Stolen Election 2004 - Action Alerts

--Please forward to any one who may have seen the alerts website or emails which referred to that website which I am now correcting--

I --the person who updates the blog--made a mistake about the date that we should urge Ohio Secretary of State Blackwell to finish the recount. The articles on the subject were not totally clear but when I looked up the original legal document in the challenge it plainly states that the recount should be started immediately and finish before Dec. 7 2004, the "safe harbor" day in which Ohio chooses its electors. He should be contacted immediately with the correct information.

For those who have not contacted him yet you should consider that although Blackwell has consistently handed down rulings that disenfranchise voters based on technicalities, he has also backed down on some of these rulings in the face of popular pressure.

I will now give a sample letter (or script for phone call) for what you can say if you either have or have not already contacted him on this issue. Contact info for blackwell, the Ohio Governor and media is below. (Unfortunately as a result of technical difficulties I am unable to change the website before aproximately10p.m. E.S.T., 11/26th.)

If you have already written to Ohio Secretary of State Blackwell on this issue please write and/or call him again and say something like, "This is an urgent corrrection an email (or call) I have previously sent (or made) to you. I had meant to say that a full statewide manual recount must begin immediately and must be finished before Dec. 7th, the day Ohio chooses its electors. Otherwise, the Dec. 7th deadline for 'safe harbor' for Ohio to choose its electors for president must be set aside (since in Federal law, this date is only in effect if there is not a challenge to the election, as there is in this case) and then--only if there is no for "safe harbor" deadline for Ohio to choose its electors for president--should the deadline for finishing the recount be before Dec. 13th, the day the electors choose the president."

If you have not contacted him yet please say something like "In order for there to be no doubt in people's minds that the election was counted in a fair way, the beginning of a full manual recount of the state must begin immediately so that a manual count of the entire state (which is estimated to take 10 days) can be finished by the time the Ohio chooses its electors for President, Dec.7th. Otherwise, the Dec. 7th deadline for 'safe harbor' for Ohio to choose its electors for president must be set aside (since in Federal law, this date is only in effect if there is not a challenge to the election, as there is in this case) and then--only if there is no for "safe harbor" deadline for Ohio to choose its electors for president--should the deadline for finishing the recount be before Dec. 13th, the day the electors choose the president.

This is the only way that all the overvotes, undervotes, and problems with machines can be checked. Since many anomalies have been discovered in the Ohio election a thorough manual recount is the only way that the world will trust the election results.

In addition, it would be best if you, as Chair of the Bush Campaign in Ohio, recused yourself from being the tie breaker in disputes between Republic and Democratic counters of provisional ballots and recuse yourself from being involved in the Ohio recount. Someone non-partisan should take this role instead. If you do not recuse yourself, and if it seems that people were disenfranchised because of your bias, the results of this election will not seem settled or fair which will cause distress in this country and the whole world. As a result I implore you not to disenfranchise voters based on technicalities!"

Regarding the federal law mentioned in the sample letter of my previous correction, is open to interpretation and will not automatically negate the Dec. 7th "safe harbor" deadline on a state or federal level. This interpretation had been mentioned in 2000 when the safe harbor deadline was coming up and Gore was still contesting Florida, but it was ignored by all the courts and election authorities in Florida. The only reason I mention it now is that time is running out to do a full manual recount by the 7th and since it is possible for states to waive the "safe harbor" date--many simply ignore it--and there is this interpretation of federal law that could cause an official to waive that date--it seemed like a good backup option to mention in a letter to Ohio's ultimate election official.

This is a version of the email I just sent with an explanation of that part of the sample letter.
