Death sentences reached modern-day low in 2004

The number of people sentenced to death last year fell to the lowest level since the Supreme Court reinstated the penalty in 1976. There were 125 people sent to death row in 2004, down from 144 the previous year and the sixth consecutive annual decline, according to figures compiled by the NAACP Legal Defense Fund. Nonetheless, Connecticut prepares for first execution in more than 40 years

The state of Connecticut is preparing for what would be the first execution in Connecticut since 1960. Michael Ross, who suffers from documented mental illness and is dropping his appeals and asking to be executed, is scheduled to be put to death May 13. In response, activists are traveling to Connecticut from across the United States to participate in a fast and vigil in protest of the execution. Lawyer and Professor David Dow, who directs the Texas Innocence Network, has penned a highly recommended new book entitled Executed on a Technicality: Lethal Injustice on America's Death Row. Here's a brief description:

"LobbyControl": Neue Initiative will über Machtstrukturen und Lobbygruppen aufklären (04.05.05)

Seit Montag möchte eine neue Initiative im Internet für mehr Transparenz und Demokratie sorgen. "LobbyControl" beschreibt sich als zivilgesellschaftliche Initiative, "die über Einflussnahme auf Politik und Öffentlichkeit und über gesellschaftliche Machtstrukturen informieren will". Ausgangspunkt sei "die Analyse, dass Unternehmen, Wirtschaftsverbände und neoliberale Denkfabriken und Eliten immer stärkeren Einfluss auf Politik und Öffentlichkeit nehmen". Ab und zu würden einzelne Affären wie die Nebeneinkünfte von Abgeordneten "Schlaglichter in die Grauzonen politischer Einflussnahme" werfen, schreiben die Kritiker. Aber es gebe zu wenig kontinuierliche und systematische Aufklärung.

Vielsagende Andeutungen?: Journalistenverband thematisiert Einschränkung der Pressefreiheit in Deutschland (04.05.05)

"Auch hierzulande, wo Journalisten nicht unmittelbar in Gefahr sind, ist die Presse nicht frei." Dies schreibt die "Journalistinnen- und Journalisten-Union" (dju) anlässlich des Tages der Pressefreiheit. Wie frei und offen können Journalisten überhaupt über die Beschränkung der Pressefreiheit oder über die Einschränkung der Arbeit von Journalisten schreiben, wenn sie feststellen, dass auch hierzulande die Presse nicht frei ist? Der Journalistenverband löst das Problem, indem er auf die Rechte der Medien verweist und sich hinsichtlich der Arbeitsbedingungen von Journalisten in Andeutungen ergeht. Genau genommen, beschreibt der Verband eher die Beschränkung der Freiheiten der Journalistinnen und Journalisten und weniger die der Medienkonzerne.

Pestizid-Rückstände im Essen haben wir schon lange satt. Und wer sich ein bisschen mit der Thematik auseinandersetzt, weiß: Die Belastungen im Obst und Gemüse steigen weiter an. Wirklich empfehlenswert sind nur Bio-Produkte. Der Anteil von Bio-Produkten am Markt wächst, macht jedoch insgesamt nach wie vor einen kleinen Teil aus. Jährlich werden in Deutschland rund 30 000 Tonnen Pestizide auf die Äcker gebracht.

Die EU-Kommission will nun den Einsatz von Pestiziden neu regeln. Dazu gibt es eine Umfrage im Internet, an der alle Betroffenen teilnehmen können. Die Ergebnisse der Umfrage fließen in die neue Strategie zur nachhaltigen Nutzung von Pestiziden mit ein. Wir sind der Meinung, dass so viele Verbraucher wie möglich an der Umfrage teilnehmen sollten, obwohl der EU-Fragebogen ziemlich kompliziert gehalten ist. Trotzdem sollten wir versuchen, mit solchen Instrumenten die EU-Politik zu beeinflussen. Die Umfrage findet ihr hier:

Unsere Bürgerinitiative hat sich seit dem Jahr 2000 wegen der gesundheitlichen Folgen des Mobilfunks an den Petitionsausschuss des Deutschen Bundestags gewandt:

Am 24.04.00 haben wir unsere erste Petition eingereicht (Pet 3-14-09-275-021869), die unbefriedigend beantwortet wurde am 24.05.00. Am 15.08.00 haben wir deshalb unsere Forderungen konkretisiert und haben dann in schöner Regelmäßigkeit Schreiben bekommen, dass die Angelegenheit noch nicht abgeschlossen ist.

Am 16.03.01 haben wir aufgrund der aktuellen Situation weitere Forderungen nachgereicht, und der Petitionsausschuss hat regelmäßig geschrieben, dass die Prüfung noch nicht abgeschlossen sei. Am 11.10.01 wurde uns mitgeteilt, dass verschiedene Eingaben gemeinsam behandelt werden sollen, und zwar unter Pet 2-14-18-275-021869.

Am 04.03.02 haben wir nochmals unsere Forderungen aktualisiert und erweitert. Diese Erweiterung wurde unter der letzten Nummer integriert.

Am 14.06.02 haben wir darauf hingewiesen, dass wir nun schon zwei Jahre auf eine Entscheidung warten, und als Sofortmaßnahme handyfreie Zonen in öffentlichen Verkehrsmitteln fordern.

Die letzte Meldung des Petitionsausschusses zur Pet 2-14-18-275-021869 stammt vom 15.10.03: "die Ihrer Eingabe zugrunde liegende Problematik konnte leider noch nicht abschließend behandelt werden. Ich werde Ihnen das Ergebnis so bald wie möglich unaufgefordert mitteilen." - Anschließend war Schweigen.

Nachdem wir gesehen haben, dass der Oettinger Bauer Friedrich Stengel ähnliche Erfahrungen machte, habe ich eine Bundestagsabgeordnete eingeschaltet und sie gebeten, aktiv zu werden. Das Ergebnis ihrer Recherche war, dass inzwischen 153 Petitionen zu diesem Thema vorliegen und dass nicht abzusehen ist, wann der Petitionsausschuss das Verfahren abgeschlossen hat. Und erst wenn dies geschehen ist, kann über eine parlamentarische Initiative etwas getan werden! Im Gegensatz zu anderen parlamentarischen Bereichen gibt es für die Beantwortung von Petitionen übrigens keine Fristen.

Damit blockiert der Petitionsausschuss mögliche parlamentarische Initiativen für bessere Gesundheitsvorsorge beim Mobilfunk! Ein Gremium, das nicht handlungsfähig ist und seit nunmehr fünf Jahren das Thema nicht abschließen kann, sollte wenigstens nicht andere Aktivitäten verhindern!

Warum wohl werden diese Petitionen auf gut bayrisch "ausgesessen", bis die Petenten entnervt aufgeben? Für mich ein Lehrstück der bundesdeutschen Demokratie und ihrer Abhängigkeit von Wirtschaftsinteressen!

Bright, but bored and feeling as if he'll be damned if he will spend one more day seated in a classroom listening to another lecture, studying for a quiz, writing a paper, or reading a book that he couldn't care less about. He wants action! Adventure! To see what he is capable of and what his limits are. The mechanics of death don't scare him, they attract him. Ares' bile tastes sweet to his lips. I know these things from experience. So, what the hell do I tell him? That he may have to kill? That he may be captured, injured, or killed? That he could end up having experiences and memories that will haunt and depress him the whole rest of his life? He doesn't believe this is possible in his heart and never will until he discovers for himself what the reality of war is. However, then it will be too late...

We know what role the U.S. government is already playing: they are arresting journalists, treating them as if they were 'insurgents.' Dorrance whines that we are losing 'badly' the 'war for hearts and minds' because Iraqis are watching all this. But so what if they're watching? One might think the wide dissemination of evidence of the insurgents' savagery would likely dispel support for their cause. It seems passing strange that Bremer's main media adviser doesn't get this, but then again the Americans don't seem to get a lot of what's going down in Iraq. No wonder we're losing the battle for hearts and minds. That a former newsman is now openly calling for censorship -- not only of al-Jazeera but also of U.S. news-gathering operations -- is the sort of outrage that passes unnoticed these days, along with so much other dangerous nonsense...

„Handys retten Leben“ aus:

"Nützt oder schadet die mobile Kommunikation?"

Der Nutzen von Handys wird oft übertrieben dargestellt. Manchmal wird sogar behauptet, sie würden im Falle von Unfällen und dergleichen Leben retten. Wie aber sieht die Wirklichkeit aus? Bei einem Unfall ist es das Wichtigste, erste Hilfe zu leisten, den Verletzten richtig zu lagern, Blut zu stillen, Erbrochenes abzusaugen, ihn zu beatmen. Erst dann kommt die Alarmierung der Ambulanz, und es ist egal, ob dies von einem Handy oder einem Festnetzanschluss aus geschieht. Sie kommt deswegen keine Minute früher.

Wieso findet ein Ambulanzfahrer den Patienten nicht, in einem kleinen Dorf, wo jeder fast jeden kennt? Schon beim Anruf kann man sagen, dass die Häuser nicht der Reihe nach nummeriert sind. Jemand stellt sich eventuell an den Strassenrand und weist dem ankommenden Fahrer den Weg. So ging das, als es noch kein Handy gab und auch noch kein Twixroute. Die Autotür zu öffnen, Passanten nach dem Weg zu fragen, an einem Haus zu klingeln oder das Zweiklanghorn einzuschalten, hat man im Handyzeitalter schon verlernt. Man ist schon so handy-geschädigt.

Feuerwehren müssen ein Dispositiv vorlegen und sich per Funk verständigen, ähnlich wie die Polizei. Ein Feuerwehrkommandant, der sich aufs Handy verlässt, handelt grobfahrlässig. Denn zückt jeder, der irgendwo Rauch sieht, egal ob in einem Dorf oder auf der Autobahn, das Handy, kann das Netz zusammenbrechen. Alles schon geschehen. Im Brandfall ist das Handy viel zu wenig sicher. Die Verletzlichkeit der Technik haben wir in den vergangenen Wochen und Monaten schmerzlich und zur Genüge miterlebt!

Nützt oder schadet die mobile Kommunikation?

Mein Handy leistet mir viele wertvolle Dienste; aber ich kann mir vorstellen, dass die Warner vor dem Elektrosmog schon ein wenig Recht haben. Ist der Schaden, den man davontragen kann, wirklich so gross, dass er auch bei sinnvollem Handy-Gebrauch den Nutzen übertrifft? Einer solchen Abwägung bin ich noch nirgends begegnet. Und trifft es wirklich zu, dass Mobilfunkantennen so schädlich sind?

Der Schutz der Gesundheit der Bevölkerung zählt nicht; das ist grotesk, aber wahr. Nicht umsonst wehren sich landauf, landab Zigtausende gegen die aufgezwungene drohende Verstrahlung ihres Lebensraumes. Sie wenden, sofern sie es überhaupt vermögen, erhebliche finanzielle Mittel für Anwalts- und Gerichtskosten auf oder geben, falls das Unheil schon eingetreten ist, Unsummen für Arztkosten und Abschirmungen aus. Eine neu etablierte Industrie macht damit gute Geschäfte. Die Krankenkassenprämien explodieren, werden bald einmal für den Normalbürger unbezahlbar. Da Geld die Welt regiert, sitzt die Industrie stets am längeren Hebelarm. Die Politik lässt die immer grösser werdende Zahl Betroffener schmählich im Stich. Wer heute gegen ein Antennenprojekt einspricht, kommt selten wegen gesundheitlicher Bedenken zu seinem Recht. Chancen hat höchstens Landschafts-, Ortsbild- oder Denkmalschutz.

Prävention, Eigenverantwortung?

Diese wird stets gepredigt. Jeder kann zwar selbst entscheiden, ob er raucht, Alkohol trinkt, ob und wie lange er vor dem PC oder dem Fernseher sitzt, ob er Auto fährt, gesund lebt, Sport treibt usw. Er kann auch das Handy benutzen, wie Sie es tun, oder es sein lassen. Aber die Strahlung einer Antenne, die man ihm vors Haus setzt, muss er völlig unfreiwillig ertragen, ist ihr rund um die Uhr und Jahr für Jahr ausgeliefert.

In der Schweiz, ja europa- und weltweit, leiden Betroffene überall unter den gleichen Gesundheitsbeschwerden, und alle erst seit der Einführung der Mobilfunktechnik. Die Strahlung kann man nicht sehen, hören, riechen oder schmecken. Bekämen die Menschen davon grüne Haare, so mancher würde grosse Augen machen.

„Handys retten Leben“

Der Nutzen von Handys wird oft übertrieben dargestellt. Manchmal wird sogar behauptet, sie würden im Falle von Unfällen und dergleichen Leben retten. Wie aber sieht die Wirklichkeit aus? Bei einem Unfall ist es das Wichtigste, erste Hilfe zu leisten, den Verletzten richtig zu lagern, Blut zu stillen, Erbrochenes abzusaugen, ihn zu beatmen. Erst dann kommt die Alarmierung der Ambulanz, und es ist egal, ob dies von einem Handy oder einem Festnetzanschluss aus geschieht. Sie kommt deswegen keine Minute früher.

Wieso findet ein Ambulanzfahrer den Patienten nicht, in einem kleinen Dorf, wo jeder fast jeden kennt? Schon beim Anruf kann man sagen, dass die Häuser nicht der Reihe nach nummeriert sind. Jemand stellt sich eventuell an den Strassenrand und weist dem ankommenden Fahrer den Weg. So ging das, als es noch kein Handy gab und auch noch kein Twixroute. Die Autotür zu öffnen, Passanten nach dem Weg zu fragen, an einem Haus zu klingeln oder das Zweiklanghorn einzuschalten, hat man im Handyzeitalter schon verlernt. Man ist schon so handy-geschädigt.

Feuerwehren müssen ein Dispositiv vorlegen und sich per Funk verständigen, ähnlich wie die Polizei. Ein Feuerwehrkommandant, der sich aufs Handy verlässt, handelt grobfahrlässig. Denn zückt jeder, der irgendwo Rauch sieht, egal ob in einem Dorf oder auf der Autobahn, das Handy, kann das Netz zusammenbrechen. Alles schon geschehen. Im Brandfall ist das Handy viel zu wenig sicher. Die Verletzlichkeit der Technik haben wir in den vergangenen Wochen und Monaten schmerzlich und zur Genüge miterlebt!

Handys als Spielzeug

Als Spielzeug sind Handys so ungeeignet wie Schnaps als Getränk für Kinder und Jugendliche. Viele Eltern (und Lehrer) wissen immer noch nicht, in welchem Ausmass die Handystrahlung ihre Kinder gefährdet. Ihr Nervensystm ist noch unvollständig ausgebildet, die Hirnschale dünner, und die Strahlung dringt tiefer ein. Die Blut-Hirnschranke öffnet sich und transportiert Eiweissverbindungen und Gifte ins Gehirn, mit allen negativen Folgen (Quelle: Prof. Leif Salford, Lund-Universität). Das weiss man entweder nicht oder will (soll!) es gar nicht wissen.

Kinderleukämie und Hirntumore

Das gehäufte Auftreten von Kinderleukämie und Hirntumoren in Spanien hat zur Abschaltung von über 2000 Antennen geführt; weitere stehen auf der Liste. Anders als bei uns, wo die Bestrahlung des Volkes in einer völlig unzureichenden, ja misslungenen NIS-Verordnung geregelt und diesem von Staates wegen aufgezwungen wird, können in Spanien Bürgermeister, Vorsteher von Provinzregierungen und Richter eine Abschaltung und den Abbruch von Anlagen anordnen. Bei uns machen sich Gemeinderäte für den Bau einer Antenne stark, nicht bedenkend, dass sich die momentanen Vorteile als Bumerang erweisen könnten. Kranke, arbeitsunfähige Menschen zahlen keine Steuern, durch Wertverminderung von Liegenschaften gibt es weitere Steuerausfälle.

Zuerst schiessen, dann zielen!

Industrie und Politik spielen mit dem Ruf nach immer neuen Studien auf Zeitgewinn. Aber die Erfahrungen (siehe oben) sind längst da. DNA-Brüche verursachen Missbildungen von Embryonen und bilden die Vorstufe zu Krebs, das zeigt die von der EU beauftragte REFLEX-Studie. Immer noch keine Ursache für einen Marschhalt und eine Denkpause? Nein, denn es kann nicht sein, was nicht sein darf!

Wäre der Mobilfunk ein Medikament, er wäre längst verboten. Aus den negativen Erfahrungen mit Asbest, FCKW, Contergan etc. hat man nichts gelernt. Zuerst wurde eine Technologie eingeführt, deren Schädlichkeit (vielleicht) erst hinterher untersucht wird, nicht umgekehrt! Es geht ums Geld, nicht um die Volksgesundheit.

Dazu gibt es in der Schweiz 3 unabhängige Netze, zwecks Konkurrenz, die gar nicht stattfindet, da sich die Preise kaum unterscheiden. Würden aus Konkurrenzgründen das Eisenbahnnetz, die Autobahnen, die Wasserversorgung usw. an 3 Lizenznehmer vergeben, hätten wir je 3 Eisenbahn-, Autobahn-, Wasserversorgungsnetze. Wer darüber nachdenkt, greift sich wahrscheinlich ziemlich irritiert an den Kopf!

Die Schweizer Grenzwerte

Oft hört oder liest man, die Schweiz habe die besten Grenzwerte Europas. Das ist eine der grössten Schummeleien, die dem Volk je präsentiert wurden. Die Wahrheit: Die willkürlich auf 1/10 heruntergesetzten Anlagewerte (auf 4-6V/m) gelten nur in Kinder-, Kranken- und Schlafzimmern und auf öffentlichen Kinderspielplätzen. Schon auf Terrassen, Balkonen, in Hausgärten, auf privaten Kinderspielplätzen, auf dem Feld, wo der Bauer arbeitet oder der Gärtner, gelten sie nicht mehr. Dort darf mit 40-60 V/m gestrahlt werden. In Basel z.B. können deshalb viele Mieter ihre Terrasse nicht mehr benützen. „Die Grenzwerte sind eingehalten“, wiederholen die Netzbetreiber mit der Beharrlichkeit einer Gebetsmühle. Die ersten Gesundheitsbeschwerden (Schlafstörungen) treten jedoch schon bei Feldstärken auf, die um das Hundertfache unter den so gelobten Anlagewerten, also bei 0,04 V/m liegen. Seriöse Forscher haben dies in breiten Untersuchungen (epidemiologischen Studien) festgestellt. Ausländische Mobilfunkbetreiber freut die Forderung nach Einführung der Schweizer Grenzwerte. Im Inneren von Häusern werden diese nämlich auch dort nirgends überschritten, und sie müssen kein Schräubchen ändern. Messungen haben das bestätigt.

Gesundheitsschädigung – alles nur Einbildung?

Die bekannt gewordenen Gesundheitsschädigungen sind keine Einbildung, denn die Schäden zeigen sich auch bei Kleinkindern und Tieren. Sogar Hühner, die aus menschlicher Sicht und menschlichem Überlegenheitsgefühl als dumm gelten und mit Sicherheit keine Zeitungen lesen, brüten infolge der Strahlung häufig keine lebensfähigen Nachkommen aus. Kühe leiden unter Euter- und Gelenkentzündung, verwerfen oder bringen missgebildete Kälber zur Welt, und alles erst, eindeutig belegt, seit dem Betrieb einer nahen Antennenanlage.

Viele Menschen wussten oder wissen sogar heute noch nichts von der Existenz einer Antenne und daher auch nicht, wem sie ihre Beschwerden "verdanken". Leidende Menschen nun zusätzlich als Psychopathen abzustempeln, bedeutet, jemandem, der schon am Boden liegt, einen weiteren Fusstritt zu versetzen. Keiner soll sich in falscher Sicherheit wiegen, denn es kann ihn schon morgen selbst erwischen!

Wer sich ein Schnurlostelefon im DECT-Standard kauft, stellt sich eine strahlende Mobilfunkantenne ins eigene Heim und gefährdet seine Gesundheit massiv. Aber er wird beim Kauf nicht darüber aufgeklärt. Auch hier: Hauptsache der Rubel rollt.

In welcher Gesellschaft leben wir eigentlich? In einer, in der jeder nur auf seinen eigenen, oft nur vermeintlichen Komfort setzt, wo Solidarität zu Recht ein Fremdwort ist? In einer Spassgesellschaft, wo man vor Problemen, die schon morgen auf uns zukommen, heute lieber die Augen verschliesst und die Lösung der nächsten Generation überlässt? Ob uns diese dannzumal für die desaströse Hinterlassenschaft und die fragwürdige Erziehung zu Konsumenten ohne Verantwortungsbewusstsein, Menschlichkeit und Solidarität dankbar sein wird?

Ich rate Ihnen, Ihren Handygebrauch unter diesen Kriterien sehr kritisch zu überdenken, zumal der moderne Mensch noch nie zuvor mit Festnetzanschluss, Anrufbeantworter, Fax und E-Mail besser erreichbar war als heute. Jeder müsste sich eigentlich die Frage stellen, ob er sich freiwillig ans elektronische Gängelband legen und sich wie ein Diener jederzeit herbeiklingeln lässt.

Rivers are polluted, forests razed, pristine wilderness sacrificed all the name of profit. Living in Los Angeles, we see everyday the smog and pollution that results from the lack of a rational transportation system in America's second largest city. How long can the wrecking of our planet continue? Diese Berichte zeigen, dass Menschen seit Jahren durch gepulste hochfrequente elektromagnetische Felder oft schwer erkrankt sind ohne dass die behandelnden Ärzte die Ursache erkannten. Daher litten und leiden Menschen, die zu Hause oder am Arbeitsplatz der Hochfrequenz ausgesetzt sind und erhalten keine Therapie. Die entscheidende Therapie ist: Beendigung der Exposition!

Die in den Medien ständig wiederholte Bewertung der Strahlenschutzkommission, es gäbe keinen Nachweis für Gesundheitsbeeinträchtigungen unterhalb der gegenwärtig geltenden Grenzwerte, hat dazu geführt, dass die meisten Ärzte (ich selbst auch bis vor 1 Jahr) bei den vielen unklaren Krankheitsbildern einen Zusammenhang mit der Hochfrequenz nicht in Erwägung zogen. Die Ärzte wissen nicht, dass an keinem einzigen Mobilfunkstandort in Deutschland Erhebungen des Gesundheitszustandes der Menschen durchgeführt worden sind! Dass die im Jahr 2001 vorgenommene Bewertung der Strahlenschutzkommission also keine wissenschaftliche Grundlage hat.

Die gerade ausgewerteten ärztlichen Erhebungen in Oberfranken bei 356 Personen unter häuslicher Langzeitbelastung belegen:

- Die gepulsten hochfrequenten elektromagnetischen Felder (von Mobilfunkanlagen, von schnurlosen DECT-Telefonen u.a.) führen zu einem neuen, bisher unbekannten Krankheitsbild mit charakteristischem Symptomenkomplex.

- Die Menschen leiden an einem, mehreren oder vielen der folgenden Symptome:

Schlafstörungen, Müdigkeit, Kopfschmerzen, Unruhe, Benommenheit, Reizbarkeit, Konzentrationsstörungen, Vergesslichkeit, Wortfindungsstörungen, depressive Stimmung, Ohrgeräusche, Hörverlust, Hörsturz, Schwindel, Nasenbluten, Sehstörungen, häufige Infekte, Nebenhöhlenentzündungen, Gelenk- und Gliederschmerzen, Nerven- und Weichteilschmerzen, Taubheitsgefühl, Herzrhythmusstörungen, Blutdruckerhöhung (anfallsweise), Hormonstörungen, nächtliches Schwitzen, Übelkeit.

- Schon ab 10 µW/m² erkranken viele Menschen.

- Die Symptome treten in zeitlichem und räumlichem Zusammenhang mit der Exposition auf.

- Es handelt sich keineswegs nur um subjektive Befindlichkeitsstörungen. Rhythmusstörungen, Hörsturz, Visusverlust, erhöhter Blutdruck, Hormonstörungen, Konzentrationsstörungen u.a. sind objektiv nachweisbar.

- Ein Teil der Gesundheitsstörungen verschwindet nach Beendigung der Exposition (Entfernung DECT-Telefon, vorübergehender Ortswechsel, dauerhafter Ortswechsel, Abschirmung) sofort.

Daraus folgt:

Der Ausbau muss sofort gestoppt werden.

Mobilfunkanlagen, in deren Umfeld Menschen mit mehr als 10µW/m² belastet sind, müssen abgeschaltet werden. DECT-Telefone müssen umgerüstet werden.

Betroffene, Angehörige und Ärzte werden sich gemeinsam mit aller Kraft engagieren.

Wir müssen es schaffen.

Grüne fordern Konsequenzen

Die Landesregierung müsse sich dafür einsetzen, dass der Salzburger Vorsorgewert auf Bundesebene gesetzlich verankert werde, fordert die Grüne Landtagsabgeordnete Heidi Reiter.

Die Studie dürfe "auf keinen Fall in den Schubladen verschwinden", sagt die Grüne Umweltsprecherin, denn Betroffene hätten ein Recht darauf, vor zu hoch strahlenden Mobilfunkanlagen geschützt zu werden.

Kleine 'Atomkraftwerke': Handys strahlen so stark, dass die DNA beschädigt wird

Aufgrund der widersprüchlichen Ergebnisse zu dem Thema Handystrahlung wurde die europäische 'Reflex'-Studie ins Leben gerufen, um endlich Klarheit zu schaffen. Das Ergebnis ist erschreckend, denn selbst in kleiner Dosis kann sie das Erbgut schädigen.

Man hat für die Untersuchung sehr hohe Qualitätsmaßstäbe gesetzt, um möglichst gute Resultate zu erhalten. Schon durch eine Strahlung von 0,3 SAR/Kg (die Einheit der Strahlungsintensität) wird die DNA verändert, wodurch z. B. Krebs entstehen kann.

Der aktuelle Grenzwert für Handys liegt bei 2 SAR/Kg, deshalb fordern die Forscher eine Senkung auf 0,2 SAR/Kg, was die Empfangsqualität aber nicht schmälern soll. Es wird geraten Kinder von Handys fernzuhalten und selber die Nutzung einzuschränken.

This judgement sets down a valuable legal precedent for those of us with EHS who have been misdiagnosed, shunted into psychiatric facilities and ordered onto inappropriate anti-psychotic medication. Even finding a lawyer to bring a case like this to court is a feat in itself, and then not only for the plaintiff, John Manweiller, to win such a difficult case but to have the horrendous nature of the injustice done to him underscored by granting the plaintiff the highest ever Irish jury award is stunning!

I am one of the many who have been misdiagnosed in a similar fashion but my pleas in Ireland for legal help to bring my case to court here were refused by (among others) the Irish Legal Aid Board and The Irish Human Rights Commission. But with this judgement and the obvious relaxation of time limit for the plaintiff (statue of limitations on medical cases is normally three years) things look far brighter now for similar cases having a happy court outcome.

I am also including today a copy of my appeal letter for legal support to the Irish Human Rights Commission in August 03 (my appeal was unsuccessful) as it points up how similar the bases of this court case is with my own. In both instances standard/proper medical procedures were not adhered to. However, I did not include the full horror of medical carelessness in my appeal letter. I omitted that my prior permission was not sought nor was I advised as to the side effects, etc of anti-psychotic medication. Furthermore, even the writing out of this prescription was badly messed up (the combination was wrong) by a doctor and over succeeding months I was turned into a dribbling, shuffling totally demoralised person who could barely think straight and with frozen shoulders which necessitated seeking the help of a private therapist! And yet I was refused all legal redress! Let's just hope we will now see many EHS sufferers who were subjected to similar medical interventions taking their cases to the courts.

MY APPEAL LETTER OF August 12, 2003.

Dear Mr. Hogan:

This is my formal appeal letter to the negative decision of the Commission's Casework Committee as stated in your letter to me dated 16 July 2003.

I wish the committee to review their decision based on the following reasons:

1. The first reason cited for refusing my request was this: "no human right appears to have been violated insofar as the condition cited ("electromagnetic sensitivity" or "electromagnetic hypersensitivity") is not at present recognised nationally or internationally in medical or legal terms, so as to bring it within the relevant national or international human rights standards".

But the committee ignored in their response to me all the human rights violations in my case that occurred which were apart from ES/EHS. I enumerated these in length in my email to you of July 4, 2003, and you informed me in your letter dated 7 August 2003 that the committee were given copies of the Human Rights violations that I enumerated. Yet, the committee omitted any reference to these. I now request the committee to respond to me regarding the specific violations I present in my emailed account of these of July 4, 2003.

2. The second reason cited for refusal is the committee's belief that my case would not be successful. But this is premised on the fact that ES/EHS has not been formally acknowledged in medical or legal terms. If it were premised on facts I stressed while writing up my list of Human Rights violations that arise in my case, then there could be a far stronger chance of my case being successful.

I believe this to be true because it is widely reported that the Human Rights of patients in mental health care have been shockingly abused. Given that generally acknowledged fact, the abuses I enumerate that I have experienced arise from a context that is known to harbour such abuses. Various governmental, medical and Human Rights organisations (for instance Amnesty International's campaign for 2003) are engaged in reform measures to correct abuses to the Human Rights of patients who have been or are in psychiatric care. It is regrettable that as yet medical misdiagnosis does not feature prominently in their lists for reforms in this area because there is a strong likelihood that given the apparent legal lacuna many patients may have been misdiagnosed. If my individual action which seeks an acknowledgement of wrongdoing in this area--medical misdiagnosis of mental illness--is successful it most likely will benefit a group whose medical experiences are similar to mine. (As Lord Laird of Artigarvan expressed it in yesterday's The Irish Times, p. 14: "Human rights are enjoyed by individuals and a group may collectively benefit.") Please refer to the article "Group set up to prepare new policy on mental health" that appeared in The Irish Times last week (Tuesday, August 5, 2003, p.5)

3. I am now submitting to you new material that highlights that the medical diagnostic process for arriving at a valid conclusion regards my condition was drastically circumvented when I first presented with symptoms in December 1996. In other words standard medical procedures were not adhered to in my case. I wish the committee to refer to the sections relating to diagnostic procedures for establishing the presence of specific mental illnesses as presented by the authors, Patricia Casey and Ciaran Craven in PSYCHIATRY AND THE LAW (1999). Then I wish the committee to refer to my medical file and observe major irregularities in adherence to standard procedures.

Most importantly I wish the committee to be aware that I was not interviewed and my case history was acquired from a relative (a sister) who lived in a different country from me and who had lived a totally different life style. She is a former nun who has lived most of her life secluded in a convent and has been solely domiciled in Ireland. As pointed out in PSYCHIATRY AND THE LAW: "Interestingly, little scientific attention has been directed to establishing the reliability of informants or to identifying those informants who are most reliable." (page 30.)

The authors of the cited text above also describe in quite some detail "The Psychiatric Interview." (31 ff.)I was not interviewed. My consent to allow an informant to be interviewed was not sought. And there was no question of me not being lucid nor incapable of being interviewed. Please refer to footnote 16, page 31 which addresses exceptions to the necessity of requiring a patient's consent. These exceptions did not arise in my case. The G.P. who wrote the note for me to be accepted into psychiatric care did not interview me. I was less than five minutes in her office. Indeed, she didn't even offer me a seat in her office and she was already writing the note as I entered the room based on the prior information of an informant. I stress again that no standard procedures were adhered to in my case.

And the result for me of this waiving of medical standard procedures and being placed on a medical misdiagnostic belt that I couldn't get off is that I am permanently defined as a "former mental patient."

You should be aware that this is the most damaging identity a person could have. Even the fact that I am now focused on legal action to rectify this injustice may be viewed by mental health specialists as symptomatic of mental illness! Being litigious is a characteristic of such people, they say!

I ask members of the committee how they would feel if they had walked in my shoes and this had been done to them in the name of medical care? And what would each of them feel while reading this newspaper caption "Former mental patient takes legal action." Would they not squirm seeing how they were being defined and knowing what being "a former mental patient" conveys?

It is not an exaggeration to say that what has been done to me is equivalent to the very worst libel and due to this medical error I have been doomed to a quality of life that is socially and in many other ways a death-sentence.

I hope the committee will consider what I have said above and I look forward to their response.

"MAN UNLAWFULLY HOSPITALISED AWARDED 3M [EUROS]

A High Court jury has awarded record damages of almost 3 million [euros] to a Dublin man, after it found he was unlawfully detained in a psychiatric hospital and had continued taking a treatment drug because a doctor threatened to lock him up if he failed to do so.

The award is the highest made by a High Court jury and comes after a 1.7 [euros] million award made earlier this month to a woman who was sexually and physically abused by her father over a number of
years.

John Manweiller (64), Rosemount Court, Dundrum, and formerly of Cross Avenue, Blackrock, Co Dublin, was awarded 2,922,000 and costs - estimated at a total of 400,000 [euros] for both sides - at the close of his successful action against the Eastern Health Board.

Mr Manweiller alleged he was unlawfully detained in St Brendan's Hospital, Grangegorman, from September until December 1984 and also for a time in November 1991.

It is also claimed he was forced to take a drug named Clopixol when discharged from hospital, which he did not want to take.

After the jury members returned with their verdict yesterday evening following an absence of more than three hours, Mr Manweiller said: "I was always confident that I had a good case." He added that he got some of the information for his case under the freedom of Information Act.

Mr Justice Eamon de Valera said there should be a payout of 250,000 [euros] to Mr Manweiller, pending an appeal by the EHB to the Supreme Court.

In his claim, Mr Manweiller sought damages for alleged personal injury, loss and damage sustained by him arising out of the negligence and breach of duty of the EHB, its servants or agents, and for trespass to his person, assault, battery, false imprisonment and breach of his constitutional rights, in particular his right to liberty. The EHB denied the claims.

Mr Justice de Valera and the jury were told by John Rogers SC, with Padraic Dwyer, for Mr Manweiller, that in 1984 his client was living at home with his parents in Cross Avenue. He became upset about his father's will and felt he was not told enough about it. In September 1984 he was sorting tools and asked his mother, then aged 83, about missing tools. She said she knew nothing about them. He raised his voice, and she cried. She left the house to go to his sister, Pauline. Pauline and a brother, Colm, arrived at the house and told him he had to go to St Brendan's [Dublin's best known psychiatric hospital].

Mr Manweiller was driven to hospital and ended up being there until December 14th, 1984. In December a doctor noted he was to get Clopixol, a psychotic drug. The following month he was given Clopixol, to which he had a reaction, and was given another drug to counteract it. Mr Rogers and Mr Manweiller's case was that he should never had been in hospital. There was no legal authority for his being there and the way he was treated. He was on Clopixol for years. In March 1991 he was transferred to a clinic in Baggot Street for treatment, but in November was readmitted to St Brendan's for nearly a month. In 1993 he was moved to a clinic in Cork Street. In October 1994 he was told he was to be taken off Clopixol and was weaned off it.

In their decision yesterday, the members of the jury found that a consultant, Dr Harry Burke, now retired, did not have "good and sufficient reason" to consider it proper to detain Mr Manweiller on September 27th, 1984. The jury also decided that Dr Burke was negligent in prescribing Clopixol for Mr Manweiller on December 4th, 1984, and that Dr Burke and other doctors were negligent in continuing the Clopixol treatment until december 1995.

The jury also found that Dr. Burke threatened to have Mr Manweiller locked up in a unit at St Brendan's if he failed to continue on Clopixol, and Mr Manweiller had submitted to that treatment solely because of the threat.

In addition the jury found that the EHB, its servants or agents, had aggravagted the injury to Mr Manweiller by the manner in which the board conducted its defence of the action."

Michael Ross is scheduled to be executed May 13 despite his proven mental illness

Ross, a serial killer and graduate of Cornell University , has been diagnosed with mental illness by several mental health professionals, including the state's own psychiatrist, Dr. Robert Miller.

According to evidence presented at trial, Ross' childhood consisted of abuse from his mother. His siblings testified at trial that he often received the br unt of their mother's anger through physical and mental abuse. Ross' mother was institutionalized twice for issues pertaining to suicidal tendencies and for the abuse of her children. Ross has dropped his appeals and hastened his own execution.

Act now by asking Gov. Jodi Rell to grant clemency for Michael Ross.

But even though allegations of torture, not just in Iraq, but also in Afghanistan, in Guantánamo Bay, and in secret CIA prisons, continue to surface, the indignation has died down. When the subject of torture comes up, Bush's war on terror is often cited to deflect attention from the disgusting images. Yet a recent Gallup Poll found 60 percent of Americans would not support torture, even against a terrorist who had information about an impending attack. So why has the revulsion disappeared? If we were confronted with pictures of US personnel torturing Swedes, would demands that the perpetrators be brought to justice have evaporated so easily?
