Ich möchte Ihnen nur als Tipp den Schriftverkehr mit der Bayrischen Versicherungskammer zukommen lassen, vielleicht ist Ihnen das eine Argumentationshilfe mit dem Grundstückseigner.

Ich habe dieser Tage mit der Bayrischen Versicherungskammer ein Gespräch zum Thema Risikoversicherung für den Grundstücksbesitzer, der sein Dach an einen Mobilfunkbetreiber vermietet. Der schriftliche Kommentar lautete:

“Wie Sie uns telefonisch mitteilten, haben Sie das Dachgeschoss eines Gewerbebetriebes an eine Mobilfunkfirma vermietet. Nach unserer Ansicht sind Sie damit nicht der Betreiber der Anlage. Wir empfehlen Ihnen die Haftungsfrage mit der Mobilfunkfirma zu klären und evtl. eine Haftungsfreistellung zu erreichen.“

Das Problem im deutschen Nachbarschaftsrecht ist jedoch folgendes:

Zuerst haftet der Grundstücksbesitzer gegenüber den Nachbargrundstücken. Dies bedeutet, dass die Nachbarn zuerst den Besitzer verklagen, da sie ja auch in KEINEM Vertragsverhältnis zum Betreiber stehen. Damit ist auch die direkte Klage gegen den Betreiber von seitens der Nachbarn nicht möglich. Erst im 2. Schritt kann der Grundstückseigner gegen seinen Vertragspartner (Betreiber/Provider) Regressansprüche geltend machen, sofern er dann finanziell überhaupt noch in der Lage ist. Die Erfolgsaussichten gegen den Betreiber sind äußerst gering, da es sich bei diesen meist um GmbH´s und/oder Tochtergesellschaften größerer "Holdings" handelt, die zumeist den Hauptfirmensitz im Ausland haben.

Dies bedeutet: der Grundstücksbesitzer geht erst einmal in finanzielle "Vorkasse" gegenüber den Nachbarn und muss dann versuchen seinen Schaden geltend zu machen, falls er dazu finanziell noch in der Lage ist.

Diskussionen, wie gefährlich Handys für Kinder und Jugendliche sind, gibt es schon lange. Dieser Tage wiederholte die Ärztekammer ihre Forderung nach einem Verbot von Mobiltelefonen für Kinder unter sechs Jahren, wie das Gratistblatt "Heute" berichtete.

Gerd Oberfeld, Referent für Umweltmedizin der Österreichischen Ärztekammer, verglich die Gefährdung am Montag gegenüber der APA sogar mit dem Rauchen. "Das ist ja auch für unter 16- Jährige verboten."

Studien aus Schweden würden beweisen, dass Personen unter 20 Jahren, die mit ihrem Handy telefonieren, ein fünfmal höheres Risiko hätten, an bösartigen Gehirntumoren zu erkranken, so Oberfeld. Es läge in der Verantwortung der Politik, gesetzliche Rahmenbedingungen zu setzen und einen breiteren Diskurs in der Gesellschaft zu starten.

In this study, the effects of nonionizing electromagnetic fields (EMF; 925 MHz) on the OmpF porin channel have been characterized at the single-channel level. Channel activity was recorded in real time by the voltage clamp method. Our results showed an increase in the frequency of channel gating and voltage sensitivity. The effects of EMF lasted for several milliseconds after the field source was terminated. However, the conductance levels of channels did not change significantly. Thermal effects of EMF on single-channel properties are a possible cause, based on theoretical evaluation of results that were comparable to those seen in conventional experiments at different temperatures. We conclude that EMF affects both the dynamics and conformation of the channel, either directly by affecting critical amino acid side-chain arrangement, or indirectly, via the electrolyte or the lipid membrane.

According to Witricity CEO E. Giler, electrical cables could soon be a thing of the past, replaced by a new system that uses electro-magnetic waves. The system is based on work by physicist Prof. M. Soliacic at the Massachusetts Institute of Technology, and comprehends ideas of Nicola Tesla and Th. Edison.

E. Giler was keen to stress the safety of the equipment, saying there is no risk because energy was transferred largely through magnetic fields, while humans and most objects around them are non-magnetic.

Is it very strange that CEO underestimates an electro-magnetic field impact on the environment if even so many of the most scientifically involved uni minders preached a carbon tax as panacea for stopping a climate change?

First, prof' Richter's study on soldiers exposed to microwave radiation in the army showed shortened latency period for brain tumors - <10 years only in young workers. Int J Occup and Env Health 6 page 187-193, 2000. He predicted this would happened with cell phone users. Second, we must not forget that most works on cell phones are simply biased in their methods, most of them were industry funded and it was felt in the way they were done. When studies are biased anything can be underestimation, both long and short term risk. That Rothman relied and agreed with their assumption which is already biased, is what can drive nuts anyone who looks for an objective view from leading people in the field.

The might of US scientific analysis and know- how has combined to produce a report on CCD, the syndrome of the disappearing bee, the key ecological issue of our time and one which constitutes nothing less than an existential crisis for humanity, such is the importance of pollination within the ecosystem.

An impressive array of experts are involved including some familiar names to those who have been following the CCD affair. Even the Department of Defence is involved. Is this a national security issue? Why not get Homeland Security in on it; or the CIA? They’ve been known to set up a sting or two.

The report itself is the result of a “ a collaborative effort to define an approach to CCD”. This approach is presumably a scientific method, but what would a layman such as myself know about that? I proceed on the basis that it isn’t entirely divorced from common sense.
