Vera Stein, involuntarily detained, won at European Court of Human Rights

Vera Stein's recent victory at the European Court of Human Rights is a cause of jubilation for many with EHS who have suffered similar fates at the hands of psychiatrists and their ilk. Please note below relevant postings on EHS being misdiagnosed as mental illness and the ensuing abuses of Human Rights that such misdiagnosis brings in its trail.

Dear Friends,

We are happy to announce that on thursday, June 16, the European Court of Human Rights arrived at the sensational verdict that Vera Stein, who in her youth was psychiatrically imprisoned and slandered as being "hebephrenic" [see note at end. I O'Connor], finally after more than 20 years of legal battle, was a victim of the crime of an illegal deprivation of her liberty in the psychiatric prison in Bremen!

This is an historic event because it is a victory on a European level at the highest court in Europe and therefore being influential for the judicial system in the whole of Europe.

For all German speaking readers, there is a livestream report here:
http://demand.radiobremen.de/bb/redirect.lsc?stream=radiobremen/tv/bubi/video/donnerstag.wmv&content=content&media=ms

The part about the verdict beginns 3:30 minutes after the start of the video. In January 2000 our group helped to promote Vera Stein's case by leading the producers of a legal advice program in the First German TV channel, "ARD Ratgeber Recht" to her, which gave her case a lot of publicity in TV for the first time. You can see the report, which is still published by the channel as a live-stream:
http://www.ratgeberrecht.de/sendung/beitrag/rs2000013005.html

(Please click on "Video zum Beitrag". After the film begins, it takes 1 minute until you can see Vera Stein speaking and her drawings, showing how she was tortured in psychiatry.)

Please snowball this important message on your privat e-mail lists and newsgroups!

The verdict is published by the International Association Against Psychiatric Assault ( http://www.iaapa.ch ) in English here:
http://www.iaapa.de/CASE_OF_ST_|0v_GERMANY.pdf

Rene Talbot Irren-Offensive (lunatic offensive) Berlin, Germany

[note: hebephrenia is defined as "A type of schizophrenia characterized by foolish mannerisms, senseless laughter, delusions, hallucinations, and regressive behavior." Also note that the writer, Rene Talbot, considers Vera Stein to have been "slandered" by being erronously defined/misdiagnosed as a hebephrenic. I also insisted in my written submissions that it was a most severe form of slander to wrongly diagnose a patient to be a person of unsound mind]

And below is a BBC news online report:

26 September 2005: 'Years locked in mental institution' Vera Stein, a German woman, describes a harrowing ordeal of being falsely imprisoned in a mental institution, tied to beds and given injections. She emerged from hospital a physical wreck, and will never recover fully from the effects of the drugs she was forced to take.

Forty-seven-year-old Vera Stein clambers into her electric wheelchair and drives into her spartanly decorated lounge.

Her disability is just one of the effects of mental health drugs that were pumped into her against her will.

This year Vera won compensation from the European Court of Human Rights, after it ruled that she had been illegally detained for years in clinics, despite being mentally healthy.

"I was nearly 19 years old, so I was an adult, when my father had me committed to a clinic in Bremen," she told me.

"I was put straight in a locked ward. The necessary court order was not obtained for this. I was given double measures of drugs to pacify me. They used physical force to inject me with 17 different types of drugs."

Under German law, to commit someone to a clinic they must either sign their consent, or a court order must be obtained. But in this case her father simply won the agreement of the health authorities to lock up his daughter.

In total, she spent nearly 20 years in institutions as a result of this. Worse still, her case is not unique.

"The mere possibility of withdrawing a person from legal life in co-operation with a psycho-medical system will always lead to abuse - and there we do have some problems," says psychiatrist Helmut Pollaehne.

He says the control mechanisms to prevent cases like Vera Stein's are not sufficient.

For example, he argues that so-called "visiting commissions" always announce their visits beforehand, weakening their control function - and warns that privatisation in the health sector makes it all the more important for the state to defend the rights of people who are in mental health institutions.

"Within the German legal system, this is a rare case because the victims of psychiatric power are not very successful in taking their case to the court," Dr Pollaehne said.

"But in terms of being a victim - I mean being a victim of the abuse of psychiatry - it was not a rare case in the 1970s and it's not a rare case nowadays."

Ms Stein is now a crusader against the use of psychiatry to lock people up.

"The association of German judges has also complained that forced incarceration, forced treatments, and violations of personal freedoms take place in a legal grey zone," she says.

She adds that a recent study at Goettingen University showed the number of people held in psychiatric clinics against their will has trebled in the last decade.

15/9/02 (Citizens' Initiative Omega -- via Google) Another tragic misdiagnosis of an EHS sufferer who have been locked up and forcibly medicated Von: Imelda O'Connor ehsisreal@yahoo.co.uk

The EHS letter-writer lives in England.

" I had to move out of my flat (due to equipment the neighbour in the flat above me was using . . .It is this equipment which has triggered all my serious hypersensitivity problems. I found it increasingly hard to procure temporary accommodation . . . whilst I reached for suitable longer term accommodation. I therefore, eventually, reminded "my" G.P., the local authority housing departments (where I had been living)--and where I was then living temporarily, and social services that they had a legal obligation to assist anyone "homeless" for medical reasons. I was told (by social services and a doctor) that I could use a room at the hospital from which I would be free to come and go as I searched for long term accommodation. I pointed out that hospitals were not appropriate places for electrosensitive people (fluorescent lights, smoke sensors and other sensors, . . . ) and was told this was a "special" room in a "special part" of the hospital without the devices I was concerned about . .

.. However, I found that the room and ward in question were an ordinary hospital room and ward &, on my very first visit, I began to feel very unwell. I therefore thanked the "hospital" but explained that I would not be able to take up the offer of a room. Thereupon, seven thuggish members of staff were ordered to grab me and drag me down a corridor into a secure psychiatric unit (the "thugs" had been waiting for me in a room into which I had been asked to step). My arms were badly twisted (despite my shouting out that I have osteoporosis), my shoes were dragged off my feet (one shoe was broken in the process). I was covered in bruises & red marks on my skin. I was put on a __[this may be 9.2 but more likely, it is 5.2]. During this, a psychiatrist spent some four minutes with me in a courtyard & declared that because I could not use a phone I must be mentally ill, & put me on a section 2 (28 days). I was force medicated for a while (again very brutally). The psychiatrist in charge of my case saw me twice only (and only during a "review", with students and other people present), & "spoke" to me for some 5 minutes only on both occasions ( & did not in fact enter into any real conversation with me). The mental health reviews tribunal did nothing to help me, and simply endorsed the section (!) Whilst ___[avoiding] (as did, by now, the hospital) that I was electrosensitive the psychiatrist in question then wanted to put me onto a section 3 (up to 6 months & -- [repeatable] for life),--but needed agreement from an independent psychiatrist. When the first one failed to agree with her, a second one was dispatched---- [she] too, however, did not think that I should be placed on any section. By this time, the psychiatrist in que tion ran out of time (the 28 days had been served)--& I was released. Surviving under the numerous fluorescent light units, the smoke __sensors has been very difficult. . . .

Is there any way I can protect myself legally from any repeat of my appalling experiences re. sectioning?"

And to turn to current "reforms" in Ireland of psychiatry and making some amends for long decades of psychiatric abuse. Despite John Manweiler's wonderful legal win some months ago(an Irish jury awarded him the highest monetary award ever), the report in last Thursday's THE IRISH TIMES (see below) paints a gloomy picture of obstructions and general lack of cooperation among Irish psychiatrists to engage in reforms. While this profession has destroyed many people's lives it is now showing no great willingness to make amends and join the Irish tribunals newly set up to review involuntary detention and forced medication. Even Tim O'Malley, the Irish minister of State with responsibility for mental health has found their lack of coperation appalling: "People who are detained against their will for psychiatric care and treatment are among the most vulnerable in our society in terms of their human rights. It is completely unacceptable that those who should be the guardians of those rights, their treating consultants, are the ones who are obstructing reform."

THE IRISH TIMES, THU, OCT 20, 05

"NEGOTIATIONS ON MENTAL HEALTH PANELS FOUNDER [by] Carl O'Brien, Social Affairs Correspondent

The Mental Health Commission, independent watchdog for the mental health sector, will seek to recruit consultant psychiatrists from abroad to take part in review panels for involuntarily detained patients after talks with the main representative body for Irish consultants broke down yesterday.

Negotiations have been taking place for almost a year between health authorities, the commission and the Irish Hospital Consultants Association (IHCA) on plans to set up mental health tribunals to help safeguard the rights of thousands of patients detained against their will in psychiatric institutions.

More than 3,000 psychiatric patients are involuntarily detained in psychiatric hospitals each year. Ireland has one of the highest rates of involuntary detention in Europe - a source of concern for human rights campaigners and patient support groups.

These tribunals, which will review all decisions by consultants to involuntarily detain patients, will consist of three members: a chairperson, who must be a lawyer, a consultant psychiatrist and a lay member.

While lawyers and lay people have been recruited, the IHCA has instructed members not to apply for the positions.

The IHCA says consultants need greater staffing back-up to be able to adhere to very strict timescales accompanying the new tribunals. Failure to adhere to the codes may leave consultants or clinical directors liable to fines of up to €1,500 or two years in jail.

Following the expiry of a deadline set for agreement on staffing the tribunals yesterday, the commission's chief executive, Brid Clarke, yesterday told The Irish Times that the delays were undermining the rights of almost 3,000 psychiatric patients involuntarily detained in hospitals each year.

As a result, she said it intended to re-advertise for consultant psychiatrists to the mental health tribunals.

"We will be advertising within Ireland and internationally and will be providing applicants with the opportunity of full-time/part-time appointments and engagement on a sessional and case-by-case basis," she said.

Minister of State with responsibility for mental health Tim O'Malley expressed his "deep frustration" at the actions of consultants who were "obstructing reform".

"People who are detained against their will for psychiatric care and treatment are among the most vulnerable in our society in terms of their human rights," he said. "It is completely unacceptable that those who should be the guardians of those rights, their treating consultants, are the ones who are obstructing reform."

He said offers of greater resources had been made to consultants, but their stance was "baffling" and cast doubt on their willingness to co-operate with the proposed reforms.

The IHCA and other consultant representative bodies say the mental health sector is understaffed and that not enough clinical back up is available for them to participate in the tribunals.

They point to the recent Inspector of Mental Health Services report, which recommended establishing the equivalent of up to 27 consultants posts, according to estimates by consultants.

It is understood that in talks on tribunals, the Health Service Executive proposed 13 new consultant posts, with the support of junior medical staff and other professionals, at an estimated cost of €6-€10 million."

BOTSWANA: Ethnische Säuberung erreicht Endphase

8 Okt 2005

September geschlagen.

FIRST VICTORY FOR THE BUSHPEOPLE! Please continue the TOTAL BOTSWANA BOYCOTT UNTIL THERE IS FREEDOM FOR ALL SAN! see: - http://www.khoisanpeoples.org/action/action-index.htm

BOTSWANA: COURT VICTORY FOR ONE BUSHMAN FAMILY
1 November 2005

The Botswana High Court ruled on Friday 28 October that the government must allow Bushman Amogolang Segootsane and his family to return to their land in the Central Kalahari Game Reserve. It must also return his goats to him and allow him to bring water into the reserve.

Segootsane brought his case after he was prevented from going back to his home in the reserve. The government closed the reserve in September and removed all the Bushmen's goats, claiming they were diseased. An international panel of vets dismissed this reason as 'spurious'.

Dozens of Bushmen have been evicted from the reserve at gunpoint in recent weeks. Three Bushmen, including a seven-year old boy, have been shot and wounded. All the Bushmen involved in the Bushman organisation First People of the Kalahari were arrested and beaten when they tried to enter the reserve last month.

Tshatlha Ntwayamogala, who was evicted from the reserve this month, told the Telegraph newspaper, "They told us, 'when you leave this place, you leave as volunteers.' So we said 'if we are volunteers, we don't want to go.' They began threatening us. They told us, if we stay behind, they will end up killing us. One of the police said 'if you don't move, you will all be killed'."

Survival's director Stephen Corry said of Friday's court victory, 'This is great news. We're very pleased that the rights of the Segootsane family have been upheld by the court, although it remains to be seen whether the government will abide by the court's ruling. Now the government surely must also allow all the other evicted Bushmen to return home.'

Britain in the dock for human rights failures

Independent [UK]

10/02/05

Britain has one of the worst human rights records in Europe and faces investigation over its failure to comply with a series of European court rulings. More than 100 findings have been lodged against Britain to which the Government has not adequately responded, five years after Tony Blair said he had fulfilled his promise to 'bring rights home' by implementing the Human Rights Act. These range findings from violations of the rights of mental health patients to the failure to protect children from unlawful corporal punishment in the home...

BOTSWANA: Verhaftete Buschmänner gewinnen “Alternativen Nobelpreis”.

29.09.2005

Subject: TRÄGER DES ALTERNATIVEN NOBELPREISES AM 11.DEZEMBER IN BERLIN

SURVIVAL INTERNATIONAL PRESSEMITTEILUNG

28.11.2005

Sonntag,11. Dezember 2005

ARRESTED BUSHMEN WIN 'ALTERNATIVE NOBEL PRIZE'

A big success for Roy Sesana, the organization First People of the Kalahari (FPK), all the Gana and Gwi people and their supporters - and a big shame for the Botswana overlord governance.

ARRESTED BUSHMEN WIN 'ALTERNATIVE NOBEL PRIZE'

29 September 2005

Five days after their leaders were arrested and beaten, there was a dramatic turnaround today in the fortunes of the Kalahari Bushmen as they learnt they have won the 'Alternative Nobel Prize'.

First People of the Kalahari (FPK), the grass-roots organisation of the Gana and Gwi Bushmen of Botswana, who are fighting for their right to return to their ancestral homeland, today won Sweden's Right Livelihood Award, known as the 'Alternative Nobel Prize'.

The award has been given for the Bushmen's 'resolute resistance against eviction from their ancestral lands, and for upholding the right to their traditional way of life.'

Five days ago the FPK leaders were amongst a group of 28 Bushmen who were arrested by police firing tear gas and rubber bullets. The Bushmen were attempting to take food and water to their relatives still inside the Central Kalahari Game Reserve, from which most of the Bushmen have been evicted. The Bushmen leaders were badly beaten after being handcuffed.

FPK has been fighting a long battle for the right of the Gana and Gwi Bushmen to live peacefully inside the reserve, which is their ancestral homeland. The reserve's rich diamond deposits have been widely blamed for the government's expulsion of the Bushmen. De Beers, which runs all Botswana's diamond mines, is now the subject of a global boycott.

Past winners of the Prize include Kenyan environmentalist Wangari Maathai, and Nigerian Ken Saro-Wiwa.

The FPK's leader Roy Sesana is the first Botswana-born winner of the prize. For more information about the award go to: http://www.rightlivelihood.org/news/event05.htm

2005 RIGHT LIVELIHOOD AWARDS HONOUR PIONEERS FOR JUSTICE, FAIR TRADE AND CULTURAL RENEWAL Alternative Nobel Prize honours bushwo/men

29. Sept. 2005

The 2005 Honorary Right Livelihood Award goes to one of Mexico’s greatest living artists and community philanthropists, Franscisco Toledo.

The SEK 2 million Award is shared by Maude Barlow and Tony Clarke from Canada, Irene Fernandez from Malaysia, and the organisation First People of the Kalahari, and its founder Roy Sesana, from Botswana.

The Jury’s citations in respect of the 2005 Right Livelihood Awards are as follows:

Francisco Toledo (Mexico) - … for devoting himself and his art to the protection, enhancement and renewal of the architectural and cultural heritage, natural environment and community life of his native Oaxaca.

Maude Barlow and Tony Clarke (Canada) - … for their exemplary and longstanding worldwide work for trade justice and the recognition of the fundamental human right to water.

Irene Fernandez (Malaysia) - … for her outstanding and courageous work to stop violence against women and abuses of migrant and poor workers.

The organization First People of the Kalahari, and its founder Roy Sesana (Botswana) - … for resolute resistance against eviction from their ancestral lands, and for upholding the right to their traditional way of life.

Founded in 1980 the Right Livelihood Awards are presented annually in the Swedish Parliament and are often referred to as “Alternative Nobel Prizes”. They were introduced “to honour and support those offering practical and exemplary answers to the most urgent challenges facing us today”.

Jakob von Uexkull, a Swedish-German philatelic expert, sold his valuable postage stamps to provide the original endowment. Alfred Nobel wanted to honour those whose work “brought the greatest benefit to humanity”. Von Uexkull felt that the Nobel Prizes today ignore much work and knowledge vital for our world and future.

A press conference with the recipients will be held in Stockholm on Wednesday, December 7th. The award presentation ceremony in the Swedish Parliament will be held on December 9th.

There were 77 candidates from 39 countries on the confidential list of nominations this year: 4 from Africa, 4 from the Arab world, 20 from Asia, 1 from Australia, 26 from Europe, 12 from Latin America and 10 from North America.

Further information on the new recipients can be downloaded from http://www.rightlivelihood.org

Botswana launches war against First Nations of Bushmen

Please distribute far and wide (incl. media) - INTERNATIONAL BOYCOTT AGAINST BOTSWANA - - ISOLATE THE TSWANA OVERLORDS -

WE, THE INTERNATIONAL COMMUNITY OF HUMANITY, MUST BEAT BACK THE BOTSWANA TERROR REGIME! - see Call for Action below these horrible news:

BOTSWANA LAUNCHES FULL-SCALE CRACKDOWN ON BUSHMEN: LEADERS IMPRISONED, CHILDREN ARRESTED, RESISTERS SHOT AT
26 September 2005

The leaders of the Bushman organization First People of the Kalahari have been arrested and imprisoned. They were among a group of 28 Bushmen, including seven children, who were seized by police as they tried to enter their ancestral homeland, the Central Kalahari Game Reserve. Their fate is now uncertain.

The Bushmen were attempting to highlight the plight of their relatives still inside the reserve. With the reserve sealed off, all hunting banned, their radio transmitters confiscated, no water allowed in and armed wildlife guards in every Bushman community, those Bushmen still holding out in the reserve have little means of survival.

The last message sent by the Bushmen in the reserve read, 'They are firing over our heads, they are beating us, we don't know if we can hold out.'

At least two Bushmen have reportedly been shot at; one is recovering in hospital, and one has since been arrested.

The government has banned journalists from entering the reserve. A group of Americans probing allegations of repression in the reserve, including the Chair of Human Rights Watch, report that they were followed, questioned, intimidated and harassed for three days by Wildlife Department officials, and finally escorted out of the reserve by armed guards.

This repression is the culmination of the government's crackdown on all Bushman resistance to their forced relocation. It comes despite the fact that the court case to establish whether the Bushmen's eviction was lawful is still going on. Rafael Runco, Chair of Survival International, said today, 'Botswana's government seems to have gone totally off the rails. Faced with criticism from all quarters, it's simply lashing out at the easiest targets - the Bushmen who it's been persecuting for so long. What it's doing now is coming perilously close to genocide - a systematic attempt to destroy an ethnic group.'

ECOTERRA Intl. CALLS FOR ACTION

TAKE ACTION

- BOYCOTT BOTSWANA - - ISOLATE THE TSWANA OVERLORDS -

1. TELL all your friends and associates about the atrocities the state and corporate terrorists of Botswana commit against the indigenous peoples of the Kalahari - send them the
http://survival-international.org and http://www.khoisanpeoples.org for references.

Warn them from the spindoctors, like Clifford Maribe, who publish their blurs of deceit on the government website of the state or through the paid mainstream media. Clifford Maribe, the propaganda mouthpiece of the Minister of Foreign Affairs of Botswana has close family links to still-President Festus Mogae and is a self-styled adversary to Survival International and other international Human Rights Organizations, who stand beside the first peoples of southern Africa in the defence of their rights. Maribe, who can not possibly disassociate himself from the ruling elites of today's Botswana, politically as well as concerning his own family relations, must be compared to Goebbels, the propaganda minister of Adolf Hitler, in their struggle to exterminate another human race. But unlike Goebbels, who claimed to have a vision, Maribe does it purely for blood-money and "because it is my job!"

Be aware that the churches are deeply entangled in the oppression of the spirited traditional peoples of the southern African wildlands.

2. BOYCOTT EVERYTHING BOTSWANA. Don't buy anything from Botswana, don't spend your vacation money in Botswana, cancel all business contracts with the oppressors. Boycott especially all companies, like de Beers, who profit from the suffering.

3. COMBAT the sale of blood diamonds from Botswana. Demand from the UN and the international diamond cartel that all diamonds from Botswana are classified as blood-diamonds and their trading is banned. Stop going out with people who buy, sell or wear diamonds from Botswana - throw them off your party! Name them and publicly shame them !

4. DEMAND from your own government a very clear boycott of the present Republic of Botswana in every respect: Any political or economic support, any co-operation with governmental officials or aid to the present Botswana governance under FESTUS MOGAE, the governance puppet of the Tswana Paramount Chief - styled Kgôsikgolo -, must STOP NOW! Not a single tax Dollar, Euro or Yen shall be given from the pockets of citizens of free nations to this terror state governance. Governmental and church officials from Botswana must be banned from all international bodies and meetings, incl. the UN and the AU, like it was done with the Apartheid regime of former South Africa.

5. CONTACT your nearest Botswana High Commission (their Embassy), demand freedom for the traditional bushmen (San and Khoi peoples) and tell them what you already did and are going to achieve with your boycott. Isolate the Botswana oppressors. They are just a phone-call away from you - hopefully they will tape what you have to say, so use a public phone.

For those, who again want to express their outrage - Write to:

The Hon F G Mogae President of the Republic Private Bag 001 Gaborone Botswana Fax: + 267 3956 086 and, if possible, copy to: Mr Nicky Oppenheimer Chairman De Beers 17 Charterhouse Street London EC1N 6RA UK Fax: +44 (0)20 7404 4730

All these actions must continue until the oppression of the first peoples of southern Africa is stopped, until all their rights are re-instituted and specifically their right to self-determination as well as to their lands and natural resources is guaranteed - once and for all!

Crack down on the Botswana overlord governance and their corporate stirrup holders wherever you find them!

BOYCOTT - BOYCOTT - BOYCOTT and CUT BOTSWANA BUSINESS AND THEIR PRESENT GOVERNANCE OUT FROM ANYTHING AND WHEREVER YOU FIND THEM ! - Until they stop the ethnocide and genocide against the First Peoples of the Kalahari !

KICK THE PRESENT BOTSWANA REGIME OUT OF THE UN, since they do not listen to the findings of the UN High Commissioner on Human Rights and his Special Rapporteur anyway!

BOTSWANA is not a signatory to the International Labour Organisation (ILO) Convention 169 on Indigenous and Tribal Peoples, but the Tswana overlord governance is persistently violating these internationally agreed standards - see
http://www.khoisanpeoples.org/indepth/ind-ilo-no-169.htm

And like in Namibia and South-Africa, i.e. in compliance of and in complicity with European and other Northern World interests in natural resources exploitation as well as together with the massive proselytism by the churches, the overlord governance in Botswana is guilty of genocide and crimes against humanity, which must bring them and their corporate allies in crime before the International Criminal Court of Justice.

The International Criminal Court (ICC) was established in 2002 as a permanent tribunal to prosecute individuals for genocide, crimes against humanity, and war crimes, as defined by several international agreements, most prominently the Rome Statute of the International Criminal Court.

Konzerninteressen vor Menschenrechtsschutz im Tschad?

Ölförderung: Konzerninteressen vor Menschenrechtsschutz im Tschad? (08.09.05)
