Gegenmaßnahmen: die Verharmlosungsaussagen der Mobilfunklobby sind gar nicht so harmlos

Die Mobilfunklobby hat es sich nicht nur in Deutschland gerichtet. Auch in Österreich geht es gefährlich zu, obgleich hier nach einzelnen Landesrechten Baubewilligungen erforderlich sind, kann im Ergebnis aufgrund der Normen des Österr. Telekomgesetzes derzeit praktisch dennoch keine wirksame Gegenmaßnahme vorweg erfolgen. Baw. laufen wir Lebewesen demnach als Versuchskaninchen herum. Erst wenn ein konkreter Schaden bewiesen wird, werden die Betreiber zahlen müssen. Ein solcher Gesundheitsschaden ist derzeit leider noch schwierig zu beweisen. Leichter gelingt dies bereits beim Nachweis der Wertminderung von Grundstücken, zufolge Errichtung eines Senders, mehr oder weniger nahe zu den betroffenen (bestrahlten) Grundstücken, Häusern, Wohnungen, etc. Dazu gibt es in Deutschland bereits rk. Urteile von Oberlandesgerichten. Der Gesetzgeber hat jeweils Unsummen für die Versteigerung von Mobilfunklizenzen lukriert und tut sich daher jetzt schwer, gegen diese Lobby aus Gründen der Gesundheitsvorsorge anzutreten, obwohl dies seine vornehme Pflicht wäre. Eine wahre Schande!!! Die Medien verhalten sich eher zurückhalten, wohl eingedenk der enormen Inseraten- und Werbeeinnahmen, die wiederum in diesem Bereich lukriert werden.

Ich habe daher auf der Suche nach Gegenmaßnahmen von einer Website aus Deutschland- ich weiß jetzt nicht mehr die Adresse - eine juristisch fundierte Information an Vermieter von Flächen an die Mobilfunklobby heruntergeladen und auf österr. Verhältnisse adaptiert und erweitert. In dieser Info werden diese Vermieter über das Gefahrenpotential, in das sie sich selbst und Dritte begeben, aufgeklärt, weil sie von den Mobilfunkbetreibern meist gar nicht auf das konkrete, auch juristische Gefahrenpotential aufmerksam gemacht werden. Das Ziel einer solchen schriftlichen Informationszusendung durch Betroffene besteht darin, diesen (potentiellen) Vermietern reinen Wein einzuschenken und darauf aufmerksam zu machen, dass die Verharmlosungsaussagen der Mobilfunklobby gar nicht so harmlos sind. So könnten zahlreiche potentielle Vermieter davon abgehalten werden, zu vermieten und bereits bestehende Verträge nicht mehr verlängert oder gar gekündigt werden. Bitte verwenden und verbreiten Sie das passende Attachement, (ich habe sowohl das deutsche als auch meine Fassung beigefügt) das natürlich sorgfältig an den jeweils konkreten Fall - meines, insbesonders auch unter Aspekten deutschen Rechts - anzupassen ist (s. die jeweiligen Textvarianten). Seine Wirksamkeit wirkt sicherlich dann verstärkt , wenn nicht auf bloß einem Schreiben mehrere Unterschriften beigefügt werden, sondern wenn jeder einzeln Betroffene ein eigenes Schreiben absendet.

CAMPAIGNERS are considering legal action again a mobile phone operator because its masts are just 6m from their homes.

Members of the Vanbrugh Park Residents' Association (VPERA) believe the Orange mobile phone station on top of a lift shaft at Westcombe Court, Blackheath, is flouting its operator's safety rules.

After 10 years, Orange is applying to Greenwich council to renew its lease for the base station, which includes six masts, three dishes and related electrical equipment Spokesman Jonathan Bond, from VPERA's "The future's green, not Orange campaign", said: "VPERA is in discussion with legal advisors.

"We hope to instigate court action against Orange for negligence and against Greenwich council for its failure to consult with residents and to allow this disgraceful situation to continue for so long.

"Our priority is to obtain a court injunction to have the base station turned off to protect those residents within 6m of the mast."

Mr Bond claimed VPERA had a statement made by Orange's legal department ruling there must be a "safety zone" of at least 10m around such stations to comply with International Commission on NonIonising Radiation Protection (ICNIRP) guidelines.

An Orange spokeswoman said: "The 10m zone refers to the signal, which is based on the antenna direction rather than the physical location of the equipment."

She added a survey in December 2004 revealed emissions from the site were well below the ICNIRP guidelines.

A PHONE mast has been approved despite protests by concerned residents.

The mast will be erected in Blakeney Road, Stevenage, despite a petition signed by more than 300 people.

A resident, who did not want to be named, said: "We are all very disappointed. It has revealed a real problem with planning policy. Mobile phone companies can put up phone masts wherever they want. It doesn't go to committee.

"We are disgusted that our protests were disregarded."

Cllr Sharon Taylor, who backed the residents' campaign, said: "The objectors put on a very strong fight and I am disappointed for them. I just hope the mast isn't as bad as it sounds but I understand they are disappointed."

She said the campaign had highlighted concerns in the planning policy surrounding phone masts.

She said: "I do feel we need to be clear if we are asking people to comment on these plans that they know what issues they can object to."

The health issues the protesters were objecting to were not official planning grounds.

Cllr Taylor said: "It gets a bit technical. We need to have some information for objectors so they know what grounds they can object under and time isn't wasted in the future."

She also said she would meet with MP Barbara Follett to try and get the Government to issue new information about the health issues surrounding phone masts.

Martin Fitch of the council's planning and regeneration team said: "Having assessed this proposal against relevant council policy and Government advice and after careful consideration of the objections from local residents, we have decided that the siting of this telecommunications mast is acceptable in planning terms.

"Under the powers delegated to the head of planning and regeneration, prior approval for the development has been granted.

Fears grow over mast near school

RESIDENTS are preparing to fight plans for a proposed mobile phone mast near a primary school.

T-Mobile has submitted plans to build a mast at the junction between Musgrave Avenue and Hurst Farm Road.

But it would be the second mast for the vicinity as Orange already has one in the area.

Hurst Farm Road resident Colin Everitt is particularly concerned as the development would be close to the local school, Meads Primary.

"One of my children attends the school, which means they will be in the vicinity of the pole 24 hours a day."

The father-of-two is worried about the possible health effects of having a mobile phone mast so close to his home and child's school.

"We have contacted the chairman of governors at Meads Primary and are also considering petitioning councillors regarding this development. I would encourage residents to write to the council expressing their objections."

The point was echoed by Clare Newman, from Mill Close, who also has a child at the school.

East Grinstead town clerk Chris Rolley said the fact that there is another phone mast in the vicinity "is clearly a factor to be taken into account".

He added: "We will reserve a formal response until formal application - but generally we oppose bay stations in residential areas."

East Grinstead Town Council will be meeting to discuss the plans on October 24, but the final decision lies with Mid Sussex District Council.

Never in the 229 years of United States history has this government “of, by and for the people” been in greater peril. Not during the Civil War, not during the Great Depression, and not during the Second World War or the Cold War which followed. Until today, gross incompetence, abuse of power, corruption, corporatocracy, and federal insolvency could be checked and reversed by balanced and separated governmental powers, and at the ballot box by a citizenry informed and provoked by an alert and independent media. If not, you are in the company of a majority of Americans who might respond to the above jeremiad with “Oh c’mon now, it can’t be as bad as all that! We’ve always had incompetence, corruption, waste, fraud and abuse in the federal government, and stolen elections are as old as the republic. It’s no different now.” So long as that majority of Americans believes this, the rule of the Busheviks and its successor oligarch regimes will be secure. Thus Bush, Inc. and its obedient mainstream media are desperately endeavoring to nourish and sustain this “illusion of normality.”

When lawlessness broke out in New Orleans in the aftermath of Hurricane Katrina, martial law was declared, military troops were called in to restore order and the news media were on top of the story. Unfortunately, when more dramatic legal developments occur and when such episodes are of much greater legal consequence, the media sometimes fail to give them the attention they deserve. The Sept. 9 court ruling concerning Jose Padilla, an American citizen locked up in a military prison in South Carolina for three years, is a case in point. The ruling should send shockwaves through the American public since the decision seriously undermines constitutional rights. A federal appellate court ruled that constitutional rules that apply to the police do not apply to military personnel. That is a sensible proposition when the military is conducting operations in a war zone like Iraq, or in a disaster zone like New Orleans, but it is an alarming idea when the U.S. military is given carte blanche...

Within days, if not hours, the special prosecutor in the CIA leak case will announce the outcome of his two-year investigation. But Patrick Fitzgerald probably won't have the last word. For months now, ambassador Joseph Wilson and his wife, Valerie Plame, the covert CIA agent unmasked by the White House, have been preparing to file a civil lawsuit against the Bush administration officials who disclosed her identity and scuttled her career.

"There is no question that her privacy has been invaded. She was almost by definition the ultimate private person," said the couple's attorney, Christopher Wolf, of the law firm Proskauer Rose, on Monday. "Suffice it to say, they have been substantially damaged, economically and personally." He said the couple would make a final decision on filing a lawsuit after Fitzgerald has completed his investigation.

If they do sue, Wilson and Plame could be the first litigants to depose senior White House officials since Paula Jones, an employee of the state of Arkansas, opened a can of worms by suing President Bill Clinton for allegedly exposing himself in a Little Rock hotel room. In a deposition for the Jones lawsuit, Clinton lied under oath about his relationship with another woman, Monica Lewinsky, a White House intern, triggering his impeachment by the House of Representatives and the disclosure of oral sex in the Oval Office. "The questions can range far afield. You can ask all kinds of stuff," said Gilbert Davis, an attorney who represented Jones in her sexual harassment lawsuit. "You can start free-wheeling with all kinds of discovery methods."

Such discovery would be invaluable for historians - and political partisans - if Fitzgerald decided not to return indictments by Oct.
28, the day the grand jury investigating the leak of Plame's name to the press is scheduled to be dismissed. Though Democrats in Congress have requested a report from Fitzgerald on his findings, legal observers say Fitzgerald is under no obligation to provide one if he decides that no crimes were committed. The possibility of greater public disclosure has not escaped the notice of Wolf, the attorney for Wilson and Plame. "By its nature a civil case is somewhat more transparent than a criminal case," he said.

Wolf is a close personal friend of the couple's, having lived for years next door to them in the outskirts of Washington. His cousin, Audrey Wolf, served as a literary agent for Joseph Wilson's bestselling memoir, "The Politics of Truth." In an Op-Ed published in USA Today this summer, Wolf wrote that he was "collecting facts for any eventual civil suit" on the couple's behalf. Early this week, Bloomberg reported that Wilson said he may file a civil suit against Bush, Dick Cheney and others, "seeking damages for the alleged harm done to Plame's career."

Wilson, who could not be reached by Salon for comment for this story, wrote in "The Politics of Truth" that his wife was "crestfallen" when she discovered that syndicated columnist Robert Novak had disclosed her identity as a CIA "operative."

"She would never be able to regain the anonymity and secrecy that her professional life had required; she would not be able to return to her discreet work on some of the most sensitive threats to our society in the foreseeable future, and perhaps ever," he wrote.

In some ways, the Paula Jones case clears the way for a lawsuit by Plame and Wilson. In 1997 the Supreme Court issued a unanimous decision giving the green light to Paula Jones' lawsuit against Clinton, despite the fact that he was a sitting president. The court ruled that Jones' allegations, which involved personal conduct during Clinton's years as a governor, were not protected by any claims of executive immunity. After much legal wrangling, Clinton finally settled with Jones in 1998 for $850,000, though he offered neither an apology nor an admission of guilt. (Clinton's top lawyer in that case was Robert Bennett, who is representing New York Times reporter Judith Miller in the CIA leak investigation.)

However, there is one constitutional defense that senior White House officials, or at least Bush, could attempt to use. In a 1982 case, Nixon v. Fitzgerald (no relation to the current special prosecutor), the Supreme Court found, in a split decision, that a president enjoys "absolute immunity from damages liability predicated on his official acts." It is not clear whether this immunity extends to the vice president or senior White House aides, or if the White House could claim that discussions of Plame's identity should be viewed as an "official act."

Most likely, the White House would try to litigate any civil case in the court of public opinion. One attorney from the Jones case, John Whitehead, said that the White House would likely renew its attacks against Wilson and Plame, working through intermediaries. "They shift the focus from the wrongdoer to the non- wrongdoer," said Whitehead, who works at the Rutherford Institute, a conservative civil rights group. (Some might argue that this strategy is now being played out in the Texas prosecution of Rep. Tom DeLay, R- Texas, on charges of money laundering and conspiracy. Republican supporters, and DeLay himself, have spent weeks attacking the prosecutor, Ronnie Earle, and have even filed a suit against him for misconduct.)

"This is a media case," said Whitehead, adding that the attorney for Wilson and Plame had better be ready for a fight. "There will be people saying things about them that they have never heard before."

Unfortunately Terminator is not yesterday’s news. Purpose: The Ban Terminator Campaign seeks to promote government bans on Terminator technology at the national and international levels, and supports the efforts of civil society, farmers, Indigenous peoples and social movements to campaign against it.

Strategy: The international de facto moratorium on Terminator technology at the United Nations Convention on Biological Diversity (CBD) is under attack. Two upcoming meetings of the CBD where Terminator is on the agenda – the Working Group on Article 8 (j) in Granada, Spain January 23-27 and the 8th Conference of the Parties (COP8) to the CBD in Curitiba, Paraná, Brazil March 20-31 2006 – offer important opportunities to strengthen the moratorium. The build-up to these meetings is also an important opportunity to encourage governments to establish national prohibitions on Terminator technology – just as Brazil and India have done. Corporations will not stop their efforts to commercialize Terminator until governments prohibit the technology.

Origins: The Ban Terminator Campaign was initiated in response to recent efforts by governments and corporations to push for Terminator field trials and commercialization. Despite widespread opposition, in February 2005, the Canadian government attempted to overturn the CBD’s international de facto moratorium on Terminator technology. The Ban Terminator Campaign was formed in response, following discussions initiated by Canadian-based civil society organizations (ETC group, Inter Pares, National Farmers Union, and USC Canada).

History: In 1998, ETC group (then RAFI) discovered Terminator patents. In 1999, in response to the avalanche of public opposition, two of the world’s largest seed and agrochemical corporations, Monsanto and AstraZeneca (now Syngenta), publicly vowed not to commercialize Terminator seeds. In 2000, the United Nations Convention on Biological Diversity adopted a de facto moratorium on Terminator seeds. As a result, many people believed that the crisis had passed, and the issue faded from public view. Unfortunately, Terminator is still being developed and is now being heavily promoted.

Publication ban lifted on alleged war criminal

The lawyer bringing forward a war crime charge of torture against a world leader has announced to New World Order News today the publication ban on the name of the person, the office and anything tending to identify the proposed defendent is lifted.

In Vancouver yesterday evening in the Supreme Court of British Columbia, Canada, the judge lifted the ban in the case of 'Gail Davidson et al vs. the Attorney General of British Columbia'.

We can now inform you that George Walker Bush, President of the United States of America, faces war crimes prosecution.

The Government of Canada's federal crown prosecutor in attendance at several previous hearings was absent. The judge refused refused Davidson's application to have the issue of sealing the courtroom heard next. She will hear on November 25th the crown's application that the case is moot(irrelevant), based presumably on the grounds that the attorney general has not consented to the application.

An event for November 19 is planned to educate and impassion people about the next court proceedings.

In New Book Ex-Chaplain at Guantánamo Tells of Torture

WASHINGTON, Oct. 2 - James J. Yee, a former Muslim chaplain at the Guantánamo Bay detention center, says in a new book that military authorities knowingly created an atmosphere in which guards would feel free to abuse prisoners.

Mr. Yee, 37, is a former Army captain and a West Point graduate who was arrested and imprisoned in 2003 on suspicion of espionage. It was a case that, in the end, proved groundless, to the embarrassment of the Pentagon.

Mr. Yee was ultimately deemed guilty of minor administrative charges involving adultery and the presence of pornography on his computer, and given an honorable discharge. But those convictions, too, were later dropped.

a.. 17:20 18 October 2005 b.. http://NewScientist.com news service c.. Fred Pearce The edges of the Antarctic ice sheets are slipping into the ocean at an unprecedented rate, raising fears of a global surge in sea levels, glaciologists warned on Monday.

The findings confound predictions made just four years ago, by the UN's Intergovernmental Panel on Climate Change (IPCC), that Antarctica would not contribute significantly to sea level rise in the 21st century.

In one area, around the Amundsen Sea in West Antarctica, glaciers are dumping more than 110 cubic kilometres of ice into the ocean each year, Eric Rignot of NASA's Jet Propulsion Laboratory in California, US, told a meeting at the Royal Society in London, UK. This loss, which is increasing each year, is many times faster than the ice can be replaced by snowfall inland, he says.

The impending ice disaster centres on Pine Island Bay on the shores of the Amundsen Sea, where the Pine Island and Thwaites glaciers enter the sea. These glaciers, like many in West Antarctica, are perched on underwater mountains. The meeting heard that warmer ocean waters are circulating beneath the ice and melting their bases at a rate of 50 metres a year.

As this happens, the glaciers float clear of the submarine mountains and slide into the ocean. According to Andy Shepherd at the University of Cambridge, UK, they are discharging ice three times faster than a decade ago.

These glaciers are being dubbed the "plug hole" of the West Antarctic Ice Sheet. If the Pine Island and Thwaites glaciers disappeared, they alone could raise sea levels worldwide by more than a metre, says Rignot.

Corks from bottles Antarctic glaciers are much bigger than those in warmer climates. They are up to a kilometre thick, tens of kilometres wide and hundreds of kilometres long. Connected to inland ice tributaries, they drain the continent's ice caps, which are the largest stores of frozen water on the planet.

In many places, the glaciologists reported that the recent acceleration in glacier flows has been triggered by the break-up of a series of floating ice shelves at the continent's edge. These shelves acted like a cork in a bottle, holding back the glaciers.

After the Larsen B ice shelf - a 3000 square kilometre floating slab of ice - broke up over three days in 2002, glaciers behind it afterwards accelerated eight-fold. "The ice mass balance of Antarctica is controlled by these ice shelves," says Rignot, who believes Antarctica is now responsible for the majority of global sea level rise.

Researchers also warned that the larger East Antarctic Ice Sheet is not as stable as thought. A recent study suggested that it might be accumulating snow in its high interior - possibly supporting the IPCC's predictions - but it warned that little was known about events on the coast (Science, vol 308, p 1898).

Rignot revealed that several major coastal glaciers in the east are now known to be accelerating, like their counterparts to the west.

JEFFERSON CITY, Mo. - Driving to work with your cell phone on, you notice the traffic beginning to slow down. Instantly and unbeknown to you, the government senses your delay and flashes a traffic congestion update over Web sites and electronic road signs.

Other motorists take heed, diverting to alternative routes or allowing more time for their trips.

Futuristic as it may seem, the scenario actually is pretty close to becoming reality.

In what would be the largest project of its kind, the Missouri Department of Transportation is negotiating with private contractors to monitor thousands of cell phones, using their movements to produce real-time traffic conditions on 5,500 miles of roads statewide.

Cell phone users won't even know anyone's watching them. But transportation and technology leaders assure there is no need to worry -- the data will remain anonymous, leaving no possibility of tracking specific people from their driveway to their destination.

"There is absolutely no privacy threat whatsoever," said Pete Rahn, director of the Missouri Department of Transportation.

But privacy advocates are uneasy.

"Even though its anonymous, it's still ominous," said Daniel Solove, a privacy law professor at George Washington University and author of the book, "The Digital Person." "It troubles me, because it does show this movement toward using a technology to track people."

Cell phone monitoring already is being used by transportation officials in Baltimore, though not yet to relay traffic conditions to the public. Similar projects are getting under way in Norfolk, Va., and a stretch of Interstate
75 between Atlanta and Macon, Ga.

But the Missouri project is by far the most aggressive -- tracking wireless phones across a whole state, including in rural areas with lower traffic counts, and doing so for the explicit purpose of relaying the information to other travelers.

"This will be the biggest system in the world, assuming our contract ends up similar to what's in the request" from the department, said Richard Mudge, vice president of Delcan NET, the Ontario, Canada-based company that won the Missouri bid and is currently negotiating the contract details.

Governments have had the ability to measure traffic volumes and speeds for years. They can embed sensors in pavement, or mount scanners and cameras along the road. But those monitoring methods require the installation of equipment, which then must be maintained, and can take only a snapshot of traffic at that particular spot.

"The traffic community has been really excited for quite some time about the possibility of being able to use cell phones to track vehicles," said Valerie Briggs, program manager for transportation operations at the American Association of State Highway and Transportation Officials. "Almost everyone has a cell phone, so you have a lot of potential data points, and you can track data almost anywhere on the whole (road) system."

Although some new cell phones come equipped with Global Positioning System capabilities that can pinpoint the exact location of phones, the tracking technology used for transportation agencies does not depend on that to work.

Instead, it takes the frequent signals that wireless phones send to towers and follows the movement of the phones from one tower to another. Then it overlays that movement with highway maps to determine what road the phones are on and how fast they are moving. Lumping dozens, hundreds or thousands of those signals together can measure traffic flow.

A Delcan NET demonstration Web site developed for Baltimore uses various shades of green, yellow and red to show block-by-block whether vehicles are moving at or below the speed limits. As rush hour started on a recent work day, observers could watch as green turned to yellow and then red on roads heading out of downtown.

The Baltimore project began this spring as a pilot program that monitors Cingular cell phone users over about 1,000 miles of road. A Delcan NET competitor, Atlanta-based AirSage Inc., has an agreement with Sprint to monitor phones for its projects in Georgia and Virginia.

"What we're hoping and assuming is that we're going to be able to continue collecting the information over time and eventually deploy it statewide," said Mike Zezeski, director of real-time traffic operations for the Maryland Department of Transportation.

Rahn hopes to make a similar Web site available to Missouri motorists, and to post estimated travel times on electronic road signs. The Missouri and Maryland plans also assume the contractor will market more detailed information to the private sector -- automakers that offer onboard navigation systems, cell phone companies, shipping businesses or media that broadcast rush-hour traffic reports.

The private sector marketing helps drive down the states' cost. Missouri expects to spend less than $3 million a year on the service, Rahn said, although the exact price won't be known until the contract is final. Maryland is spending just $1.5 million, although the entire Baltimore project costs more than $5 million, Zezeski said.

Although there apparently are no plans to do so, the Electronic Privacy Information Center suggests that someone should notify cell phone owners that their phones are being monitored for traffic data. Privacy experts also worry that the traffic monitoring could later evolve into other uses -- perhaps to catch speeders or fugitives.

"It's a mission creep issue that would be of most concern to consumers," said Lillie Coney, associate director of Washington, D.C.-based electronic privacy center. "They may start out saying we want to know if there's a traffic problem and then take that information and start using it for different purposes."

Adds Solove, the privacy professor: "I look in the future and I see, `Wow, this is just another one in the class of ways that people can be tracked.'"

Sparked by today's Washington Post story that suggests Vice President Cheney's office is involved in the Plame-CIA spy link investigation, government officials and advisers passed around rumors that the vice president might step aside and that President Bush would elevate Secretary of State Condoleezza Rice.

It's certainly an interesting but I still think highly doubtful scenario," said a Bush insider. "And if that should happen," added the official, "there will undoubtedly be those who believe the whole thing was orchestrated – another brilliant Machiavellian move by the VP."

Said another Bush associate of the rumor, "Yes. This is not good." The rumor spread so fast that some Republicans by late morning were already drawing up reasons why Rice couldn't get the job or run for president in 2008.

"Isn't she pro-choice?" asked a key Senate Republican aide. Many White House insiders, however, said the Post story and reports that the investigation was coming to a close had officials instead more focused on who would be dragged into the affair and if top aides would be indicted and forced to resign.

"Folks on the inside and near inside are holding their breath and wondering what's next," said a Bush adviser. But, he added, they aren't focused on the future of the vice president. "Not that, at least not seriously," he said.

Spring Park residents are protesting against a mobile phone mast to be built on a Grade II listed church.

According to the secretary of Spring Park Residents' Association (SPRA), Marzia Nicodemi-Ehikioya, the group has received more than 600 letters against the application to place a mast on the bell tower of All Saints' Church in Bridle Road.

Resident Brintha Patel said she was concerned the mast represented a possible health risk for those living in the area.

She said: "I'm concerned about the health issues, we don't know enough about the possible effects, that's the problem."

When American corporations come up against inconvenient science, say, a study showing that mercury in fish can damage a developing fetus, or that a blockbuster drug has nasty side effects, they call in the American Council on Science and Health (ACSH). Industry-funded ACSH is the most aggressive debunker of pesky research reports emanating from government and academia. Its medical/executive director’s calm, soothing voice can be heard on television and radio, quelling public fears about the latest bad news about health and the environment. That man is Dr. Gilbert Ross. It was Ross who defended the Wood Preservative Science Council, saying that, contrary to reams of scientific evidence, the arsenic in pressure-treated wood poses “no risk to human health”; Ross who wrote on behalf of the farmed-salmon industry that the PCBs in fish “are not a cause of any health risk, including cancer”; and Ross whose organization once asserted that the jury’s still out on whether environmental cigarette smoke really is hazardous to your health. Much of his time is spent tarnishing noncorporate-sponsored work as junk science of questionable motive. But Ross may not be ACSH’s most prudent choice to question the credibility of other doctors, scientists, and researchers. Although the biography posted on the organization’s website doesn’t mention it, Ross actually had to abandon medicine on July 24, 1995, when his license to practice as a physician in New York was revoked by the unanimous vote of a state administrative review board for professional misconduct. Instead of tending to patients, Ross spent all of 1996 at a federal prison camp in Schuylkill, Pennsylvania, having being sentenced to 46 months in prison for his participation in a scheme that ultimately defrauded New York’s Medicaid program of approximately $8 million. During a three-and-a-half-week jury trial, federal prosecutors laid bare Ross’ participation in an enterprise, headed by one Mohammed Sohail Khan, to operate four sham medical clinics in New York City. For his scam to work, Khan needed doctors who could qualify as Medicaid providers, and Ross responded to an ad in the New York Times promising “Very, very good $$.” The scheme was brazenly larcenous: The clinics, which were later described as “very dirty and unsanitary,” raked in indigent patients—most of them homeless, alcoholic, or drug-addicted men—by offering them prescriptions for expensive drugs that they could resell on the street for cash. Word spread fast, and in streamed patients who, in exchange for the valuable scrip, would provide their Medicaid recipient numbers, give blood samples, and undergo medically unnecessary examinations, procedures, and tests. All of this brought Ross and the other doctors in the scheme money from the state’s Medicaid system, a percentage of which was kicked back to Khan. Ross testified at his trial that he had no knowledge of the ongoing fraud at the clinic where he worked. This defense only added to his troubles when, following his conviction, the judge ruled that Ross had obstructed justice by committing perjury. In addition to his prison sentence, Ross was ordered to forfeit $40,000 and, for his role in the fraud, to pay restitution of $612,855—an amount that was later reduced to $85,137 on the grounds that he didn’t have the assets to pay more. In 1997 a judge sustained a decision by the U.S. Department of Health and Human Services to bar Ross for 10 years from participating in either the Medicare or Medicaid programs, holding that he was “a highly untrustworthy individual” who had, at Khan’s clinics, engaged in “medically indefensible” practices. After his release from prison, Ross answered another ad in the New York Times, this one for a “staff assistant” at ACSH. Ross told president Elizabeth Whelan that he’d been convicted of a crime, done time in prison, and no longer possessed a medical license. She hired him anyway, and in 1999 he was promoted to medical/executive director. In 2000, while admitting his “unethical and criminal activity,” which he said was motivated by “greed,” Ross asked a state review panel to reinstate his medical license. The panel ruled against him. Ross finally got his license back in 2004, though he faces three years of probation should he ever choose to practice medicine again. Last year, in filling out a form for nydoctorprofile.com, an official state website, Ross faced a field titled “Criminal Convictions.” He left it blank.

Beware America, there is something brewing on the horizon. The storm clouds are gathering. For anyone who has closely followed this administration and the way that they try to cow the masses to avoid bad publicity, the upcoming weeks are fraught with danger. As the Plamegate case starts to wind up, rest assured the storm of grand distraction is heading straight for us.

For the unaware, those who rely on mainstream/corporate media for their "news", Plamegate is a two year investigation into the leaking of a covert CIA operative's identity to the press. The prosecutor, Patrick Fitzgerald, has been doggedly trying to unravel so much corruption that all the talking heads can do is wonder who is going to be indicted. The fact remains though that the indictments have to be coming within the next two weeks. The term for the special prosecutor expires at the end of this month and we can be sure that Bush will not renew this investigation.

The story goes like this. In the run-up to the Iraq War the Bush administration was trying desperately to scare the nation about the WMD capability of Iraq. We heard tales of nefarious chemical weapons, terrifying biological weapons and the potential for Iraq to possess nuclear weapons. It is the nuclear potential that saw the development of Plamegate. There was a report that Iraq was trying to purchase uranium from the Niger and at the behest of the Vice President's office, Joseph Wilson was sent to investigate. He came back and informed the government that the story was completely untrue and as it turned out, the documents involved were crude forgeries. Despite the truth, the president bravely marched on and stated the Niger story as fact in his next state of the union address. Eventually, Wilson wrote an op-ed piece in the New York Times refuting the White House claims. Instead of owning up to their "error", the Bush attack machine went into overdrive and the identity of Wilson's wife as an undercover CIA operative was anonymously leaked to the press.

If that does not sound like a big deal, try and remember that it is treasonous and a felony. Considering this was the party that rammed the "rule of law" down our throats with the partisan Clinton impeachment, it would seem quite germane. Considering Bush himself promised to restore integrity to the White House, the implications are extremely significant. What is lurking beneath the surface however is far more potentially damaging to this entire administration. The elephant in the room that people are not talking about is why there were forged documents to begin with and the overall publicity campaign waged by the administration to push us into war. With the benefit of hindsight and the lack of any WMD, it becomes quite clear that the reason we were sold this war on were not accurate. When you factor in the Downing Street Memos it becomes clearer still that those "inaccuracies" were known in advance and that the administration willfully and purposefully lied this country into war. When you then factor in that one reporter, Judy Miller, was willing to rot in jail for 85 days for a story she never even wrote, the corruption trail ends up at the top of the food chain.

Make no mistake about it; this story can take down the most corrupt administration in modern history. The obvious names being thrown around for indictments are Karl Rove and Scooter Libby but the fact is this sordid business has no less than 21 administration officials tied up in it, including Bush and Cheney. That being said, it is when this administration faces its harshest criticism that inevitably something happens to distract the American people. Usually that something is in the form of a terrorist attack, chatter, or something to panic the American people into submission and bury the story they do not want covered. This is when you will hear about a high profile arrest, usually the number three guy in al Qaeda. Or maybe we will here about "credible" intelligence about impending attacks on the New York City subway system. Eventually the intelligence will be debunked as years old, or unreliable. Eventually it will be discovered that it was not really the number three guy in al Qaeda, but rather their clerk. Those corrections will come days later and be buried by the corporate media so most people will never connect the reason for the initial subterfuge. So do not be deceived, it is coming America. Five years ago we were lectured day in and out by the republican machine that the rule of law was too vital to our democracy to allow it to be sullied. I only seek consistency.

So be vigilant America. Within the next two weeks indictments will be handed down against some major players in this administration. These indictments will point to far more egregious occurrences than just the charges at hand. They will expose the big lie that has been festering in this country for years now. That is the fact that 2,000 American soldiers have died for willful and purposeful lies told by this president and his administration. Their blood still cries out from the desert sands of Iraq, waiting for the truth to vindicate their sacrifice.

Ironically, a rejection of the constitution might possibly have diminished the chances of such an all-out internecine bloodbath. In sharp contrast to the president's 'happy talk to victory' strategy, a constitutional defeat could have compelled a start for genuine Iraqi self-determination. A conclave of representatives from all of Iraq's diverse tribes and ethnic and religious groups meeting on their own timetable would have allowed true consensus-building. CIA leak probe 'widening to include use of intelligence'

Evidence is building that the probe conducted by Patrick Fitzgerald, special prosecutor, has extended beyond the leaking of a covert CIA agent's name to include questioning about the administration's handling of pre-Iraq war intelligence.

According to the Democratic National Committee, a majority of the nine members of the White House Iraq Group have been questioned by Mr Fitzgerald. The team, which included senior national security officials, was created in August 2002 to "educate the public" about the risk posed by weapons of mass destruction on Iraq.

Mr Fitzgerald, who has been applauded for conducting a leak-free inquiry, has said little publicly about his 22-month probe, other than that it is about the "potential retaliation against a whistleblower", Joseph Wilson. After Mr Wilson, a former ambassador, went public with doubts about the evidence that Iraq was developing nuclear weapons, the name of his wife, Valerie Plame, a CIA official, was leaked to reporters.

The prosecutor has given no indication whether he will charge anyone in the case. At the weekend Judith Miller, the New York Times reporter jailed for 85 days after refusing to testify, provided new details about the scope of Mr Fitzgerald's investigation. She was asked "repeatedly" how Lewis "Scooter" Libby, chief of staff to Vice-President Dick Cheney, "handled classified information".

Ms Miller said Mr Libby had made "a sharp critique of Mr Wilson", and referred several times to the fact his wife worked at the CIA. Ms Miller also expressed surprise at a letter sent by Mr Libby when she was in jail that, she said, could imply he was trying to influence her testimony. "I replied that this portion of the letter had surprised me because it might be perceived as an effort by Mr Libby to suggest that I too would say we had not discussed Ms Plame. Yet my notes suggested that we had discussed her job," she wrote.

According to Time magazine, both Mr Libby and Karl Rove, President George W. Bush's chief political adviser, who has appeared four times before the grand jury, would resign or take unpaid leave if indicted for their role in the case.

Mr Rove has been adopting a lower profile, backing out of two public speeches over the last week. However, Scott McClellan, White House spokesman, said yesterday: "Karl is here at the White House doing his duties, as he always does."

The US failure to find weapons of mass destruction in Iraq resulted in two inquiries into the prewar intelligence, one led by the Senate intelligence committee and the other by a White House-appointed panel.

But both panels confined themselves to investigating the intelligence community, concluding that the White House was largely the innocent victim of faulty intelligence. Neither delved into the political use of the available intelligence by the administration.

Making the "Strong," "Tough," & "Macho" Case for Withdrawal

The mainstream media and political pundit/activist class has, for the last few years, been focused on the need for politicians to appear "strong," especially on national security. That word has been distorted by both political parties into a euphemism for "essentially ignoring the people who killed 3,000 Americans on 9/11, and instead supporting a war in Iraq - a country that had nothing to do with 9/11."

Despite all of this, we have seen a few courageous politicians step up and talk openly about how ridiculous this oxymoronic definition of "strength" really is. Back in 2004, Sen. Bob Graham (D-FL) opposed the Iraq War on the grounds that it was taking the military's focus off the more pressing problem of al Qaeda. Earlier this year, Sen. Russ Feingold (D-WI) made the case for a target timetable for withdrawal , noting that it would be in America's national security interests to get out of an ever-worsening and mismanaged situation.

Now, Sen. Carl Levin (D-MI) is making the case that unless we put withdrawal on the table, the Iraqis will never have a real incentive to take responsibility for their own country's security. GOP base losing faith in Bush

WASHINGTON -- Evangelicals, Republican women, Southerners and other critical groups in President Bush's political coalition are worried about the direction the nation is headed and disappointed with his performance, an AP-Ipsos poll found.

The growing unease could be a troubling sign for a White House struggling to keep the Republican Party base from slipping over Supreme Court nominee Harriet Miers, Gulf Coast spending projects, immigration and other issues.

''Politically, this is very serious for the president,'' said James Thurber, a political scientist at American University.

Only 28 percent say the country is headed in the right direction, while 66 percent say it is on the wrong track, the poll found. Those most likely to have lost confidence include white evangelicals, down 30 percentage points since November, Republican women, down 28 points, Southerners, down 26 points, and suburban men, down 20 points. Miers to Face Tougher Time Than Roberts in Hearings

In a room at the Justice Department this summer, Harriet Miers listened silently as young lawyers playing senators threw question after question at John G. Roberts Jr. at a secret practice hearing, or "murder board." She watched as he rattled off Supreme Court cases and, as one participant put it, "artfully dodged" inquiries he did not want to answer.

Now it's her turn. After an unexpectedly rocky first week, Miers's nomination to the Supreme Court appears likely to hinge on her performance before the Senate Judiciary Committee at hearings that probably will open early next month, according to strategists in both parties.

The question is how much she learned from Roberts's murder boards and how much constitutional law she can master in cramming sessions over the next several weeks.

Unlike Roberts, who made a career arguing before the high court and commands the nuances of obscure rulings, Miers never practiced that sort of law, nor did she, in her various behind-the-scenes roles at the Bush White House, demonstrate the sort of skill at public performance that Senate hearings demand. The politicization of science presents a severe challenge to modern democratic governments, which depend on a creative tension between elected representatives on the one hand, and unelected technocratic elites on the other. While we cannot allow scientific experts to rule us directly, we nevertheless need them desperately. Our leaders simply cannot do their jobs competently without considerable reliance on expertise that they themselves do not possess. But the politicization of science -- in essence, a corruption of the communication channels between credible experts and policymakers -- weakens and ultimately destroys this necessary relationship.

The advent of the modern conservative movement, its takeover of the Republican Party, and its ultimate triumph under the administration of George W. Bush have brought us to a point where a true divorce between democratic government and technocratic expertise seems conceivable. Indeed, it appears to be actually underway. To those who understand that such a split will lead to economic, ecological, and social calamity, it presents a terrifying prospect -- and leaves us with only two options. PEDIATRICIANS URGE A PRECAUTIONARY APPROACH TO TOXIC LEAD

The American Academy of Pediatrics (AAP) has just issued a new " policy statement " urging the U.S. to eliminate toxic lead from all housing, to stop poisoning the nation's children.[1]

The Academy says 25% of children in the U.S. still "live in housing with deteriorating lead-based paint and are at risk of lead exposure with resulting cognitive impairment and other sequelae [consequences]."

This means there are more children labeled "at risk" today than there were 20 years ago. During the 20 years, the median level of lead in children's blood has dropped nearly 8-fold (from 15 ug/dL to 1.9 mg/dL) because lead was banned from gasoline, from water pipes, and from food containers. However, during the same period, bad news about lead's harmful effects at low levels has accumulated year after year.

According to the latest estimate from the Academy, about 20 million children (ages 0-18) live in homes where lead-based paint is still a hazard, 5 million of them age 5 or younger. The youngest three million of these -- kids up to age 3 -- are in greatest danger because they are most likely to lick or chew window sills or other sources of lead- based paint, or to put their hands or household objects or toys in their mouths. Lead-based paint tastes like lemon drops.

This is the first time the Academy has urged the elimination of toxic lead-based paint at its source as the best way to stop the poisoning of children. In the past the Academy has relied on pediatricians to educate parents about ways to prevent their children from being poisoned.[2]

Notice the difference: The old approach assumed that attentive parents could manage to raise healthy children in a toxic environment. When they failed, a "case manager" from the health department stepped in locate the source of exposure and fix the problem. At least that was the theory. This cumbersome and expensive one-on-one approach did not protect the nation's children. In contrast, the Academy's new policy assumes that persistent toxicants like lead cannot be managed but must be eliminated -- signaling a clear shift to a precautionary approach. As the Academy's new policy says, "The focus in childhood lead-poisoning policy... should shift from case identification and management to primary prevention, with a goal of safe housing for all children." We salute the American Academy of Pediatrics for this important step forward.

The Academy's new policy statement contains considerable new information about the dangers of exposing young children to lead:

** The current " level of concern " for lead in a child's blood is still set by the federal government at 10 micrograms of lead in a deciliter (1/10th of a liter) of blood, expressed as ug/dL. The federal government recommends taking no action on lead below 10 ug/dL. From 10 to 15, monitoring is recommended but no action. Unless a child has 15 ug/dL lead in their blood for longer than 3 months, or if a child has 20 ug/dL in their blood at any time, then the government recommends investigating the child's environment to find the source of the lead exposure and reduce or eliminate it.

However the Academy's new policy statement confirms that no one any longer believes that 10 ug/dL protects lead-exposed children from harm, or that there is any "safe" level of lead exposure for children. The federal government itself came to this conclusion in 2002: "there is no apparent threshold below which adverse effects of lead do not occur," said the Centers for Disease Control and Prevention (CDC) . The Academy, too, acknowledges that, "Evidence continues to accrue that commonly encountered blood lead concentrations, even those less than 10 micrograms/deciliter, may impair cognition [brain function], and there is no threshold yet identified for this effect." In other words, any amount of lead in a child causes some brain damage -- there is no "safe" level of lead except zero. Yet the federal government continues to recommend that children poisoned by lead be ignored if their blood lead level is lower than 10 ug/dL.

The main effect of lead is to impair cognition, which is usually measured (after age 5) by an IQ test. Any amount of lead reduces a child's IQ to some degree.

The Academy's new policy statement says, "The best-studied effect is cognitive impairment, measured by IQ tests. The strength of this association [between increased lead and decreased IQ] and its time course have been observed to be similar in multiple studies in several countries. In most countries, including the United States, blood lead concentrations peak at approximately 2 years of age and then decrease without intervention." This decrease occurs because children older than 2 don't put hands and objects in their mouths as often as babies and toddlers do, plus the child is gaining weight, so lead is being diluted.

For children with more than 10 ug/dL of lead in their blood, each additional 10 ug/dL of lead reduces IQ another 2 to 3 points. However, two recent studies have shown that the first 10 ug/dL increase is the most damaging, reducing a child's IQ by "more than 7 points," the Academy reports. In other words, the "dose response curve" is steepest at the lowest doses; the greatest harm from lead begins to occur when a children has the least lead.

Obviously, this means it is important to prevent that first 10 ug/dL rise in a child's blood lead levels.

The Academy acknowledges these studies but says that its new policy statement does not reflect this new information. The Academy is waiting for additional confirmation before acting more aggressively to protect young children from that first 10 ug/dL "hit" to their systems.

** The new policy statement acknowledges that toxic lead is associated with aggressive behavior and delinquency in children. Past policy statements by the Academy have ignored the body of literature, going back to 1943 , linking lead exposure with aggressive and violent behavior and delinquency. The Academy now says:

"Other aspects of brain or nerve function [besides IQ], especially behavior, also may be affected. Teachers reported that students with elevated tooth lead concentrations were more inattentive, hyperactive, disorganized, and less able to follow directions. Additional follow-up of some of those children showed higher rates of failure to graduate from high school, reading disabilities, and greater absenteeism in the final year of high school. Elevated bone lead concentrations are associated with increased attentional dysfunction, aggression, and delinquency. In children followed from infancy with blood lead measurements, self-reported delinquent behavior at 15 to 17 years of age increased with both prenatal and postnatal lead exposure, and bone lead, thought to represent cumulative dose, is higher in adjudicated delinquents. These data imply that the effects of lead exposure are long lasting and perhaps permanent."

** Effects of lead are irreversible

This is another important point in the Academy's most recent policy statement: it reviews evidence showing that harm from lead is irreversible. Physicians used to think (or at least hope) that ending toxic exposure would allow a child to recover lost brain function. That possibility now seems very unlikely.

** Damage to hearing, impaired sense of balance

The Academy's policy statement says that, "Subclinical effects on both hearing and balance may occur at commonly encountered blood lead concentrations." In other words, at levels of toxic lead routinely found in many children today, we can expect hearing loss from lead. Does this contribute to poor performance in school, with reduced life- possibilities?

** Lastly, the Academy now recommends that all children should be tested for lead in the blood at least once during their first 2 years of life. In the past the Academy has said universal testing is not worth the money. Now that levels of lead as low at 1 or 2 ug/dL are known to cause some damage to a child's brain, the Academy has reversed its position on universal testing.

The Academy did not rush precipitously to adopt a precautionary approach to lead poisoning, urging removal of lead-based paint from all housing. The paint industry openly acknowledged in the 1890s that lead-based paint was dangerous; in 1897 at least one company was advertising that its paint " is NOT made with lead and is not poisonous." The poisoning of children by dust from lead-based paint was first reported in medical literature just over 100 years ago, in 1904. Lead-based paint was banned for interior uses in Australia and most of Europe during the 1920s.[3] The U.S. waited 50 more years before banning it in 1978.

The problem of children poisoned by lead-based paint was widely recognized by public health physicians in the U.S. in the 1930s. The City of Baltimore began routine surveillance of lead poisoning in children in 1931. Reports of large numbers of children poisoned by lead-based paint appeared in medical literature in the 1950s. (See Rachel's #294 .) Unfortunately, those early reports emphasized that lead was mainly a danger to poor, African-American children living in urban slums. Public health specialists subsequently recognized that even well-to-do children in the suburbs were being poisoned by lead, but the original understanding of lead as a problem of poor blacks proved hard to reverse. In a society oriented by 350 years of law and custom to white supremacy,[4] a silent epidemic of poisoning thought to affect only poor blacks had no political meaning.

Nevertheless, public-interest scientists (Barry Commoner, Rene Dubos and others) pressed for controls on lead-based paint[5] and, in 1971, Congress passed The Lead-Based Paint Poisoning Prevention Act declaring lead-based paint a health hazard to children and ordering that it be stripped from the nation's stock of federally subsidized housing. However, President Nixon was then developing his "southern strategy" to woo voters away from George Wallace, the avowedly white supremacist candidate for president. In 1971, President Nixon "rejected a recommendation of Government health specialists for a national push this year against childhood lead poisoning."[6] That set the tone for the federal response to the dangers of lead-based paint. Twenty years later the New York Times would report that the federal lead-paint-removal program had "produced a legacy of frustration and failure." "The Government's record in dealing with this problem is one of absolute dereliction," said Dr. Herbert Needleman in 1990, according to the Times.[7]

Now, 100 years after the first medical reports of children poisoned by lead-based paint in their homes, lead-based paint flaking off the walls of homes is still the main cause of childhood lead poisoning.[1] The victims are still generally, though by no means exclusively, poor and they are still far more likely to be black or Latino than white.

Obviously the nation has dragged its feet on this problem. This seems odd because it is widely acknowledged that huge sums of money could be saved by cleaning up lead in housing. The new policy statement from the Academy of Pediatrics discusses several cost-benefit analyses showing that eliminating the lead hazard from housing would save billions of dollars each year because lead diminishes a child's IQ and IQ translates into earning power (which, in turn, translates into tax revenues).

Here are some numbers from the Academy's new policy statement.[1] There are 4 million homes in the U.S. needing lead removal. The cost would be a one-time investment of $28 billion. The savings each year thereafter would be $43 billion. So lead removal would pay for itself the first year and then save billions each year thereafter. An investment of $28 billion is less than the U.S. spends every six months in Iraq.

The Academy cites other studies that make the same point, but you get the idea -- there's a huge amount of money to be saved by ending the poisoning of our children.

To state it in the reverse: we are foregoing billions of dollars in income and taxes each year in order to keep our urban children poisoned. This is an astonishing use of scarce resources, to put it mildly. How can we possibly explain such a bizarre national policy?

All I can figure is that some things are more important than money.

Here is a hypothesis based on U.S. history: Perhaps both Republican and Democratic administrations of the past 35 years have found it advantageous to keep inner-city kids behind the 8-ball by diminishing their IQs early in life, making them less successful in school, plus making them more aggressive and violent. I know this is an outrageous hypothesis, but hear me out.

For forty years, 1940-1980, the nation was ruled by a "bottom up" New Deal coalition of liberal middle-class whites plus minorities plus the organized working class. During this period, inequalities of income and wealth were held in check chiefly by the power of labor unions, by tax policies, and to a lesser extent by welfare programs. Recall that the income tax rate on the top tax-bracket was 91% from 1949 to 1964 (including during the Eisenhower administration) -- compared to 35% today.[8]

But "conservative" politicians (of both parties) began to undermine the "bottom up" New Deal coalition in the early 1960s, using race as the wedge issue to split the coalition.

This historical reality -- using race to divide and conquer the New Deal coalition -- has been well-documented in four excellent books:

In 1964, Barry Goldwater ran for president on an anti-civil rights platform. He lost, and two more civil rights laws were enacted in 1965 and 1968. These laws -- plus the civil disorder of the period 1965-1968 ("Burn, baby, burn!") -- fueled a backlash. (Many people conveniently forget that this phase of 1960s civil disorder was a response to 5 years of white supremacist riots, bombings, murders, and assassinations, 1960-1965.)[9]

White supremacist "conservative" politicians fanned the backlash. George Wallace discovered that a white supremacy message resonated not only in the south but also in the mid-west. In 1963, Wallace had an epiphany: "They all hate black people, all of them. They're all afraid, all of them. Great God! That's it! They're all Southern. The whole United States is Southern!"[10] In the 1964 Democratic primary, Wallace took 34% of the vote in Wisconsin, 30% in Indiana, and 43% in Maryland. In the 1972 presidential campaign, Wallace won 51% of the vote in Michigan.

President Nixon went on to develop what is still today euphemistically called the "southern strategy," a polite phrase for "white supremacy." As we have seen, in 1971 Mr. Nixon rejected the advice of public health specialists and refused to tackle the problem of toxic lead poisoning among urban children. It wouldn't pay to be seen as investing tax dollars in the health of those inner city troublemakers. Ronald Reagan built on the Nixon legacy, openly hostile to civil rights and affirmative action (at least affirmative action for blacks; affirmative action for whites was OK with the Gipper[11]). Reagan even tried to reverse the federal policy of withholding subsidies to segregated schools, until the Supreme Court tripped him up. Despite this setback, Reagan's white supremacist policies attracted fundamentalist religious conservatives and thus helped cobble together the current conservative coalition that slowly took power starting about 1972.[12]

The genius of the white supremacist strategy (later to be combined with other diversionary "social" issues -- anti-intellectual, anti-gay, anti-abortion, pro-school prayer) is that it provided a focus for the fears, hatreds and frustrations of lower middle-class and working class whites -- deflecting attention away from the real political action of those decades, which was to cut taxes for the rich and the super-rich and redesign the world order to make it easy to move money overseas (where it was easier to hide from the U.S. tax man) -- a byproduct of "globalization" which had the effect of making the super-rich richer.[13]

So that, in a nutshell, is the political usefulness of a permanent underclass of blacks and Latinos trapped in poisoned housing -- they provide endless targets for white supremacist frustrations and fantasies, while they deflect attention away from the real political action of the last 20 years, which is the funneling of hundreds of billions of dollars from the middle class and the working poor into the pockets of the super rich. During the Reagan-Bush years, 1980-1992, the super rich (the wealthiest 1%) saw their incomes rise by 78% while the median wage-earner saw his or her income decline 5%.[14] Those with declining incomes have been seething with frustration as the American dream has passed them by. They have tried to tread water by putting more family members to work, working longer hours, driving longer distances in worsening traffic to second and even third jobs, but for low- and middle-income groups, keeping up with the Jones gets harder each passing year. To deflect attention away from this massive upward redistribution of economic rewards, "conservative" politicians have developed a ready explanation, expressed in the shorthand of white supremacy: " welfare queens " and " Willie Hortons " have been stealing from hard-working, law-abiding Americans.

To this day, white supremacy remains the central issue -- almost never discussed openly -- that divides U.S. society.[15] The environmental movement tried for a time to overcome this history, but the "environmental justice" movement has, so far, been unable to claim its fair share of the available funds. Wealthy white groups, and many of their funders -- while adopting the rhetoric of environmental justice -- have not offered equal space at the table for non-whites,[16] and so the cycle of frustration and anger is perpetuated even among liberal environmentalists.

It seems safe to say that until liberals figure out how to rebuild a durable interracial political coalition (including a democratically-run, all-inclusive labor movement), the "conservatives" will retain political control of the U.S., wealth will continue to float upward, destroying the middle class, and democracy will continue to fade into empty rhetoric.

This then is the importance of the new policy statement by the American Academy of Pediatrics. By advocating a precautionary policy of removing lead from housing, it affirms that everyone has a basic right to a non-toxic environment and a decent start in life. Making such a policy real will not be easy -- the silent forces of white supremacy remain arrayed against it -- but it nevertheless does keep alive the hope that we may one day create a society "with liberty and justice for all."
