Zu den Artikeln „Geringe Strahlenbelastung“ (AZ vom 30. Juni), „Messergebnisse lagen klar unter Grenzwerten“ (2. Juli), „Ängste und Emotionen“ (5. Juli) sowie zum „Ratgeber Mobilfunk“ (Zeitungsbeilage vom 5. Juli 2004)
Es ist schon erstaunlich, was die Mobilfunkbetreiber durch ihre „Informationszentrale Mobilfunk“ (IZMF) unternehmen, um die von Mobilfunksendeanlagen ausgehenden Gesundheitsgefahren unter Berufung auf die geltenden Grenzwerte herunterzuspielen und zu verharmlosen. Demgegenüber ist zu betonen, dass die in Deutschland geltenden Grenzwerte anerkanntermaßen viel zu hoch sind. Außerdem bezwecken sie allein den Schutz vor den thermischen Effekten des Mobilfunks, d. h. vor der Wärmestrahlung, lassen aber alle anderen biologischen Effekte außer Acht und treffen in dieser Hinsicht keinerlei Vorsorge. Das ständige Lavieren mit eben diesen Grenzwerten hat den Frankfurter Biophysiker, Professor Dr. Werner Mäntele, zu der Aussage bewogen: „40 Millionen Handynutzer sind potentielle Versuchskaninchen in Deutschland“.
Leider lassen sich von solchen warnenden Stimmen weder die Mobilfunkbetreiber noch unsere Politiker beeindrucken. Als der Staatssekretär im Hessischen Umweltministerium sich auf Grund der von der IZMF publizierten, „hervorragend“ niedrigen Messergebnisse veranlasst sah, öffentlich eine Herabsetzung der Grenzwerte zu befürworten (vgl. AZ vom 30. Juni, S. 5), wurde er sofort zurückgepfiffen. Das Ministerium teilte noch am selben Tage mit, dass „die Absenkung der Grenzwerte kein Thema ist“ und dass man die Messergebnisse anderer Bundesländer abwarten will. Hier zeigt sich wieder einmal die unheilvolle Verzahnung von Wirtschaft und Politik.
Denn bei einer Senkung der Grenzwerte müsste so manche Mobilfunk-Basisstation stillgelegt werden. Bezeichnend ist, dass sich das Ministerium auf die gerade noch so hochgelobten Ergebnisse der Messreihe des IZMF nicht mehr verlassen will. In der Tat hatte man sich im Rahmen dieser Messreihe offenbar auch in Gießen Messpunkte ausgesucht, die von vornherein niedrige Messwerte garantierten. Hätte man nämlich Messungen auf den der Mobilfunksendeanlage Am Alten Friedhof benachbarten Wohngrundstücken durchgeführt, wären bis zu 30 fach (!) höhere Werte gemessen worden.
Wundern muss man sich auch über die verharmlosenden Äußerungen des Gießener Professors für Hygiene Dr. Thomas Eikmann. Mit diesen Äußerungen setzt er sich in Widerspruch zu den über 1000 Ärzten, die im „Freiburger Appell“ auf Grund ihrer Erfahrungen mit Patienten, die in der Nähe von Mobilfunksendeanlagen leben, vor den erheblichen Gesundheitsgefahren warnen, die von solchen Anlagen ausgehen. Weiß Professor Eikmann nicht, dass gewisse Frequenzen in den menschlichen Zellen Resonanzen zeigen? Kennt er nicht die besorgniserregenden Teilergebnisse der von der Europäischen Gemeinschaft in Auftrag gegebenen REFLEX-Studie, wonach elektromagnetische Felder bereits unterhalb der geltenden Grenzwerte in menschlichen Zellen DNA-Brüche hervorrufen und das Erbgut schädigen, worüber erst jüngst wieder in der Ärzte Zeitung vom 29.06.2004 berichtet wurde? Und ausgerechnet er möchte Patienten, die von „Elektrosensibilität“ betroffen sind, „einladen“, sich zur Behandlung „unter vier Augen“ in seine Ambulanz zu begeben. Wie verträgt sich ein solches Werben um Patienten überhaupt mit dem ärztlichen Standesethos?
Übrigens: Warum müssen in Flugzeugen Handys abgeschaltet werden? Die Zeitungsbeilage „Ratgeber Mobilfunk“ des IZMF weiß darauf die Antwort: „Bordinstrumente in Flugzeugen sind sehr sensibel.“ Der menschliche Organismus etwa nicht?

Kasseler Bürgerinitiativen “Risiko Mobilfunk”
Liebe MitstreiterInnen,
am 8.7. hielt das von den Betreibern finanzierte Desinformationszentrum Mobilfunk IZFM seine Propaganda-Veranstaltung in der Stadthalle Kassel ab. Die Kasseler Bürgerinitiativen "Risiko Mobilfunk" wollten dabei natürlich nicht abseits stehen. Hier unser Kurzbericht:
Schon nachmittags waren wir mit Transparenten und Flugblättern (anbei) präsent für einen "Fach-Workshop", zu dem das IZMF ein geladenes Publikum, darunter sämtliche Ortsbeiräte angeschrieben hatte. Zehn Personen kamen...
Die öffentliche Veranstaltung begann um 18.30 h. Diesmal waren etwa 50 "Gallier" in und vor dem Saal präsent, gegenüber etwa 10 entschiedenen Mobilfunk-Befürwortern und etwa gleichviel unentschiedenen im Publikum. Das Podium war natürlich völlig einseitig mit den Honoratioren des IZMF besetzt. Es war klar, dass unsere Beiträge die "Diskussion" beherrschten.
Der eigentliche Clou des Tages waren unsere vier Installationen vor der Stadthalle, in Sichtweite der Straßenbahnhaltestelle:
· Installation Nr. 1: Ein Holzstall mit drei lebenden Ferkeln, dazu ein großes Plakat: "Grunzwerte? Saumäßig!" (Da mussten selbst unsere Kontrahenten vom IZMF sich ein Lächeln abquälen.)
· Installation Nr. 2: Ein Bett mit einem ineinander verschlungenen Liebespaar (Schaufensterpuppen), die sich gegenseitig zwei Scheine "50 Milliarde Euro" bzw. "UMTS-Lizenzen" zustecken. Darüber stand auf einem rosa Plakatherzen über den Köpfen "Politik" und "Mobilfunkindustrie".
· Installation Nr. 3: Ein Skelett, mit Plakat "Transparenz durch Sicherheit? " (Umkehrung des Veranstaltungstitels des IZMF: "Sicherheit durch Transparenz"
· Ein geöffneter Sarg, darin eine Inschrift "Gesundheitsvorsorge".
Außerdem gab es einen Info-Tisch, sowie Transparente u.a. mit den Inschriften:
- "Wer diesen Grenzwerten vertraut, dem hat man das Gehirn geklaut"
- Die 'Grenzwerte' schützen nicht die Bevölkerung vor der Strahlung, sondern die Mobilfunkindustrie vor der Bevölkerung"
- "Mobilfunstandards:

Gerne hätten wir der IZMF-Veranstaltung mehr Publikum gewünscht – und damit auch uns. Leider war von den Medien nur die Lokalzeitung HNA präsent. Schade – die Hessenschau hätte etwas zu filmen gehabt.
Zum Abschluss der Veranstaltung haben wir die Anwesenden per Saalmikrophon eingeladen, sich wirklich zu informieren: Nämlich gegenüber der Stadthalle in der "Kultur-Werkstatt", Friedrich-Ebert-Straße 175. Die ganze Woche über haben wir dort täglich ab 16 Uhr eine Ausstellung über die Gesundheitsrisiken des Mobilfunks geöffnet. Am 14.7. findet dort ab 19.30 h eine Finissage statt mit der gefeierten Performance „debil-Tel“ des Aktionskünstlers Stephan Moddrow.

Liebe Mitbürgerinnen und Mitbürger!
Viele Menschen leiden unter gesundheitlichen Störungen im Umkreis von Mobilfunksendern. Unabhängig voneinander klagen Tausende über Schlafstörungen, Konzentrationsschwäche, Erschöpfungszustände, Herzrhythmusstörungen, Kopfschmerzen, Augenrötung und Tinnitus. Immer mehr Forschungsergebnisse untermauern die Schädlichkeit von Mobilfunkstrahlung, bis hin zu erhöhtem Risiko von Hirntumoren und Leukämie. Nachgewiesen wurde kürzlich u.a. die Gefahr der Unfruchtbarkeit bei Männern infolge von Handystrahlung (HNA vom 29. 6. 2004). Vorsorge-Politik? Fehlanzeige! Die Wirtschafts-Milliarden haben Vorrang...
Dagegen haben sich bundesweit an Hunderten von Orten Bürgerinitiativen gebildet, auch in Kassel in mehreren Stadtteilen. Wir sind nicht gegen Mobilfunk – wohl aber gegen die jetzt verwendete Technologie von gepulsten Hochfrequenz-Blitzen. Hier wurde ungeprüft eine Risiko-Technologie eingeführt, die nun flächendeckend an uns allen erprobt wird!
Um den wachsenden Widerstand niederzuhalten, haben die Betreiber eine gemeinsame Propaganda-Zentrale mit dem Namen „Informationszentrum Mobilfunk“ IZMF gegründet. Dieses „Informations“-Zentrum führt derzeit mit dem Segen des Hessischen Umweltministers (!) eine Messreihe in Hessen durch. Das Traum-Ergebnis: Die Messergebnisse liegen überall unter den Grenzwerten. Entwarnung? Nein! Augenwischerei!
Die „Grenzwerte“ schützen die Wirtschaft, nicht die Gesundheit.
Diese Grenzwerte sind so hoch angesetzt, dass sie gar nicht überschritten werden können. Das ist so, als würde man als Tempolimit auf der Autobahn die Schallgeschwindigkeit festsetzen und dann „messen“, dass alle Fahrzeuge weit darunter bleiben...
Das Geld, das die Mobilfunkindustrie dem TÜV-Nord für diese Messungen bezahlt, hätte sie sinnvoller in die Erforschung einer gesundheitsverträglicheren Technologie gesteckt.
Der Hintergrund? Die Grenzwerte schützen nur vor den thermischen Wirkungen hochfrequenter Felder. Sie verhindern lediglich, dass sich Körpergewebe um mehr als 1 Grad Celsius nach 30-minütiger Bestrahlung erwärmt. Diese „Grill-Wirkung“ kann jedoch nur im Meter-Abstand von den Sendeantennen auftreten! Die Grenzwerte schützen nicht vor den athermischen Wirkungen der Mobilfunkstrahlung, das heißt vor den schädlichen elektromagnetischen Einwirkungen auf den Organismus, die weit unterhalb der Schwelle der Wärmewirkung liegen. Diese Wirkungen reichen kilometerweit; gerade weil es um feinste Körperprozesse geht, genügen dafür niedrigste Feldstärken.
„Informations“-Veranstaltung am 8. Juli in der Stadthalle
Am Donnerstag, 8.7.2004 um 18.30 Uhr, veranstaltet das IZMF in der Stadthalle Kassel eine „Informations“-Veranstaltung. Unter dem Titel „Sicherheit durch Transparenz“ werden dem staunenden Publikum die Ergebnisse der Messreihen vorgestellt.

Fragen und Antworten zum Thema Mobilfunk-Strahlung
Der derzeitige Grenzwert für gepulste elektromagnetische Felder beträgt gemäß der 26. Verordnung zum Bundesimmissionsschutzgesetz für das D-Netz (Deutsche Telekom / T-Mobile) 4.500 mW/m² und für das E-Netz (E-Plus) 9.000 mW/m²; d.h. also 4.500 bzw. 9.000 Milliwatt pro Quadratmeter.
In Deutschland gelten die höchsten Grenzwerte in Europa !
* Wussten Sie, dass das EU-Parlament bereits in 2001 einen Grenzwert von 0,1 mW/m² empfahl und die Landessanitätsdirektion des Landes Salzburg in 2002 sogar max. nur 0,001 mW/m² ? Das ist mehr als 9-Millionenfach unter dem deutschen Grenzwert für das E-Netz!
* Wussten Sie, dass eine einwandfreie Handynutzung noch bei 0,000001 mW/m² möglich ist? Das ist 9-Milliardenfach unter dem Grenzwert!
* Wussten Sie, dass der gesetzliche Sicherheitsabstand zu einer UMTS-Anlage in Deutschland 2 Meter beträgt; hingegen der EU-Ausschuss 120 Meter empfiehlt und das Land Salzburg sogar 200 Meter?

Diese Wissenschaftler fordern weit niedrigere Grenzwerte, die uns auch vor den nichtthermischen Wirkungen der Mobilfunkstrahlung besser schützen könnten.
Nicht bewiesen?
Die Betreiber behaupten, diese Gesundheitsgefahren seien „nicht bewiesen“, weil sie sich nur zum Teil im Labor reproduzieren lassen nach dem Schema „Wenn A dann B“. Bewiesen ist damit nur ihr veraltetes Wissenschaftsverständnis aus dem 19. Jahrhundert, das zwischen einem unbelebten Fleischkloß und einem lebendigen Organismus nicht unterscheiden kann. Die moderne Molekularbiologie kennt längst nicht-lineare Verursachungen. Weite Bereiche der heutigen Medizin gehen aus von Syndromen, deren komplexe Wirkungsbündel sich nicht mechanisch aufschlüsseln lassen. Im Bereich der Allergologie sind statistische Nachweise für Krankheitsbilder anerkannt, obwohl die Wirkmechanismen im Körper bislang nicht im Detail nachvollziehbar sind.

am 8.7. hielt das von den Betreibern finanzierte Desinformationszentrum Mobilfunk IZFM seine Propaganda-Veranstaltung in der Stadthalle Kassel ab. Die Kasseler Bürgerinitiativen "Risiko Mobilfunk" wollten dabei natürlich nicht abseits stehen. Hier unser Kurzbericht:
Schon nachmittags waren wir mit Transparenten und Flugblättern (anbei) präsent für einen "Fach-Workshop", zu dem das IZMF ein geladenes Publikum, darunter sämtliche Ortsbeiräte angeschrieben hatte. Zehn Personen kamen...
Die öffentliche Veranstaltung begann um 18.30 h. Diesmal waren etwa 50 "Gallier" in und vor dem Saal präsent, gegenüber etwa 10 entschiedenen Mobilfunk-Befürwortern und etwa gleichviel unentschiedenen im Publikum. Das Podium war natürlich völlig einseitig mit den Honoratioren des IZMF besetzt. Es war klar, dass unsere Beiträge die "Diskussion" beherrschten.
Der eigentliche Clou des Tages waren unsere vier Installationen vor der Stadthalle, in Sichtweite der Straßenbahnhaltestelle:
· Installation Nr. 1: Ein Holzstall mit drei lebenden Ferkeln, dazu ein großes Plakat: "Grunzwerte? Saumäßig!" (Da mussten selbst unsere Kontrahenten vom IZMF sich ein Lächeln abquälen.)
· Installation Nr. 2: Ein Bett mit einem ineinander verschlungenen Liebespaar (Schaufensterpuppen), die sich gegenseitig zwei Scheine "50 Milliarde Euro" bzw. "UMTS-Lizenzen" zustecken. Darüber stand auf einem rosa Plakatherzen über den Köpfen "Politik" und "Mobilfunkindustrie".
· Installation Nr. 3: Ein Skelett, mit Plakat "Transparenz durch Sicherheit? " (Umkehrung des Veranstaltungstitels des IZMF: "Sicherheit durch Transparenz"
· Ein geöffneter Sarg, darin eine Inschrift "Gesundheitsvorsorge".
Außerdem gab es einen Info-Tisch, sowie Transparente u.a. mit den Inschriften:
- "Wer diesen Grenzwerten vertraut, dem hat man das Gehirn geklaut"
- Die 'Grenzwerte' schützen nicht die Bevölkerung vor der Strahlung, sondern die Mobilfunkindustrie vor der Bevölkerung"
- "Mobilfunstandards:

Gerne hätten wir der IZMF-Veranstaltung mehr Publikum gewünscht – und damit auch uns. Leider war von den Medien nur die Lokalzeitung HNA präsent. Schade – die Hessenschau hätte etwas zu filmen gehabt.
Zum Abschluss der Veranstaltung haben wir die Anwesenden per Saalmikrophon eingeladen, sich wirklich zu informieren: Nämlich gegenüber der Stadthalle in der "Kultur-Werkstatt", Friedrich-Ebert-Straße 175. Die ganze Woche über haben wir dort täglich ab 16 Uhr eine Ausstellung über die Gesundheitsrisiken des Mobilfunks geöffnet. Am 14.7. findet dort ab 19.30 h eine Finissage statt mit der gefeierten Performance „debil-Tel“ des Aktionskünstlers Stephan Moddrow.

Liebe Mitbürgerinnen und Mitbürger!
Viele Menschen leiden unter gesundheitlichen Störungen im Umkreis von Mobilfunksendern. Unabhängig voneinander klagen Tausende über Schlafstörungen, Konzentrationsschwäche, Erschöpfungszustände, Herzrhythmusstörungen, Kopfschmerzen, Augenrötung und Tinnitus. Immer mehr Forschungsergebnisse untermauern die Schädlichkeit von Mobilfunkstrahlung, bis hin zu erhöhtem Risiko von Hirntumoren und Leukämie. Nachgewiesen wurde kürzlich u.a. die Gefahr der Unfruchtbarkeit bei Männern infolge von Handystrahlung (HNA vom 29. 6. 2004). Vorsorge-Politik? Fehlanzeige! Die Wirtschafts-Milliarden haben Vorrang...
Dagegen haben sich bundesweit an Hunderten von Orten Bürgerinitiativen gebildet, auch in Kassel in mehreren Stadtteilen. Wir sind nicht gegen Mobilfunk – wohl aber gegen die jetzt verwendete Technologie von gepulsten Hochfrequenz-Blitzen. Hier wurde ungeprüft eine Risiko-Technologie eingeführt, die nun flächendeckend an uns allen erprobt wird!
Um den wachsenden Widerstand niederzuhalten, haben die Betreiber eine gemeinsame Propaganda-Zentrale mit dem Namen „Informationszentrum Mobilfunk“ IZMF gegründet. Dieses „Informations“-Zentrum führt derzeit mit dem Segen des Hessischen Umweltministers (!) eine Messreihe in Hessen durch. Das Traum-Ergebnis: Die Messergebnisse liegen überall unter den Grenzwerten. Entwarnung? Nein! Augenwischerei!
Die „Grenzwerte“ schützen die Wirtschaft, nicht die Gesundheit.
Diese Grenzwerte sind so hoch angesetzt, dass sie gar nicht überschritten werden können. Das ist so, als würde man als Tempolimit auf der Autobahn die Schallgeschwindigkeit festsetzen und dann „messen“, dass alle Fahrzeuge weit darunter bleiben...
Das Geld, das die Mobilfunkindustrie dem TÜV-Nord für diese Messungen bezahlt, hätte sie sinnvoller in die Erforschung einer gesundheitsverträglicheren Technologie gesteckt.
Der Hintergrund? Die Grenzwerte schützen nur vor den thermischen Wirkungen hochfrequenter Felder. Sie verhindern lediglich, dass sich Körpergewebe um mehr als 1 Grad Celsius nach 30-minütiger Bestrahlung erwärmt. Diese „Grill-Wirkung“ kann jedoch nur im Meter-Abstand von den Sendeantennen auftreten! Die Grenzwerte schützen nicht vor den athermischen Wirkungen der Mobilfunkstrahlung, das heißt vor den schädlichen elektromagnetischen Einwirkungen auf den Organismus, die weit unterhalb der Schwelle der Wärmewirkung liegen. Diese Wirkungen reichen kilometerweit; gerade weil es um feinste Körperprozesse geht, genügen dafür niedrigste Feldstärken.

Diese Wissenschaftler fordern weit niedrigere Grenzwerte, die uns auch vor den nichtthermischen Wirkungen der Mobilfunkstrahlung besser schützen könnten.
Nicht bewiesen?
Die Betreiber behaupten, diese Gesundheitsgefahren seien „nicht bewiesen“, weil sie sich nur zum Teil im Labor reproduzieren lassen nach dem Schema „Wenn A dann B“. Bewiesen ist damit nur ihr veraltetes Wissenschaftsverständnis aus dem 19. Jahrhundert, das zwischen einem unbelebten Fleischkloß und einem lebendigen Organismus nicht unterscheiden kann. Die moderne Molekularbiologie kennt längst nicht-lineare Verursachungen. Weite Bereiche der heutigen Medizin gehen aus von Syndromen, deren komplexe Wirkungsbündel sich nicht mechanisch aufschlüsseln lassen. Im Bereich der Allergologie sind statistische Nachweise für Krankheitsbilder anerkannt, obwohl die Wirkmechanismen im Körper bislang nicht im Detail nachvollziehbar sind.

Destroying Democracy

Anyone watching C-SPAN on July 8th, when Congressman Bernie Sanders I-VT and a bipartisan coalition took to the floor to protect the privacy of what Americans are reading and viewing on the internet, got one hell of a civics lesson. In an extraordinary display, the usually placid floor of the United States House of Representatives erupted as the Republic majority demonstrated once again that winning is their only goal. And democracy shouldn't be allowed to stand in the way.
Section 215 of the USA Patriot Act - a law hastily passed in the wake of the horrendous 9/11 attacks - greatly expanded the government's authority to seize "business records" without any showing that the person whose records are being seized is involved in any kind of wrongdoing. These "business records" include files about what books innocent Americans are borrowing from libraries and buying from booksellers.
So, the amendment would have prevented the government from using section 215 to go to the federal secret court to get an order - which the court is essentially powerless to deny - requiring the disclosure of Americans' reading records. The amendment was supported by a broad cross section of members - from progressives like Congressman Sanders, John Conyers (D-MI) and Jerrold Nadler (D-NY) to conservatives like Butch Otter (R-ID) and Ron Paul (R-TX). But the day before the vote, the White House significantly upped the ante when the Administration issued a rare veto threat against the bill in our amendment to protect readers' privacy passed. This was Bush throwing down the gauntlet and his foot soldiers in the House Republican leadership got the message. This was a must win.
When the vote finally occurred on the amendment, the typical 17 minute time limit expired and the amendment had won 219-201, with almost 30 Republicans voting for the amendment. But wait! The Republican presiding over the House didn't end the vote. Then the House Republican leaders began the process of "persuading" errant Republicans that supporting the President is more important than supporting our most fundamental Constitutional rights. A couple of votes changed. Then supporters of the amendment took to their feet demanding that the vote be closed.
Shouts of "Shame, Shame, Shame" echoed through the House Chamber as scores of angry members on the Democratic side took to their feet. But the Republicans are apparently immune to such public shaming, having become experienced at overturning fair votes in Florida and on the floor of the House last year during the Medicare vote after keeping that vote open for three hours.
Finally, after keeping the vote open twice as long as scheduled the Tom DeLay and company had threatened, cajoled, and enticed enough Republicans to tie the vote at 210-210. To the jeers of the amendments supporters the presiding Republican let the gavel fall and the amendment was defeated on a tie vote.
Ironically, the Republicans had subverted the most basic underlying principle of a democracy - that the will of the majority as evidenced by a fairly taken vote should prevail - in order to protect the Bush Administration's abridgement of American civil liberties under section 215 of the Patriot Act.
Win at any cost. What a sad civics lesson for America's children and for foreign countries who are supposed to look to America as an example of democracy.

IS MONSANTO QUIETLY DROPPING rBGH?
Since its release onto the market in 1994, Monsanto's recombinant Bovine Growth Hormone (rBGH) has been banned in most industrialized nations, other than the U.S., Brazil, and Mexico. While the genetically engineered hormone is regularly being injected into 22% of the dairy herd in the U.S. to force cows to give more milk, scientists warn that it may increase milk drinkers' risks of getting cancer. After a decade of forcing unlabeled and untested rBGH-tainted milk and dairy products on consumers, Monsanto is mysteriously scaling back its production of the controversial drug. In January the company announced a 50% cutback in production. Recently, Monsanto's plants in Austria and Augusta, Georgia, have halted production entirely, supposedly due to minor contamination problems. Rumors within the industry, however, are that Monsanto is in a panic about field reports of major damage to bovine health, including bone cancer, prompting the company to phase out production of the controversial hormone so as to avoid legal liability.

MAD COW REGULATIONS: A LONG TIME COMING
Last January, after the first case of Mad Cow Disease was discovered in the U.S, the federal government tried to alleviate consumer concerns by announcing new regulations that would forbid the feeding of blood, slaughterhouse wastes, and manure to cows. Six months later, none of those regulations have been implemented, although the USDA says the formal publications of new rules is imminent. The beef industry has applied intense pressure to the FDA and USDA to ensure that new regulations don't cut too deeply into profits. At the same time, the health of the American consumer is being jeopardized.

Kurtz and Ferrell face 20-year charges of mail and wire fraud in federal court arraignment
Dr. Steven Kurtz, Associate Professor of Art at the University of Buffalo, was arraigned and charged in Federal District Court in Buffalo today on four counts of mail and wire fraud (United States Criminal Code, Title 18, United States Code, Sections 1341 and 1343), which each carry a maximum sentence of 20 years in prison.
The arraignment of Dr. Robert Ferrell, Professor of Genetics at the University of Pittsburgh, who was indicted along with Kurtz, has been postponed for a week for health reasons.
The defendants were charged not with bioterrorism, as listed on the Joint Terrorism Task Force's original search warrant and subpoenas, but with a glorified version of "petty larceny," in the words of Kurtz attorney Paul Cambria. The laws under which the indictments were obtained are normally used against those defrauding others of money or property, as in telemarketing schemes. Under the arraignment conditions, Kurtz is subject to travel restrictions, random and scheduled visits from a probation officer, and periodic drug tests.
EMINENT SCIENTISTS CONFUSED AND ALARMED
A great number of people are wondering why this seemingly absurd case is still being pursued.
"I am absolutely astonished," said Donald A. Henderson, Dean Emeritus of the Johns Hopkins University School of Hygiene and Public Health and resident scholar at the Center for Biosecurity of the University of Pittsburgh Medical Center. Henderson was awarded the Presidential Medal of Freedom by President Bush for his work in heading up the World Health Organization smallpox eradication program and was appointed by the Bush administration to chair the National Advisory Council on Public Preparedness.
"Based on what I have read and understand, Professor Kurtz has been working with totally innocuous organisms... to discuss something of the risks and threats of biological weapons--more power to him, as those of us in this field are likewise concerned about their potential use and the threat of bio-terrorism." Henderson noted that the organisms involved in this case--Serratia marcescens and Bacillus atrophaeus--do not appear on lists of substances that could be used in biological terrorism
