"Jeder Geräteschuppen benötigt eine Genehmigung, tausende Handymasten werden ohne Nachbarrechte hochgezogen, weil die große Koaliton es 1996 so beschloss! Das soll nun vor den Verfassungsrichtern geklärt werden! Nachbarrechte sind Grundrechte! Gesundheitsschutz ist ein Menschenrecht!", erklärt Gabriela Moser, Verkehrssprecherin der Grünen.

Ohne Rücksicht auf AnrainerInnen werden Tausende Handymasten errichtet. Viele Nachbarn sehen sich in ihrer Gesundheit durch die Mobilfunkanlagen beeinträchtigt. - Langzeitstudien dazu fehlen. Umweltmediziner einschließlich des Obersten Sanitätsrates und der Wiener Ärztekammer fordern daher die Minimierung der Sendeleistung und die Optimierung der Netze. Die wissenschaftlichen Gutachten werden häufig von der Mobilfunkindustrie beauftragt. Unzählige Bürgerinitiativen fordern immer wieder Anrainerrechte.

Fast jede Baumaßnahme, auf jeden Fall aber der Bau von Betriebsanlagen, die Emissionen gleich welcher Art aussenden, sogar z.B. eine Balkonverkleidung, sieht die Möglichkeit der AnrainerInnenbeteiligung im Rahmen eines Genehmigungsverfahrens vor. Mobilfunkanlagen hingegen werden generell ohne Genehmigungsverfahren errichtet. Ein Genehmigungsverfahren, das Einspruchsrechte für Anrainer beinhaltet, fehlt nämlich im TKG (Telekommunikationsgesetz).

Eine Änderung des TKG wurde von den Grünen wiederholt beantragt und stets abgewiesen oder vertagt. Eine landesweite Mobilfunkpetition, die dies ebenfalls verlangt, liegt in ihrer dritten Version ( 3. Legislaturperiode) unbehandelt im Parlament.

Die einzige Möglichkeit, eine Änderung des TKG herbeizuführen ist derzeit eine Gesetzesanfechtung des TKG beim Verfassungsgerichtshof wegen fehlender AnrainerInnenrechte bzw. fehlendem Gesundheitsschutz durch ein Drittel der Abgeordneten.

Die Abgeordneten des Nationalrats der Grünen fechten nun gemeinsam mit Abgeordneten der SPÖ das Telekommunikationsgesetz wegen Verfassungswidrigkeit an. Die Abgeordneten berufen sich auf den Gleichheitsgrundsatz, das Recht auf Achtung des Privatlebens, das Recht auf ein faires Verfahren und auf die Verpflichtung des Gesetzgebers zu konkreten Vorgaben an die Verwaltung (Art 7 und 18 Bundes-Verfassungsgesetz, Art 6 und 8 Menschenrechtskonvention). Obwohl von Handymasten Gefahren für die Nachbarn ausgehen können, ist kein standortspezifisches Bewilligungsverfahren mit Beteiligung der Nachbarn - wie dies etwa bei gewerblichen Betriebsanlagen der Fall ist - vorgesehen. Der Bundesminister für Verkehr, Innovation und Technologie kann bestimmte Funkanlagen zulassen, die Kriterien sind im Gesetz ungenügend ausgeführt. Strahlungen von Handymasten verletzen das Grundrecht auf Privatrecht, wenn die Nachbarinteressen bei Aufstellung der Masten nicht entsprechend berücksichtigt werden.

Leider dauerte es jahrelang, bis ich die Unterstützung von anderen Abgeordneten bekam, sodass nun der Antrag eingebracht werden kann.

Why in the heavens name would a 13 year old not be able to sleep? Mine slept like logs at that age, but of course they were boys, and there were No Mobiles then. But please chew on it and observe if your teenagers are doing the same.

A new study shows a disturbing high medicine use by 13-15 year olds in Odense, Denmark. Up to 9% of the teenagers have used sleeping pills within the last month. 13 year old schoolgirls regularly use sleeping pills. This is the fact in Odense, exposed by a new City Council queastionaire study of 7. – 9 grade students in Odense, the Capital City of Fyn.

Up to 9% of the students, in the study group, answered yes to have used medicine against sleeplessness within the last month. The biggest users were 13 year old school girls.

We are chocked over that such a large number of the students have used this kind of medicine, says the health consultant at Odense Council, Mette Ladegaard.

The study was a questionnaire survey, which was answered by over 4000 students.

I think it is deeply worrying if the sleeping pills have been prescribed to the child by its own GP.

But it is even more worrying if the medicine has been prescribed to the parents, and they in turn give it to their children, says Mette Ladegaard.

Sufferers like Kate Figes say wi-fi leaves them feeling exhausted, nauseous and sleepless

It is the hi-tech tool that has revolutionised home and office alike - but a growing band of campaigners claim wi-fi is a major threat to health.

Sufferers say the electro-magnetic waves emitted by wireless computer networks - wi-fi - leave them feeling exhausted, nauseous and sleepless.

Author Kate Figes, spent hundreds of pounds installing wireless internet in her Stoke Newington home, then found it made her so ill she had to scrap it.

Ms Figes, 49, claims she is so sensitive to wi-fi's electro-magnetic waves she can instantly tell whether it is installed in a particular room.

This comes days after campaigners called for parents to remove the system from their homes to prevent harming their children's health.

Ms Figes said: "The day we installed wi-fi two years ago was the day I started to feel ill. At first I could not work out what the problem was. I had no idea why I felt so sick and run-down. But I knew that when I walked through the front door it felt like walking into a cloud of poison.

"Imagine being prodded all over your body by 1,000 fingers. That is what I felt when I walked into the house... Then I started to think it might be the wi-fi, so we scrapped it - and I felt better."

She added: "Most people I've spoken are really dismissive, but I don't think they've considered the long-term impact of this technology." The mother-of-two is just one of many people who contacted campaigning group ElectroSensitivityUK about their fears over the harmful effects of wi-fi.

A spokesman for the group said: "We've been inundated by calls from people who know this is affecting them, but in many cases are wary of speaking out. The telecommunications companies pour scorn, but none of them has been able to prove wi-fi is safe."

But Chris Guy, head of Reading University's School of Systems Engineering said: "The amount of power emitted by wi-fi devices is about a tenth of that given out by mobile phones. It is very, very unlikely that it is harmful because the power levels are so low. I just do not believe wi-fi is damaging people's health."

Today, for example, the president of Lakeland University, Ontario, maintains that his campus banned wi-fi because evidence of physiological and behavioural evidence is compelling.

Fred Gilbert, the president of the university, said that 31 scientists have signed the Benevento Resolution which does recommend precautionary strategies to wireless systems.

According to this article on Treehugger, Gilbert thinks that electric and magnetic fields are likely to affect young people more than old codgers. He likens EMF fields to second hand tobacco and asbestos, which proved to be dangerous long after they were in wide use.

The Benevento Resolution said authorities should designate wi-fi free zones in cities, in schools, hospitals and on public transport systems.

Vendors of wi-fi systems and promoters of wi-fi and WiMAX systems have so far been curiously silent about the debate.
