Wie das Bundesverwaltungsgericht (BVerwG) (BVerwG 2 WD 12.04) in seiner kürzlich veröffentlichten Urteilsbegründung zum Freispruch eines wegen Gehorsamsverweigerung angeklagten Soldaten erklärt, verletzt die Bundesrepublik Deutschland mit Unterstützung der US-geführten alliierten Streitkräfte im Krieg gegen den Irak seine völkerrechtlichen Verpflichtungen. Laut Urteilsbegründung sehen "weder der NATO-Vertrag, das NATO-Truppenstatut [und] das Zusatzabkommen zum NATO-Truppenstatut (...) eine Verpflichtung der Bundesrepublik Deutschland vor, entgegen der UN-Charta und dem geltenden Völkerrecht völkerrechtswidrige Handlungen von NATO-Partnern zu unterstützen."
