On Election Day, problems throughout Ohio were reported all day long. In the days and weeks that followed, people throughout the state continued to point to many irregularities in the presidential vote. The voting machines were susceptible to glitches, mistakes and hacking, and even the Ohio Secretary of State Blackwell (who chaired the Ohio Bush-Cheney election campaign) admitted there were "missteps" in the election process. As was the case in the 2000 election, these problems disproportionately affected African-American and low-income voters.

There are a host of outstanding questions about the November 2nd election, in Ohio and other states:

· Why were there 92,000 unprocessed votes, over and under counts? And what was the basis for accepting or denying these ballots?
· Why were 155,000 people forced to vote provisionally, and what was the basis for accepting or denying these ballots?
· Why did election officials in one county inform staff on the Thursday before the election that there would be a Homeland Security alert on Election Day, and then take ballots to a warehouse for a secret count which resulted on a 14,000 vote increase for Bush from his 2000 total?

Congressmembers John Conyers, Maxine Water and Stephanie Tubbs-Jones all led a hearing of the House Judiciary Committee in Columbus, OH in mid-December, where yet more concerns and questions were made public. Lawsuits have been filed, people have protested, and the work to secure a thorough recount of every vote cast in Ohio continues.

Rev. Jesse Jackson, Sr. has initiated a call for a Pro-Democracy - Count Every Vote Rally to be held in Columbus, Ohio (the state capital) on Monday, January, 3, 2005. The rally will pull together people from all around Ohio, as well as others who can make the trip.

United for Peace and Justice is one of several national coalitions and organizations lending support to this effort. We call on everyone who can to join this important rally, just days before the U.S. Congress will convene to accept the results of the votes cast by the Electoral College delegates on Dec. 13th.

The details of the rally are still be worked on, and we will be updating the information on our web site as soon as possible. In the meantime, if you are in Ohio, or can find a way to travel there, make plans now to participate in the Pro-Democracy Rally on Jan. 3rd.

Whether or not you can be with us in Columbus, please think about people you know who might be able to make the trip and pass this message along to them.

Take Action on Election Violations as Congress Meets to Certify the Vote!

More than a month has passed since voters cast votes for the President and Vice-President of the United States -- but every day, more and more stories surface that call into question the election's integrity.

Machines broke down, counted backwards, eliminated votes, and registered votes for the wrong candidate. Progressive and African-American neighborhoods experienced by far the longest lines on election day, the most vote spoilage, the most elimination of provisional ballots, and the most victimization by precinct manipulation.

Four hundred thousand callers phoned voter protection hotlines, with complaints ranging from absentee ballots lost in the mail, to outright voter intimidation and disenfranchisement. And partisan election officials with conflicts of interest undermined voting rights in states from Ohio to Florida to New Mexico. Even progressive Democrats on the House Judiciary Committee have questioned the elections' legitimacy, in a series of rigorous, painstakingly detailed letters documenting the unprecedented extent and scope of vote suppression, available at http://www.house.gov/judiciary_democrats/

How can we have confidence in American democracy when so many questions about this election remain unanswered? In addition to the long-standing issues subtly undermining democracy -- corporate domination of the two major parties, plurality elections, and corporate media bias - the recent election betrayedd democratic principles overtly.

Despite the efforts of a few valiant members of Congress, most of our Senators and Representatives have ignored our pleas for serious investigation into the "irregularities" that surrounded the 2004 election. But one more opportunity remains for these government officials to stand for democracy.

On January 6, 2005, Congress will meet in joint session to certify the 2004 presidential election. On that day, if one member of the House and one member of the Senate object to the certification of the vote, then all members of Congress will finally discuss these issues. On January 6, 2001, not a single Senator would join with the Representatives who demanded an inquiry into the Florida recount. This year, let's make our Senators take a stand!

Leiharbeiter müssen nach dem Prinzip "gleicher Lohn für gleiche Arbeit" grundsätzlich genauso bezahlt werden wie die Stammbelegschaft in dem Betrieb, an den sie ausgeliehen wurden.

Das ergibt sich aus einem in Karlsruhe veröffentlichten Beschluß des Bundesverfassungsgerichts (BVG). Demnach werden Verleihunternehmen durch das Gesetz zur Arbeitnehmerüberlassung vom Dezember 2002 nicht in ihren Grundrechten verletzt. Insgesamt hatten zehn Firmen und Verbände gegen das im Rahmen des Hartz-Refomkonzepts beschlossene Gesetz geklagt, weil sie darin eine Verletzung ihrer Berufs- und Koalitionsfreiheit sehen. Die Amtshaftung lässt grüßen

Als Anlage erhalten Sie meine Rede als Ratsmitglied vor dem Rat der Stadt Porta Westfalica, welche dazu geführt hat, dass der Mobilfunkmast mitten im Wohngebiet in Porta Westfalica - Lerbeck - zunächst nicht mit UMTS-Technik aufgestockt wird.

Der entsprechend positive Beschluss des Ausschusses für Planung, Umweltschutz und Bauwesen wurde aufgehoben. Nach Beratung meinerseits mit dem technischen Beigeordneten der Stadt und Abklärung der rechtlichen Möglichkeiten wird der Antrag (keine Aufrüstung auf UMTS mitten im reinen Wohngebiet) am 31.01.05 im Rat neu zur Abstimmung vorgelegt.

Durch das BGH-Urteil vom 13.02.04 sind uns mehrere Wege eröffnet worden:

1. Die Bundesimmissionsschutzverordnung hat keinen Vorsorgecharakter - schließt eine Gesundheitsgefährdung nicht aus. Hiermit ist der Bund aus der Haftung und diese wird nunmehr auf die Kommunen verlagert. Da diese für ihre Ratsbeschlüsse haften, müssen die Kommunen nunmehr Vorsorge treffen.

2. Da die Bundesimmissionsschutzverordnung nicht schützt, ist Normenkontrollklage geboten, da eine Schutzverordnung, welche nicht schützt, aber Grundlage für Genehmigungen ist - weil die Einhaltung der Grenzwerte fiktiv gesunde Arbeits- und Wohnverhältnisse in der Nähe zu Mobilfunkanlagen unterstellt.

3. In reinen Wohngebieten ist eine Mobilfunkanlage weder allgemein noch ausnahmsweise zulässig (§ 31 Abs.2 BauGB). Eine Zulassung der Hauptanlage ist nur im Wege der Befreiung möglich, wenn z.B. die Grundzüge der Planung nicht berührt werden und das Allgemeinwohl die Befreiung erfordert. Letzteres kann ja wohl nicht ernsthaft angeführt werden. In den übrigen Gebieten (Kleinsiedlungsgebiet, allgemeines Wohngebiet, besonderes Wohngebiet, Dorfgebiet, Mischgebiet, Kerngebiet, Gewerbegebiet, Industriegebiet) kann nur über das BGH-Urteil vom 13.02.04 argumentiert werden, dass nunmehr Forschungsergebnisse vorliegen, welche eine Gefährdung belegen (Nailaer Studie, mobilfunkrelevante Auszüge der REFLEX-Studie Juni/Juli 2004 nach dem Urteil). Der BGH hatte sogar nur Forschungsansätze gefordert, welche eine andere Sicht der Dinge zur Folge gehabt haben könnte. Im Außengebiet ist die Chance sehr gering, diese Anlagen zu verhindern - aber da sie ja irgendwo stehen müssen, sollte dies nicht unbedingt verhindert werden.

In Minden zur Stadtgrenze Porta soll aber ein 39m hoher Sendemast von T-Mobile in 30m zum nächstgelegenen Mehrfamilienhaus (reines Wohngebiet) aufgestellt werden. Der Mast steht im Außengebiet - seine Auswirkungen hat er aber direkt auf reines Wohngebiet. Hier wird es vermutlich nur über die betroffenen Bürger per Klageweg möglich sein, dies zu verhindern.

Im Ergebnis kann daher nur gelten, mit den Mobilfunkbetreibern das Gespräch zu suchen:

Wir haben diverse Klagemöglichkeiten und vor Gericht und auf hoher See sind wir alle in Gottes Hand - Urteile können für jede Seite unangenehm ausgehen. Und da auch die Mobilfunkindustrie kein Interesse daran haben kann, sich selbst per Gerichtsurteil sämtliche Mobilfunkstationen in der Nähe von Wohnbebauung oder Arbeitsplätzen zu nehmen, ist Konsens angesagt und das geringste Übel zu wählen. Waffen haben wir jetzt.

Ich empfehle jedem Ratsmitglied in jeder Kommune, sich genau zu überlegen, in reinen Wohngebieten im Wege der Befreiung Mobilfunksendestationen zuzulassen. Die Amtshaftung lässt grüßen (gesetzliche Grundlagen etc. finden Sie in der Anlage).

Sehr geehrter Herr Bürgermeister,
sehr geehrte Damen und Herren Ratsmitglieder, liebe Gäste, Bürger der Stadt Porta

Ich höre immer wieder in Bezug auf „kleine Mobilfunksendeanlagen“ mit weniger als 10m Höhe + Abstand zur nächstgelegenen Wohnbebauung von 8,30 m und bestimmter Sendeleistung : Das müssen wir genehmigen, da kann man nichts machen

Es ist nicht mehr so, dass man gegen Mobilfunksendeanlagen in nächster Nähe zu Wohnbebauung nichts machen kann. Zumindest seit Juni/Juli diesen Jahres müssen wir etwas dagegen unternehmen: zunächst kurz umrissen die gesetzlichen Grundlagen für allgemein zulässige Mobilfunkanlagen welche bisher als nicht störende gewerbliche Nutzung galten und zugelassen werden mussten und zwar im:

Kleinsiedlungsgebiet: § 2 BauNVO

allgemeinen Wohngebiet: § 4 BauNVO

besonderen Wohngebiet: § 4a BauNVO

Dorfgebiet: § 5 BauNVO

Mischgebiet: § 6 Bau NVO

Kerngebiet: § 7 BauNVO

Gewerbegebiet: § 8 BauNVO

Industriegebiet: § 9 BauNVO

In diesen Gebieten galt die Fiktion des § 1 BauGB: mit der Vorlage der Standortbescheinigung der Regulierungsbehörde für Telekommunikation und Post gelten die Anforderungen an gesunde Wohn- und Arbeitsverhältnisse als erfüllt.

Was wird überprüft ?

Von der RegTep wird nur die Einhaltung der Grenzwerte 26. Bundesimmissions-Schutzverordnung (BimSchV) überprüft

Wurden diese Grenzwerte eingehalten, konnte bisher eine Genehmigung nicht verweigert werden.

Ob diese Grenzwerte - bei uns bis zu 1.000.0000-fach höher, als z.B. bei unseren europäischen Nachbarn - ausreichen bzw. überhaupt Schutz bieten – ob diese Fiktion der gesunden Wohn- und Arbeitsverhältnisse überhaupt so gelten kann sollte vom Bundesgerichtshof geklärt werden.

Es ging um eine Mobilfunkanlage im nicht reinen Wohngebiet !

Die Klägerin führte in 100 m Entfernung von einer Mobilfunksendeanlage eine Praxis und verlangte den Betrieb der Sendeanlage zu unterlassen, da eine Gesundheitsgefährdung davon ausgehe.

Am 13. Februar 2004 ist das BGH-Urteil ergangen.

Tenor: Die 26. BimSchV mit ihren Grenzwerten enthält keine Vorsorgekomponente d.h. die Einhaltung der Grenzwerte schließt eine Gesundheitsgefährdung nicht aus! Dies steht wörtlich in der Urteilsbegründung.

Das bedeutet: der Bund kann für eventuelle Schäden nicht haftbar gemacht werden – diese Verantwortung tragen z.B. die Kommunen.

Das Dumme war - und dies bemängelte der BGH: Die Klägerin hat nicht einmal auf neue Forschungsansätze hingewiesen, die ein Gefährdungspotenzial erkennen lassen und nur deswegen wurde die Klage abgewiesen.

Nach Bekanntgabe dieses BGH-Urteils aus Februar 2004 wurden mobilfunkrelevante Ergebnisse (Teile) der von der Europäischen Union geförderten REFLEX-Studie von Professor Adlkofer, dem Koordinator des Projektes, im Juni 2004 veröffentlicht.

Diese Studie wurde von 12 überwiegend universitären Forschergruppen aus 7 Ländern durchgeführt. Beteiligt waren die Universitäten Bologna, Bordeaux, Mailand, Wien, Zürich, Berlin, Hannover sowie 5 nichtuniversitäre Forschungseinrichtungen

Ziel war es, den potentiellen Einfluss von elektromagnetischen Feldern niedriger Energie auf biologische Systeme zu ergründen.

Ergebnis: einfach- und doppel-DNA-Strangbrüche

Ebenfalls nach Bekanntgabe dieses BGH-Urteils aus Februar 2004 wurde die Nailaer Studie veröffentlicht, im Juli 2004 mit dem Ergebnis: im Umkreis von 400 m von Mobilfunkstationen ist die Krebsrate neu aufgetretener Krebsfälle in den ersten 5 Jahren doppelt so hoch wie außerhalb dieses Radius in der zweiten Dekade 5 -10 Jahre sogar dreimal so hoch. Die Erkrankten sind im Durchschnitt um 8 Jahre jünger.

Da nunmehr nicht nur Forschungsansätze sondern Forschungsergebnisse vorliegen, die eine Gesundheitsgefährdung nachweisen, besteht die Möglichkeit – eröffnet vom Bundesgerichtshof – gegen Mobilfunkanlangen auch in nicht reinen Wohngebieten zu klagen.

Zusätzlich ist die Möglichkeit der Normenkontrollklage geboten, da die Bundesimmissionsschutzverordnung ja lt. BGH gar keinen Schutz darstellt – keine Vorsorgekomponente enthält.

Wir müssen nach dem Bundesgerichtshofsurteil und Kenntnis der Gesundheitsgefährdung durch die veröffentlichten Studien gar keine Mobilfunkstationen in der Nähe von Wohnbebauung zulassen – egal in welchem Gebiet.

Und jetzt zum reinen Wohngebiet:

Ich zitiere aus der Beschlussvorlage des Umweltamtes Porta zur wohlwollenden Befürwortung der Erweiterung der Sendeanlage Lerbeck, Georg-Rost-Str. auf UMTS-Standart:

In reinen Wohngebieten ist eine Mobilfunksendeanlage weder allgemein noch ausnahmsweise zulässig !

Eine Zulassung der Hauptanlage ist nur im Wege der Befreiung gem. § 31 Abs. 2 BauGB möglich, wenn: die Grundzüge der Planung nicht berührt werden und das Allgemeinwohl die Befreiung erfordert.

Der Bebauungsplan lässt derartige Anlagen nicht zu – und das Allgemeinwohl verbietet doch wohl eine Befreiung !

Die Anwohner und Bürger in Lerbeck sind schon den Mobilfunkstrahlen der dort bereits installierten Mobilfunkanlage ausgesetzt und als wenn das nicht genug ist setzt unsere Verwaltung noch eins oben drauf !

Zusätzlich - es handelt sich um eine Erweiterung der bestehenden Anlage – zusätzlich zu der bisherigen Belastung werden die Menschen der gepulsten Mikrowellen-Strahlung der UMTS-Technik ausgesetzt.

Und das ohne Not ! – wir müssen das nicht genehmigen ! Von wegen keine rechtliche Handhabe.

Und jetzt kommt die Begründung des Umweltamtes für die Befürwortung der Erweiterung: bitte hören Sie genau zu ! Ich zitiere:

„Bei einem Standort außerhalb des Bebauungsplan-Gebietes müsste ein fast gleich hoher Mast gebaut werden, was zu einer städtebaulichen Verunstaltung führen würde “. Zitat Ende

Was ist hier eigentlich wichtiger ? Die Gesundheit der Menschen oder ein Funkmast in der Landschaft ?

Mobilfunkanlagen haben in reinen Wohngebieten nichts zu suchen

Ich fasse zusammen:

Nach dem, was wir heute wissen – insbesondere durch die REFLEX-Studie und die Nailaer Studie, kann niemand mehr im Rat oder in den Ausschüssen und in der Verwaltung die 3 Affen spielen: nicht hören – nicht sehen – nicht sprechen. Ich weiß von nichts gilt nicht mehr!

In reinen Wohngebieten haften wir schon jetzt für Gesundheitsschäden der Anwohner – denn dort sind diese Anlagen weder allgemein noch ausnahmsweise zulässig - in den übrigen Gebieten haften wir spätestens seit Veröffentlichung der Studien, welche die Gesundheitsgefährdung der in unmittelbarer Nähe wohnenden Bürger belegen – der Nachweis, welcher dem Bundesgerichtshof wenigsten in Forschungsansätzen gefehlt hat und nun sogar in Forschungsergebnissen vorliegt. Oder will ernsthaft jemand hier in diesem Saal die EU-Studie anzweifeln ?

Haftungsfolgen der Gemeinde gegenüber Dritten können durch Beschlüsse des Rates eintreten und zwar durch § 839 BGB i.V.m. Art. 34 GG die sogenannte Amtshaftung.

Von der Rechtsprechung werden übrigens die Ratsmitglieder als Amtsträger im haftungsrechtlichen Sinne betrachtet.

So haftet die Gemeinde z.B. wenn die Amtsträger einer Gemeinde ihre Amtspflicht bei der Aufstellung von Bebauungsplänen verletzen, Gesundheitsgefährdungen zu verhindern, die dem zukünftigen Bewohnen des Plangebietes drohen.

Voraussetzung ist zwingend ein Ratsbeschluss, der verursachend für den Schaden gewesen sein muss.

Nach § 839 Absatz 4 Buchstabe a BGB tritt eine Haftung der Ratsmitglieder dann ein, wenn sie in vorsätzlicher oder grob fahrlässiger Verletzung ihrer Pflicht zuwider gehandelt haben.

Vorsatz ist gegeben, wenn das Ratsmitglied die Schädlichkeit des Beschlusses kennt und die Schädigung auch will; es reicht aus, wenn es die Schadensfolge billigend in Kauf nimmt.

Sie kennen jetzt die Schadensfolgen von Mobilfunkanlagen – es handelt sich hier jetzt nicht mehr um eine Glaubensfrage.

- Ist es schädlich – ist es das nicht ? -

Herr Bürgermeister: Mobilfunkanlagen haben weder in reinen Wohngebieten noch in der Nähe von Kindergärten und Schulen etwas zu suchen !

Wir tragen durch unsere Entscheidungen die Verantwortung für die Gesundheit unserer Bürger – nicht nur die Stadt – nein jedes einzelne Ratsmitglied !

Und wenn darüber entschieden werden soll, dass Mobilfunkanlagen in reinen Wohngebieten oder in der Nähe von Schulen und Kindergärten installiert werden sollen - haben das die von den Betroffenen gewählten Vertreter, die Ratsmitglieder im Rat zu entscheiden.

Richard Branson stopped all Virgin Mobile Phone stores from selling mobile phones to under 16 year old children

The fainter the reception from a cell phone mast the harder the phone works so the radiation output increases.

Two recent articles in British papers may be of interest. One from "Daily Mirror" "Do not let your kids use mobiles" banner headline on front page, smaller heading "radiation can alter their DNA", warn scientists. The article goes on to quote from an EU funded REFLEX group who carried out the research in seven European Countries using 12 research groups. The study cost £3 million and looked at radiation impact on animal and human cells. They found that cells exposed to mobile phone waves showed a significant increase in DNA damage. In some cases the damage was permanent. Worringly damage appeared to carry on into the next generation of cells. Mutated cells are seen as possible cause of cancer.

The other article reported that Richard Branson millionaire owner of the Virgin Group was to stop all his Virgin Mobile Phone stores from selling to under 16 year old children following the death of a friend of his from a brain tumour possible linked to mobile phone use!

Maybe it's all about the money. The public, who is paying for these items, is being told that TASERs will be used as a safe, non-lethal alternative to guns. But in reality, they are being used in situations where police would never use lethal force. In fact, according to Amnesty International, the data shows that TASERs are used on unarmed suspects in 80% of the cases, including verbal non-compliance (36%), and only 3% of the time in cases involving potential 'deadly assault.' Their report details 74 TASER-related deaths that have occurred in the United States and Canada since June 2001...

Deputy Premier Eric Ripper said on Wednesday state Cabinet had endorsed an agreement that recognised the Noonkanbah people as the traditional owners of their 1811 square kilometre native title claim in the west Kimberley region.

Noonkanbah station made front-page news in 1980 when Aboriginal people from all over Australia rallied to prevent a petroleum company drilling in the area of a sacred site. Despite their efforts, the drilling was only delayed. It went ahead the next year with state government support...
