In 1905, the federal government did not make laws that willfully violate the Constitution. There were no surveillance cameras on street signs, nor metal detectors in doorways. People were not strip-searched or frisked for weapons prior to boarding public transportation. Americans back then were allowed to have civil liberties, privacy, and private property. Jurists on the Supreme Court understood the letter of the law embodied in the Constitution, and understood that it was their job to protect it...
