Krebs erregender Mobilfunkmast?

Neuhardenberg (MOZ) In der Gemeinde Neuhardenberg gibt es einen erschreckenden Verdacht: Der Mobilfunkturm nahe des Birkenweges, der heute von Vodafon betrieben wird, könnte mitverantwortlich für gehäufte Krebserkrankungen sein. Anwohner des Birkenweges haben sich deshalb Rat suchend an Bürgermeister Mario Eska gewandt. Auf acht von zwölf Grundstücken im Birkenweg leben zurzeit Menschen mit Krebserkrankungen, hat Mario Eska die Situation im Gemeinderat geschildert. Heute soll es nun eine Bürgerversammlung geben - mit dem Mobilfunkturmbetreiber.

Neuhardenbergs Bürgermeister nimmt es ernst, wenn Einwohner ihre Sorgen an ihn herantragen und um Hilfe bitten. Erst recht, wenn es um den Verdacht geht, dass ein Mobilfunkturm möglicherweise mit Ursache für Krebserkrankungen ist. "Wenn auf acht von zwölf Grundstücken im Birkenweg, der gleich neben dem Mobilfunkturm liegt, Menschen mit einer Krebserkrankung leben, dann ist das zumindest ungewöhnlich und dann muss man möglichen Ursachen nachgehen", hatte Mario Eska vor dem Gemeinderat erklärt. Der Mann ist kein Experte, aber er hat sich umgehört. "In einem Nachbardorf von Neuhardenberg gibt es eine ähnliche Sachlage", sagt er, will jedoch mit Rücksicht auf die Bürger, die sich bislang noch nicht an den Bürgermeister oder Öffentlichkeit gewandt haben, den Ortsnamen nicht öffentlich nennen.

Das Thema ist brisant. Erst vor wenigen Monaten gab es in Petershagen und Falkenberg eine Bürgerinitiative, die sich vergebens gegen den Aufbau eines neuen Mobilfunkturmes eingesetzt hatte. In Letschin wurde trotz Bürgerbedenkens vor einiger Zeit ein solcher Mobilfunkturm neu aufgebaut - allerdings nicht auf dem Dach der Schule, wie zeitweise auch zur Diskussion stand.

Bislang gab es stets die Genehmigung durch die Behörden, bislang aber gibt es auch noch keine Untersuchungen von Langzeitfolgen, die möglicherweise von Mobilfunktürmen ausgehen. Als sicher gilt nur, dass sich die Betreiber solcher Funktürme in aller Regel im Rahmen der gesetzlichen Vorgaben bewegen.

Dennoch staunte Neuhardenbergs Bauamtsleiter Dietmar Müller zum Beispiel nicht schlecht, als er wegen des Bürgeranliegens zum Thema recherchierte. "27 Anrufe habe ich gebraucht, um da langsam durchzudringen", versuchte er die komplizierte Recherche allein zum Neuhardenberger Mobilfunkturm zu beschreiben. Dabei kam unter anderem heraus, dass es zwar regelmäßige Messungen der Strahlungen dieser Anlagen gibt, allerdings offenbar nicht bei allen Mobilfunktürmen. "Nach meiner Kenntnis wird hier in der Region regelmäßig an Standorten in Bad Freienwalde, Müncheberg und Fürstenwalde gemessen", erklärte Bauamtsleiter Dietmar Müller. Dort allerdings seien nach den Ergebnissen die Schwellenwerte der Anlagen um mehr als das Hundertfache unterschritten. Der Neuhardenberger Mobilfunkturm ist offiziell zugelassen. Er wurde 1992/93 von der Telekom gebaut, so Müller. Er hat mehrfach den Besitzer gewechselt und wird jetzt von der Deutschen Funkturm GmbH betrieben. Die Zulassung durch die Regulierungsbehörde für Telekommunikation und Post läge vor, sagt Müller.

Auf ihrer Internetseite (http://www.bmwa.bund.de) räumt die Regulierungsbehörde in Sachen Mobilfunkstrahlung ein: "Durch den Betrieb von Mobilfunkeinrichtungen werden Strahlen ausgesendet. Bisherige Forschungsergebnisse können nicht belegen, dass es durch die Handy-Strahlung zu gesundheitlichen Beeinträchtigungen kommt. Sie können es aber auch nicht ausschließen."

Zudem haben die Betreiber von Mobilfunkanlagen erst im Januar 2005 Rückendeckung bekommen. Das Landgericht Braunschweig hat die Klage einer Bewohnerin abgewiesen, auf deren Haus eine solche Mobilfunkanlage betrieben wird. Die Klägerin hatte geltend gemacht, dass sowohl sie als auch ihre Familienangehörigen durch den Betrieb der Anlage mit gesundheitlichen Langzeitschäden zu rechnen hätten, unter anderem einer erhöhten Krebsgefährdung, einer Schwächung der körpereigenen Abwehr, einer verminderten Melatoninproduktion und Kopfschmerzen. Sie war der Ansicht, die 26. Bundesimmissionsschutzverordnung, in der die Grenzwerte für elektromagnetische Strahlung festgelegt sind, sei verfassungswidrig, weil bei der Festlegung der Grenzwerte die gefährlichen athermischen Wirkungen der Strahlung nicht berücksichtigt worden seien. Damit habe der Gesetzgeber das Vorsorgeprinzip zum Schutz der Bevölkerung nicht berücksichtigt.

Zwar legte die Frau einige aktuelle Gutachten vor, die aus Sicht des Gerichtes aber keine handfesten Beweise für eine Gesundheitsgefahr erbrachten. Damit gäbe es, so das Gericht, keinen Grund für eine geänderte Risikobewertung.

Dass es keineswegs sicher ist, dass die gehäuften Krebserkrankungen in den Häusern im Neuhardenberger Birkenweg auf den Mobilfunkmast zurück zu führen sind, weiß auch der Neuhardenberger Gemeinderat. Bürgermeister Mario Eska will die Situation dennoch nicht unbeachtet lassen. Der Bereiber des Mobilfunkturmes hat Gesprächsbereitschaft signalisiert.

Heute will er bei einer Bürgerversammlung zum Thema informieren. Fest steht, dass die Gemeinde wenig Einfluss auf den Standort des Mobilfunkturmes nehmen kann. Das Land, auf dem er steht, war Anfang der 90er Jahre an die Telekom verkauft worden.

Die Einwohnerversammlung findet heute, ab 19 Uhr, im Sportlerheim statt.

Thursday morning, the Senate Foreign Relations Committee will be meeting to vote on John Bolton's nomination. As it stands, a 10-8 party line vote of the Republican-controlled committee would favorably send Bolton's nomination to the Senate floor for a final vote by the full body, where confirmation is likely.

But we still have a chance to stop the Bolton nomination in Thursday's committee meeting before it reaches the Senate floor.

My Democratic colleagues and I have been working overtime to try to convince at least one fellow Republican committee member to join with us -- to resist the arm-twisting from the White House and the Senate Republican leadership, and to instead do the right thing by rejecting this terrible nomination.

At this point, our best chance may well rest with Republican Senator Lincoln Chafee from Rhode Island. Unfortunately, Senator Chafee has decided to reluctantly support the Bolton nomination, despite the fact that a new Zogby poll shows over 80% of Rhode Islanders oppose the nomination. I need your help right now and over the next 24 hours to personally lobby Senator Chafee to change his mind:

We all know that John Bolton is absolutely the wrong choice to be America's next UN Ambassador. But before you call Senator Chafee's office, I wanted to remind you of a few of the many reasons why:

* John Bolton has politicized the intelligence-gathering process. The last thing we should be doing is promoting officials who try to twist intelligence in order to create "imminent threats" to our country -- especially in light of the debacle in Iraq, where over 1,600 soldiers have died, over 12,000 soldiers have been injured, plus countless other innocents of the war.

* John Bolton has shown disdain for the United Nations throughout his career. We all want to reform the UN. But why would we send someone who is so disrespected -- someone who said "there is no United Nations" and "if [the UN Headquarters] lost 10 stories, it wouldn't make a bit of difference."

* John Bolton has shown a pattern of trying to fire subordinates for no good reason. In every case he was overruled, but his behavior and vindictiveness had a chilling effect on independent intelligence analysts. It got so bad at one point that Secretary of State Colin Powell himself had to make a special trip to visit the analysts and boost their morale.

* John Bolton has not been truthful with the Foreign Relations Committee. He led the committee to falsely believe that he didn't really care that these intelligence analysts didn't give him the information he wanted and he just "shrugged it off". Nothing could be further from the truth -- he went after them aggressively. He also didn't tell the truth about the comments he said he received from the Ambassador to South Korea whom he said complimented him. In fact, the Ambassador was very critical of him.

* Many leading opponents to the Bolton nomination come from within the Bush Administration. The strongest criticism of John Bolton comes from Republicans, including self-described conservative Carl Ford, who called Bolton a "serial abuser."

It's remarkable to me that despite all of this evidence and so much more, not a single Republican on the Foreign Relations Committee has been willing to oppose this ill-conceived nomination -- yet.

"Rettet den Regenwald" bezieht sich dabei auf Informationen der Nichtregierungsorganisation "BankTrack", die die deutsche Bank im Zusammenhang mit anderen Mitfinanzierern in einem Bericht von Juni 2004 erwähnt. Die WestLB wie die Behauptung alsfalsch zurück. Sie entbehre jeder Grundlage: "Die WestLB ist in keiner Form an diesem Projekt beteiligt", sagte Sprecher Hans Albers.

Entwurf für Telemediengesetz: Bundesregierung will Datenschutz massiv einschränken (11.05.05)

Der Entwurf des Bundeswirtschaftsministeriums für ein neues Telemediengesetz stößt auf massive Kritik von Bürgerrechts- und Verbraucherorganisationen. Der Arbeitsentwurf sieht unter anderem vor, dass jeder "Diensteanbieter" auch ohne Zustimmung des Nutzers personenbezogene Daten speichern und weitergeben darf. Für die Zulässigkeit der Speicherung der Nutzungsdaten sollen Anhaltspunkte für eine rechtswidrige Nutzung des Dienstes genügen - und zwar nicht nur der Verdacht, die Entgelte für den Dienst nicht zu zahlen, sondern auch der Verdacht, den Dienst "in sonstiger Weise rechtswidrig zu Lasten des Diensteinhabers oder Dritter zu nutzen". Auch ist vorgesehen, dass Auskünfte über die Nutzer nicht nur an Strafverfolger, sondern auch an Private erteilt werden sollen. Die Bürgerrechts- und Datenschutzinitiative STOP1984 kritisierte, es entstehe der Verdacht, dass über den Umweg angeblichen Verbraucherschutzes eine vorbereitende Vorratsdatenspeicherung etabliert werden solle.

Auch der Verbraucherzentrale Bundesverband (vzbv) warnte, unter dem Vorwand, gegen illegale Downloads vorgehen zu können, drohe eine ungehemmte Datensammlung durch die Hintertür.

CREATING HUMAN-ANIMAL HYBRIDS

New guidelines set by the National Academies of Sciences would permit the development of human-animal hybrids. The creation of these new species would be allowed for the sake of research. According to the standards, this would be permitted "under circumstances where no other experiment can provide the information needed." The standards also recommend "strong scientific justification" for experiments where human cells are used to develop major aspects of the brain of the new animal. In addition, newly developed human-animal species are not allowed to breed with each other. These standards are voluntary, and human-animal hybrids are already under production. An ethics committee at Stanford University has approved a proposal to create mice with brains made almost completely of human brain cells. Stanford law professor Hank Greely, who chaired the ethics committee, said the board endorsed this procedure based on the assumption that the animal would probably not experience higher levels of human thought, given the size and shape of the mouse brain. The committee recommended closely monitoring the mice's behavior and immediately killing any that display "human-like behavior," although, admittedly, no one quite knows how an observer would be able to truly distinguish whether or not a lab mouse is thinking and feeling like a human. HUMAN GENES ARE WHAT'S FOR DINNER

Japanese scientists are splicing human genes into rice that will ultimately be grown for human consumption. While some opponents say the concept borders on cannibalism, genetic engineers claim the new rice has environmental benefits. Researchers spliced a gene from a human liver into rice to help the plant "digest" pesticides, thereby allowing the crop to be sprayed with up to 13 different pesticides without damaging the rice. The developers of the new human-rice admit that if this gene were to escape into the wild, a new generation of "superweeds" could be inadvertently created. The USDA has refused to respond to allegations that it has been covering up cases of Mad Cow disease in the U.S. for well over a decade. Lester Friedlander, a former USDA veterinarian, says he was told by USDA officials as far back as 1991 that if his testing laboratory ever found evidence of Mad Cow disease, he was to tell no one. He and other scientists say they know of cases where cows tested positive for the disease in laboratories but were ruled negative by the USDA. Mad cow is a concern to public health because humans can contract a fatal brain illness known as variant Creutzfeldt Jakob disease from eating beef products contaminated with the mad cow pathogen. WORLD LEADERS MEET TO BAN 12 PERSISTENT TOXIC CHEMICALS

Government officials from 130 nations are currently meeting in Uruguay to discuss methods of eliminating twelve of the world's most toxic pesticides and chemicals. Specifically, these toxins, such as DDT and PCBs, are referred to as Persistant Organic Pollutants (POPs). They are known to kill people, damage the nervous and immune systems, cause cancer and reproductive disorders, and interfere with normal infant and child development. The University of Hawaii has released a new study that shows people who consume processed meats have a 6,700% increased risk of pancreatic cancer over those who consume little or no meat products. The study was done over a period of seven years on nearly 200,000 people. Researchers pin the blame on sodium nitrite, a chemical used in nearly all processed meats, including sausage, hot dogs, jerkies, bacon, lunch meat, and even meats in canned soup products. Although these same meats can be purchased without sodium nitrite, consumers must seek the few products that are labeled as such. The USDA attempted to ban sodium nitrite in the 1970s, but was blocked by the meat industry, which relies heavily on the chemical to add color to processed meats, making them look more appealing. KYKOTSMOVI, Ariz., May 9, 2005-Could a 150-year-old document hold the key to Hopi self-determination? Quite possibly, explained attorney Lana Marcussen at the Hopi Veterans' Memorial Center on April 28, as she discussed the 1848 Treaty of Guadalupe Hidalgo. In that treaty, signed after nine years of war between the United States and Mexico, Mexico ceded 55% of its territory-the lands that would become the states of Texas, New Mexico, Arizona, California and parts of Colorado, Nevada, and Utah-to the American government in exchange for $15 million in reparations for war damage.

The Mexican government gave up land, but negotiated measures to protect the civil and property rights of its citizens who would be living in territories controlled by the United States. In particular, Article VIII guaranteed, "In the said [ceded] territories, property of every kind, now belonging to Mexicans not established there, shall be inviolably respected. The present owners, the heirs of these, and all Mexicans who may hereafter acquire said property by contract, shall enjoy with respect to it guaranties equally ample as if the same belonged to citizens of the United States," (quoted from a 2004 U.S. Government Accounting Office document, "Treaty of Guadalupe Hidalgo: Findings and Possible Options Regarding Longstanding Community Land Grant Claims in New Mexico").

Ms. Marcussen is an expert in water law, Indian law, and public land law. She has an extensive knowledge of Spanish land grants, and it is on the basis of those land grants given by Spain to the indigenous peoples of the "Americas" that the Hopi may be able to claim real property rights in the land, water, and minerals of their homeland. Hopi real property rights would supersede all other rights, including those claimed by the federal government. Ms. Marcussen explained to an audience overflowing the meeting room that at its most profound basis, the issue is sovereignty. Under the United States Constitution, power is distributed between two sovereigns, the federal government on the one hand and state governments on the other. Under this principle, the third sovereign is the people, as individuals and as a group, and the people's rights are superior to both federal rights and states' rights. Tribal sovereignty, not specified by the Constitution, has had to find its place within this basic structure.

Ever since the federal government "conquered" the indigenous peoples of this country, it has declared itself the principle sovereign over those peoples. The Hopis and other tribes have a little sovereignty, as much as the federal government thinks they should have at any given time, and the federal government holds Indian property in trust to do with as it sees fit, in principle if not in reality, for the benefit of the Indians.

The Treat of Guadalupe Hildalgo turns this theory upside down. "Because the Mexican government recognized you as individual sovereigns together in a city (or pueblo), your right is superior, as is your right to control, without the permission or participation of the federal government, your land and your water," said Ms. Marcussen. She explained that while the Hopi have not yet asserted their sovereign rights, other Pueblo Indians have, and they have won in court. She further explained that the rights of Pueblo people as individuals take precedence over the rights of the tribal governments, which were imposed on the tribes by the federal government by the Indian Reorganization Act of 1934.

When the federal government accepted Article VIII of the Treaty of Guadalupe Hidalgo, it committed to protecting all of the property of the people who chose to remain where they were in the lands ceded by Mexico. These people were Mexican citizens, and the U.S. promised to respect their rights as such, whether they chose to remain Mexican citizens and relocate, or they chose to stay where they were and eventually become citizens of the United States.

The federal government then set about determining how much land belonged to the Pueblo peoples under the terms of the Treaty. In California, they asked the Pueblo peoples in 1851 to provide proof of their land grants and pretty much accepted all of the land claims that were filed. The federal government lost one half of California and realized that it had made a mistake. In response, the government in 1854 radically changed the criteria for proof of Spanish or Mexican land grants in Arizona and New Mexico.

Rather than asking people to bring in their original land grants, the government sent out its own surveyor. If the official surveyor thought someone had a claim, that person would be allowed to bring his papers into court and the court would decide whether to allow the claim. Some scholars have estimated that only about 25% of the original Spanish land grants were recognized in New Mexico (of which Arizona was originally a part), while the GAO report states that as many as 55% were recognized, but in any case, all 23 claims submitted by the Pueblos of what is now the State of New Mexico were eventually proved and honored. On that basis Ms. Marcussen and her colleagues have won primary water rights-not federal reserved rights-for tribes in New Mexico.

So where does this leave the Hopi? The pueblos of the Southwest were given land grants in part because after the Pueblo Revolt of 1680, the Catholic Pope declared that the Pueblo Indians, by virtue of the fact that they lived in cities and had a social and political organization sophisticated enough to drive the priests out of the Southwest at will, which is what they did in 1680, were civilized people (and, incidentally, would make good soldiers). As the Spanish military and clergy re-entered the Southwest, they started issuing land grants to the pueblos as well as to Spanish individuals. Since the Spanish visited Hopi as early as 1540, it is likely that there is a land grant to the Hopi (or, as they were called then, the Moqui). And if there is, the Hopi are entitled to Article VIII rights under the Treaty of Guadalupe Hidalgo. That means that when the federal government holds land or water or natural resources in trust for the Hopi, it is merely a trustee, not a sovereign. Therefore, it does not have the right to negotiate the sale or lease of that property, much less force the Hopi to accept the terms that the federal government has set in collusion with the Department of the Interior for the benefit of multinational corporate interests.

"If you really have Article VIII rights, real property rights," said Ms. Marcussen, "you as individuals and as a people have superior rights. If we can establish that you have Article VIII rights, you are the sovereign. If you are the sovereign, you can say, 'I don't care what you pay; we will not sell.'"

While Ms. Marcussen stated that the United States government is still having a difficult time accepting that Indian peoples could have real property rights, those rights have been affirmed by the courts for the New Mexico pueblos and for the Tohono O'odham in Arizona. When Ms. Marcussen completed her talk, one of the many Hopi elders who were present said, "This gives us lots of energy and hope; it is reminding us of something we already knew, and shows how we might go forward."

Ms. Marcussen's presentation was hosted by Black Mesa Trust as part of its celebration of the Decade of Water. Dedicated to preserving the N-aquifer for future generations of Hopi and Navajo children and to fostering the sustainable and just use of water around the world, the Trust is sponsoring a run from the Hopi Village of Lower Moencopi to Mexico City in March 2006. Native American runners will present indigenous water concepts and ethics to an international audience of world leaders at the Fourth World Water Forum.

Earth Lightens Up

Earth's surface has been getting brighter for more than a decade, a reversal from a dimming trend that may accelerate warming at the surface and unmask the full effect of greenhouse warming, according to an exhaustive new study of the solar energy that reaches land.

Ever since a report in the late 1980s uncovered a 4 to 6 percent decline of sunlight reaching the planet's surface over 30 years since 1960, atmospheric scientists have been trying out theories about why this would be and how it would relate to the greenhouse effect, the warming caused by the buildup of carbon dioxide and other gasses that trap heat in the atmosphere.

Meanwhile, a group led by Martin Wild at the Swiss Federal Institute of Technology in Zurich, home of the international Baseline Surface Radiation Network (BSRN) archive, had gone to work collecting surface measurements and crunching numbers.

"BSRN didn't get started until the early '90s and worked hard to update the earlier archive," said Charles N. Long, senior scientist at the Department of Energy's Pacific Northwest National Laboratory and co-author of a BSRN report in this week's issue (Friday, May 6) of the journal Science.

"When we looked at the more recent data, lo and behold, the trend went the other way," said Long, who conducted the work under the auspices of DOE's Atmospheric Radiation Measurement (ARM) program.

Data analysis capabilities developed by ARM research were crucial in the study, which reveals the planet's surface has brightened by about 4 percent the past decade.

The brightening trend is corroborated by other data, including satellite analyses that are the subject of another paper in this week's Science.

Sunlight that isn't absorbed or reflected by clouds as it plunges earthward will heat the surface. Because the atmosphere includes greenhouse gasses, solar warming and greenhouse warming are related.

"The atmosphere is heated from the bottom up, and more solar energy at the surface means we might finally see the increases in temperature that we expected to see with global greenhouse warming," Long said.

In fact, he said, many believe that we have already been seeing those effects in our most temperature-sensitive climates, with the melting of polar ice and high altitude glaciers.

The report's authors stopped short of attributing a cause to the cycle of surface dimming and brightening, but listed such suspects as changes in the number and composition of aerosols—liquid and solid particles suspended in air—and how aerosols affect the character of clouds.

Over the past decade, the ARM program has built a network of instrumentation sites to sample cloud characteristics and energy transfer in a variety of climates, from tropical to polar.

"The continuous, sophisticated data from these sites will be crucial for determining the causes," Long said.

Long also pointed out that 70 percent of the planet's surface is ocean, for which we have no long-term surface brightening or dimming measurements.

Why the Sun seems to be 'dimming'

They have reached the disturbing conclusion that the amount of solar energy reaching the Earth's surface has been gradually falling.

Paradoxically, the decline in sunlight may mean that global warming is a far greater threat to society than previously thought.

The effect was first spotted by Gerry Stanhill, an English scientist working in Israel.

Cloud changes

Comparing Israeli sunlight records from the 1950s with current ones, Dr Stanhill was astonished to find a large fall in solar radiation.

"There was a staggering 22% drop in the sunlight, and that really amazed me." Intrigued, he searched records from all around the world, and found the same story almost everywhere he looked.

Sunlight was falling by 10% over the USA, nearly 30% in parts of the former Soviet Union, and even by 16% in parts of the British Isles.

Although the effect varied greatly from place to place, overall the decline amounted to one to two per cent globally every decade between the 1950s and the 1990s.

Dr Stanhill called it "global dimming", but his research, published in 2001, met a sceptical response from other scientists.

No Disciplinary action will be taken against council officials despite a blunder which meant a phone mast was put up without planning permission. Newcastle Borough Council launched an investigation into plans by mobile phone firm Orange to build a mast at the junction of Clayton Lane and Clayton Road, in Clayton.

The probe was ordered because planning officers failed to inform Orange's agent, Marconi, that the mast plan had been refused by councillors after a 350-name petition against the development was handed in by residents in March. Orange say the mast will now be installed.

But the council has ruled no disciplinary action should be taken, although a review of procedures will now take place.

Families living near the site say the decision is unacceptable. Ray Rees, a father-of-four from Warwick Avenue, Clayton, said: "The council seem to be unable to acknowledge what happened and give the full details."

Mr Rees, aged 53, has submitted a formal complaint to the council but says his questions about what happened have not been fully answered.

He said: "Planning officer Neale Clifton apologised for the error but there was no response relating to the reasons why it happened in the first place."

Planning legislation says that if a certain period of time passes without the planning authority notifying the applicant about the decision - 56 days - then the development can proceed.

Marconi said the deadline to notify it of a decision was March 17. It claimed they did not receive the notice until March 18.

An officers' report to councillors says post from Orange requesting details of a council decision was received by the council on January 21, but not marked as received until January 24. So officers used January 24 instead of January 21 to start the countdown for a notification.

The report states: "In this case the decision notice was sent, by fax, to the agents on March 18, one day late. At the time of the sending of the fax, officers were acting in the belief that they had until March 21 to ensure the agent had received the decision."

The gaffe has forced the council to admit procedural changes are needed.

The report adds: "The investigation has been unable to identify a specific individual who made an error. Accordingly no disciplinary proceeding has been taken in this matter. Nevertheless the investigation has highlighted procedural weaknesses that must, be addressed to minimise the likelihood of this kind of event arising in the future."

A spokesman for Orange confirmed the company had contacted Newcastle Borough Council and announced it intends to proceed and build the mast.

The spokesman could not confirm when the work will start, but said Orange was keen to proceed, because the site has deemed planning consent for a mast.

Representing the Mobile Phone Operators, Michael Dolan's letter (Letters, May 5) selectively quotes from both the Stewart and National Radiological Protection Board reports attempting to mask the health concerns regarding the electro magnetic radiation emissions from phone masts. Far from being reassured by the vested interest government and phone industry, making huge profits at the risk to public health, the following quotes from these same reports confirm this technology is far from safe:

6.38. "There is now scientific evidence which suggests that there may be biological effects occurring at exposures below these (NRPB and ICNIRP) guidelines" (Stewart Report).

And from the NRPB's Mobile Phones and Health 2004.

"6. We conclude that it is not possible to say that exposure to RF radiation, even at levels below national guidelines, is without adverse health effects . . . 7. The board notes that a central recommendation in the Stewart Report was that a precautionary approach to the use of mobile phone technologies be adopted . . .

18. There remain particular concerns in the UK about the impact of base stations on health."

So is this meant to reassure us Mr Dolan? You deliberately site your harmful masts next to housing and schools. Do you call this a "precautionary approach"?

While government/phone operator funded research attempts to gloss over the health concerns, independent research is regularly confirming the dangers to health, and proving the current guidelines, set 9,000 times too high, are meaningless. Only last week research from Germany again showed how the pulsed microwave signals from phone masts permanently damages living cells. The phone operators' blatant disregard for our health is outrageous.

COUNCILLORS were expected to refuse permission for a trio of telecom masts at yesterday's development committee meeting (Tuesday).

Three separate applications for mobile 'phone monopoles in Glenrothes were being considered as The Gazette went to press. Planners were recommending prior refusal on all of them. All three were deemed to set an "undesirable precedent" for similar developments if they were approved. And the signs seem to indicate a hardline approach by Fife Council on future masts in the town.

Vodafone applied to erect a 12-metre mast on Flemington Road - a few yards away from the Aldi supermarket car park. The council received an objection from the store, which said company Head Office had not been notified. Aldi also stated the information it had received had been poor.

Elsewhere, Vodafone wanted to put up a 10-metre mast in Minto Place, but council planners concluded this would be "out of scale and out of character" with the area. Three objections for the Minto mast were received from members of the public.

Thirdly, a controversial device planned for Leslie Road - also submitted by Vodafone - was similarly expected to be blocked yesterday. Eight letters of objection were lodged with the council on a number of issues, including health risks, visual impact on the area and road safety.

The company had hoped to construct the 13.4 metre mast between Leslie and Leslie Roundabout, on the same side of road as the Fettykil Fox inn.

However, council planners advised that any device should be no larger than the existing street furniture, which stands at 10 metres tall.

Last Sunday, Fox TV News re-ran a one-hour documentary called 'Iran: The Nuclear Threat.' From start to finish, it assumes (without presenting any evidence) that Iran is building nuclear weapons and is a horrendous threat to the peace of the world. The only dissenting views shown are there merely to demonstrate how stupid or devious some people are (people such as a UN weapons inspector and an Iranian spokesman). Watching it, the sense of déjà vu is overwhelming. It's almost exactly like the buildup to the attack on Iraq: call the inspectors woolly-headed, call the deniers liars, call the dissenters cowards. Assert the case but offer no evidence to support it...

Don't ask America's top brass exactly how the Iraq war is going. They don't know. The various U.S. services have never managed to agree on a unified system for gauging successes and failures in the counterinsurgency campaign. Instead, everyone uses a different yardstick. Recently the National Intelligence Council, the information clearinghouse for America's spy services, produced a study of the problem. ONE of Australia´s leading scientists and a pioneering policewoman are among the 15 victims of the nation´s worst plane crash in almost 40 years. Police today said all aboard the Fairchild Metroliner III aircraft were killed when it crashed and exploded in flames yesterday near the Lockhart River Aboriginal community in Cape York, in far north Queensland.

The plane smacked into a 500m high, tree covered hillside on approach to Lockhart River airstrip on a flight from Bamaga at the tip of Cape York.

Although there was rain, low cloud and strong wind at the time, the two pilots had not reported problems. Investigators said it was too early to determine the cause of the crash.

The aircraft´s flight recorder has been recovered and it will be taken to Canberra for analysis.

Among the dead was Dr David Banks, 55, the principal scientist with quarantine authority Biosecurity Australia.

He was in north Queensland doing work for the northern Australian quarantine strategy, which aims to protect the country from pests and diseases that can enter the country from more northern nations.

Ausbau der Mobilfunknetze erhitzt die Gemüter - Gemeinden sind mit der Situation meistens überfordert

Egal ob Scheyern, Ernsgaden oder Reichertshofen - die Mobilfunknetze im ganzen Landkreis Pfaffenhofen, sollen mit Hochdruck ausgebaut werden. Vor allem für das neue UMTS-Netz werden noch viele Standorte benötigt. Dass die Akquisiteure der Netzbetreiber nicht nur in der Kreisstadt unterwegs sind, ist hinlänglich bekannt. Immer wieder werden unbedarfte Mitbürger mit plumpen Argumenten über den Tisch gezogen, so kürzlich geschehen im Rohrbacher Gewerbegebiet.

Kaum wird ein möglicher Standort für eine Mobilfunksendeanlage bekannt, so gründen sich auch schon Bürgerinitiativen, die lautstark versuchen "ihr Wohnumfeld", von solch ungeliebten Anlagen frei zu halten - verständlich, stehen die Mobilfunksendeanlagen doch im Verdacht, der Auslöser für so manche Krankheit zu sein. Dabei wird von den Anliegern alles mögliche unternommen was erlaubt ist und auch manches was nicht mehr erlaubt ist, um ihr Ziel zu ereichen.

So mancher Bürgermeister im Landkreis muss leidvoll erfahren, dass der Mobilfunkpakt II nicht das Papier wert ist, auf dem er geschrieben steht.

Doch gerade die Kommunen haben Möglichkeiten dort einzugreifen, wo es nötig ist - sie wissen meistens nur nicht wie! Einige Kommunen aus dem Nachbarlandkreis Kehlheim, so wie auch aus anderen bayerischen Landkreisen, machen uns vor wie das geht.

Aufgrund der neuesten Rechtsprechung (z.B. Verwaltungsgericht München) ist es nun möglich, zur Berücksichtigung des vorbeugenden Immissionsschutzes im Rahmen der Bauleitplanung, aber auch des Bauordnungsrechtes, entsprechende Vorgaben der Kommunen zu berücksichtigen.

Die Kommunen haben nun die Möglichkeit, die Bauleitplanung für komplette Orts- oder Stadtgebiete zu ändern, in dem sie die Umsetzung einer integrierten Mobilfunkplanung beschließen, mit dem Ziel der Berücksichtigung des vorbeugenden Immissionsschutzes. Es ist aber nicht möglich, dass die Kommune einen rechtsverbindlichen Grenzwert festsetzt. In der Begründung des geänderten, bzw. neuen Bebauungsplanes muss die Kommune festschreiben, dass man Gesundheitsvorsorge betreiben will, mit dem Ziel die Strahlenbelastung der Bevölkerung so weit wie möglich zu reduzieren, ohne jedoch Mobilfunk auszuschließen.

Um dieses Ziel zu erreichen und die aktuelle Situation nicht zu verschlechtern, ist als Sofortmassnahme eine Veränderungssperre zu erlassen, welche eine Errichtung von neuen Mobilfunksendeanlagen, auch unter zehn Metern Höhe, in bewohnten Gebieten ausschließt. Diese Veränderungssperre ist sofort nach Beschlussfassung und öffentlicher Verkündung rechtskräftig und kann bis auf vier Jahre verlängert werden.

Die Netzbetreiber könnten nun aber hergehen und ihre Masten unmittelbar an den Ortsrand setzen. Möchte man das verhindern, ist es auch unumgänglich, eine Änderung des Flächennutzungsplanes für den Außenbereich zu beschließen. Um Rechtsgültigkeit zu erlangen, müssen jedoch unter Berücksichtigung des vorbeugenden Immissionsschutzes, funktionelle Positivstandorte ausgewiesen werden.

Ein derartiges Konzept kann nur in Zusammenarbeit mit einem professionellen Ingenieurbüro entstehen, dass auch in der Lage ist, die topographische Situation der jeweiligen Kommunen in die Positivplanung mit einzubeziehen.

Ingenieurbüros die Sendemasten auf Schulgebäuden empfehlen würden, sollten grundsätzlich abgelehnt werden !

Die Erarbeitung eines rechtsverbindlichen, professionellen Konzeptes lässt natürlich Kosten entstehen, die von den Kommunen getragen werden müssen, obwohl die Gewinne beim Staat (50 Milliarden EURO für Lizenzen) und bei den Netzbetreibern gemacht werden. Der vorbeugende Gesundheitsschutz muss uns diese Kosten jedoch wert sein, zumal ja auch der Großteil der Bevölkerung das Handy nutzen will.

Es gibt auch eine "einfachere Lösung", die zwar momentan sehr wirkungsvoll ist, für den Großteil der Gemeinden aus rechtlicher Sicht aber keine brauchbare Langzeitlösung darstellt. Hierbei handelt es sich um den Erlass einer Ortsgestaltungssatzung, welche die Errichtung neuer Mobilfunksendeanlagen aus ortsgestalterischen Gründen verbietet. Eine derartige Satzung kann nur von Verwaltungsgerichten verworfen werden, die wiederum nur entscheiden können, wenn ein Kläger mit Klagebefugnis dagegen klagt. Der Außenbereich muss aber auch bei dieser Variante berücksichtigt werden, das heißt es muss natürlich auch hier eine professionelle Planung mit Positivstandorten gemacht werden.

Die Standortplanungen der Netzbetreiber sind in erster Linie kostenorientiert. Daraus resultiert dass die meisten Sendeanlagen dort stehen, wo die passenden Versorgungsleitungen sowieso vorhanden sind, nämlich auf den Dächern mitten in unseren Wohngebieten. Aber auch dort werden hohe Mieten für den Standort gezahlt, die sich so mancher Netzbetreiber gerne sparen würde. Wenn nun die Kommunen hergehen und eine Vorsorgeplanung mit Positivstandorten erstellen, so eröffnet sich für die Kommune natürlich auch ein gewisser Handlungsspielraum. Die Städte und Gemeinden könnten nun hergehen und den Netzbetreibern günstige oder gar kostenlose Standorte zur Verfügung stellen, wenn die Netzbetreiber im Gegenzug dafür "gefährliche Standorte" in den Ortsgebieten aufgeben. In jedem Falle gilt hier: wer nichts zu bieten hat, der kann auch nicht viel verhandeln!

Um die passiven Gemeinden aus ihrer Lethargie zu reißen, hat die ödp "Bürgeranträge" als Muster vorbereitet, die als Anträge an den Gemeinderat, bzw. Stadtrat in oben genannter Form gestellt werden können. Der ödp-Kreisverband Pfaffenhofen hält diese Anträge für interessierte Bürger, aber auch als Vorlage für die Gemeinden bereit.

Die Ausweitung der Sojaflächen ist auch Ergebnis europäischer Agrarpolitik und europäischen Konsums, der auf billiges Fleisch setzt und die Einfuhr von Sojaschrot fördert.

Even though Governor Richardson proposed a plan for protecting the most fragile parts of Otero Mesa, the Interior Department chose instead to give oil and gas companies virtually unlimited access to this special place. The agency's decision also ignored comments submitted by tens of thousands of people from all over the country in support of protecting Otero Mesa.

What's worse, the Interior Department went ahead with its plan even though federal land managers believe there is little chance of finding economically recoverable amounts of oil and gas in the area.

Lawyer for tribe argues that its sacred traditions and beliefs being violated by Energy Department

LAS VEGAS - There is a centuries-old story of Snake Mountain that is still taught to the children of the Western Shoshone Nation.

"Someday when we wake that snake up … it will get mad and rip open," Shoshone Spiritual Leader Corbin Harney wrote in his 1995 book "The Way it Is - One Water, One Air, One Mother Earth."

"With his tail, that snake will move the mountain, rip it open and the poison will come out on the surface."

Today Snake Mountain is called Yucca Mountain, site of the under-construction high-level nuclear waste repository, 90 miles northwest of Las Vegas and about 15 miles east of Death Valley in Inyo County.

Robert Hager, the lawyer for the Shoshone tribe, got the OK Wednesday from U.S. District Judge Philip Pro to submit that story as part of Harney's affidavit into the court record of a lawsuit the tribe hopes will halt the nuclear waste dump.

Pro, following an hourlong hearing, took under advisement the Western Shoshone Nation's request for an injunction to stop the project.

Although Hager did not specifically make an argument to stop the project on First Amendment grounds that the Shoshone people are being denied the right of freedom of religion, he gave the Energy Department, overseers of Yucca Mountain, a good indication of where this case eventually may be headed.

Hager, supported by Harney's affidavit, argued that Yucca Mountain is being "desecrated" by the project, that the Indians are being denied access to the sacred rock prayer rings where "the Great Spirit" sends them messages and that bodies of the Indians' ancestors have been disrupted by tunneling.

"The rock rings at Yucca Mountain are very sacred places where the Shoshone people prayed, and when our people pray at the rock rings the message comes and goes through those rings," Harney says in his affidavit.

"I am aware the bodies of some of our ancestors have been removed from Yucca Mountain by government agents, which is a violation of our sacred traditions and beliefs that the body of a person who dies should be buried and should remain at the place where that life ended."

Harney, who is now 85, was among two dozen members of the tribe in Pro's courtroom Wednesday. He and other Shoshones said they no longer have access to the rock ring area.

Hager also said Shoshones already are being poisoned by the project and that as many as 2,500 of them are at risk of getting silicosis - fibrosis of the lungs caused by long-term exposure to silica dust - from the project.

The federal government countered that the Shoshones are barking up the wrong tree by seeking injunctive relief in Las Vegas federal district court, arguing that the Washington, D.C., Circuit Court or the U.S. 9th Circuit Court of Appeals has jurisdiction in this matter.

Justice Department Attorney Sara Culley said the Nuclear Waste Policy Act, which places such matters before the court of appeals, applies in this case. The Shoshones are asking for their injunction by arguing that another statute, the Yucca Mountain Development Act, is unconstitutional.

Pro said jurisdiction is a key question with which he must wrestle.

"I have to stay focused on whether I have jurisdiction," Pro told both sides.

Hager argued that not only does Pro have jurisdiction in this case as set forth by the Ruby Valley Treaty of 1863, which specifies uses for the tribe's nearly 60 million acres, Pro also has the power to rule that the Yucca Mountain Development Act is unconstitutional because it is "based on lies."

He was referring to the revelation in late March by Energy Secretary Samuel Bodman that employees of the U.S. Geological Survey had written e-mail messages indicating some scientific work had been falsified.

Internal Energy Department e-mails written in preparation for seeking a license to open the nuclear waste repository indicate the alleged falsification focused on the speed at which water flowed through the mountain, an issue that would have meant disqualification of the Yucca site years ago, Hager told Pro.

Hager argued that the president and Congress relied on those tainted reports as sound scientific evidence to pass and sign into law the development act, and that such actions make the statute unconstitutional.

Culley said to stop the project now will be detrimental to many phases including environmental and scientific studies that "Congress has determined is in the best interest of the public."

She said a ruling in favor of the Shoshones also would halt long-term monitoring of the site and electrical maintenance, as well as put 1,600 Energy Department employees out of work.

"The site will fall into disrepair," she said of a lengthy stoppage.

As for removal of Indian bodies from Yucca, Culley said the Shoshones have been invited to "walk through the site" to observe future tunneling, which she said will not occur again for four years. Drilling, however, is continuing, she said.

And Culley said the Indians are not in any immediate harm because environmental protections are in place and that the long process toward licensing involves public input, and that includes the concerns of the Shoshones. She said the earliest date for storing nuclear waste there is 2010.

Culley said the Shoshones will "not likely prevail on the merits" in part because courts long ago determined the Indians do not have title to the land.

Last year, President Bush signed a measure to distribute $145 million to approximately 10,000 Western Shoshone as compensation for land that was taken from the tribe.

The tribe has refused to accept the money and in March filed its lawsuit to stop the nuclear dump project.

Western Shoshone National Council Member John Wells said after the hearing that the government's argument that the tribe no longer owns title to the land should not apply in this case.

"The government should abide by the treaty," Wells said, noting that when American Indians refer to land they are talking about Mother Earth that everyone owns and shares, "not the government's European concept of land ownership."

The treaty specifies the U.S. government can use the land for settlements, mines, ranches and the construction of roads and railroads. Wells said that had the government proposed storing hazardous materials in Yucca Mountain at the time the treaty was signed the Shoshones "definitely would have said no."

Western Shoshone Nation Chief Raymond Yowell said after the hearing that some members of the tribe still call the site Snake Mountain and that the story of it rising up and spewing poison "was the vision of a holy man long before the White Man came.

"Of course, that holy man could not have known about the circumstances now, but, in his vision, he foresaw that one day energy could explode from the mountain. We want to stop that from happening. Mother Earth is sacred to us."

Since George W. Bush has been in power in the United States many people have opposed him, fought for truth and for democracy.

These folks are scattered around the world, from Berkeley to Bismarck to Buffalo — to Berlin. They have held signs in freezing temps on a freeway in Bangor; they have sat alone at a kitchen table to write intrepid letters to the editor in Blacksburg, South Carolina, and they have prayed aloud for peace in Bagdad, Arizona.

All around us are stories of people who have displayed extraordinary courage in these dark times. They personify the image of lighting a candle in the darkness — in the rain — on Main Street — sometimes all alone.

It's not easy, it's often terrifying, and it's absolutely necessary.

I would like to try to gather some of these stories and distribute them to peace groups around the world through the Internet.

The purpose is to tell the Peace Links group in Primghar, Iowa that they are not alone. They have brothers and sisters in huge numbers, just about everywhere; to tell the Peace and Justice Committee of St. Mark's Church in Minneapolis that they have commonality with some very special people in Miami, Florida.

I am asking you to tell me about groups or individuals in your area that have a story of courage that might be of interest to others.

You can either write the story yourself and send to me or give me a lead, an email address where I might contact this person or group.

I would then write the story and send it to groups around the world via email, under the heading: "The Cost of Freedom".

I hope to be able to gather quite a few of these stories and send one every once in awhile.

My motivation for doing this project:

- I think there are a lot of very interesting, untold stories that deserve some recognition.

- I would also like to chuck my spit wads at the elephant. I write books. And the more folks who know about my books the more I can fling. I would include a link to my website with each mailing.

In Frankreich gibt es eine lebhafte und kontroverse Debatte über die EU-Verfassung.

ATTAC Frankreich hat sich frühzeitig mit dieser Frage der Verfassung beschäftigt (S. SIG 29), fördert und fordert die öffentliche Debatte um die „Verfassung“ und führt – zusammen mit anderen Organisationen und Gewerkschaften - eine breite Kampagne für das NEIN, nachdem die Attac-Mitglieder sich zu 84% für das NEIN und ¾ für eine solche Empfehlung seitens Attac ausgesprochen hatten. Attac Frankreich plädiert für einen "neuen demokratischen Aufschwung Europas". Die Ablehnung dieser „Verfassung“ ist allerdings eine Voraussetzung für ein Europa von unten.

In Deutschland und in Österreich laufen die Kampagnen ein wenig anders, denn die Bevölkerungen werden für unmündig gehalten, sie dürfen nicht über die Verfassung abstimmen. Das österreichische Parlament hat es nicht für nötig befunden, eine Volksabstimmung zum Thema durchzuführen. Wohl ist es in dem medialen Ghetto Österreich auch schwierig, die Bürgerinnen und Bürger ausreichend zu informieren. „Auch wenn derzeit ein formeller Beitritt der Schweiz zur EU nicht auf der Tagesordnung steht, lehnt sich die Wirtschafts- und Sozialpolitik in der Schweiz sehr eng an das neoliberale Europa an“, daher unterstützt attac Schweiz die Kampagne für die Ablehnung der „Verfassung.

Debatte um das Grundeinkommen

Die kapitalistische Globalisierung zerrüttet nicht nur die Gesellschaften des "globalen Südens" (Walden Bello), sondern schlägt mehr und mehr zurück auf die Metropolen. Wie können wir darauf reagieren? Diskutiert wird die dreifache Forderung nach radikaler Arbeitszeitverkürzung ("30 Stunden sind genug", SiG 34), Mindestlohn und Grundeinkommen. Dieses Heft befasst sich mit den unterschiedlichen Konzeptionen für ein Grundeinkommen.

Vertreter eines bedingungslosen Grundeinkommens gehen davon aus, dass die Produktivität der Weltwirtschaft so gesteigert wurde, dass wir mit einem "Diskurs der Fülle gegen die Ideologie des Mangels" angehen sollten (H.Krampertz): "Jeder Mensch hat, nur einfach so, weil es ihn gibt, ein Recht auf Teilhabe am gesellschaftlichen Leben und am gesellschaftlichen Reichtum. Das muss sich niemand verdienen, nicht durch Arbeit, nicht durch Wohlverhalten, durch gar nichts. Das ist Menschenrecht". Einkommen und Arbeit sollen prinzipiell entkoppelt werden. Das kann auch finanziert werden: "Eine gerechtere Heranziehung hoher Einkommen und Vermögen reichen allemal zur Finanzierung" (W.Rätz). Berichte aus Namibia, Spanien und Brasilien zeigen unterschiedliche praktische Ansätze.

Einer Gegenposition reicht die Umverteilung der Einkommen nicht aus, ihr geht es auch um die solidarische Umverteilung von Arbeit und eine radikale Arbeitszeitverkürzung. Sie wirft die Frage auf, wie und unter welchen Produktionsverhältnissen denn der Reichtum erzeugt wird, der da verteilt werden soll. Massenarbeitslosigkeit im Norden wie im Süden ist in dieser Sicht das Ergebnis der globalen kapitalistischen Konkurrenz, die zur Überproduktion und zur Niedriglohnökonomie führt. "Arbeit und Einkommen können nicht voneinander getrennt werden: Angriffe gegen die Arbeitsbedingungen schlagen sich zwangsläufig im Einkommensniveau nieder und umgekehrt" (A.Klein).

Die Debatte über die konkrete Ausgestaltung der Parole "Genug für alle", über die Methoden der Bekämpfung der Massenarbeitslosigkeit und über das Ziel der Demokratisierung der internationalen Arbeitsteilung wird sicherlich mit großer Leidenschaft fortgesetzt werden.

Inzwischen nimmt der Neoliberalismus einen neuen Anlauf: Die Weltbank hat einen neuen Chef, ausgerechnet den Kriegstreiber Wolfowitz. Das ist für uns ein Anlass, die Geschichte ihrer jährlichen Gutachten nach zu verfolgen (P.Cammack).

Die WTO bereitet sich auf das nächste Treffen in Hongkong vor. Entgleisen lassen oder neue Regeln erkämpfen - das ist die Frage an Nicola Bullard und Martin Khor.

wie bereits in mehreren örtlichen Zeitungen berichtet, wird gerade eine Mobilfunkantenne auf das Dach des Hauses Waldweg 42 in Hamburg-Sasel errichtet. Hiergegen wurde spontan eine Bürger-Initiative gegründet. Als wir den Mietvertrag letzten Sommer unterzeichneten, gab es keinen Hinweis darauf, dass eine Mobilfunkantenne auf das Haus installiert werden soll. Als „Betroffene“ haben wir uns jetzt mit dem Thema auseinander gesetzt und mit Entsetzen festgestellt, dass sehr viele Mediziner, Physiker und Politiker bereits sehr deutliche Warnungen ausgesprochen haben, die allerdings in Deutschland hartnäckig ignoriert werden zugunsten der Mobilfunkanbieter. Es gibt zahlreiche Informationsquellen im Internet: einige Links haben wir unter http://waldweg42.verkaufsteam.de zusammengetragen.

Das einzige Mittel gegen die massive Bestrahlung scheint die öffentliche Meinung zu sein sowie Protestschreiben an die zuständigen Politiker. Die Öffentlichkeit ist allerdings weitestgehend nicht informiert (oder gar desinformiert?). Wir wollen aber einen Beitrag dazu leisten und haben deshalb eine eBay-Auktion gestartet, die auf die Problematik aufmerksam machen soll…

Eventuell lenken die Mobilfunkbetreiber ein, wenn ihnen genug Kunden davonlaufen. Daher mache ich den Anfang und verzichte ab sofort auf mein Handy. Ich habe das Telefon zertrümmert und bei eBay angeboten (Artikel-Nr.: 7155414196) und hoffe so auf viel Aufmerksamkeit, viele Nachahmer und viele Protestschreiben! Es bleibt bei unserem Nein zu Militarisierung und Marktradikalismus im Europäischen Verfassungsvertrag

Wolfgang Gehrcke, außenpolitischer Sprecher des PDS-Parteivorstandes, erklärt zur bevorstehenden Abstimmung des Deutschen Bundestages über die Europäische Verfassung:

Der Vertrag für eine Europäische Verfassung soll bis zum 27. Mai 2005 von Bundestag und Bundesrat ratifiziert werden. Mit einem deutschen Ja soll die Volksabstimmung in Frankreich beeinflusst werden. Die PDS lehnt den vorliegenden Verfassungsvertrag ab und wird dies erneut in den parlamentarischen und außerparlamentarischen Debatten deutlich machen. Im Wesentlichen sind es drei Gründe, die die Entscheidung der PDS maßgeblich bestimmen.

1. Die Bevölkerung in Deutschland ist von einer direkten Entscheidung über den Verfassungsvertrag ausgeschlossen. Dieser Umstand schafft in der EU Zonen unterschiedlicher Bürgerrechte. Gerade ein Regelwerk, das den Anspruch erhebt, historisch zu sein, bedarf in allen europäischen Ländern der Legitimation durch die Bürgerinnen und Bürger. Die PDS ist unabhängig davon, wie sie den Verfassungsvertrag beurteilt, für eine Volksabstimmung in allen europäischen Ländern, so auch in Deutschland, eingetreten. Es gibt schon deshalb keine Veranlassung, die Verweigerung einer Volksabstimmung durch eine parlamentarische Zustimmung zu legitimieren.

2. Der Verfassungsvertrag erhält durchaus Aussagen für eine Stabilisierung Europas als Friedenszone und die Bedeutung der Charta der Vereinten Nationen in diesem Zusammenhang. Diese Absichtserklärung wird aber entwertet durch die Verfassungsverpflichtung der EU-Mitgliedsstaaten, ihre militärischen Fähigkeiten zu verbessern, durch die Aufstellung von EU-Militärverbänden und eine faktische Verknüpfung mit der NATO. Aufrüstung als Verfassungsziel, das kann und wird nicht die Zustimmung demokratischer Sozialisten finden.

3. Der freie Markt und freier Wettbewerb sind als Grundlage europäischer Wirtschafts- und Sozialpolitik im Verfassungsvertrag verankert. Diese Grundlage ist für eine soziale Entwicklung in Europa ungeeignet. Im Unterschied zum Grundgesetz ist im Europäischen Verfassungsvertrag die Marktwirtschaft nicht organisch mit der Sozialbindung des Eigentums als Verfassungsziel verbunden. Freier Markt und freier Wettbewerb als Verfassungsziele könnten zur Legitimation von Sozial-Dumping und Privatisierung öffentlichen Eigentums genutzt werden.

Die Debatten um den vorliegenden Verfassungsvertrag mussten differenziert und abwägend geführt werden. Die PDS hat zur Information der Öffentlichkeit mehr geleistet als die Bundesregierung. Bei aller Abwägung im Debattenprozess spitzt sich nun die Entscheidung auf die Abstimmungsfrage Ja oder Nein zum vorliegenden Verfassungsentwurf zu. Diesem Umstand kann auch die PDS nicht ausweichen. Die Abwägungen der PDS haben ein deutliches Übergewicht für ein Nein ergeben.

Den Bürgerinnen und Bürgern Frankreichs ist die Last auferlegt, für alle in der EU entscheiden zu müssen. Die PDS ist solidarisch mit den demokratischen Kräften des Neins in Frankreich. Die Europäische Linke tritt für ein anderes, besseres Europa und eine andere, bessere Verfassung ein.

A Mobile phone giant has revived plans to install a mast in the heart of a Bath community fighting off a scheme by a rival company. Bear Flat residents were given cause for hope earlier this year when phone operator O2 agreed to examine a fresh site in its hunt for a mast location.

But rival firm Hutchinson 3G has now applied for planning permission to put a mast on top of the building where the Smiles store is situated at the junction of Wellsway and Wells Road.

Two years ago, a Government planning inspector upheld Bath and North East Somerset Council's decision to refuse the application on the grounds that it would spoil the skyline.

Objections to the new application have been even more fierce than first time around, attracting 182 letters of protest compared to 60.

Issues raised range from concerns about potential health risks, the effect on the skyline, possible interference with electronic equipment and the 7ft mast's impact on property prices.

Some residents also question whether more masts are needed, and want to know why Hutchinson 3G cannot share facilities with O2.

The latest application has been recommended for approval by council planning officers, who believe changes to the design mean that it will not clutter the skyline.

Originally, Hutchinson 3G had wanted to put up three antennae, two dishes and an equipment shed disguised as chimney pots and flues.

The latest proposals are for the antennae to be disguised as a flagpole, as well as one dish and an equipment shed painted the same colour as the flat-roofed Bath stone building, which has two floors of flats above its ground floor shops.

But Sian Meredith, local spokeswoman for campaign group Mast Sanity, said: "It's too near to homes and schools and it's been refused before. There is nothing that is different about this new application. It's visually unacceptable."

O2 has won a long-running battle for the right to put up a mast between Wellsway and Bloomfield Road, but is now considering an alternative site in Alexandra Park.

Mik Phelps, who has been helping to co-ordinate opposition to the Hutchinson 3G application, added: "The company is not looking at sharing with O2 on its new site, which clearly would be okay for it if it's okay for O2.

"This is yet again a mobile phone operator trying to muscle its way through.

"It obviously hasn't taken no for an answer, but the level of local objection is even greater than before."

A spokesman for Hutchinson 3G said Bear Flat offered the best site available, and mast-sharing with O2 could not yet be considered.

He stressed that the equipment would meet international health and safety guidelines, and would not interfere with legitimate electronic equipment.

Residents were invited to an information day on the application last June.

National planning policy states that phone companies should share masts where possible but that local planners have no authority to refuse decisions based on feared health risks.

The application will be decided at a council committee meeting at Southdown Junior School, Mount Road, at 6pm on Monday, May 16.

A publican has vowed to give up his business and move his family from Wessington if plans to site a 17-metre mobile phone mast in the village go ahead.

Scott Brown, landlord of the Three Horseshoes, says he and his family will pack up and leave if Orange and the farmers on whose land the mast would be erected do not listen to him and other campaigners and resite the mast.

A meeting was due to be held between the farmers – the Easom family – Orange and the protesters last night.

"Safety guidelines state that a mast should not be erected within 200 metres of a school and they say this one will be 300 metres from our school," said Mr Brown.

"But the children use the village green and I have measured the distance from the pole and that takes them well within the 200-metre safety zone.

"They have a choice of where to site this pole, but the children at the school will have no choice if they put it up. I cannot put my children in that sort of danger."

Mr Brown has erected a sign outside his pub urging villagers to join his petition and flyers stating "The future's bleak, the future's Orange," are going up around the village.

NE Derbyshire District Council granted planning permission for the mast at Nether Green Farm, Moorwood Moor Lane.

Villagers are angry because the permission was delegated to head of planning and development Keith Hill rather than going before the planning committee.

A district council spokesman said: "All local planning authorities have 56 days in which to process this type of telecommunications application. If they do not make a decision within 56 days the applicant automatically gets consent.

"In the case at Wessington, there was not a planning committee due to meet within 56 days of the application. Under the council's scheme of delegated powers it was allowed to decide on the matter without it going to the planning committee."

Villagers say they did not know about the application until a month before it was decided, despite the application having been made a year ago.

Orange spokeswoman Sue Hammett said the company had written to the school, parish council and the nearest residents, informing them of the planning application.

She said they received a letter from the parish council voicing concerns about the siting of the mast and wrote back asking if the council could suggest an alternative site.

"We expected the parish council to put this information out to the community so if the villagers did not know about the application, they need to look to them."

T Mobile is hoping to erect a mobile phone mast for third generation mobile phones in Argyle Road, North Finchley.

There is a lot of opposition to this from those living nearby. A questionnaire sent to parents at the Moss Hall Nursery and Junior schools revealed that the vast majority of parents who responded were against it.

The main concern is the health issue, and yet such a vital concern is disallowed during planning application procedures as a reason for banning the mast.

Need I ask why Barnet Council is even considering allowing such masts to be erected in residential areas when research into the possible adverse effects of beams from mobile phone masts particularly on children, the elderly and frail remains incomplete?

I am glad that Barnet Council will not allow masts to be erected in school grounds, but what about safety for the rest of us?

T Mobile's consultation process was a joke. They have sent in their application ignoring the results of the schools' questionnaire.

As I live in Courthouse Road, at the very least I would have expected to have a letter from T Mobile informing us of their intentions, and about the surgery to answer questions at the school. I received nothing at all.

As far as the surgery is concerned, I am told only 20-30 people attended. Some parents of children at Moss Hall with whom I spoke realised too late that the surgery was to be held the day after they were sent a letter.

We should remember that these masts could be up for generations. Once the precedent has been set for allowing the erection of masts in residential areas, what's to stop more of them being installed?

A New mobile phone mast could be built in Immingham, 250 metres from homes.

In my view mobile phones have not been around long enough to prove they are not harmful. North East Lincolnshire Council's planning committee will decide tomorrow whether to approve the 25m high mast, with six antennas and four dishes.

Should it do so the mast, to serve Orange customers, would be built at the rear of the Phoenix House site, on Manby Road, and the existing mast, at the ATS site, would be removed.

Resident of Woodlands Avenue, off Manby Road, Des Berry (79) said: "I would strongly object. It is the same as overhead powerlines. We have enough kelter in the atmosphere around here."

Neighbour Dean Smith (35), whose house is for sale, said: "It is not very good when you are trying to sell a property and having a mast built nearby.

"We have not had any letters about it and we should have a right to have our say."

He added: "In my view mobile phones have not been around long enough to prove they are not harmful."

According to a report, that will be seen by the committee when it meets at 9.30am in Grimsby Town Hall, Immingham Town Council has expressed reservations about the proposal, partly on health and safety grounds.

The town council also believes that it will be "detrimental to the environment", although Orange has agreed to carry out landscaping work.

The report states: "The proposed mast would be further from residential properties than the existing one. It is considered that the proposal is acceptable in terms of visual impact.

"The Government guidelines state that, provided a base section meets the International Commission on Non-Ionising Radiation Protection (ICNIRP) guidelines for public exposure, it should not be necessary for the local planning authority to consider the health effects and concerns about them.

"It is considered that the proposal is acceptable on health and safety grounds and a refusal on this issue could not be justified".

Officers suggested the scheme be approved, subject to a number of conditions, including the removal of the existing mast.

An Orange spokesman said the proposal was simply to replace "like with like".

That's right, President Bush's overreaching has put the most powerful country in human history in fear fear that the U.S. will not be able to handle likely conflicts. As a result of that fear the conscientious objection of soldiers is not something they want to hear. But, they will hear it. And, more importantly, more and more Americans will hear it. They will learn that our soldiers are being ordered to commit acts they find unconscionable. Our youth will hear that if they enlist, they can't get out and recruitment will be made more difficult. Sgt. Benderman has already won. The question is how will the U.S. military handle the reality of a man of conscience?

The working class's refusal to synchronize its politics with its economic interests is one of the enduring puzzles of the present age. Between 1989 and 1997, middle-income families (defined in this instance as the middle 20 percent) saw their share of the nation's wealth fall from 4.8 percent to 4.4 percent. Yet Al Gore lost the white working class by a margin of 17 percentage points, and John Kerry lost it by a margin of 23 percentage points. As the GOP drifts further to the right, and becomes more starkly the party of the wealthy, it is gaining support among the working class. I have never seen a wholly satisfactory explanation for this trend ... Let's consider another possibility, then: The working class, or at least a large segment of same, suffers from a psychological disorder...

A CONTROVERSIAL phone mast faces being torn down after it was erected in the wrong place.

Plans by T-Mobile to build a 15-metre high tower were opposed by residents in Brunstane, who are now further enraged because the mast has been built closer to their homes than was originally proposed.

The mobile phone giant’s tower in Milton Road East has been built about 20ft from the nearest home and about 9ft from where it was supposed to be, apparently to avoid a gas main.

The council has completed an investigation and found that the mast is in the wrong place after complaints from residents.

T-Mobile will now have to apply for new planning permission, and if that bid is unsuccessful it will be told to take the mast down.

Letters seeking objections to the plans were only sent out to five nearby households by the city council, which residents claim left many people in the dark about T-Mobile’s plans.

They say even after they complained to the council about the location of the mast, T-Mobile has continued wiring it up ready for use.

Zahid Ali, 41, of Milton Road East, said: "It is an eyesore. Every time I look out of my front room, dining room, or two bedrooms, I see this thing in front of me.

"It will affect the resale value of our houses. No-one will want to buy a property so close to a mast."

Pensioner Alastair Hare, 72, who also lives on Milton Road East, added: "We live in some of the oldest properties in the Portobello area.

"But we would not have bought houses here if that thing was sitting outside the front door.

"There was no discussion about it - only [five] houses received letters about the bid for planning permission.

"They’ve got to go somewhere, but why straight in front of people’s houses?"

Sandra Yeaman, who has lived in Milton Road East for 23 years, said: "I do not think the council should grant T-Mobile new planning permission.

"How can they be trusted after they failed to notify the people most affected?"

A council spokeswoman said: "It’s in the wrong place so T-Mobile will have to put in a new application. It could be an enforcement issue."

A T-Mobile spokesman said: "There’s no way it’s been built in the wrong place. But we will speak to the council and completely corroborate with officers seeing as they think it is."

Residents had hoped that the nearby Jewel and Esk Valley College would come to the rescue and house the mast, but to no avail.

The T-Mobile spokesman said: "We were told by officials that the the college was not prepared to have the mast on their land."

But Howard McKenzie, principal at Jewel & Esk Valley College, said: "Following discussions, and after providing access to the college site, T-Mobile informed us that our site was not in fact suitable for their requirements."

President George W. Bush claims that he is spreading freedom throughout the world. However, for him 'freedom' appears to be more a slogan, devoid of content and used to harness U.S. nationalism for his own purposes. Freedom meant much more to the Founders of the American republic. They would be appalled at the president's crusade to impose democracy abroad and its resulting, but unnecessary, erosion of liberties at home. Bush's attempts to renew expiring USA PATRIOT Act provisions, which were supposed to be a temporary enhancement of government police powers in the wake of 9/11, show his shallow commitment to freedom where it is needed most -- here at home...
