikalischen und biologischen Experimenten dient und für diese Nutzung auch CE-Zeichen und Prüfbericht erteilt wurden.

Das Gerät hat eine Sendeleistung von ca. 50 mW, ein Handy im Vergleich dazu 3000 mW! Als Folge wäre eine 60 mal höhere medizinische Wirkung zu erwarten, wobei ein Handy selbstredend für therapeutische Zwecke genauso wenig zugelassen ist, wie das Skalarwellengerät.

Was verbindet ein Handy mit dem Skalarwellengerät, das u.a. zur Erforschung biologischer Wirkungen der Mobilfunktechnik entwickelt worden ist? Jedem Fachmann ist bekannt:

1. dass sich beim mobilen Telefonieren der Kopf zwangsläufig im sog. Nahfeldbereich der Sendeantenne befindet. Ihm sind die longitudinalen Wellenanteile bekannt, die im Nahbereich auftreten, die in Transpondersystemen (RFID) der Energieübertragung dienen und in der Fachliteratur auch als Stehwelle oder als Skalarwelle bezeichnet werden.

2. dass in der Biologie z.B. bei der Zellkommunikation oder bei der Nervenleitung (Ranviersche Schnürringe an den Punkten der Wellenknoten einer Stehwelle) starke Hinweise für eine Verwendung von Skalarwellen in höher entwickelten Organismen vorhanden sind.

Wird der eine bekannte Zusammenhang mit dem anderen in Verbindung gebracht, ist bei der Skalarwellenstrahlung und nur bei dieser eine biologische Relevanz zu erwarten. Zur wissenschaftlichen Erforschung der Eigenschaften und Wirkungen ist eine entsprechende Apparatur erforderlich. Prof. Meyl hat dazu einen Schwingkreis mit offener Kondensatorstrecke aufgebaut. Zwischen beiden kugelförmigen Elektroden spannt sich dabei ein longitudinal, von Kugel zu Kugel ausgerichtetes elektrisches Wellenfeld. Diese Anordnung hat sich bereits hunderte mal bewährt.

Da in der Wissenschaft stets eine Reproduzierbarkeit verlangt, hat Prof. Meyl das Skalarwellengerät zur Vermarktung an eine Firma gegeben. Im Experiment zeigen die Skalarwellen ungewohnte Eigenschaften. Sie sind mehrdimensional modulierbar, in keiner Weise an die Lichtgeschwindigkeit gebunden, kaum abschirmbar, verlieren mit dem Abstand nicht an Energie und sind anscheinend auch biologisch relevant. Für den schnellen Staatsanwalt ist das jedenfalls schon beschlossene Sache!

Der Nachrichtensender N24 hat auf die aktuelle Meldung hin einen Vertreter der Mobilfunkindustrie zu Wort kommen lassen, der auf die Einhaltung der vorgeschriebenen Grenzwerte hingewiesen hat. Doch diese beziehen sich nur auf die abgestrahlten elektromagnetischen (transversalen) Wellenanteile, nicht auf die (longitudinalen) Skalarwellenanteile. Um letztere aber war es in der Sendung gegangen. War das kein Fachmann, oder hat er bewusst die Fernsehteilnehmer täuschen sollen? Er hat reflexhaft oder wissentlich zu dem transversalen und damit zum falschen Wellenanteil Stellung bezogen. Vertreter der Funktechnik sollte bekannt sein, dass für den Empfang von Rundfunkwellen Antennenstrukturen notwendig sind, die beim Menschen gänzlich fehlen!

Wir fordern schon seit 10 Jahren, eine wissenschaftliche Erforschung des longitudinalen Wellenanteils. Das muss keineswegs ein Abschaffen des Mobilfunks bedeuten. Die Fokussierung auf den wesentlichen Wellenanteil hätte lediglich eine Optimierung der Handys in Hinblick auf eine Minimierung der biologisch relevanten Störstrahlung zur Konsequenz.

So sollte beispielsweise ein D-Netz-Handy zur Optimierung des Antennenwirkungsgrades, d.h. zur Maximierung der transversalen Nutzwelle bei gleichzeitiger Minimierung der longitudinalen Störstrahlung eine Antenne mit 16 cm Länge haben. Welches Handy arbeitet heute noch mit einer angepassten Antenne? Wäre es nicht wichtiger, der Gesundheit des Nutzers bei der Geräteentwicklung mehr Gewicht zu geben, als der Miniaturisierung?

Die Mobilfunkindustrie wird sich kaum gegen eine Weiterentwicklung und Verbesserung der Technik sperren, schließlich verdient sie mit jeder Neuerung neues Geld. Und davon hat sie jede Menge, nachdem kein anderer Wirtschaftszweig umsatzbezogen so wenig in die Forschung investiert wie sie. Für Forschung erklärt sie sich kurzerhand für nicht zuständig und verweist gebetsmühlenartig auf Ämter, Forschungsministerien und Universitäten.

Wenn sich diese aus der Verantwortung stehlen wollen und kurzerhand die Existenz von Skalarwellen ableugnen, dann fühlt man sich ins finstere Mittelalter versetzt, als Galilei die offiziellen Kirchenvertreter aufforderte, durch sein Fernglas zu sehen und diese sich weigerten, auch nur hin zuschauen. Es könnte ja sein, dass man mit dem Skalarwellengerät etwas zu Gesicht bekommt, was ein Umdenken erzwingt. Ist es da nicht bequemer, mit Geistheilern und anderen Scharlatanen den Wissenschaftler zu überführen und die Inquisition wieder einzuführen?

Ein Villinger Strafbefehl mit republikweiter Aufmerksamkeit

Weil ein Amtsrichter gegen einen FH-Professor vorgeht, verschreckt der Wissenschaftler publicityträchtig Handy-Konzerne und Fachjournalisten

Für eine nicht kleine Fangemeinde gilt er als Genie unter den Furtwanger Wissenschaftlern: der Villinger Fachhochschul-Professor Konstantin Meyl. Bewunderer nennen ihn den Kopernikus des Schwarzwalds, seine Gegner gehen aber mit seiner Skalarwellen-Theorie hart ins Gericht. Während in der Wissenschaftsgemeinde der Streit tobt, ist der smarte Professor immer für eine Überraschung gut. Den letzten Coup landete er mit einer Pressemitteilung, die Mobilfunkbetreiber und Journalisten republikweit in Aufruhr versetzte und dem für Pressesachen zuständigen Villinger Richter und dem Oberstaatsanwalt eine Unmenge an Anfragen von Handykonzernen, von Computer-Bild bis hin zum Nachrichtensender N 24 bescherte.

Die Geschichte begann mit Drall - mit einer Anzeige gegen Meyl. Der in Villingen lebende Professor machte sich nicht nur einen Namen wegen seiner umstrittenen Skalarwellen-Theorie, die Dekan und Prodekan seines Furtwanger Fachbereichs "Computer & Electrical Engineering" in wesentlichen Teilen "als reine Spekulation" bewerten, wie es auf der FH-Homepage heißt. Meyl lässt auch Geräte bauen, die auf dieser Theorie beruhen sollen. Der Kern seiner These: Physikalische Wellen lassen sich verlustfrei übertragen und sammeln dabei Raumenergie ein. Faszinierend finden den Gedanken viele, und so hat er unter Wissenschaftlern nicht nur Kritiker, sondern auch Anhänger. Einer von ihnen, ein Mediziner, testete eines dieser Experimentier-Geräte.

Zunächst ging es dem Probanden gut, rekapitulierte Rainer Horn, Richter am Amtsgericht und zuständig für die Pressearbeit. Dann aber verschlechterte sich der Zustand des Mannes. Die Folge: Er erstattete Anzeige gegen Meyl. Der Fall landete auf dem Schreibtisch des Villinger Richters Schleusener. Der entschied gegen Meyl und erließ einen Strafbefehl von 40 Tagessätzen, wie Oberstaatsanwalt Jens Gruhl bestätigte.

Ausschlaggebend dafür war, dass der FH-Professor den Eindruck erweckte, das Skalarwellengerät könne auch für medizinische und therapeutische Zwecke eingesetzt werden, umschreibt Horn den juristischen Knackpunkt. In Teilen hatte das Gerät eine Prüfzulassung, nicht aber als ganzes. Das allein war für den Richter ausschlaggebend: Ob das Gerät strahlt oder Wellen aussendet, "was es macht", war für Gericht und Staatsanwalt "irrelevant", so Gruhl.

Soweit die Staatsanwaltschaft: Gar nicht irrelevant war es dagegen für den FH-Dozenten Meyl. Er legte nicht nur gegen den Strafbefehl Einspruch ein, über den bis gestern noch nicht entschieden war, sondern formulierte im Umkehrschluss auch eine Pressemitteilung, die es in sich hatte. Unter dem Titel "Handys verlieren CE-Zulassung - Mobiltelefone darf man nicht anfassen", hieß es dort unter anderem: "Nach der Auffassung der Staatsanwaltschaft Konstanz dürfen Handynutzer ab sofort ihr Mobiltelefon weder ans Ohr halten noch dabei anfassen, da die Geräte damit ihre Zulassung verlieren. Durch das Berühren selbst des isolierten Gehäuses soll es sich um ein Medizinprodukt mit therapeutischer Wirkung handeln." Der Strafbefehl richte sich keineswegs gegen die Grenzwerte für elektromagnetische Wellen. Er betreffe die biologische Wirkung der von jedem Mobilfunksender abgestrahlten, aber bisher unbeachtet gebliebenen Störstrahlung, so Meyl weiter.

Solche Sätze treffen einen Nerv und elektrisierten die Fachleute der Mobilfunkkonzerne und Journalisten. Computer-Bild, Vodafone und der Konzern "O2" meldeten sich bei der Staatsanwaltschaft und beim Amtsgericht. Die Vermutung der Experten: Sorgt ein Strafbefehl des kleinen Amtsgerichts dafür, dass Handys verboten werden müssen, weil die Nutzung der Mobiltelefone den Straftatbestand der Körperverletzung erfülle, schilderte Horn eine der typischen Spekulationen. Der Richter konnte Entwarnung geben. Auch ob der Betrieb eines Handys strafbar sei, wurde insistiert, es war "ein Aufruhr einen ganzen Vormittag lang", resümierte Horn.

Und er könnte eine Fortsetzung finden: denn wird dem Einspruch stattgegeben, kommt es zu einer Verhandlung - mit sicherlich breiter medialer Aufmerksamkeit. Denn der Herr Meyl, der betreibe eine "pointierte Pressearbeit", meinte kurz angebunden Oberstaatsanwalt Gruhl. (gha)

Handys darf man nicht anfassen

Zu dem Bericht im Südkurier vom Mittwoch ist nachzutragen, dass der einzige und Hauptbelastungszeuge der Staatsanwaltschaft, der das Skalarwellengerät von Prof. Meyl getestet haben will, gar kein Mediziner ist. Es handelt sich vielmehr um den Geistheiler B., der im Südschwarzwald sein Unwesen treibt.

Sein Gesundheitszustand ist auch von keinem Arzt überprüft worden, weshalb sich der Staatsanwalt bei seiner Aussage allein auf die unzuverlässige Selbstbeobachtung des Geistheilers verlassen hat. Zudem hat die Staatsanwaltschaft über diesen Fall bereits entschieden: Die Anzeige war abgewiesen und dem fragwürdigen Zeugen der Besuch eines niedergelassenen Arztes empfohlen worden.

In der Sache selber ist richtig zu stellen, dass die Wellen natürlich keine Energie einsammeln. Die in Kreisen der Wissenschaft seit 100 Jahren u.a. von Nobelpreisträgern diskutierten Skalarwellen, für deren Erforschung Prof. Meyl an der FH-Furtwangen ein Nachweisgerät entwickelt hat, stehen vielmehr im Verdacht für den Elektrosmog verantwortlich zu sein. Mit seiner Forderung nach wissenschaftlicher Erforschung kann sich Meyl der Unterstützung weiter Kreise der Bevölkerung sicher sein. Ganz anders die Staatsanwaltschaft, die in dem zugelassenen Experimentiergerät ein medizinisches Therapiegerät gesehen haben will und gleichzeitig vor den abgestrahlten Wellen die Augen verschließt. Da bleibt Raum für Spekulationen. Hat das Gerät eine homöopathische oder am Ende gar keine Wirkung? Kann von einer Welle auch dann eine invasive medizinische Wirkung ausgehen, wenn sie gar nicht existiert? Das soll verstehen wer will.

Unterm Strich könnte die Einflussnahme der Staatsanwaltschaft in laufende Forschungsarbeiten als Verstoß gegen das im Grundgesetz verankerte Recht auf Freiheit von Forschung und Lehre gewertet werden, womit sich der Vorgang noch zu einem Justizskandal ausweiten könnte. In diesem Fall werden sicher andere Zeugen über ihre wissenschaftlichen Ergebnisse referieren, als der zweifelhafte Geistheiler mit seinem misslungenen Selbstversuch.

An independent medical expert has found radiation readings taken near power lines in an Auckland suburb at the centre of a cancer cluster scare are 10 times higher than the levels accepted elsewhere in the world.

Dr Robin Smart has studied the relationship between high voltage lines and health and found evidence of exceedingly high radiation levels in the West Auckland suburb of Massey.

While some overseas countries have dropped the suggested level of electo-magnetic field (EMF) radiation to 0.1 microtesla, New Zealand's limit - set by the Ministry of Health - is 10,000 times higher at 100 microtesla.

Dr Smart, who conducted tests yesterday in the area with an EMF reader, found on the playing field of Lincoln Heights School the reading reached 1.0 microtesla - 10 times the accepted limit in other countries.

Two children from the same family in a nearby street, who are both pupils at the school, have leukaemia. Their mother has recently suffered two miscarriages.

One metre from the edge of the school field - directly under a high voltage powerline - the EMF rating jumped to 1.5 microtesla.

At the former home of Cameron Duncan, the young Kiwi film-maker who died last year from cancer, an EMF reading in the lounge was recorded at 1.4 microtesla. Dr Smart said he was shocked at the readings.

He said there was very good evidence to show that at 0.4 of a microtesla you would be looking at increased rates of childhood leukaemia.

Cameron's mother, Sharon Duncan, who has moved from the house, said she wants the matter taken seriously.

"I have always been suspicious of the power lines over the house and I am not surprised at the high reading," Mrs Duncan said.

Last year it was revealed Cameron and two friends - Charles Hetaraka and Jeffrey Thumath - were diagnosed with cancer within two months of each other.

Charles and Cameron both died in 2003, at age 17. Jeffrey is still fighting the disease.

Since then, dozens more people have come forward with their stories of cancer and other health problems.

National Radiation Laboratory scientists in Christchurch said residents living in areas with high voltage pylons had nothing to fear.

NRL scientist Martin Gledhill said there was no research finding a link between cancer and power pylons.

The Cell Phone Industry: Big Tobacco 2.0?

So, there's this incredibly popular product that has widespread consumer use and a massive marketing presence. Nearly everyone uses it, and it has very high social acceptance, even though some people find it annoying when it's used in public. It's highly habit-forming; people who use the product on a regular basis find it almost impossible to live without.

Unfortunately, studies start to appear showing that the product might be harmful to its users--even cancer-causing. The product's manufacturers deny the presence of any danger and even spend millions of dollars trying to discredit the research that points to problems. Then, an insider emerges, seemingly with proof that the product could be dangerous. The industry agrees to publish warning data about the product, but continues to maintain that the product itself is safe for use.

Lawsuits against the product's manufacturers are filed, but all are dismissed. Industry analysts know that any case that does succeed could start a domino effect of future lawsuits, which keeps the industry determined to maintain that the product is harmless, despite increasing evidence to the contrary.

Sound familiar? Well, put down your lighter, I'm talking about cell phones. I've already maintained that I don't like the cell phone industry's iron-clad control over phone releases and pricing, its ever-lengthening contracts, and the annoying habit it has of crippling Bluetooth phones so that I can't use them the way I want to. But it takes only a few minutes of looking into the cell phone radiation quagmire before I start to think, man, these guys have Big Tobacco 2.0 written all over them. Actually, I'm not the first to think of it, but a recent article in the University of Washington alumni magazine indicates that the behaviors aren't going away, even as the potentially damning research continues to mount.

OK, I know the obvious differences: I'm sure cell phone manufacturers are not deliberately making their products more addictive, for example--although they are, of course, always offering new and improved services and ever-increasing buckets of minutes, which can't help but encourage us to use our phones more and more frequently. But, just as Big Tobacco did, the cell phone industry seems bound and determined to thwart and deny any suggestion that its product might be dangerous.

A history of bad news For example, in 1994, University of Washington bioengineering professors Henry Lai and Narendra Singh found that the DNA in rats' brains was damaged after two hours of exposure to levels of microwave radiation considered safe by the government. When Lai and Singh published the research, a leaked memo from Motorola's head of global strategy, Norm Sandler, talked about ways to minimize damage by undermining their research, with Sandler writing, "I think that we have sufficiently war-gamed the Lai/Singh issue." Ouch. Worse, research biologist Jerry Phillips, who was paid by Motorola to conduct similar testing, says he was able to duplicate Lai and Singh's findings, but was then asked not to publish the research and was subsequently shunned by the company. Motorola says it told Phillips that his findings needed clarification, and the industry still maintains that Lai and Singh's results have never been duplicated and can't be considered legitimate.

The biggest Russell Crowe-style insider in this case, though, is Dr. George Carlo, who was hired by the Cellular Telecommunications & Internet Association to head up a $28 million research program into possible health effects from cellular phones. Unfortunately, he now says his findings show an increased rate of brain cancer deaths, development of tumors, and genetic damage among heavy cell phone users. He wrote this letter of concern to the president of AT&T Corporation and later went public with his findings after what he considered to be neglect by the industry. He's since broken with the industry, become a vocal critic, and coauthored a book called Cell Phones: Invisible Hazards in the Wireless Age--so you can tell he's on the "cell phones could cause cancer" side of things.

Meanwhile, more studies keep coming, and they seem to be getting worse. A study funded by the European Union reported last December that radio waves from mobile phones do, definitively, damage DNA and other cells in the body--and that the damage extended to the next generation of cells. Even though mutated cells are considered a possible cause of cancer, the UK National Radiological Protection Board said that since the study didn't show that the damage definitely led to disease, consumers shouldn't worry too much about the findings.

Uh, right. In the meantime, the report recommended that children use mobile phones only in emergency situations. You know, just in case. How reassuring.

The cell phone industry hasn't commissioned another large-scale study--at least not publicly--since its fateful encounter with Dr. Carlo--and why would they? They're in a catch-22. It's a multibillion dollar industry, and they simply can't afford to find out, definitively, that cell phones are dangerous.

Worse, just like the tobacco companies, if they start issuing warnings and precautionary tales now, it'll look like they knew all along that the radio waves were dangerous, opening them up to major liability claims. They've already dodged one big, big bullet--an $800 million lawsuit against Motorola and cell phone carriers was thrown out in 2002, with the judge ruling that there wasn't sufficient evidence for trial. Since then, neurologist Dr. Christopher Newman, who filed the lawsuit, has died of brain cancer.

Listen, I use a cell phone, and I'm not trying to scare the bejesus out of everyone. But I do use a headset when I'm talking for any long period of time, and I carry that sucker in my purse, not my pocket. (I know you guys don't have that luxury, but reconsider the briefcase, OK?) And if you're shopping for a new phone, you might want to check our cell phone radiation chart to see which ones carry a low dose.

In a few more years, we'll either know for sure that cell phones can cause cancer, or we'll know they can't. I just hope we don't find out the hard way--through subpoenaed documents from cell phone makers and carriers who've been trying to minimize their damages and maximize their profits for more than a decade.

Cancer Kills 7 in Tower of Terror

Residents' fear over radio masts on roof

A block of flats bristling with mobile phone and radio masts has been branded the Tower of Terror after a grim series of cancer deaths.

Seven residents have died from the disease in the last 18 months alone, with four receiving treatment for related illnesses. Four others have suffered strokes.

Now panic stricken neighbors are desperate to have the masts removed amid fears the emissions are death rays.

Residents' Association chairman, Bill Marrow, 65, who was recently fitted with a pacemaker, said: "Every time I get a headache these days I'm worried I could be the next person to be struck down. The whole block is extremely concerned. We're all asking who is going to be next?"

Vodaphone and Orange have base stations on top of Liscard House -the block housing 86 flats in Wallasey, Merseyside - and there is also a radio mast for the emergency services.

Health chiefs have launched an investigation and offered residents urgent medical checks. Reg Blackmore, 77, is currently nursing his wife Monica back to health after she too fell victim to the cancer curse. He said, "We love it here. It's been a fantastic place to retire to but we are so worried that our health is suffering with each passing day."

Campaigner Bill accepts there is no scientific proof linking radio masts to cancer; but said: "I fear that one day someone will come along and tell us we were right about this. Until then, it is better to be safe than sorry. We're determined to get these masts removed. We know there is no concrete proof these masts are causing the cancers but it is not fair to have the worry over our heads."

Birkenhead and Wallasey Primary Care Trust confirmed health checks were on offer and they would meet residents' requests for data on cancer rates which they can cross reference with those in their building.

Orange said that it had agreed to co-operate during the probe. A spokesman added: "Radiation coming from our masts is well below the guidelines. But we will do everything possible to allay the residents concern."

PHILLIP DAY'S COMMENT: Here is another burgeoning industry racing ahead without fear of the consequences. I have a much better idea for mobile phones. We should switch the things OFF altogether and get a life. Aside from the radiation, consider that mobiles ringing a dozen times a day increase stress levels by making a spontaneous demand on your time. Friends will be able to contact you if you don't have one; we sometimes forget there was life before Nokia and 'Moto' and that ghastly 'frog' I wish someone would drop into a blender.

Am I seriously suggesting ditching the mobile? Yes! Do I use one? Not for a while now. As for the baleful 3G concept of sending pictures of stuck-out tongues to teenage buddies, resulting in a whole new generation of masts bristling along the ridge, 'nuff said. Keep one in the glove box if you must (a phone not a tongue), to ring in traffic accidents like a good citizen, and then switch the darned thing off and stuff it back in the dark. Email's a serious enough demand, isn't it? If anyone should be using a mobile phone all over the world, it's me! And I don't! And there's peace!


Mobile Phone Risks 'Rise in Rural Areas'

Mobile phones are at the centre of a new health scare after scientists found that users in rural areas may be at higher risk of brain cancer.

Research shows that the chance of developing a malignant brain tumour could be eight times higher in the countryside compared with towns.

And the risk of developing any brain tumour rises fourfold for country-dwellers using mobile phones for five years or more, says a study published today. It is thought the extra risk may be triggered by the higher power output levels from phones used in rural areas.

Base stations tend to be farther apart outside towns which means the phone needs to generate higher radiowave intensity to compensate for the poor signal.

This could result in higher exposure to radiation emissions. Experts say there are no proven health risks to using mobile phones, but they are such a new phenomenon that problems could still emerge. There are 60 million mobile users in Britain - up from 9 million in 1998 - with around one quarter aged under 18.

In the latest study from Sweden, researchers looked at more than 1,400 adults aged 20 to 80 who had been diagnosed with a malignant or benign brain tumour between 1997 and 2000.

The brain cancer patients were compared with a similar number of healthy adults living in the same area. Each group was asked to record their daily use of mobile and cordless phones, according to a report in the journal of Occupational and Environmental Medicine.

The researchers at University Hospital in Orebro found there was a higher risk of all types of tumours for people living in rural areas - defined as less than 90,000 inhabitants - compared with towns.

People living in a rural area who had been using a digital mobile phone for more than three years were over three times more likely to be diagnosed with a brain tumour than those living in urban areas.

There was a fourfold higher risk for those using a digital mobile phone for five or more years in the countryside compared with the towns.

An eightfold increase in malignant brain tumours was found in country dwellers compared to those in towns.

Researchers said the length of time spent on the phone had little impact on the chances of being diagnosed with a brain tumour.

Professor Lennart Hardell, who led the research, said the findings should be treated with caution because the actual number of brain tumours in areas classified as rural was very small. "Clearly our results support the notion that exposure may differ between geographical areas," he added.

"But there is no information on the exact difference between geographical areas."

There are 45,000 base stations fitted with antennae or 'masts' situated 200m to 500m apart in towns and up to 5 km apart in rural areas of the UK.

Alasdair Philips, director of the mobile phone emission pressure group Powerwatch, said: "It would be sensible for those in areas with a poor signal to limit their calls."

Mike Dolan, executive director of the Mobile Phone Operators Association, said: "All mobile handsets in the UK comply with international health and safety guidelines which apply whether the phones are used in rural or urban areas. After fourteen years of in our efforts to advance stranded solutions to a major problem facing humanity it just boggles the mind to see media so readily granting the hydrocarbon confusionists a place of legitimacy on the world's public opinion stage.

With some 10 degrees warning (Freudian slip) the Arctic is the proverbial coal mine for Climate Change, and I'm here to report figuratively dead canaries littering the landscape up there by the thousands.

I urge everyone to read two very readable papers on climate change. The first tells about how the scientists themselves struggled when faced with the inescapable conclusions from the ice core data, went from a place of total disbelief to a reluctant acceptance that indeed small changes in model inputs conclusively resulted in dramatic changes (ice ages are triggered by North Atlantic Thermoline shifts).

The second paper is a good climate change summary.

There is no further debate. The climate change data set is unquestionably conclusive as the tiny air bubbles locked in the ice cores served as time locked trace gas atmospheric samples for our spectroscopy analysis. This data permitted us to reconstruct a complete climate history showing in great detail what we had for an atmosphere on this planet. Further, oxygen isotope analysis from the ice cores completed an incredibly detailed picture to provide even minute seasonal temperatures changes going back some 420,000 years.

What is there left to debate? This nonsense is the same charade as our good doctor in a white lab coat claiming that tobacco is good for you. That went on for years before the public caught on that was only the special interests making unseemly profits at the expense of an unsuspecting public.

With similar motives today the special interests in the energy sector have effectively muted the climate change urgency now to where the transition is going to be inescapably difficult.

Global warming has been hidden in ocean warming and the public will
eventually come to appreciate that while all this was all going on early inventors like Viktor Schauberger, Nicola Tesla, Barry Davis and others had invented scalable energy solutions that could have prevented or mitigated our ecology degradation. The sad truth is this mess did not have to occur and that the Florida Gulf Current is likely to shut down in the not too distant future and along with it the loss of the food carrying capacity for Europe's 450 million people.

The domino effects do not stop there, yes it gets much worse and none of us will be able to escape the climate change consequences.

The planet has long enjoyed the beneficial cooling mirror effect from the vast expanse of the polar ice cap with its high refractive index. The Russians and the US Trident Submarine program played cold war cat and mouse war games under the ice cap and continuously pinged the ice cap thickness to assess surface launch conditions. This date set is a complete data set as well and in forty short years we have seen a 50 % thinning of the polar ice cap which serves as the planet's fragile cooling mirror.

Rudimentary thermal dynamic tells us that the first mass loss is the slowest mass loss and that the next remaining 50% thickness will be gone in less than 15 years. Scary enough for you yet. It gets worse, much worse.

Underneath the polar ice cap lie trillions of tons of frozen tundra (METHANE is 20 times the greenhouse gas effect that carbon is!!!). Inert while frozen but when this stuff starts to melt and gasify, it will further exacerbate our Thermagedon.

Hollywood is to be commended for doing a great public service and dramatizing the urgent climate change issue. This movie alone will do what the urgent warnings from 50,000 of the world's senior scientists was not able to do when they said that we have unwittingly set our selves on a perilous course.
